Executive Summary: On March 4„ 2015, Plan Check Fees of $2,964.70, were paid by Jill Douglas/Silver Spur Designs, LLC. The check was returned for non -sufficient funds, and Ms. Douglas was contacted. During a phone call, Ms. Douglas stated that the house was not going to be built. Cherie Williams of City of Palm Desert Department of Building and Safety, contacted the plan reviewer, Scott Fazekas & Associates, and learned that plan check had not commenced. Plans were returned to City of Palm Desert, Department of Building & Safety. Ms. Douglas covered the check amount and $25 NSF check fee. On March 23, 2015, the City received a request from Jill Douglas/Silver Spur Designs, LLC., requesting a refund of 80% of the plan checks fees, because the house would not be built and no plan check commenced. Discussion: Plan Check Fees of 80% are refundable because no plan check had commenced. City policy requires that refunds exceeding $2,000.00 require City Council approval. I received a call from the owner of the property stating that the house is not going to be built. She also wanted to know what the status of the plan check is and wondering if she would have to pay the whole plan check fee. I talked with Russell and yes, the full $2,964.70 fee will be required plus the finance fee. I left her a voicemail letting her know and that a letter will follow in the mail or email. I also called Scott Fazekas office and they will be returning the plans. Therefore, can you send a letter to Jill to have something in writing? I was not able to get her address yet. Fortunately, your request to cancel the review came before plan review commenced. Before any refund can be issued, full payment must be made to cover the original non -sufficient funds check that was submitted to us. You may request a refund via letter or email for the amount of $2,371.76. The amount represents the maximum refund of 80% of the plan check fees paid. To recap: Check #109, dated 3/4/15, for $2,964.70 was submitted to City of Palm Desert Department of Building and Safety for the above Plan Review. This check was returned for non -sufficient funds in the account. In addition, a $25.00 non -sufficient funds check fee was also due for this returned check. The total due for the Plan Check above is $2,989.70. This amount is due in the form of cash, cashier's check or money order. We are unable to accept your personal check. This amount will need to be paid to City of Palm Desert Finance Department, prior to any release of plans to you. The plans may be picked up once the $2,989.70 original plan check, and non -sufficient funds check fee has been paid. These will be available at the Department of Building and Safety counter any time between 8:00 a.m. — 5:00 p.m., Monday through Friday.
