CITY OF PALM DESERT PUBLIC WORKS DEPARTMENT STAFF REPORT REQUEST: ADOPT RESOLUTION NO. 2015- S1 ACCEPTING A DEDICATION FOR A PUBLIC UTILITY EASEMENT MADE IN PARCEL MAP NO. 33996 SUBMITTED BY: Mark Greenwood, P.E., Director of Public Works DATE: June 11, 2015 CONTENTS: Resolution No. 2015- 51 Recorded Parcel Map Vicinity Map Recommendation By Minute Motion, waive further reading and adopt Resolution No. 2015- 51 accepting the dedication to the City of Palm Desert for a five (5) foot wide public utility easement made in Parcel Map No. 33996. Background Parcel Map No. 33996 is bounded by Cahuilla Hills to the north, the CVWD Palm Valley Channel to the east, and Metate Place to the south and is located in Mountains at Bighorn. The map, which was approved by the City Council on September 13, 2007, where Resolution No. 07-62 was adopted, provided for the creation of one buildable parcel and one parcel for landscaping. The map recorded on October 23, 2007. The subject offer of dedication for a public utility easement, shown on the map over only the buildable Parcel 1, was made under the Owner's Statement of the map, but not accepted under the City Clerk's Statement. Research into the matter revealed that the acceptance language was on the last review check print of the map, but somehow got omitted on the original, executed map. The City Attorney advises having Council adopt the attached Resolution to accept the subject dedication. Wohlmuth, City Manager hwood, P.E., Public Works RESOLUTION NO. 2015- 51 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, ACCEPTING THE DEDICATION OF A FIVE (5) FOOT WIDE PUBLIC UTILITY EASEMENT, AS SHOWN ON PARCEL MAP NO. 33996 BE IT HEREBY RESOLUVED, by the City Council of Palm Desert, California, as follows: 1. An offer of dedication was made on the Map of Parcel Map No. 33996 of the City of Palm Desert, California, for a five (5) foot wide public utility easement as shown on said map, but not formally accepted by City Council. 2. City Council hereby accepts the offer made on said map to the City of Palm Desert for an easement of five (5) feet in width for public utility purposes as shown on said map.
