HomeMy WebLinkAboutNotice of Exemption 659-14 Hwy 111 Right-turn to West Bound Fred Waring 659-14)(- D CITY OF PALM DESERT PUBLIC WORKS DEPARTMENT STAFF REPORT REQUEST: ADOPTION OF CATEGORICAL EXEMPTION AND FILING OF NOTICE OF EXEMPTION FOR THE HIGHWAY 111 RIGHT TURN TO WEST BOUND FRED WARING DRIVE (PROJECT NO. 659- 14) SUBMITTED BY: Mark Greenwood, P.E., Director of Public Works DATE: April 23, 2015 CONTENTS: Notice of Exemption Form Vicinity Map Recommendation By Minute Motion, adopt the Categorical Exemption for the Highway 111 Right Turn to West Bound Fred Waring Drive Project and authorize the Director of Public Works to execute and file the Notice of Exemption with the County Clerk: Strategic Plan Objective This project will meet objectives outlined in Envision Palm Desert Forward Together in Tourism & Marketing by improving access to retail developments while mitigating traffic congestion. Background In September 2011, the City of Palm Desert acquired right of way from N and D Restaurants, Inc., the owner of the property at the Red Lobster Development. The additional right of way was required to construct a dedicated right turn onto westbound Fred Waring Drive from Highway 111 to mitigate traffic congestion. The free right turn project will be funded partially by state funds which require that the California Environmental Quality Act (CEQA) requirements be met. Staff used the CEQA guidelines to assess the environmental impacts. Based on the CEQA guidelines staff has determined that the project will have little to no environmental impact, therefore, meets the criteria for a Categorical Exemption. Attached are the CEQA Notice of Exemption forms to be filed with the County Clerk. Funds are available in the project account 213-4383-433-4001. There is no fiscal impact associated with this action beyond the filing fee amount.
