HomeMy WebLinkAboutOrdinance 1288 - Small Residential Rooftop Solar SystmsOrdinance No. 1288 CITY OF PALM DESERT BUILDING & SAFETY DEPARTMENT STAFF REPORT REQUEST: ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT ADDING SECTION 15.17 TO THE MUNICIPAL CODE RELATING TO EXPEDITED PERMITTING PROCEDURES FOR SMALL RESIDENTIAL ROOFTOP SOLAR SYSTEMS. SUBMITTED BY: Russell A. Grance, Director of Building and Safety DATE: July 9, 2015 CONTENTS: Ordinance No. 1288 Recommendation: Waive further reading and pass Ordinance No. 1288 to second reading. Executive Summary: On September 21, 2014 Governor Brown approved AB 2188, which modifies specific statutes that compose the Solar Rights Act. The most significant change to the act is a statutory mandate for all local jurisdictions in California to adopt an ordinance that creates a streamlined, expedited permitting process for small residential rooftop solar energy systems (photovoltaic and water heating) on or before September 30, 2015. The amended language of Government Code Section 65850.5 also mandates that each jurisdiction substantially conform its expedited, streamlined permitting process to recommendations contained in the most current version of the California Solar Permitting Guidebook adopted by the Governor's Office of Planning and Research (OPR) in developing its ordinance. Each jurisdiction must evaluate and implement the statutory requirements and recommendations to ensure substantial conformance. Additionally, AB 2188 makes the following major changes to various requirements and definitions found in Civil Code Section 714 governing common interest developments and Government Code Section 65850.5 governing local jurisdictions: • Requires adoption of an ordinance that creates a standardized expedited, streamlined permitting process for small photovoltaic or water heater residential rooftop solar energy systems consistent with the goals and intent of Government Code 65850.5(a) on or before September 30, 2015; Ordinance No. 1288 Staff Report Residential Solar Permitting July 9, 2015 Page 2 of 3 • Requires that a jurisdiction substantially conform its expedited, streamlined permitting process with the recommendations for expedited permitting, including the checklist and standard plans adopted by the OPR in the most current California Solar Permitting Guidebook, in developing the ordinance; • Requires adoption of a checklist of all requirements for a photovoltaic or water heating system to be eligible for expedited review; • Requires approval of an application where the jurisdiction determines that the application is complete and meets all prescribed requirements; • Allows for the use of electronic signatures on relevant permitting documents; • Requires that jurisdictions allow electronic submittal of the expedited permit documents; • Requires a single inspection, subject to an exception for fire inspections, that must be performed in a timely manner; • Mandates that a jurisdiction can no longer require approval of an association (such as an HOA) before approving a permit application for any solar energy system; and • Changes the definition of "significantly" in reference to determining whether a reasonable restriction significantly increases a cost or decreases efficiency for solar water heating systems and photovoltaic systems with regards to a jurisdiction's use of a method, condition, or mitigation to avoid specific, adverse impacts and covenants, conditions, or conditions imposed by a common interest development (i.e. an HOA). Background or Discussion: The City of Palm Desert by its current process already adheres to most of the provisions of AB 2188 in the reviewing and issuance of residential solar permits. The City, however, needs to adopt the ordinance mandated by Section 65850.5. The attached ordinance is intended to satisfy that requirement. The ordinance codifies the requirements of Section 65850.5, such as accepting and approving applications electronically, directing the City's Building Official to develop a checklist of all requirements with which small rooftop solar energy systems shall comply to be eligible for expedited review (currently 10 business days), and authorizing the Building Official to administratively approve such applications. In order to meet the September 30, 2015 implementation date of the new Solar Permitting ordinance, the introduction of the ordinance will need to occur on the Council meeting of July 9, 2015. The second reading/public hearing will be performed at the August 27, 2015 City Council meeting with the effective date thirty days after approval. WHEREAS, Subsection (a) of Section 65850.5 of the California Government Code provides that it is the policy of the State to promote and encourage the installation and use of solar energy systems by limiting obstacles to their use and by minimizing the permitting costs of such systems; and WHEREAS, Subdivision (g)(1) of Section 65850.5 of the California Government Code provides that, on or before September 30, 2015, every city, county, or city and county shall adopt an ordinance, consistent with the goals and intent of subdivision (a) of Section 65850.5, that creates an expedited, streamlined permitting process for small residential rooftop solar energy systems. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PALM DESERT DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 15, Section 15.17, Residential Solar PV Permits, is hereby added to the City of Palm Desert Municipal Code to read as follows: CHAPTER 15.17 RESIDENTIAL SOLAR PV PERMITS Sections: 15.17.010 Adoption 15.17.020 Purposes 15.17.030 Definitions 15.17.040 Mandatory Requirements 15.17.050 Validity 15.17.010 Adoption That the ordinance codified in this chapter is hereby adopted by reference as "Residential Solar PV Permits" of the City of Palm Desert, and from the date on which the ordinance codified in this chapter shall take effect, the provisions thereof shall be controlling within the corporate limits of the City of Palm Desert. Ordinance 1288 15.17.020 Purpose The purpose of this chapter is to provide for an expedited, streamlined solar permitting process that complies with the Solar Rights Act, as amended by AB 2188 (Chapter 521, Statutes 2014) to achieve timely and cost-effective installations of small residential rooftop solar energy systems. This chapter encourages the use of solar systems by removing unreasonable barriers, minimizing costs to property owners and the City of Palm Desert, and expanding the ability of property owners to install solar energy systems. This chapter allows the City of Palm Desert to achieve these goals while protecting the public health and safety. 15.17.030 Definitions The following words and phrases as used in this chapter are defined as follows: "Electronic submittal" means the utilization of one or more of the following: 1. e-mail, 2. the internet, 3. facsimile. "Small residential rooftop solar energy system" means all of the following: 1. A solar energy system that is no larger than 10 kilowatts alternating current nameplate rating or 30 kilowatts thermal. 2. A solar energy system that conforms to all applicable state fire, structural, electrical, and other building codes as adopted or amended by the City and paragraph (iii) of subdivision (c) of Section 714 of the Civil Code, as such section or subdivision may be amended, renumbered, or redesignated from time to time. 3. A solar energy system that is installed on a single or duplex family dwelling. 4. A solar panel or module array that does not exceed the maximum legal building height as defined by the City of Palm Desert. "Solar energy system" has the same meaning set forth in paragraphs (1) and (2) of subdivision (a) of Section 801.5 of the Civil Code, as such section or subdivision may be amended, renumbered, or redesignated from time to time. Ordinance 1288 15.17.040 Mandatory Requirements Section 65850.5 of the California Government Code provides that, on or before September 30, 2015, every city, county, or city and county shall adopt an ordinance that creates an expedited, streamlined permitting process for small residential rooftop solar energy systems. Section 65850.5 of the California Government Code provides that in developing an expedited permitting process, the city, county, or city and county shall adopt a checklist of all requirements with which small rooftop solar energy systems shall comply to be eligible for expedited review. The building official is hereby authorized and directed to develop and adopt such checklist. As required by Section 65850.5, the small residential rooftop solar energy system permit process to be adopted by the building official, including the standard plan(s), and checklist(s), shall substantially conform to recommendations for expedited permitting contained in the most current version of the California Solar Permitting Guidebook adopted by the Governor's Office of Planning and Research. The checklist shall be published on the city's internet website. The applicant may submit the permit application and associated documentation to the City's building division by personal, mailed, or electronic submittal together with any required permit processing and inspection fees. In the case of electronic submittal, the electronic signature of the applicant on all forms, applications and other documentation may be used in lieu of a wet signature Prior to submitting an application, the applicant shall: 1. Verify to the applicant's reasonable satisfaction through the use of standard engineering evaluation techniques that the support structure for the small residential rooftop solar energy system is stable and adequate to transfer all wind, seismic, and dead and live loads associated with the system to the building foundation; and 2. At the applicant's cost, verify to the applicant's reasonable satisfaction using standard electrical inspection techniques that the existing electrical system including existing line, load, ground and bonding wiring as well as main panel and subpanel sizes are adequately sized, based on the existing electrical system's current use, to carry all new photovoltaic electrical loads. For a small residential rooftop solar energy system eligible for expedited review, only one inspection shall be required, which shall be done in a timely manner and may include a consolidated inspection by the building official and fire chief. If a small residential rooftop solar energy system fails inspection, a subsequent inspection is authorized; however the subsequent inspection need not conform to the requirements of this subsection. Such approval does not authorize an applicant to connect the small residential rooftop energy system to the local utility provider's electricity grid. The applicant is responsible for obtaining such approval or permission from the local utility provider. A city, county, or city and county shall not condition approval for any solar energy system permit on the approval of a solar energy system by an association, as that term is defined in Section 4080 of the Civil Code. 15.17.050 Validity The city council of the city of Palm Desert hereby declares that should any section, subsection, sentence, clause or phrase of this chapter or the code hereby adopted is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of the ordinance codified in this chapter. The City Council of the City of Palm Desert hereby declares that is would have passed the ordinance codified in this chapter, and each section, subsection, clause, or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional. SECTION 2. If any portion of this ordinance is for any reason held by any court to be invalid or unconstitutional, that portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereof nor other applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are declared to be severable.
