SHORE DRIVE TO MONTEREY SHORE, LLC, SUBJECT TO THE
APPLICANT CONVERTING THE EASEMENT AREA FROM TURF
TO DROUGHT TOLERANT DESERT LANDSCAPING

Recommendation
By Minute Motion, authorize the Mayor to execute a Grant of Easement for a
monument sign for incidental and landscape maintenance purposes located
at the northwest corner of Monterey Avenue and Dinah Shore Drive to
Monterey Shore, LLC, subject to the applicant converting the easement area
from turf to drought tolerant desert landscaping.
Background
On February 24, 2015, the Architectural Review Commission granted approval for three
monument signs for Monterey Shore Plaza. Two of the signs are to be located on
Monterey Plaza property at Dinah Shore Drive and Shopper Lane and at Miriam Way.
The third sign was approved to be at the northwest corner of Dinah Shore Drive and
Monterey Avenue on property owned by the City of Palm Desert.
The City acquired the land at the northwest corner of Monterey Avenue and Dinah
Shore Drive from the County of Riverside by Quitclaim Deed, which recorded on March
18, 2015, as Document No. 2015-0108083. The acquired land is bounded by Dinah

Shore Drive to the south, Monterey Shore Plaza (Costco Center) to the west, the Union
Pacific Railroad to the north, and Monterey Avenue to the east.
This approval should be subject to conditioning the building permit for the walls to have
the applicant convert the existing turf area within the easement area to drought tolerant
desert landscaping. The applicant has verbally agreed to this condition.

FOR VALUABLE CONSIDERATION, the receipt of which is hereby acknowledged,
the CITY OF PALM DESERT, a municipal corporation,
hereby grants to MONTEREY SHORE, LLC, A CALIFORNIA LIMITED LIABILITY
COMPANY, ITS SUCCESSORS AND ASSIGNEES, the following described real
property in the City of Palm Desert, County of Riverside, State of California:
An easement for monument sign, incidental and landscape maintenance
purposes over that certain property described in a legal description and plat
attached hereto and made a part hereof as Exhibits "A" and "B" respectively.
