HomeMy WebLinkAboutConvey - 73697 Santa Rosa Way - APN 627-102-019Resolution No. 2015-76 Resolution No. SA -RDA 047 CITY OF PALM DESERT/SUCCESSOR AGENCY TO THE PALM DESERT REDEVELOPMENT AGENCY STAFF REPORT REQUEST: AUTHORIZATION TO CONVEY CERTAIN REAL PROPERTY FROM THE CITY OF PALM DESERT TO THE SUCCESSOR AGENCY TO THE PALM DESERT REDEVELOPMENT AGENCY SUBMITTED BY: Ruth Ann Moore, Economic Development Manager DATE: August 27, 2015 CONTENTS: Site Map of lot line adjustment for 73697 Santa Rosa Way Grant Deed Resolution No.2015-76 SA Resolution No. SA -RDA 047 Recommendation 1) That the City Council waive further reading and adopt Resolution No. 2015-76 authorizing and approving the conveyance of certain real property from the City to the Successor Agency to the Palm Desert Redevelopment Agency; 2) That the Board of Directors of the Successor Agency to the Palm Desert Redevelopment Agency waive further reading and adopt Resolution No.SA-RDA 047 accepting the conveyance of real property from the City; 3) By Minute Motion: Authorize the City Manager/Executive Director to execute any and all documents necessary for the conveyance. Background On June 4, 2014 the State of California Department of Finance (DOF) approved the Long Range Property Management Plan (LRPMP) for the Successor Agency to the Palm Desert Redevelopment Agency that authorized the property located at 73697 Santa Rosa Way as designated for government use. On July 21, 2014 the property was deeded to the City of Palm Desert. It was determined that only the southern, vacant portion of the property (see Site Plan) would be needed for the future expansion of the Joslyn Center with the remaining northern portion to be sold on the open market. A parcel map waiver separating the original property into two parcels was completed and the new grant deed was recorded on May 12, 2015. Parcel 1 (as shown in the attached exhibit of the Grant Deed) is now the portion of the original property that includes the residential structures. Parcel 2 is the vacant portion of the original property located adjacent to the Joslyn Center. Staff Report Conveyance of City Property to Successor Agency Parcel 1 Santa Rosa Way August 27, 2015 Page 2 of 2 Discussion: Since Parcel 1 is to be sold, it must be transferred back to the Successor Agency to the Palm Desert Redevelopment Agency and all monies received will be distributed to the taxing entities. The attached resolutions will facilitate the transfer of Parcel 1 from the City back to the Successor Agency. The LRPMP will then be amended to now include Parcel 1 as a property to be sold by the Successor Agency. If this item is approved, approval by the Oversight Board and the State Department of Finance will be required prior to finalizing the property transfer. Fiscal Analysis The proposed conveyance of property from the City to the Successor Agency has no fiscal impact to the General Fund. Once the Successor Agency property is sold on the open market, the City, as a taxing entity, will receive approximately 3% of the sale proceeds. The Long Range Property Management Plan was approved by the State of California Department of Finance on June 2, 2014 allowing for the conveyance of the property located at 73697 Santa Rosa Way, Palm Desert, California for governmental use and the property was deeded to the City of Palm Desert on July 21, 2014. E. On May 12, 2015, a new grant deed was recorded separating the property into two parcels and the City desires to execute and deliver to the Successor Agency that certain quitclaim deed in the form attached hereto as Attachment "A" (the "Deed") for Parcel 1 and conveying that certain real property described therein. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PALM DESERT HEREBY FINDS, DETERMINES, RESOLVES, AND ORDERS AS FOLLOWS: Section 1. The Long Range Property Management Plan was approved by the State of California Department of Finance on June 2, 2014 allowing for the conveyance of the property located at 73697 Santa Rosa Way, Palm Desert, California for governmental use and the property was deeded to the City of Palm Desert on July 21, 2014. On May 12, 2015, a new grant deed was recorded separating the property into two parcels and the City desires to execute and deliver to the Successor Agency that certain quitclaim deed in the form attached hereto as Attachment "A" (the "Deed") for Parcel 1 and conveying that certain real property described therein. F. The Board desires to accept the conveyance of the real property described in the Deed and the real property described in any such quitclaim deed executed and delivered to the Board in the future.
