Approve Change Order No. 1 to Contract No. C34320 in the amount of $10,400 for the Highway 111 Right Turn to Westbound Fred Waring Drive Project; 2. Authorize the transfer of $10,400 from contingency to base; 3. Authorize the Mayor to execute said Change Order No. 1; and 4. Accept the work as complete and authorize the City Clerk to file a Notice of Completion for Contract No. C34320. Background In September 2011, the City of Palm Desert acquired right-of-way from N and D Restaurants, Inc., the owner of the property at the Red Lobster development. The additional right-of-way was required to construct a dedicated right turn onto westbound Fred Waring Drive from Highway 111 to mitigate traffic congestion. In addition to the Staff Report Approve Change Order No Page 2 of 2 September 24, 2015 1 and NOC for Contract C34320 work at the Highway 111 and Fred Waring Drive intersection, the project included sidewalk and ADA compliant driveways at the MOR Furniture store. On June 11, 2015, City Council awarded Contract No. C34320 in the amount of $404,000 to Granite Construction Company of Indio, California, for the Highway 111 Right Turn to Westbound Fred Waring Drive Project. During construction of the project, unsuitable material was discovered and had to be removed and replaced with aggregate base. The contractor also made minor adjustments during construction including adding additional traffic loops that were outside of the original scope. The amount associated with the additional work is $10,400 and is reflected on Change Order No. 1. The amount represents 2.57 percent of the original contract amount and is well within the contingency already approved by Council. Staff has inspected the work performed by the contractor and has found said work to be complete and in accordance with the contract requirements. Fiscal Analysis The initial contract amount was $404,000, and Change Order No. 1 will increase the contract amount to $414,400. There is no fiscal impact beyond the cost of the project. The Contractor shall construct, furnish equipment and materials, and perform all work as necessary or required to complete the Change Order items for a lump sum price agreed upon between the Contractor and the City of Palm Desert, otherwise referred to as Owner.
