Recommendation:
By Minute Motion, Staff requests that the City Council refund Building Permit Fees in
the amount of $20,280.93 for Building Permits
Executive Summary:
In two transactions, dated February 2, 2015, and March 3, 2015, Building Permit Fees
of $20,280.93 were paid by Comstock Homes. On June 9, 2015, the City received a
request from Comstock Homes requesting a refund of building permit fees from the
Building and Safety Department.
Discussion:
Mr. Robert W. Comstock of Comstock Homes requested in a meeting with the City
Manager that Comstock Homes be allowed to enter into a "Third Party Inspection
Agreement." This agreement allowed a full time inspector on the site at all times in
hopes of accelerating their project (Villa Portofino).
The City entered into an agreement with Comstock Homes on March 21, 2014, which
allowed Comstock Homes to acquire the services of Willdan Engineering to provide
third party inspection services for the Villa Portofino project.

THIS AGREEMENT Is made and entered into this W day o(f„ 2014 by, between and
among Witldan EnpMesrinq, a California corporation ("Inspeck ), the City of Palm Desert,
California and Comstock Honors ("Applicant").
RECITALS
Whereas. City of Palm desert Is agreeable that Applicant may contrad directly with a qualified
third party engineering firm to perform Iron services on behay of the City;
Whereas, Applicant desires to enter Into a third party agreement with Inspector to perform such
services;
Whereas. Inspectors are experienced in providing such services for municipal corporations and
is able to provide experienced personnel to cagy out the duties invohred;
NOW, THEREFORE, in consideration of the covenants and premises herein stated, it is agreed
as follows:
A. Applicant Intends to construct: Housing Tract (hereinafter the "Project"). Inspector agrees to
perUortn the following services for Applicant with respect to the project: insoeotion in
B. Inspector shall be compensated far such services by direct payment from Applicant.
Notwithstanding that Applicant is to compensate Inspector directly. It Is agreed that Inspector's
duties with respect to Uds project am to State and City requiremerrts and not to Applicant. The
compensation shag be as follows: Hourly rate of $95. Such compensation to Inspector shall
not be in lieu of other fees as may be charged by the City.
IN WITNESS WHEREOF, the panties execute this agreement upon the terms and conditions
