HomeMy WebLinkAboutRes No 2804PLANNING COMMISSION RESOLUTION NO.2804 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL TO APPROVE THE ADOPTION OF A NEGATIVE DECLARATION OF ENVIRONMENTAL IPMACT AND ADOPTION OF AMENDMENTS TO THE GENERAL PLAN HOUSING ELEMENT AND SAFETY ELEMENT CASE NO: GPA 21-0002 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 18t" day of January 2022, hold a duly noticed public hearing to consider the request by the City of Palm Desert for approval of the above noted; and WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 18t" day of January 2022, opened the public hearing and solicited public comments and continued the public hearing to the February 1, 2022, Planning Commission meeting; and WHEREAS, the Planning Commission of the City of Palm Desert, did on the 1st day of February 2022, hold the continued public hearing and consider the request by the City of Palm Desert to recommend approval of the Housing Element and Safety Element updates to the City Council and voted 3-0 (DeLuna and Pradetto absent) in recommending approval of the updates to the City Council; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act," Resolution No. 209-41 the Deputy Director of Development Services found that the Housing Element and Safety Element amendments are a "project" as defined by CEQA. As a result, the City completed an Initial Study. The Initial Study found that the Housing Element and Safety Element will have no impact on the Environment and a Negative Declaration is proposed. WHEREAS, at the said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist to justify the recommendation to the City Council of said request: The proposed Housing Element Update is in the public interest and there will be a community benefit, insofar as the proposed Housing Element facilitates the development of housing for all residents of Palm Desert. Development of housing for residents of all income levels will also reduce the vehicle miles traveled in the City, which will improve the regional air quality and reduce wear and tear on public streets and infrastructure, all of which is in the public interest. 2. The proposed Housing Element Update is consistent with the goals and policies of the General Plan, insofar as it is consistent with the other elements of the General Plan and implements policies and programs directly relating to residential land uses. PLANNING COMMISSION RESOLUTION NO. 2804 3. The proposed Housing Element Update does not conflict with provisions of the Zoning Ordinance, and the Zoning Ordinance is being updated to comply with state law. NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, AS FOLLOWS: 1. That the above recitations are true and correct and constitute the findings of the Planning Commission in this case. 2. That the Planning Commission does hereby recommend approval of General Plan Amendment 21-0002 as proposed. APPLICANT/PROJECT SPONSOR: City of Palm Desert 73-510 Fred Waring Drive PROJECT DESCRIPTION/LOCATION: Negative Declaration of Environmental Impact regarding the approval of the update of the Housing Element of the General Plan, in conformance with State requirements. The Deputy Director of the Department of Development Services, City of Palm Desert, California, has found that the described project will not have a significant effect on the environment.
