Subject: City Council Agenda (January 27, 2022)
Below you will find questions received from the Mayor and/or Councilmembers and answers provided
by City staff regarding tonight’s Council meeting agenda.
Action Calendar – Item 17:
•Question: Can you specify the finite date, per RivCo Registrar, for City Council to get a ballot
initiative on the June election? Is there any reason for the delay to November?
o Answer: Riverside County Registrar of Voters has released a calendar of dates for the
June 7, 2022, Consolidated Primary Election. A copy has been attached for reference.
Staff was given direction to research the process to get a ballot initiative on the
November ballot. More research would need to be done in order to provide a more
detailed response regarding the process to get a ballot initiative on the June ballot,
which can be done at Council’s request.
Public Hearing – Item 21:
•Question: At the last City Council Meeting, Mayor Pro Tem Jonathan expressed concerns
regarding the requirement to submit studies being included in the ordinance. Council asked for
the ordinance to be re-written to soften this language. The proposed ordinance on the agenda
has removed this language altogether. Is it within staff's normal prerogatives to suggest (as
opposed to require) studies of the sort listed as a means to ease resolution of resident
concerns?
o Answer: Yes, staff’s normal practice is to request relevant plans and studies while
going through the application process to assist with easing resident concerns. The
removal of the requirement in the ordinance allows staff to continue with this practice.
The idea behind the ordinance was that we are facilitating public informational
meetings to encourage cooperation with neighbors early on, not adjudicate the zoning
case. In addition, we will be able to better report to Council, PC, ARC what issues the
residents brought up in advance and if the developer worked with them. This is a
major improvement and should make our processes run smoother.

Public Hearing – Item 22:
•Question: For the Redistricting Workshops, will a Spanish Translator/Interpreter present?
o Answer: Yes, there was a translator physically present at the first workshop on January
20, 2022. The live translation was available for in person attendees via headphones
and virtual attendees via a Translator Room in Zoom. The second Workshop will be
virtual and will have a translator available via the Zoom Translator Room. Staff will
have conference rooms available for individuals to participate in the meeting from City
Hall if they prefer. There will be a room set up for English and for Spanish.
•Question: Can I get a zoomed in version of the proposed maps to see more detail?
o Answer: Yes, a zoomed in version of the proposed maps is attached.
Public Hearing – Item 23:
•Question: Are there funds generated by the villa units, i.e. a one-time per-door fee?
o Answer: No, there is not a one-time door fee for the villa units, however, all villa units
are eligible for Short-Term Rentals that will be managed by the hotel and will generate
TOT. More information on this will be provided in staff’s presentation.

By this date, the Governor shall issue a proclamation calling the primary election and shall

combination of such signatures and the prorated filing fee, the county elections official
shall issue the nomination papers provisionally. Any candidate who submits a number of
valid in-lieu signatures that meet the nomination signatures requirement and equals or

for Judicial offices of the Superior Court pay the filing fee at the time of filing the
Declaration of Intention to become a candidate.) The number of valid in-lieu signatures
any candidate obtains may be subtracted from the number required for his or her
nomination papers. A candidate shall not be required to execute a nomination paper if the

The non-refundable filing fee is based on the annual salary for the office on the first day to
circulate petitions in lieu of filing fee. The filing fee requirement, if any, must be paid
before nomination documents are issued. The filing fee may be paid in money, In-Lieu
Petitions, or a combination of both.
NOTE: The Registrar of Voters and the Secretary of State can only accept checks,
cashier’s checks, or money orders. We cannot accept cash. Candidates who do not

On or before this date, a candidate for the office of governor, in order to appear on the
ballot, must file with the Secretary of State's office, two versions (one redacted and one
unredacted) of every income tax return the candidate filed with the Internal Revenue
Service (IRS) in the five most recent taxable years. The candidate shall redact information
pursuant to Elections Code section 8903.
The candidate must also sign and file with the Secretary of State's office a written consent
and acknowledgement form granting the Secretary of State permission to publicly release
the redacted version of the candidate's tax return.

a ballot measure) if they want to expand the present voting system from 2 to 5 districts to go into effect for
the 2024 election cycle if passed by the voters.
Several Palm Desert residents would prefer the City Council pass a motion today to move (without a ballot
measure) toward a five district system of electing Council members to go into effect for the November 2022
election cycle.
However, there is room for a compromise motion; namely, a motion to have the voters decide the issue by
putting a ballot measure on the June 2022 mid‐term election and if passed, go into effect for the November
2022 election cycle.

The purpose of this email is to express my thoughts briefly, regarding a couple of the agenda
items listed for the January 27th City Council Meeting.
Regarding Action Calendar Item 17. ‐
REQUEST FOR DIRECTION on consideration of future City Council adoption of a
resolution calling for a ballot measure on five districts
I am in complete support of the Council proceeding with a Council‐initiated ballot measure,
and for the City Council to adopt a resolution calling for a ballot measure prior to June 2022. It
seems apparent that the City of Palm Desert has grown in size and diversity enough to necessitate
five voting districts and this is the time to make that change.
Regarding Action Calendar Item 18. ‐
REQUEST FOR DIRECTION regarding Portola Avenue / I‐10 Interchange improvements (Project No.
637‐02)
I am in support of all of the recommendations of the City Manager.
Especially directing the City Manager or designee to work with Coachella Valley Association of
Governments to return the remaining City bond funds on deposit.

Mister Mayor and the Palm Desert City Council:
I and many other residents of Palm Desert want to see 5‐way redistricting.
I do not feel represented properly if only 2 districts are representative of Palm Desert's diversity
As you know there are socioeconomic extremes in our mighty city. There is a large population of absentee homeowners,
and in‐between we break down along party lines and further on the spectrum there are workaday residents paying your
salary.
Several Palm Desert residents would prefer the City Council pass a motion today to move (without a ballot measure)
toward a five district system of electing Council members to go into effect for the November 2022 election cycle.
There is room for compromise; namely, a motion to have the voters decide the issue by putting a ballot measure on the

Subject: a compromise motion that lets the voters decide if they want a five district
voting system
Honorable Mayor and Members of the Palm Desert City Council:
It appears that the Palm Desert City Council is ready to pass a motion today to let the
voters decide (by way of a ballot measure) if they want to expand the present voting
system from two to five districts to go into effect for the 2024 election cycle if passed by
the voters.
Several Palm Desert residents would prefer the City Council pass a motion today to
move (without a ballot measure) toward a five district system of electing Council
members to go into effect for the November 2022 election cycle.
However, there is room for a compromise motion; namely, a motion to have the voters
decide the issue by putting a ballot measure on the June 2022 mid-term election and if
passed, go into effect for the November 2022 election cycle.

To the Palm Desert Mayor and City Council Members,
I understand that the Palm Desert City Council is ready to pass a motion today to let the voters decide (by way
of a ballot measure) if they want to expand the present voting system from 2 to 5 districts. This would not go
into effect until the 2024 election cycle – which I think is too long to keep the status quo.
I am a Palm Desert residents and would prefer the City Council pass a motion today to move toward a five
district system of electing Council members. This would go into effect for the November 2022 election cycle.
As always, there is room for a compromise motion. This motion would allow the voters to decide the issue by
putting a ballot measure on the June 2022 mid‐term election. If passed, this would go into effect for the
November 2022 election cycle.
The City of Palm Desert needs to move to 5 districts as soon as possible so that all residents are equally
represented.

The purpose of this email is to express my thoughts briefly, regarding a couple of the agenda
items listed for the January 27th City Council Meeting.
Regarding Action Calendar Item 17. ‐
REQUEST FOR DIRECTION on consideration of future City Council adoption of a
resolution calling for a ballot measure on five districts
I am in complete support of the Council proceeding with a Council‐initiated ballot measure,
and for the City Council to adopt a resolution calling for a ballot measure prior to June 2022. It
seems apparent that the City of Palm Desert has grown in size and diversity enough to necessitate
five voting districts and this is the time to make that change.
Regarding Action Calendar Item 18. ‐
REQUEST FOR DIRECTION regarding Portola Avenue / I‐10 Interchange improvements (Project No.
637‐02)
I am in support of all of the recommendations of the City Manager.
Especially directing the City Manager or designee to work with Coachella Valley Association of
Governments to return the remaining City bond funds on deposit.

To whom it may concern,
My name is Josh Kerr and I' ve been a traveling professional surfer for 20 years competing at
the highest level on the World Surf League tour for close to 15 of those. I also now head up
the Red Bull Airborne specialty event series which is part of the World Surf League. I' m
originally from the Gold Coast of Australia and have resided in Carlsbad, California with my
wife and 2 kids for over 10 years now.
With California being my home for close to a decade, I'm a big believer in a destination of this
magnitude and nature in one of the most beautiful places in California that doesn' t have an
ocean. The combination of endless waves and world class golf in the climate that Palm Desert
offers is a dream come true. It will be amazing for not only my young family, but for existing
and aspiring surfers from California and all over the world that are just as excited as myself to
be able to go to Palm Desert and enjoy everything it has to offer!
