ORAL COMMUNICATIONS Mr. Jim Foote, BLM, mentioned that the Wild Flower Festival is being held Saturday, March 6, 2010, at the Santa Rosa and San Jacinto Mountains National Monument Visitor Center and he distributed a flyer. Mr. Foote also distributed information regarding dogs on the hiking trails. He stated that there seems to be discrepancies on this issue and would like to get this item on the agenda for an upcoming meeting. Dr. Rita DiCarlo, a Palm Desert resident and dog owner, requested that signage be installed at the University Dog Park stating that no alcohol and/or food be allowed. She stated that a group serves mimosa and sells food at this dog park every Friday morning at 7:30 a.m. She further stated that dogs aren't being watched and that one dog was recently killed. She's asked them to stop this activity and even offered to donate money to them instead. Ms. Steele reported that Code Compliance was out there last Friday and will be there every Friday and has stopped the activity. In regard to the dog that died, Ms. Steele reported that the Code Compliance investigation found that two dogs had been playing in the small dog area; and several hours later one of them died at home as a result of a lung puncture that occurred during play. It was ruled that the other dog was not vicious and it wasn't a mauling. Dr. DiCarlo disputed the report, and stated that the owner of the surviving dog had been asked to leave four times that morning. IV. APPROVAL OF MINUTES A. MINUTES OF THE MEETING FROM JANUARY 5, 2010 A Motion was made by Vice Chair Guyer, seconded by Commissioner Dawson, that the Minutes of the meeting of January 5, 2010, be approved as presented. Motion carried 8-0-1 with Commissioner Barnard absent. V. UNFINISHED BUSINESS — None VI. NEW BUSINESS - None VII. REPORTS AND UPDATES A. They have the power to make recommendations to the City Council regarding all matters pertaining to all parks in the City. The commission's duties and responsibilities are very broad, and anything pertaining to the parks is to first be brought to the commission for review. He further noted that the commissioners are each assigned a park to inspect and report back to the commission prior to each meeting. The Brown Act, known as the open meeting law, states that all of the public's business should be done in the open in pubic; therefore, this commission is open to the public. Mr. Erwin emphasized to be very careful about the use of e-mail. The Brown Act was modified in January to state that if a quorum gets together and discusses matters over which it has jurisdiction ( i.e., the chairman sends out an e-mail to commissioners and one person replies to everyone), it constitutes a discussion and is an official meeting. Use extreme caution in e-mails. Don't discuss via e-mail items over which the commission has control. B. OPERA ART Ms. Arlene Rosenthal, President of Opera Arts, reported that the Festival of Opera & Art will be held in Civic Center Park on April 11, 2010, from 12 p.m. to 5 p.m. There will be representatives from entertainment venues, singers, a variety of food vendors, and activities for all ages. She noted that working with Palm Desert has been a very good experience. Approximately 2,000 thousand people are expected to attend the event based on the advertising and media coverage they are receiving. Parking issues are not anticipated based on past events in the park on Sundays. C. AQUATIC CENTER UPDATE Ms. Steele provided an update on the current status of the on-going design of the aquatic center. Meetings have been held with Gould Evans and Associates, the selected designer, who is also teamed with Mr. Ken Moeller of Arch Pak Aquatics. Staff, council members, parks and planning commissioners, and the designers are meeting on a regular basis on various aspects of design. A joint session of the Planning Commission and City Council and a Public Hearing will be held Wednesday, March 24, 2010, at 4 p.m. in the Council Chambers. The session is to discuss design and environmental assessment and clearance. A fee study is also being performed, but fee recovery estimates will not be available at the March 24 session. The intent is to break ground in the fall of 2010. It is expected that the project will go out to bid in June, and open on Memorial Day 2011. Vice Chair Guyer stated that the media is reporting that the Redevelopment Agency is trying to spend money quickly. There are very aggressive programs to spend redevelopment funds so that the state cannot take the funds. Vice Chair Guyer asked why there is such an aggressive push now for the aquatic center when there wasn't in the past. Councilman Spiegel noted that it was because previous plans were not acceptable to council members at that time. D. PARK VANDALISM Ms. Steele reported that there has been an increase in major vandalism including the wiring and up-lighting at Freedom Park; several fires, broken skylights, roof damage at the Soccer Park, and increased graffiti. It appears that the Soccer Park has had the heaviest vandalism. The police department and park patrols have been increased. Councilman Spiegel asked if video cameras have been considered. Mr. Greenwood stated that the installation of video cameras should be agendized for this commission to consider. Mr. Greenwood also suggested inviting Lt. Andrew Shouse, Frankie Riddle, and Citizens on Patrol (COPS) to a meeting. Commissioner Hall asked that there be a presentation on the responsibilities of park ambassadors. Ms. Steele stated that it would be included at the next meeting. Dr. DiCarlo commented that when she spoke to the park patrol he said it's difficult to get to the parks as often as they'd like. She asked if there could be a "lifeguard" at parks. Councilman Spiegel and Ms. Steele both said no. Mr. Greenwood suggested that COPS may be a good source for patrolling the parks. E. CITY OF PALM DESERT ARBOR DAY Palm Desert is celebrating Arbor Day "A Growing Tradition" on April 24 at the Visitor Center/Henderson Community Building from 9 a.m. to 12 p.m. There will be a tree planting, tours of the Eric Johnson Gardens, planting demonstrations, and vendors. On April 22, Earth Day will be commemorated by staff, volunteers, and James E. Carter Elementary School second graders who will be planting a tree and seedlings they have been growing. F. PALM DESERT YOUTH SPORTS ASSOCIATION Opening day ceremonies are Saturday, March 6, 2010, in Civic Center Park. The Marine Band will be playing, the War Birds will do a flyover, and the 2010 Humanitarian Award will be presented. G. CALIFORNIA AND PACIFIC SOUTHWEST TRAINING CONFERENCE The conference is being held in Palm Springs March 9 - 12. The Mayor of Palm Springs has extended an invitation to the commissioners to attend the Mayor's reception. H. PARK EVENTS Ms. Steele reported on upcoming park events. I. FAMILY YMCA OF THE DESERT Mr. Rob Ballew distributed information on the after school "Y Be Fit" program. Fitness and nutritional elements were included in the program. There were 34 children who consistently attended the program, and the results showed an increase in fitness and ability over the course of the program. BMI was difficult to track because of the fact that children grow. At the end of the year-long program, parents reported that the program helped them to make changes in their families' fitness and nutritional routines. Mr. Ballew believes the program is important to the valley and wants to expand the program to other cities; and all of the schools in the Palm Springs Unified School District now want to participate. There is nothing being offered in the Desert Sands Unified School District at this time, but they hope interest will be generated. He also reported on upcoming YMCA activates. J. DESERT RECREATION DISTRICT Mr. Craig DeWitt reported that there were 16 racers at the soap box derby on February 27. The rain affected the turn out as did the late start. The event ran smoothly and it was a great venue. A more detailed report will be made once all of the numbers are finally tallied. K. JANUARY AND FEBRUARY PARK INSPECTIONS Commissioner Dawson asked if it were permissible to e-mail park inspection reports to Ms. Steele. Ms. Steele stated that it is permissible, and noted that they can also be faxed to her or dropped off. L. NEWS ARTICLES Vice Chair Guyer noted the article regarding San Diego's 100-year old Balboa Park deterioration. They are forming a non-profit group to raise fund for the park's maintenance. COMMISSIONER COMMENTS Commissioner Babcock stated that he and his wife attended the January "Get Fit Palm Desert" with Mayor Finerty. He stated that the Mayor was so far out in front that they never saw her until she was getting into her car to leave. His point being that if you're going to get fit with the Mayor, you better be in shape. Commissioner Thomas commented on the website for the parks and thanked staff for updating the site. He noted that there's a statement that four new parks are being considered on the city's north side. Ms. Steele stated that this will be removed because two of the parks have been built, and the other two are on hold pending additional development. Mr. Greenwood stated that the funds are set aside for these two parks. Commissioner Thomas also noted that the Parks and Recreation Guide needs to be updated. Ms. Steele distributed packages of dates grown in the City's date grove. Mr. Wohlmuth reported that this is the last year the City will harvest the grove. He stated that it's too expensive to continue to harvest and package the dates, and that the aquatic center will be using the area under the trees for parking. Commissioner Housken asked if there were another way to continue to harvest the grove. Mr. Niemczak also stated that it's expensive and difficult to find someone to harvest such a small grove. IX. Since that time staff has been working through details of design with the project team and continues to move the ball forward on this project in anticipation of beginning construction in the fall of this year. Staff will continue to provide monthly updates to the commission on the status of the Aquatic Center. It was suggested that Staff invite Lt. Andrew Shouse to address the Commission about how the sheriff's department and staff are working together to eliminate the vandalism. The Riverside County Sheriff's Department will be in attendance at the May 4, 2010 meeting if there are any specific questions from Commissioners. Last summer, the Commission was still meeting two times per month. Since the Commission currently meets only one time per month, staff is requesting that the Commission cancel the August 3, 2010, meeting in order to best coincide with the City Council being dark. CITY OF PALM DESERT i*K-111C,._ 4 1111-3N- ,‘11� �eti� • PARKS AND RECREATION •.R„ 9 3�o STAFF REPORT To: Parks and Recreation Commission From: Jay Niemczak, Parks Facilities Manager Date: April 6, 2010 Subject: Trail Ordinance On March 18, 2010, Staff met with Mr. Jim Foote, Monument Manager of the Santa Rosa and San Jacinto Mountains National Monument to discuss amending the City's trail and dog ordinance. The majority of City maintained trails begin on City property and enter federally owned land as the trails wind their way along the mountainside in the southern portion of the City. Federal entities that have jurisdiction over portions of the trails include the Bureau of Land Management and the California Department of Fish and Game. Each of these entities have specific regulations regarding lease requirements and the prohibition of dogs. For the City to comply with all regulating entities involved, the City dog ordinance should be amended to include dog regulations and prohibitions specific to trails. Mr. Foote has researched all regulations and would like to present his findings and suggestions to the Commission. Included is a matrix identifying the suggestions for alignment of City of Palm Desert Municipal Codes with other agency rules and regulations prepared by Mr. Foote. The following recommended revisions are identified in italics: Revise subsection 5 as follows: Homme-Adams Park is designated as an "under immediate voice control" facility. Leashes are required on the Homestead and Gabby Hayes Trails which emanate from Homme-Adams Park and Cahuilla Hills Park, respectively C Documents and Settings\jniemczak\Local Settings\Temporary Internet Files\Content Outlook\ZAH9BVOMDog Ordinance doc Revise subsection 6 as follows: Dogs are prohibited on all trails and areas in the Santa Rosa Mountains except the Homestead Trail, Gabby Hayes Trail, and segments of the Hopalong Cassidy trail connecting these two trails Revise section 11.01.120(B) as follows: It is the mandatory duty of all persons owning, possessing, in control of, or otherwise responsible for a dog, cat or an equine animal in a city park or other recreation area of the city to promptly collect, pick up and remove all fecal matter left behind by said animal in or upon the park or other recreation area of the city Add a new subsection to 11.01.080 Prohibited conduct generally, as follows: Cross-country travel is prohibited in the Santa Rosa Mountains from January 1 through September 30, and allowed from October 1 through December 31. Cross-country travel is defined as travel off authorized trails. During the period when cross-country travel is prohibited, individuals may venture no more than 50 feet from centerline of trails on either side for purposes of resting, nature study, or other similar activities. This does not constitute cross-country travel. Holders of permits issued for research and extended study are exempt from the cross- country prohibition Revise section 11.01.080(A) as follows: Within the limits of any public park or recreation area of the city, no person shall ride or drive any horse or other animal, or propel any vehicle, cycle or automobile, except at a place especially designated and provided for such purposes. Bicycles are prohibited year-round from traveling cross-country in the Santa Rosa Mountains; travel by such conveyance is restricted to authorized trails Revise section 11.01.060 as follows: No person shall hold, conduct, participate in, attend or address any meeting, organized gathering or assemblage, group picnic, celebration, parade, service or exercise in any park or recreation area without a written permit granted by the director as provided herein. Competitive recreation events on or off trails in the Santa Rosa Mountains, including the use of developed trailheads in association with a competitive event, are prohibited. C\Documents and Settings\jniemczak\Local Settings\Temporary Internet Files\Content Outlook\ZAH9BVQN\Dog Ordinance doc March 2, 2010 Parks and Recreation Commission City of Palm Desert Request for consideration Alignment of municipal code 11.01.120 (attached) with management prescriptions as approved in the Coachella Valley Multiple Species Habitat Conservation Plan(CVMSHCP). • CVMSHCP was approved in October 2008; City of Palm Desert is a signatory. • CVMSHCP allows dogs in designated areas only within the Santa Rosa and San Jacinto Mountains Conservation Area; in Palm Desert; the only approved area for dogs within the Conservation Area is the Homme-Adams Park/Cahuilla Hills Park loop. • Current trailhead kiosks installed by the City are consistent with the "dog rule"approved in the CVMSHCP, i.e., dogs are prohibited on all trails except those constituting the Homme-Adams Park/Cahuilla Hills Park loop(Homestead Trail, Gabby Hayes Trail, and segment of the Hopalong Cassidy Trail connecting these two trails). • Current trailhead kiosks are NOT consistent with municipal code 11.01.120; in accordance with the code, leashed dogs are allowed on all trails(except in the Randall Henderson Trail area). • Regarding dogs under"immediate voice control," current trailhead kiosks are NOT consistent with municipal code 11.01.120; whereas Homme-Adams Park and Cahuilla Hills Park are designated as "under immediate voice control"facilities,the current kiosks require dogs to be within 50 feet of the handler when under voice control. Recommendation: • Change municipal code 11.01.120(A)(6)to read, "Dogs are prohibited on all mountain trails and areas except the Homestead Trail, Gabby Hayes Trail, and segment of the Hopalong Cassidy Trail connecting these two trails." • Change municipal code 11.01.120(A)(5)to read, "Homme-Adams Park and Cahuilla Hills Park are designated as "under immediate voice control" facilities; dogs in these areas must remain within 50 feet of the handler." These were done very early in the trail development,when only the loop between Homme and Cahuilla Hills existed. You might think about further defining rules for dogs 11.01.120 Duty to care for animals. A. Dogs or cats must be led by a cord or chain not more than six feet long or properly confined within the interior of a vehicle, except: 1. When dogs which have been specially trained and are being used by blind or disabled persons to aid and guide them in their movements, 2. When dogs are within the boundaries of canine commons and not posing a threat to other animals, persons or property; 3. Small pets which are kept on the person of the possessor at all times; 4. In connection with activities authorized in writing by the director, including fowl or other animals turned loose at the direction of the director; 5. Homme or Adams Park and Cahuilla Hills Park are designated as "under immediate voice control" facilities; 6. Dogs are prohibited in the Randall Henderson trail area. B. For the purpose of this title, the words and phrases set out in this section shall apply: "Alcoholic beverage" means beer, wine, whiskey, bourbon, any distillant of wine or any beverage, brew or distilled liquid containing any portion of alcohol as one of its contents. "Amplified sound" means music, sound wave, vibration or speech projected or transmitted by electronic equipment, including amplifiers. "Camping" means the pitching of tents, use of sleeping bags, cots, beds or other paraphernalia usually associated with living in the out-of-doors. This includes the use of motor homes, recreation vehicles or camper trailers in parking lots. i Alignment of City of Palm Desert Municipal Codes with Other Agency Rules and Regulations Request for recommendation presented to the Palm Desert Parks and Recreation Commission April 14,2010 by: Jim Foote Monument Manager Santa Rosa& San Jacinto Mountains National Monument Purpose • Provide for consistent management of trails and areas among adjacent jurisdictions in the Santa Rosa Mountains in accordance with the Coachella Valley Multiple Species Habitat Conservation Plan(CVMSHCP). Benefits • Enhances public understanding of legal trail use. • Reduces violations of rules and regulations stemming from inconsistent management. Background • The population of bighorn sheep occupying the Peninsular Ranges of California was listed as threatened by the California Department of Fish and Game in 1984,and listed as endangered by the U.S. Fish and Wildlife Service in 1998. • Preparation of a trails management plan for the Santa Rosa and San Jacinto Mountains Conservation Area,an element of the CVMSHCP,was initiated in 1999. Focus of the trails management plan is to provide for recovery of bighorn sheep while allowing for recreational enjoyment of trails and areas within essential bighorn sheep habitat to the extent that recovery will not be impeded. • Recovery Plan for Bighorn Sheep in the Peninsular Ranges, California was approved by the U.S. Fish and Wildlife Service in 2000. Certain trails, including the Art Smith Trail and Bump& Grind Trail,were identified as trails with potential conflicts that should be addressed in an interagency trails management plan.The trails management plan for the Santa Rosa and San Jacinto Mountains Conservation Area contained in the CVMSHCP constitutes such an interagency plan. [Note: The Recovery Plan predated construction of the Hopalong Cassidy, Mike Schuler, Herb Jeffries,Gabby Hayes,and Homestead Trails,hence these trails are not identified in the Recovery Plan.] • The CVMSHCP was approved in October 2008.The City of Palm Desert is a signatory to the plan. Suggestions to align City of Palm Desert municipal codes • See table on next page for summary, and Alignment of City of Palm Desert Municipal Codes with Other Agency Rules and Regulations for specific information. Service animals are defined in Title 28 of the Code of Federal Regulations, section 36.104 as"any guide dog, signal dog, or other animal individually trained to do work or perform tasks for the benefit of an individual with a disability, including, but not limited to, guiding individuals with impaired vision, alerting individuals with impaired hearing to intruders or sounds,providing minimal protection or rescue work, pulling a wheelchair, or fetching dropped items." Section 36.104 also defines an individual with a disability as an individual with a physical or mental impairment that substantially limits one or more of the major life activities of caring for one's self,performing manual tasks, walking, seeing, hearing, speaking, breathing, learning, and working. Current text of section 11.01.120(A)(6): "Dogs are prohibited in the Randall Henderson trail area." Proposed text of section 11.01.120(A)(6): "Dogs are prohibited on all trails and areas in the Santa Rosa Mountains except the Homestead Trail.
