Recommendation
By Minute Motion:
1. Approve Tax Roll Billing commencing with the November 2015 Tax Roll for all non -
Master Billed residences;
2. Approve Contract extension with Burrtec Waste and Recycling Services for a total of
eight (8) years to May 31, 2023; contract No. c27411
3. Approve the proposed 0% PPI rate increase and 6.09% gate/disposal fee increase
from $41.70 to $44.24 ($2.54) per ton;
4. Apply the PPI and gate/tipping fee rate increase to residential effective July 1, 2015;
5. Apply only the gate/tipping fee rate increase to commercial accounts until 2018;
6. Approve Amended Franchise Contract; and
7. Waive further reading and adopt Resolution No. 2015-48 , approving the new
adjusted rate schedule of fees (Exhibit 3 for residential, commercial, and roll -off) for
the collection, recycling, and disposal of municipal solid waste and
residential/commercial recycling contained in Contract No. C 27410 Solid Waste
Management Services.

Executive Summary
Currently, the Franchise Contract between the City of Palm Desert and Burrtec Waste and
Recycling Services for Integrated Solid Waste Management Services provides for one -
four year extension to May 31, 2019; however, staff is proposing to extend the Contract for
a total of eight (8) years, thereby extending the expiration date to May 31, 2023. Also
recommended is placement of trash fees on non -Master Billed property owner tax rolls to
commence with the November 2015 (month when County assesses/mails yearly tax bills)
property tax bills for the billing period of July 1, 2015 through June 30, 2016, including the
proposed rate increase.
Based on the attached Exhibit 3 rate sheets, Burrtec is requesting a $2.54 per ton rate
increase of the Edom Hill gate fee/tipping fee from $41.70 per ton to $44.24 per ton, a pass -
through based on a County approved rate increase. The overall proposed rate increase
breaks down to a $0.12 per month increase for residential service of a 96-gallon container
and a $3.30 increase for commercial service of a 3-yard bin serviced three times a week
effective July 1, 2015. Since the rate increase is not the result of an increase in the PPI, the
increase would be passed through to both residential and commercial customers.
Discussion
On Thursday, April 9, 2015, City Council held a Study Session to review the City's
Integrated Solid Waste Management Franchise Contract with Burrtec Waste and Recycling
Services, LLC. At the meeting, along with Residential Tax Roll Billing, the following items
were discussed and have been negotiated within the amended Contract:
• TERMS:
- Current Franchise Agreement term expires May 31, 2015
- Agreement: Existing one four (4) year extension term to May 31, 2019
- Negotiated: Additional four (4) term to May 31, 2023
- Total eight years will provide Burrtec financing options for a new fleet of trucks
- Provision to replace eight (8) Burrtec (or approximately 50%) of route trucks with
alternative fuel sources

- Burrtec to hold Producer Price Index (PPI) Increase (does not include tipping
fee/disposal increase) for three (3) years for COMMERCIAL ONLY -

• MISCELLANEOUS ITEMS:
- Other more minor items were amended within the Agreement such as insurance
requirements/language
- Other changes as a result of current and previous modifications to Franchise
content and programs (i.e., Pilot Food Waste Program, new Organics Recycle
Program, HHW Program, etc.)
- Increase stop service from one 30-day stop to a maximum of four months, split
into either one request for a total of four consecutive months or two requests with
each request being a maximum of two consecutive months
With regard to Tax Roll Billing, over the last five (5) years, with the significant recession,
home foreclosures, and increased unemployment rate, City staff realized a problem that did
not exist before; the lack of a mandatory payment system for recycling and trash service.
While City ordinance mandates that all Palm Desert residents maintain solid waste and
recycling service through Burrtec, a deficiency exists in the payment process for collection
of unpaid accounts. Specifically, the issue is that if Burrtec stops service due to non-
payment, this could result in health and safety concerns related to stock piling of trash in
yards/garages and illegal dumping. In light of these concerns, as provided for in Section
2.13 of the current Franchise Agreement which provides Burrtec the option for Tax Roll
Billing, staff is recommending this option in effort to provide more efficiency with the
accounting process and to alleviate the health and safety concerns related to non-payment
of service.
The first step in the process toward Tax Roll Billing was approval of the Ordinance
Amendment to Palm Desert Municipal Code Section 8.16.010, which had its second reading
before City Council on May 14, 2015.
Since 2010, the City utilized portions of its Recycle Funds (AB939) to offset rate increases
to Palm Desert residents. In 2013, the City opted to offset the rate increase to commercial
customers (with the exception of roll -offs) using AB939 funds as well, which dropped the
remaining fee from $1.87 paid to the City through Burrtec to $0.00. As a result, all future
rate increases will be passed through to both residential and commercial customers, with
the exception of the PPI increase hold for three (3) years to commercial only.
As noted above, based on the attached Exhibit 3 rate sheets, Burrtec is requesting a $2.54

rate increase breaks down to a $0.12 increase (from $10.71 to $10.83 per month) for
residential service of a 96-gallon container and a $3.30 increase ($235.25 actual rate) for
commercial service of a 3-yard bin serviced three times a week effective July 1, 2015.
The annual trash/recycle fee to be placed on the County Tax Roll will be for the period of
July 1, 2015 through June 30, 2016 at the following yearly rates:
96-gallon container currently at $10.71 with $0.12 rate increase to $10.83 monthly =
$129.96 yearly
64-gallon container currently at $8.56 with $0.10 rate increase to $8.66 monthly =
$103.92 yearly

• 32-gallon container currently at $6.43 with $0.07 rate increase to $6.50 monthly =
$78.00 yearly
• Greenwaste container currently $1.15 with $0.01 rate increase to $1.16 monthly =
$13.92 yearly
• Note: If more than one trash container, walk-in service, greenwaste, etc., then the
fee would be higher based on level of service.
Strategic Plan
Approval of this request will not have an impact on the City's Strategic Plan.
Fiscal Analysis
The proposed amended Integrated Solid Waste Management Franchise Contract will
provide revenue to the City's Recycle and General Fund through Tax Roll Billing ($0.73
Recycle and $0.33 General Funds) as well as the 8% Franchise Fee paid to the City. The
proposed rate increase will not have a fiscal impact to the City's budget unless applied to
the City.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF PALM DESERT, CALIFORNIA, APPROVING TAX
ROLL BILLING, THE NEW ADJUSTED RATE SCHEDULE
OF FEES (EXHIBIT 3A, 313, AND 3C) FOR RESIDENT,
COMMERCIAL, AND ROLL -OFF) FOR THE COLLECTION,
RECYCLING, AND DISPOSAL OF MUNICIPAL SOLID
WASTE AND RESIDENTIAL/ COMMERCIAL RECYCLING
AND NEW COMMERCIAL RECYCLE RATE CONTAINED
IN CONTRACT NO. C 27410 — SOLID WASTE
MANAGEMENT SERVICES
WHEREAS, on the 1st day of June 2015, the City approved its Amended
Franchise Agreement with Burrtec Waste and Recycling, LLC and approved the
Agreement at its meeting of May 28, 2015, and
WHEREAS, the term of the Franchise Agreement expores to May 31, 2023; and
WHEREAS, Burrtec now provides solid waste collection and residential and
commercial recycling services to the residents and businesses within Palm Desert; and
WHEREAS, the franchise agreement sets forth rates for solid waste collection
and recycling services within the City of Palm Desert as provided in Exhibits 3A, 313,
and 3C and 4A, 413, and 4C and commencing on the second year of said agreement
new rates may be applied at 100% of the PPI with a 5% cap unless otherwise approved
and to become effective July 1st of each year; and
WHEREAS, the Riverside County Waste Resources Management District
(RCWRMD) sets the landfill tipping fees and effective July 1, 1996, reduced the landfill
tipping fee from $38.50 to $30.00 per ton; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm
Desert, California, as follows:
SECTION 1: That the City Council of the City of Palm Desert, California,
rescinds all previous resolutions.
SECTION 2: The annual rate increase shall be 100% of PPI with a 5% cap.

SECTION 3: The Franchise Agreement now provides for Tax Roll Billing
commencing with the November 2015 Tax Roll for the billing period of July 1, 2015 to
June 30, 2016.
SECTION 4: Burrtec will pay to the City $1.06 to be divided $.73 to the Recycle
and $.33 to the General Funds.
SECTION 5: That the City Council of the City of Palm Desert, California,
effective July 1, 2015, ratifies the 0% (December 2013 to December 2014) Producer
Price Index and 6.09% gate/disposal fee increases for solid waste collection and
recycling service requested by Burrtec Waste and Recycling as provided for in the
Franchise Agreement.
SECTION 6: Burrtec to hold Producer Price Index (PPI) Increase (does not
include tipping fee/disposal increase) for three (3) years for commercial only
commencing in July 1, 2015.
SECTION 7: That the County of Riverside has increased the per ton
gate/disposal fee at the transfer station/landfill from $41.70 to $44.24 an increase of
$2.54.
SECTION 8: The City Council of the City of Palm Desert, California, approves
the new solid waste rate increases for 2015 as reflected in each Exhibit 3 to become
effective July 1, 2015.
SECTION 9: That the City Council of the City of Palm Desert, California,
approved in 2013 the utilization of the remaining AB939 fees of $1.87 (formerly $4.19)
per ton tipping fee plus an additional $.03 per ton so that residential and commercial
customers (excluding roll off and other special services) did not absorb the PPI and
gate/disposal fee increases for 2013.
SECTION 10: The additional $.03 per ton was absorbed by Burrtec in mid-2013.
SECTION 11: The City Council of the City of Palm Desert, California,
approved the commercial recycle rate structure established at 35% of the trash fee and
includes the 8% Franchise Fee. Rate reflected on Exhibit 3B became effective
November 1, 2013.
SECTION 12: The Commercial Recycle Rate Structure as outlined in Exhibit 3B
and the Roll Off Service Rates as outlined in Exhibit 3C is paid by Burrtec customers.
SECTION 13: All other solid waste and commercial recycling rates, services, 8%
franchise fee, any other fees, reports, etc. shall be in accordance with the Agreement
currently in effect.

I am in receipt of the City's letter of May 8, 2015 signed by Frankie Riddle regarding a hearing on a proposal to roll the
cost of refuse collection within the City onto the County tax rolls. I understand that, as the owner of a residence within
the City, I would no longer pay quarterly refuse collection charges directly to the service provider (currently Burrtec);
instead, the charges would be added to my semi—annual property tax statements.
As an absentee owner, I will be unable to attend the hearing and comment in person. If my understanding is correct,
then please consider this email a statement in support of the proposal, since its positive impacts would include:
1. Benefit to property owners through semi-annual vs. quarterly payments
2. Further benefit to property owners as the cost of refuse collection would be income-tax deductible
3. Benefit to Burrtec through simplification of the billing and collection process which, hopefully, would reduce
operating costs that otherwise would be passed to the property owners

Dear Council Members,
I am opposed to Burrtec Waste Management being granted "Tax Roll Billing."
They are a business that should handle every aspect of their business including doing their own
customer billing. The responsibility should not be placed on the backs of honest property owners.
Burrtec should consider selling their business if this is such a burden.
The City of Palm Desert should no way involve themselves in they way Burrtec operates their business,
to do so constitutes conflict of interest.
I am a widow with no support from late husband. Can't afford to help Burrtec, I have my own
problems, too many to trouble you with, it is a struggle. Something simple to you is a disaster for me.
What is your incentive to create an ordinance favoring Burrtec? Will you be getting a tax credit or some
type of tax incentive to do so?
Don't you have to have all the citizens of Palm Desert vote to approve anything being attached to our
property tax bills? The assessment is a disguise to give Burrtec preferental treatment.
Please prove me wrong that you are putting the best interests of a single contractor ahead of the
interests of the whole community. Please restore my faith in the people whom we elected to
represent us.

My husband and I recently completed your internet survey regarding communication for
proposed legislation. One of the concerns we tried to get across is that the communication
between the City and the resident is lacking. The attachments are great examples.
Out of the blue we received a very wordy letter from Mr. Riddle about some approved Tax Roll
Billing that impact residents. There's been no mention that we know of about this issue and the
letter does not clarify what it's all about. It already sounds like it will impact us negatively but
we have no idea what to expect monetarily.
I went to the City website for clarification (nothing related to this posted) but found this:

To my understanding we will be charged through taxes for waste and recycling services
which previous had been charged directly by Burrtec at a rate of $25.39 quarterly.
We are Canadian residence using beautiful Palm Desert as a winter retreat and as
Canadians we are only able to reside in United States for a maximum period of
approximately 6 months.
Last year we resided at our above premises and used waste disposal for January
through March at a total cost of $25,68.
While we were happy with the services provided by Burrtec I understand that we will
now be charged annually for waste and recycling services for the fully 12 month period
when in fact the service will not be necessary for at least 6 months of the year.

We wonder based on this proposal if there will be any facility for obtaining a rebate for
periods in which service are not provided.
I assume this measure has been taken to cover additional costs to the City resulting
from certain home owners abusing the system by not paying for refuse removal from the
local providers.
An assessment which would include those defaulting home owners should eliminate
any extra costs to the City and facilitate a rebate to home owners like ourselves who
only require the service on a limited basis. I would ask the City to consider a rebate
formula if it has not already done so.

Dear Council Members,
I am a property owner of record in Palm Desert I received a notice in my Burrtec bill in
early May. This notice informed me of an approval at the April 23, 2015, City Council
meeting of Tax Roll Billing for Municipal Solid Waste collection services. My
understanding is that the Council further needs to approve the written report/resolution
regarding this matter before Riverside County enters the appropriate addresses or APN
for listing on the tax rolls for inclusion of the solid waste service fees under your
Franchise agreement with Burrtec Waste.
Many property owners in Palm Desert and other desert cities are part-time residents
and use Burrtec Collection services only during the part of the year they actually reside
in Palm Desert. I pay for trash collection in the months I am residing in Palm Desert
and I do not pay for the service when I am not here and DO NOT USE BURRTEC
service. Without the benefit of seeing the written report on this matter, it appears the
effect of Tax Roll Billing would be to charge all residents against their property tax bill
for a full years worth of services regardless of how much service is actually provided.
This change in policy is an unfair fee for those of us who spend our winters
AND our money in Palm Desert. If Burrtec needs to increase their rates, fine, but they
should do it in the normal business manner and send all users a notice. The inclusion
of this service in our property tax will also penalize those of us who only use only small
containers or don't use green containers. How will the difference in the type of service
be included in the property taxes? It seems (feels) under -handed and not quite above
board. Why are you even considering this change. Thank you for taking the time to
read my concerns.

Thanks for speaking with me on the phone about your recent letter dated May 8, 2015 regarding a
public hearing related to a proposal to place billing for Burrtec Trash services on the property tax bills.
As I mentioned, I am unable to be in the desert on the date of the meeting, so I am submitting
comments in writing.
As snow birds from Wisconsin, we have owned two properties in Palm Desert. First one in Ironwood,
and now we have a home in Monterra. We generally have been able to spend about 8 to 12 weeks a
year there. Burrtec has provided excellent trash services and generally has billed us only for the time
that we are there along with a few bracketing weeks. Obviously when no one is in the house, there is
zero trash to dispose of and therefore we shouldn't have to pay anything. My understanding is that
Burrtec has asked that the bills for trash be placed on the property tax bills. Of course they did! They
can then charge everyone for trash pickup every month whether it's needed or not, and they are getting
the city to do all of their collections for them. They should see an immediate 7 to 15 % increase in profit
with this plan just from foisting their billing and collection costs onto the City of Palm Desert. And that
doesn't take into account the increase in revenue from charges to all of the snow birds who will now pay
for trash disposal even when their house is empty for months at a time. In spite of this you mentioned
that they are asking for a rate increase. How ironic!
Despite the short time I am in the desert each year I have no problems with my property taxes. They are
used for schools, roads, safety, parks, the aquatic center, golf ... in short this money is improving quality
of life for everyone in Palm Desert. This proposal is different. Making me pay for trash collections
during the months that I'm not in the desert makes no sense. For 15 years Burrtec has put our service
on vacation when we were back in Wisconsin and it has never been a problem. There is no public
benefit from this proposal except to Burrtec. Perhaps next, the City Council will tackle folks who don't
pay their electric bills. I suppose you could say that the average Cal Ed bill is $450/month. We can just
put that on the property tax for everyone even if they don't use any electricity ---because they SHOULD
have the service.
I hope the Council will decide not to proceed with this proposal. If you do, I suggest that you name the
new tax 'Make Burrtec a Fortune 100 company at the expense of Palm Desert residents'. Or maybe it
could be the 'Stick it to the Snow Birds tax'. I am surprised and disappointed to even hear of this
proposal. It certainly is not in keeping with the City Councils usual sound and logical decisions.

In regards to your letter of May 8th concerning the proposed assessment of
waste collection fees on our municipal tax bill.
We are seasonal residents at our home in Palm Desert, from mid -October
through mid -April and accordingly we presently pay for the services provided
for this period of time.
Since your letter didn't specify how we would be billed under the new
arrangement, I contacted Burrtec for clarification and was told that under the
proposed arrangement I would be billed for the entire year regardless whether
I used the services or not.
Accordingly we strongly oppose this recommendation since it will unfairly
double our cost for waste disposal for services not provided.

SUBJECT: Residential Tax Roll Billing for Municipal Solid Waste Collection
Dear City Council,
We are in receipt of your letter dated May 8, 2015, which was sent to Property Owner of Record for residential owners in
Palm Desert.
We own a residence located at 73840 Grapevine St., in Palm Desert. Our full time home is located in Sammamish
WA. We are snowbirds in Palm Desert where we spend the winter months each year. We pay our property tax and other
governmental fees for the use of the services that are appropriate for public expenditures. We also contribute to the local
economy by spending money with local businesses and restaurants.
I am writing because I object to the proposal to charge all residential owners a refuse fee on a yearly basis via property
taxes, rather than for the actual months when we use the garbage service. The only entity benefiting from this would
be increased revenue going to Burrtec. Burrtec is a private company that knows the business and should be able to
adequately adjust their business plan, budget, and staffing to efficiently accommodate the ebbs and flows of our snowbird
population.
If this does get approved, what are next 12-month subsidies for SoCal Edison, SoCal Gas, CVWD, and Time Warner
Cable based on minimum monthly billing and attached to our property tax bills
We strongly object to the Residential Tax Roll Billing and I urge the City Council to reject the plan.
We have a system in place now that works well, and is done without the interference of the government. If Burrtec needs
more revenue they should ask for a rate increase and direct bill on a monthly basis those households that actually use
their service.

We are writing to the Palm Desert City Council to voice our objection to a
proposal to charge refuse fees on our Riverside County property tax bill.
We live in Whittier, California. Since 1976 we have had a second home in
Palm Desert at 43480 Illinois Avenue. We visit this second home about twice
a month, less when we travel.
We do not have solid waste services.
We do not need solid waste service.
We cannot use solid waste service at this second home as we are not there
to put it out.
We have gardening services that dispose of mowings,cuttings and trimmings.
Our small bit of household waste is taken home to Whittier.
We again object to this blanket proposal covering all houses such as ours.

Re: Refuse Fees
I have attempted to contact your offices at 760-346-0611 and have been put on hold then hung up on
many times since receiving you letter dated May 8 2015 about proposed refuse fees added to our tax
billings. I am sure you are well aware of the fact that 50% of the owners are snowbirds and have no
need for refuse pick up from April to the end of October each year. It seems to be inappropriate to bill
us all year for a service not need or used. I strongly object to this lining of Waste Management's pockets
at the expense of ordinary owners. Please make my opinions clear at you meeting proposed today at
4:00. 1 also find the timing of these decisions suspect, as when they are at the expense of the snowbirds,
they are proposed and passed while we are away. Do you not appreciate out contributions to your city?
Should we all be looking to more accommodating cities? Thank you in advance for your attention to this
matter and look forward to your prompt reply to my concerns.
