CASE NO: MISC 20-0019 APPLICANT AND ADDRESS: H3K DESIGN, 501 S. Palm Canyon Drive, Palm Springs, CA 92264 NATURE OF PROJECT/APPROVAL SOUGHT: Consideration to approve a request to convert the former EZ Lube building into a design showroom: H3K Design. LOCATION: 74180 Highway 111 ZONE: D.O. Mr. Kevin Swartz, Associate Planner, presented a proposal to convert the former EZ Lube building into a design/furniture showroom for H3K Design. The project includes the following; converting the bay garage doors to fixed and operable glass; re-painting the exterior (cream, light grey, and dark grey); removing the existing driveway along Cabrillo Avenue; modifying the parking area; a new 5-foot high decorative fence featuring pressed concrete breeze block; wrought iron; and new landscaping along the west and north property lines. Staff recommends approval of the proposed remodel, and a new 5-foot high decorative fence. The conversion from an automotive use to a design showroom will enhance the commercial corridor along Highway 111 as it transitions into the residential neighborhood. The Commission discussed the pedestrian access gate, modification of the sidewalk, location of the trash enclosure, parking requirements, and the air conditioning units. They recommended screening the air conditioning units below the parapet. The Commission discussed the block wall and suggested a stacked bond block instead of the wrought iron, with good landscaping in front of it to soften it. They also suggested looking at something more upscale than wrought iron. A material that will be more appropriate for the level of design as shown for the overall project. The Commission discussed the front of the building on the south elevation and said the subtle two tone differences complement the building’s design but as you move around to the west elevation it appears chopped up with many variables that take away from the building. They said a stacked bond block wall set back from the deco block panels with some manipulation and nice landscaping will create a ARCHITECTURAL REVIEW COMMISSION MINUTES September 22, 2020 G:\Planning\Janine Judy\ARC\2020\Minutes\200922min.docx Page 3 of 5 nice layering. They also suggested artfully ramping up the new block wall with artwork or metal designs on both sides of the wall. ACTION: Commissioner Vuksic moved to continue Case No. MISC 20-0019 subject to: 1) restudy the wall material and show more consistency; 2) choose a material more appropriate for the level of design; 3) restudy landscape choices; and 3) ensure that air conditioning units are below the parapet. Motion was seconded by Commissioner Levin and carried by a 5-0-2 vote, with Lambell, Levin, Schmid, Van Vliet, and Vuksic voting YES and McAuliffe and McIntosh absent. B. Preliminary Plans: 1. CASE NO: PP/CUP 20-0003 APPLICANT AND ADDRESS: CHANDI ENTERPRISES LLC, 42270 Spectrum Street, Indio, CA 92203 NATURE OF PROJECT/APPROVAL SOUGHT: Consideration to approve a mixed-use project consisting of approximately 16,500 square feet of retail/office uses on the ground floor, and 60 residential units (1- 3 bedrooms) on the second and third floors; Chandi Mixed-Use Project. LOCATION: SEC Fred Waring Drive & San Pablo Avenue ZONE: D.E.: Mr. Kevin Swartz, Associate Planner, presented a proposal for a mixed- use three-story building located on the southeast corner of Fred Waring Drive and San Pablo Avenue. He reminded the Commission this came before them on July 14, 2020 and summarized the changes made by the applicant since that meeting. He recommended preliminary approval of the project and of the architectural design. If approved, the applicant may proceed to Planning Commission once all City departments have issued conditions of approval. The Commission reviewed the changes and discussed the size and texture of the stone surfaces, the window detail, the eyebrow canopy, the rooftop mechanical screen louvers, addition of ceiling height to the residential units, the areas identified for solar, the on-site storm water retention plan, changes to the parking structure with materials, color and texture, fire sprinklers and detector check risers. They asked about the north elevator access control for the public and residents and the applicant explained that the public will have access to the first and second floor but only the residents will have controls to the third and fourth floors. The applicant explained there will be planters placed on the second floor of the building that are self-contained with a wire screening attached for vines to grow up and create a green privacy barrier. The Commission and the applicant discussed the recommendation to provide breaks or openings in the project to maximize the ability for a cross breeze through the courtyard during the hotter months. The applicant said they will enhance the landscape design and provide a misting system and introduce a water feature to assist with evaporative cooling to bring the ambient temperature comfort down. The Commission and the applicant reviewed and discussed the location of all utility meters and how that will work with the architecture. The applicant stated the gas meters will be wall mounted, and they may potentially have a boiler system with sub meters in each one of the units. The Commission stated they were still concerned with their locations from an architectural standpoint, Mr. Swartz reminded the Commission they are looking for preliminary approval to move this along to the Planning Commission. He pointed out that the first round of construction drawings will return to the ARC to monitor this project as it moves through the process. ACTION: Commissioner Schmid moved to continue Case No. PP/CUP 20-0003 subject to: 1) showing layout and locations of all utilities and how they blend with the architecture; 2) provide a more detailed roof plan showing the parapet walls; 3) all parapet walls need to be extended/returned back more than 3’; and 4) restudy the block choice on the east elevation. Motion was seconded by Commissioner Lambell and carried by a 5-0-2 vote, with Lambell, Levin, Schmid, Van Vliet, and Vuksic voting YES and McAuliffe and McIntosh absent. Attached is the Notice of Action. The project request is to convert the existing Chevron gas station on the corner of Highway 111 and Deep Canyon Road to a Sinclair gas station. Zoning Ordinance Summary All new and modifications to monument signs requires approval from the ARC. Staff is including the full scope of work under ARC’s approval as well. Staff Recommendation Staff recommends approval of refacing the existing monument signs and the modification to the existing “Short Stop” sign. In regards to the canopy, the applicant is including their branding and logo, and staff is requesting comments from the ARC. Staff will work with the applicant on the decorative dinosaur along Deep Canyon. Consider just applying it to the small detail on the bottom of the canopy; 2) When applying the green to the canopy, the same color must wrap around the sides of the canopy; 3) design canopy as a 3-dimensional element to better illustrate the proposal; 4) submit dimensions of the dinosaur art feature at the corner of the property; 5) leave the current bases as is for the monument signs and just reface the two signs; 6) clarify the need for the Short Stop wall sign versus the Dino Mart wall sign, and the Cam’s Corner wall sign; 7) addition of landscape on the corner; and 8) gas pump designs were acceptable. Attached is the Notice of Action. The project request is to demo the existing Pizza Hut building within the Neighborhood Walmart shopping center, and construct a new 7,500- square-foot retail/restaurant building. The building is proposed with four (4) tenant suites, but could be altered based on tenant needs. At the July 28, 2020, ARC meeting, the Commission had concerns with the west elevation since it faces Highway 111. The concerns had to do with it appearing as back of house with the utility rooms being visible. The ARC discussed rotating the building so the back of building would front the gas station. The owners and architect have tried several designs including rotating the building, but due to site challenges cannot rotate the building. They are proposing to screen the west elevation with a screen wall and landscaping. The building’s architecture maintains a contemporary theme with flat roof lines, architectural pop-outs, awnings, recessed windows, warm earth tone colors, and thick architectural elements. The proposed building is single-story in height with roof lines between 22, 25, and an overall height of 35 feet. The building is oriented where the storefronts are facing the parking lot and the rear of the building is facing Highway 111. The rear elevation includes awnings and trellises. The overall building design includes: desert colors, plaster finishes, foam cornice details, aluminum frame windows and doors, awnings, storefront glass, and red roof tile. All rooftop equipment will be screened from all public views. The landscape design consists of a desert theme, with species requiring minimal water usage. The proposed landscaping along Highway 111 will be heavily landscaped with a variety of shrubs. Zoning Ordinance Summary The proposed project requires approval of a Precise Plan by the Planning Commission. The project complies with all development standards including setbacks, building height, parking, lot coverage, and land use compatibility. The land use designation is Regional Retail within the General Plan and zoned P.C.-(3) and Scenic Preservation. The P.C.-(3) regional commercial center provides a unified area for commercial uses which offer a wide range of goods and services, including comparison and convenience shopping, entertainment, cultural, and recreational uses. The district provides for large-scale, large-format, commercial development that serves the broader region and is generally located around major intersections. The proposed building is similar to the newly constructed building within the shopping center fronting Fred Waring Drive (Fred Waring). The project will also provide retail/restaurant options for the surrounding area and for the hotel guest within the Springhill Suites by Marriott. The businesses will operate in the same manner as the other retail uses within the City. The new building will not interfere with parking as determined by staff and the proposed use would complement the adjacent uses in the vicinity. Staff Recommendation Staff agrees with the ARC that the building should be rotated so the elevation fronting Highway 111 is not the back of the building. The City currently has this challenge with the existing buildings in the Las Sombras center on Highway 111 and Fred Waring (Olive Garden) where the buildings are screened with walls fronting Highway 111, and are unattractive. Staff has concerns with the proposed building design, and is requesting comments from the ARC. This would allow the patios to front 111 and allow for additional architectural features that will create interest from 111; 3) the service doors need to be screened better with additional layering. If the building were to rotate with the back facing the gas station, this would help; 4) the tower elements need more offsets, as well as the rectangular elements; 5) the towers need to be more pronounced; 6) the entire building needs additional offsets as well; 7) balance the trellis to awning ratios; 8) carry all building forms so they are four-sided; 9) revise plant palette to include taller plants in some areas; and 10) ensure that all kitchen equipment on roof is screened properly with parapets. The application was approved by the Planning Commission (PC) on September 15, 2020, subject to a condition that the project return to the Architecture Review Commission (ARC) for revisions to the building architecture and landscaping. The project is returning to ARC for approval of the preliminary architecture. This item was originally approved by the ARC on July 14, 2020, subject to design revisions to add recessed windows on the primary elevations. The Notice of Action and minutes for this approval are attached. The PC was concerned that the front elevations lacked sufficient articulation to break up the massing. The applicant has resubmitted revised elevations to address the PC’s comments. The Applicant shall agree to defend, indemnify, and hold harmless the City of Palm Desert or its agents, officers, and employees from any claim, action, or proceeding against the City of Palm Desert or its agents, officers or employees, to attack, set aside, void, or annul, any approval of the City of Palm Desert, whether by its City Council, Planning Commission, or other authorized board or officer of the City. 6. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Department of Building & Safety City Fire Marshal Department of Public Works Coachella Valley Water District 7. The Applicant and/or any successor in interest shall comply with all applicable local, state, and federal laws and regulations. 8. This project is subject to payment of the City's Public Art fee. The fee will be applied at the time of a building permit issuance and shall remain in the City's Public Art Fund. 9. All ground -mounted utility structures including, but not limited to, transformers, HVAC equipment, and backflow prevention valves shall be located out of view from any public street or adequately screened through the use of landscaping and/or masonry walls. 10. Site lighting shall be reviewed and approved by the Department of Community L Development and shall conform to the City's Outdoor Lighting Ordinance. 3 PLANNING COMMISSION RESOLUTION NO.2780 11. Final landscape and irrigation documents shall be prepared by a landscape architect registered with the State of California and shall be submitted to the City's Department of Community Development and the Coachella Valley Water District for review and approval. All sheets shall be wet signed by the landscape architect and shall include the license number and the expiration date. The landscape plan shall conform to the preliminary landscape plans, prepared as part of this application, and shall include dense plantings of landscape material. All plants shall be a minimum of five gallons in size, and all trees shall be a minimum 24-inch box in size. 12. All project irrigation systems shall function properly, and landscaping shall be maintained in a healthy and thriving condition. The maintenance of landscaping and the irrigation system shall be permanently provided for all areas of the project site, as well as walkways and the portion of public right-of-way abutting the project site (parkways and medians). Furthermore, the plans shall identify responsibility for the continued maintenance (such as homeowners' association, landscape maintenance district, property owner, etc.). 13. No materials or equipment shall be stored to a height greater than adjacent screen walls and fences. 14. A copy of the herein -listed conditions of approval shall be included in the construction documentation package for the project, which shall be continuously maintained on -site during project construction. 15. The applicant shall resubmit the project to the Architectural Review Commission for design review and approval of the architecture and landscaping within the retention basin. Department of Public Works: Prior to issuance of a grading permit: 16. The applicant shall submit a grading plan to the Department of Public Works for review and approval. Any changes to the approved civil plans must be reviewed for approval prior to work commencing. 17. The applicant shall submit a PM10 application for approval. The applicant shall comply with all provisions of Palm Desert Municipal Code Section 24,12 regarding Fugitive Dust Control. 18. MINUTES PALM DESERT PLANNING COMMISSION SEPTEMBER 15, 2020 3 Vice-Chair Greenwood asked Mr. Melloni to elaborate on the conditions recommended by the Architectural Review Commission (ARC), and how they were integrated into the exhibits that staff presented to the Planning Commission. Mr. Melloni responded that the ARC directed the applicant to create pop-outs or further recess of some of the windows to create more interest with the shadow lines. He said the applicant provided updated elevations; however, the package was not complete, so he did not include them in the presentation. He stated that the comments would be addressed when the project goes back to the ARC for final approval of the construction drawings. Vice-Chair Greenwood asked if staff reviewed the design changes based on the ARC comments. Mr. Melloni replied, yes. Vice-Chair Greenwood asked if staff was satisfied with the changes. Mr. Melloni replied, yes. He reiterated that the changes were not included in the Planning Commission presentation, but would be taken back to the ARC for final review and approval. Vice-Chair Greenwood thought that Dinah Shore Drive has good examples of tilt-up architecture. He struggled with the proposed project, which does not commensurate with that level of architectural design. He asked what the City is using as a gauge to review industrial projects. Mr. Melloni responded that the City is using the existing architecture along the corridor as a reference point. For this project, staff referenced the Barkingham Pet Hotel. Mr. Stendell interposed that the gauge is working with the ARC, and staff leans on the ARC’s recommendation. MR. DAVE MADDEN, the architect for the project, stated that he worked with staff and ready to move forward with the construction documents. He commented that they reviewed the conditions of approval, and they do not have any objections. Commissioner Ron Gregory voiced his concern with landscape for the retention basin. MR. MADDEN commented that it was logical to add an ingress and egress from the driveways to continue the natural flow for stormwater quality. Commissioner Gregory stated that there is not a lot of landscape, and it is going to be mostly rock, which is typical for the area. He said the plant material would not do much due to the small amount of land over the sight line, and the plant material selected would not be there in a few years because they are not sustainable. He hoped the landscape architect could address his concerns. MR. MADDEN responded that they could make adjustments. MINUTES PALM DESERT PLANNING COMMISSION SEPTEMBER 15, 2020 4 Commissioner Gregory asked staff if the City should not care about the landscape because it is in an industrial area. Before moving forward, Mr. Stendell asked Chair Holt to open the public hearing. Chair Holt declared the public hearing open and invited public testimony FAVORING or OPPOSING this matter. Mr. Stendell continued that they care and do not forget about the industrial areas. There are certain realities as far as the way lots are sloping. However, it does not mean that they cannot come up with unique design solutions. If the Planning Commission feels that the landscaping needs extra work, the Commission could make comments and requirements as the conditions of approval. Vice-Chair Greenwood inquired if the City has any examples along Dinah Shore Drive with a retention basin front-loading the street. Mr. Stendell responded that he could not answer without taking a drive through the area. He stated that the general rule of thumb is how aggressive and deep is the basin. A shallow retention basin could look like a natural landscape area. Commissioner Gregory commented that he does not know how deep is the proposed retention basin. However, if there is sufficient room, it would be great to make the retention basin look like it is part of the landscape. MR. MADDEN stated that Commissioner Gregory’s comments are acceptable. With no further testimony offered, Chair Holt declared the public hearing closed. Vice-Chair Greenwood noted that there is a discrepancy between the precise grading plan and the landscape plan. The precise grading plan shows a narrow strip of riprap, and the landscape plan provides undulation. He felt there needs to be careful consideration and coordination between the two disciplines to show the front end is executed well aesthetically and have a good planting. He understood that the ARC reviewed the project, and he does not want to overstep his bounds as a Planning Commissioner. However, he felt the building has flat planes, and there is not a lot of proportion. He mentioned that there many good examples on Dinah Shore Drive of tilted architecture in industrial buildings. He struggled with the project not being commensurate with that level of architecture, which is a big building facing Dinah Shore Drive. Commissioner Joseph Pradetto supported Vice-Chair Greenwood’s comments. Although he is not an architect, he was not impressed with the design. He did think of granting some leniency, being that the building is located in an industrial zone. However, he wished he did not have to take for granted that the City would get a mediocre design in the north part of the City, which is a gateway for a lot of commerce. He did not have a solution, but shared his concern that the ARC did not give the Planning Commission the best design possible. MINUTES PALM DESERT PLANNING COMMISSION SEPTEMBER 15, 2020 5 Mr. Stendell suggested the Planning Commission could approve the project entitlement so it could move forward, subject to sending the preliminary architecture back to the ARC before to the final construction documents. If not, the Planning Commission could send the project back to the ARC for a second look without approving the entitlement. Chair Holt asked if it is correct that the approval could be contingent on the applicant working on the landscape items as well. Mr. Stendell replied that is correct. He noted that the landscape design is within the purview of the ARC. Vice-Chair Greenwood moved to waive further reading and adopt Planning Commission Resolution No. 2780, approving Case No. PP 19-0010 contingent upon the proposed project returning the ARC for review of their previous comments, address landscaping and plant species within the retention basin, and subject the conditions of approval; and adopted a Notice of Exemption in accordance with CEQA. Chair Holt inquired if the City’s General Plan has guidelines in general or otherwise for landscaping of retention basins. Mr. Stendell responded that the General Plan does not get into that level of detail. There might be some design standards, but they could be outdated. He looked to Engineering Assistant Christina Canales; however, he did not think the City has specific details for landscaping and retention basins. Chair Holt asked if it could be beneficial to have design standards to handout to developers or landscape designers. Mr. Stendell responded that he did not know. He had mixed opinions on having standard drawings. He felt if there are standard drawings, you get standard designs. He said if the Planning Commission has any opinions to let him know and he would be happy to look at it from a staff perspective. Assistant Engineer Christina Canales added that the City does not have design standards in regard to landscaping, only for the basin for safety reasons. Commissioner Gregory commented that the City does not need to have design standards, but maybe some verbiage. The verbiage could state, if the parkway is to be used as a retention basin, then the landscaping has to make sense and integrate with the retention basin, so it looks attractive. XI. LOCATION: 73-725 Dinah Shore Drive ZONE: SI Mr. Nick Melloni, Assistant Planner, presented a request for approval to construct a two-story 18,434-square-foot light -industrial building on Dinah Shore Drive. The building will feature suites for up to three tenants. The building architecture is characterized by simple rectangular massing and forms, which are consistent with the intended industrial nature of future building tenants. Primary entrances to the respective suites are oriented towards Dinah Shore Drive (Dinah Shore). Each of these entrances is highlighted by a covered entry projecting outwards from the primary mass of the main building. The side and rear elevations feature limited articulation, with the rear featuring industrial style roll -up doors. The exterior finish palette consists of various shades of gray and stacked stone veneer. The building design screens roof -mounted equipment and exhaust vents with a continuous six-foot parapet wall. Electrical equipment and fire risers will be located within a room towards the rear of the building. Roof drains and gutters will be located within the walls of the building. The majority of site landscaping is concentrated along the street frontage within the proposed retention basis. The landscape palette consists of a mix of desert -native shrubs, and accent plants including various agave and yucca. Trees, including Blue Palo Verde and Chitalpa Pink Dawn will be placed within the parking areas and around the rear and side perimeter of the development. Commissioner Lambell was concerned with the lack of shade noted on the renderings and asked the architect what can be done to avoid this becoming just a flat face. MR. DAVE MADDEN, architect, pointed out that the articulation is achieved by the three (3) entryway covers one on each side of the high tower. The covered entries with the rock veneer stick out 4 to 6' from the building Commissioner Levin and MR. MADDEN discussed the lack of recess on the windows. MR. MADDEN said on the front elevation he will take the four center windows on the left and right side of the entryway, double frame a wall in front of it and recess them 4" to 6". Commissioner McAuliffe thinks that will work and suggested they double frame and set the windows to the inside to give them about 6" of recess. Commissioner McAuliffe and MR. MADDEN discussed the areas for the roof drains. MR. MADDEN said they will have interior drains one on the left and one on the right that will drain towards the front with pickups in the roof to catch the water. Commissioner Levin moved to approve subject to double -framing and setting windows to the inside on either side of the primary entry to create additional recess and architectural interest, as well as shading.
