Recommendation
Waive further reading and adopt Resolution No. 2015- 28 increasing
the Water Quality Management Plan (WQMP) review deposit amount from
$2,000 to $3,700.
Discussion
In 2012, City Council approved Resolution 2012-37 amending aspects of the
development services fee schedule, which included a new fee of $2,000 for review of
the WQMP. The fee for WQMP review is based on the amount of staff hours spent
reviewing the plan. When the WQMP review exceeds approximately 11 hours of staff
time, the applicant is required to submit another deposit to cover the remaining plan
review costs. If staff time is under 11 hours, then the applicant is refunded the
remainder of the deposit.
An evaluation of fees collected for WQMP plan review for 2014 and 2015 show that the
initial deposit of $2,000 was exceeded in 80 percent of the plan reviews. On average,
the applicant exceeded the $2,000 deposit by $1,766.40. Staff requests that the WQMP
deposit be increased to $3,700 to cover the average cost of plan review by staff.

Fiscal Analysis
If approved, the cost of the fee will cover the salary for staff time devoted to reviewing
the WQMP. There will be no impact to the General Fund.

RESOLUTION 2015- 28
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, ESTABLISHING A $3,700 FEE FOR WATER
QUALITY MANAGEMENT PLAN (WQMP) REVIEW
WHEREAS, on June 14, 2012, the City Council approved Resolution 2012-37,
which included establishing a new fee for WQMP review for $2,000; and
WHEREAS, staff has determined that the amount of time historically spent on
WQMP plan review requires the collection of an additional $1,700 deposit; and
WHEREAS, California Government Code Section 66016 requires notice to be
given and data made available at specified times prior to the adoption of amending
service fees sometime hereinafter at a public meeting of this City Council; and
WHEREAS, all requirements of California law are hereby found to have been
complied with in and for these proceedings.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PALM DESERT, CALIFORNIA, AS FOLLOWS:
Section 1: That a fee of Three Thousand Seven Hundred and 00/100 Dollars
($3,700.00) be established to compensate for expenses incurred by the City for WQMP
plan review, payable using a cashier's check, money order, or cash for the purpose of
paying the fee.
Section 2: The fee established herein shall become effective immediately.
Section 3: The City Clerk shall certify to the adoption of this Resolution.
BE IT FURTHER RESOLVED that the City Council does hereby authorize the
City Treasurer/Director of Finance to charge the deposit for processing each Water
Quality Management Plan review.
PASSED, APPROVED, and ADOPTED at the regular meeting of the Palm
Desert City Council held on this 23rd day of April 2015 by the following vote, to wit:

Subject: WQMP Plan Review Fee
I did a fee analysis for WQMP fees after I noticed the frequency in which developers were
exceeding their WQMP deposit amounts for plan review. Developers are required to submit a
$2,000 deposit when they submit a WQMP for review. The City charges $176 per hour, the City
Engineer's fee, against the time it takes to review the document. I analyzed WQMP's submitted
in 2014 and 2015, and found that on average the developers are exceeding the plan review
deposit by $1,766,40. It is often difficult to collect the remaining balance from developers. I
suggest that we raise the deposit amount to $4,000 in an effort to avoid collecting additional
fees after review. The fee analysis is below.

ESTABLISHED WATER QUALITY MANAGEMENT PLAN CHECK FEE
IN THE DEVELOPMENT SERVICES FEE SCHEDULE TO REFLECT
THE COST BASED ON ACTUAL EXPENDITURES
NOTICE IS HEREBY GIVEN that a Public Hearing will be held before the Palm
Desert City Council to consider the implementation of Resolution 2015- relating to
amending the previously established Water Quality Management Plan (WQMP) plan
check fee in the Development Fees Schedule.
SAID PUBLIC HEARING will be held on Thursday, April 23, 2015, at 4:00 p.m. in
the Council Chamber of the Palm Desert Civic Center, 73-510 Fred Waring Drive, Palm
Desert, California. All citizens are invited to present oral or written comments relative to
the proposed amendment to the WQMP plan check fee. Any citizen unable to attend
may submit written comments to the City Clerk prior to the Public Hearing.
Copies of the report may be reviewed at the Civic Center, Monday through Friday
between the hours of 8:00 a.m. and 5:00 p.m.
