Authorize the approval of second amendment to Contract No, C33050 with Wurms Janitorial Services, Inc. for the period of July 1, 2015, through June 30, 2016. 2. Approve a one year term extension for Contract No. C33050 for the period of July 1, 2015- June 30, 2016, which includes the second amendment. 3. Authorize an increase to the monthly janitorial services cost, effective January 1, 2016, for Contract No. C33050 from $1,618.95 p/month to $1,754.99 p/month. Funds are currently available in Sherriff Substation Maintenance Account No. 5104195-4369500. Background In September 2013, the Palm Desert City Council awarded Wurm's Janitorial Services, Inc. an annual contract for monthly janitorial services at the Palm Desert Police Substation located at 73- 520 Fred Waring Drive. Wurm's was providing such services since 2011 and an amendment was approved in 2014 increasing the contract from $1,113.07 to $1,618.95 monthly. This increase was primarily due to the relocation of the Sheriff Investigations Bureau (i.e. narcotics, homicide, etc.) and additional staff to the basement of the Substation on March 1, 2014. Sheriff Communication Operations (911 dispatch) are also provided at the substation. The current contract with the janitorial provider will expire on June 30, 2015. The County and City entered into a lease agreement, and the City has responsibility for maintenance operations, which includes janitorial services. The county provides lease payments to the City that is calculated to cover maintenance operations and fair market lease. Total occupied square footage at the Substation is 17,921 square feet. Please note that the building totals 25,393 square feet. Staff Report -Contract C33050 Second Amendment July 9, 2015 Page 2of2 Approval of the proposed contract amendment will do the following: • Increase the monthly janitorial services at the Palm Desert Sheriff Substation from $1,618.95 p/month to $1,754.99 p/month (a $136.04 monthly increase). This adjustment is related to the one dollar increase of the minimum wage to $10 p/ hour under AB 10 (Alejo), signed by the Governor into law in 2013 and effective on January 1, 2016. • Extend the existing contract one year through June 30, 2016. Please note that the contractor's employees have to undertake an extensive background investigation by the Sheriff's Department to be permitted entry into the facility. Both City and County staff have been very pleased with the responsiveness and services of the current contractor. Staff respectfully requests that the City Council approve this amendment. Fiscal Analysis Should the City Council concur with staff's recommendation, the costs of janitorial services at the police substation should not exceed $20,243.64 for the period of July 1, 2015-June 30, 2016. Staff will go back out to bid next year for janitorial services at the Substation. Funds for this service are currently available in Sherriff Substation Maintenance Account No. 5104195-4369500. C33050 SECOND AMENDMENT This second amendment is entered into this 1 st day of July, 2015, by and between the City of Palm Desert, California ("City") and Wurms Janitorial Services, Inc. ("Contractor") to extend the term of Contract No. C33050 and provide a monthly compensation increase for janitorial services for the City owned building at 73-520 Fred Waring Drive, known as the Palm Desert Sheriff Substation. RECITALS 1. The City and Contractor entered into Contract No. C33050 on September 12, 2013, for janitorial services related the cleaning of the City owned building at 73- 520 Fred Waring Drive. On March 1, 2014, the City and Contractor entered into an amendment to Contract No. C33050; and 2. Per that agreement, Wurms provide services to the upstairs and basement area occupied by the Sheriff's Communication Center and Investigation Bureau that comprises approximately 17,921 square feet; and 3. Janitorial services will remain unchanged and is five days p/week in the upstairs area (Dispatch) and three days p/week in the basement area (Investigations); and 4. Staff further recommends a contract term extension through June 30, 2016. THEREFORE, for good and valuable consideration, including, without limitation, the mutual promises, conditions, and agreement set forth herein, the City and Contractor, agree as follows: A. TERM The term of this Contract Amendment shall commence on July 1, 2015 and end on June 30, 2016. B. COMPENSATION Commencing July 1, 2015, through December 31, 2015, the City will continue to pay Wurms Janitorial Services, Inc. $1,618.95 per month. Effective January 1, 2016, through June 30, 2016, the City will pay Wurms Janitorial Services, Inc. $1,754.99 per month. All remaining requirements within the original contract and first amendment will remain in force and unchanged. CONTRACT NO. C33050 The undersigned represent that they are authorized to execute this Second Contract Amendment on behalf of the parties hereto on whose behalf they purport to sign. Existing law requires that, on and after January 1, 2008, the minimum wage for all industries be not less than $8.00 per hour. This bill would increase the minimum wage, on and after July 1, 2014, to not less than $9 per hour. The bill would further increase the minimum wage, on and after January 1, 2016, to not less than $10 per hour.
