HomeMy WebLinkAbout10 Homebuyer Assist Desert Rose - Falcon CrestSTAFF REPORT CITY OF PALM DESERT/ PALM DESERT HOUSING AUTHORITY JOINT CONSIDERATION MEETING DATE: November 18, 2021 PREPARED BY: Veronica Chavez, Finance Manager REQUEST: Recommendation Approve homebuyer assistance loans to qualified buyers for resales within Desert Rose and Falcon Crest not to exceed forty percent (40%) of the allowable sales price and authorize the City Manager to approve transaction costs specific to each resale. By Minute Motion, that the City Council and the Housing Authority Board: 1) In the developments of Desert Rose and Falcon Crest, approve silent homebuyer assistance loans not to exceed forty percent (40%) of the allowable sales price (to be increased by reasonable closing costs, commissions, and any approved upgrades), in total for either a direct sale or a Housing Authority sale from any available funding source restricted for such purpose (BEGIN, Housing Mitigation, Housing Authority program income) and authorize the Director of Finance to draw from the appropriate funds accordingly; 2) Authorize the City Manager to approve payment of the transaction costs if necessary for the purpose of repairs required for closing, fees customary to real estate transactions in Riverside County including escrow, title FHA fees, inspections, vermin eradication, commissions, approved upgrades, and disclosures: and 3) Authorize the Chairman of the Palm Desert Housing Authority or the Housing Authority Executive Director or a designee to execute any documents necessary to facilitate this transaction and actions taken herewith. Strategic Plan Obiective This request relates to the strategic plan objective, Land Use, Housing, and Open Space, more specifically Priority 2: Facilitate development of high -quality housing for people of all income levels. Desert Rose and Falcon Crest are part of the Authority's affordable housing program, making single-family homes available for purchase to lower income -qualified homebuyers. November 18, 2021 —Staff Report City of Palm Desert/Housing Authority—Homebuyer Assistance Desert Rose -Falcon Crest Page 2 of 3 Background Analysis The Palm Desert Housing Authority ("Authority"), as successor housing entity to the Palm Desert Redevelopment Agency and in order to maintain associated affordability covenants, has the first right of refusal to purchase properties in Desert Rose and Falcon Crest if the owner decides to sell. If the Authority fails to execute its option to purchase within an option period, the homeowner can sell the property to a non - qualified buyer and the Authority would lose its affordability covenant on the property. Current owners that have restrictive covenants recorded against the property are required to notify the Authority if they intend to sell their property. Pursuant to the covenants, resale prices are restricted to either a calculated resale price based on the purchase price escalated by the change in the area median income or the appraised value, whichever is less. The sales prices in Desert Rose currently range from $135,000 to $160,000 and from $200,000 to $260,000 in Falcon Crest. For many years, City staff has been able to facilitate direct sales from current owners to new qualified buyers within the option period by maintaining an interest list of potentially qualified households interested in purchasing a home within one of the two developments. Households are selected from the interest list by household size and income suitable to the home available and then by order of submission. Each of the households on the interest list need some level of assistance in order to purchase the available home. When an owner re -sells to a qualified household (buyer) during the covenant period, the owner (seller) repays the loan they were provided when they purchased the home along with deferred interest. This money along with any other monies, restricted for this purpose, are utilized to assist the new buyer. The funding source will depend on what criteria the buyer meets. Monies to fund the homebuyer assistance comes from various sources including Building Equity and Growth In Neighborhoods (BEGIN), Housing Mitigation, and Housing Authority program income from repaid loans. The original programs provided homebuyer assistance loans in varying amounts but for the last 10 years has been capped at forty percent (40%) of the allowable sales price or $80,000 (in total). However, the calculated prices are now rising due to the area median income increasing and the exact amount of the homebuyer assistance loans will depend on the household's qualifying income and adjusted prices. Staff is requesting the assistance loans to be capped at forty percent (40%). The homebuyer assistance loans are provided in an amount that ensures an affordable housing cost in accordance with Title 25, Division 1, Chapter 6.5, of the California Code of Regulations so the buyer will not receive more in assistance loans than is necessary.
