Recommendation
By Minute Motion that the City Council:
1. Waive further reading and approve an amendment to professional
architectural design Contract No. C33330B with Prest-Vuksic Architects in
the amount of $12,875,00, for the additional design scope for the
Alessandro West Improvement Project;
2. Authorize the move of 10% contingency ($3,869.50) to base and
appropriate $9,005.50 from Capital Project Fund Account No. 4004341-
4400100. Costs will be reimbursed to the City from bond proceeds
pursuant to the approved Alessandro Bond Proceeds Funding Agreement;
3. Authorize the Executive Director to execute the professional services
contract amendment as it relates to the design of the Alessandro West
Improvement Project.
Background
Over the last decade the former Redevelopment Agency acquired several properties
located adjacent to the Alessandro Alley. The intent of the acquisition was to implement an
improvement project that would assist in renovating the blighted area and provide
improvements that would stimulate new economic development and expansion of the
commercial properties located to the south. Future expansions or reconstruction of the
older commercial buildings will require additional parking inventory.
On March 26, 2015, the City approved two design contracts to finalize the design of the
Alessandro West Improvement Project. The first contract was with the Altum Group in the
amount of $105,560.00, plus a 10 percent contingency to update and complete the
engineering plans for the project. The second contract was with Prest-Vuksic Architects in
the amount of $38,695.00, plus a 10% contingency to complete the architecture designs for

the remodeling of the Las Palmas Apartment frontage, new carports to serve the apartment
complex, project lighting and landscaping.
Discussion
In March of 2015, the City entered into a contract with Prest-Vuksic Architect (PVA) to
complete the construction drawings to ensure compliance with current building codes,
lighting design for the entire Alessandro West corridor, landscape designs, as well as
bidding and construction administration services. The proposed amendment to the contract
will address the following additional scope of work for the project:
1. Modify the south face of the existing walls that were recently erected on private
property to be in keeping with the Alessandro West wall design.
2. Establish a design for future walls that will be harmonious with the recently erected
walls.
3. Provide landscape, lighting and electrical design for the proposed central parking
area located at San Marcos and San Clemente Circle (see attached map).
4. Provide structural design for central parking lot light poles.
5. Coordinate with civil engineer in regard to additional parking lot.
PVA proposal is in the amount not to exceed $12,875.00.
Fiscal Analysis
Funds are currently budgeted in Fiscal Year 2015/2016 Account No. 4004341-4400100.
Although the Capital Projects Fund would initially advance the funds for the design and
construction of the Alessandro West Improvement Project, the City will be reimbursed by
the Successor Agency pursuant to the approved Alessandro Bond Proceeds Funding
Agreement and funds available from the Project Area 1 Bond Funds.

This Contract Amendment covers changes to the subject contract as described herein. The consultant shall perform
all work as necessary or required to complete the Contract Amendment items for a lump sum price agreed upon
between the Consultant and the City of Palm Desert, otherwise referred to as Owner.
Contract Time Extension 90 Days.
Revised Contract Total $ 51,570.00
The undersigned Consultant approves the foregoing Contract Amendment # 1 as to the changes, if any, in the
contract price specified for each item including any and all supervision costs and other miscellaneous costs relating to
the change in work, and as to the extension of time allowed, if any, for completion of the entire work on account of said
Contract Amendment # 1. The Consultant agrees to furnish all labor and materials and perform all other necessary
work, inclusive of that directly or indirectly related to the approved time extension, required to complete the Contract
Amendment items. This document will become a supplement of the contract and all provisions will apply hereto. It is
understood that the Contract Amendment shall be effective when approved by the Owner.
Execution of this Contract Amendment by the Consultant constitutes a binding accord and satisfaction that fully
satisfies, waives, and releases the Owner from all claims, demands, costs, and liabilities, in contract, law or equity,
arising out of or related to the subject of the Contract Amendment, whether known or unknown, including but not
limited to direct and indirect costs and/or damages for delay, disruption, acceleration, and loss of productivity, as well
as any and all consequential damages.
This document will become a supplement to the Contract and all provisions will apply hereto, all items included above
must have required signatures as per the purchase resolution.

REIMBURSABLE EXPENSES
Reimbursable Expenses would be billed using a multiplier of 1.15 (15%) in addition to the Architect's
compensation and include actual expenditures made by the Architect and Architect's employees in the
interests of the Project for the expenses listed in the following subparagraphs:
1. Fees paid in securing approvals of authorities having jurisdiction over the project.
2. Computer plotting and reproductions of drawings, specifications and other documents.
3. Postage and special handling of documents.
4. Expense of overtime work requiring higher than regular rates, if authorized by the Owner.
5. Expense of additional insurance coverage or limits, including professional liability insurance,
requested by the Owner in excess of that normally carried by the Architect.
6. Any consultants (structural engineer, landscape architect, etc.) retained by the Architect.
