Any person wishing to discuss any item not appearing on the agenda may address the Architectural Review Commission via the Zoom session at this point by giving his/her name and address for the record. Remarks shall be limited to a maximum of three (3) minutes unless the Commission authorizes additional time. Because the Brown Act does not allow the Commission to take action on items not on the Agenda, members will not enter into discussion with speakers but may briefly respond or instead refer the matter to staff for a report and recommendation at a future Commission meeting. ADJOURNMENT Commissioner Levin moved to adjourn the Architectural Review Commission meeting at 1:25 p.m. ERIC CEJA, SECRETARY JANINE JUDY, RECORDING SECRETARY CITY OF PALM DESERT COMMUNITY DEVELOPMENT DEPARTMENT ARCHITECTURAL REVIEW COMMISSION MEMORANDUM To: Honorable Chair and Members of the Commission From: Nick Melloni, Assistant Planner Date: November 10, 2020 Subject: MISC 20-0023 – Fence Exception at 72895 Sonora Drive Project Summary This project is a request for an exception for an existing fence to deviate from the requirements of the Palm Desert Fence and Wall Ordinance. The applicant constructed the fence earlier this year in the front yard of a single-family residence located at 72895 Sonora Drive. The fence is the subject of an open code compliance case on the property. The applicant constructed the fence out of vinyl, it is 5-foot-8-inch-tall, setback between 18 to 23 feet back from the face of the curb, and runs 50 feet along the street frontage. Staff has attached current photos of the fence and plans provided by the applicant. The applicant is requesting the Architectural Review Commission (ARC) approve the fence as constructed, with the addition of eight landscape trees. Zoning Ordinance Summary PDMC Section 25.40.080 (Ordinance) establishes standards for fence height, permissible materials, landscaping, and fence design. The Ordinance provides an exception process for deviations from these standards, subject to approval by the ARC. The fence does not conform to the following requirements: • Height: Per the Ordinance, the maximum permitted height of the fence is 6 feet at a 20 feet setback and 4 feet 11 inches at an 18 feet setback. A portion of the current fence is 5 feet 8 inches tall at a setback less than 20 feet and exceeds the maximum height by 9 inches. • Material: Fences or walls visible from the public right-of-way must be constructed from decorative block or wrought iron. The fence uses vinyl. • Landscape: Fences or walls adjacent to a public street must provide landscaping. There is presently no landscaping between the face of the wall and the sidewalk. November 10, 2020 – Architectural Review Commission Memorandum MISC 20-0023 Fence Exception at 72895 Sonora Drive Page 2 of 2 • Design: Walls along public streets are required to provide undulation in the form of an 18-inch offset or a pilaster at least every 30 feet of the wall. This fence does not provide for undulation. Additionally, the fence is required to be finished in a desert color. Exceptions to the standards of the Ordinance may be granted, subject to ARC approval based on the following findings: 1. That unusual circumstances exist which make the literal interpretation and enforcement of the standards impractical or contrary to the purpose of the ordinance codified in this section. 2. The exception shall not result in damage to adjacent properties. 3. Property owners adjacent to the proposed exception shall be informed of the application at least 10 days prior to the ARC meeting. 4. Exceptions for nonconforming materials, including wood and vinyl fences, shall be based on architectural merit and compatibility with the home’s architectural style. There are no unique circumstances, such as land-use characteristics or geographic features, applicable to the property. Staff notified the adjacent properties of the request via letters mailed on October 30. Staff Recommendation As presented, the proposed fence does not conform to the Ordinance and does not satisfy the required findings to receive an exception. Staff does not believe the fence can be modified to enhance the design merit or compatibility with the surrounding neighborhood. Staff recommends denial. Attachments: 1. The building is a multi-tenant, mid- century style commercial building on the Highway 111 frontage road located east of San Pablo Avenue. The tenant space is 20 feet wide, with a 14-inch-tall overhang where existing signage is mounted. The proposed sign consists of individual channel letters and a sculpted cabinet sign. The total area of the proposed sign is 8.66 square feet, with a maximum letter height of 14 inches. While typically Planning staff approves signs, staff is bringing this proposal to the Architectural Review Commission (ARC) due to the following unique context: • The sign uses a sculpted cabinet sign in addition to channel letters. • The letter height matches the height of the overhang, and typically, spacing is required. Zoning Ordinance Summary Section 25.56 of the Palm Desert Municipal Code (PDMC) is the City’s sign ordinance and establishes review criteria for all exterior signage. The sign ordinance allows the ARC to review any sign as determined by the Planning Director or Zoning Administrator based on the unique design, context, color, size, shape, location, or circumstances. The ARC’s decision is based on the findings listed under PDMC 25.68.050 (D). Staff Recommendation Staff is concerned the sign is not harmonious with the building due to the height of the channel letters matching the fascia where the sign is mounted and the use of two different constructions for the sign. When the applicant purchased the home, the sports court and lighting were already installed. The applicant is requesting to replace and add new outdoor lighting within the sports court. There will be a total of four LED pole lights at a height of 14 feet. Zoning Ordinance Summary Per Section 25.40.070 Private Tennis Courts and Sports Courts states that if a homeowner is installing lighting for night play, the owner must provide a lighting plan according to the Provisions of Chapter 24.16 Outdoor Lighting and approval from the Architectural Review Commission (ARC). Chapter 24.16 Outdoor Lighting states that light poles in residential zones have a maximum height of 18 feet, and the lamp lumens shall be 15,000 lumens or less and provide for full cutoff features. Staff Recommendation The proposed four LED pole lights are 14 feet in height, are less than 15,000 lumens per light, and are fully shielded, which meets code. The property also has large vegetation to help with the screening of the lights. The previous homeowner had lighting, and the City never received complaints from the neighbors. Additionally, the City received a letter from the adjacent neighbor stating that the proposed lighting is acceptable to them. Therefore, staff recommends approval of the request. Attachments: 1. Property Description The project site is a 3.18-acre property located at 73750 Dinah Shore Drive (Dinah Shore). The property is developed with an 116,750-square-foot personal storage facility operated by Extra Space Storage. The site was approved for development in 2004 with Precise Plan 04-17 and Tentative Parcel Map 32930. Access to the site is available via a single access point on Dinah Shore. A private, gated drive-aisle provides access throughout the site. There is an existing 65-foot wireless telecommunication facility (WTF) located within a landscape planter at the eastern edge of the property, currently owned by American Tower Company and occupied by Verizon Wireless. The tower will feature 12-panel antennas and 36 remote radio units (RRUs) mounted at the height of 56 feet and screened by faux palm fronds. The tower location will be near the northwestern corner of the site in a paved area tucked against the corner/indentation of an existing storage building. Support equipment for the tower includes multiple electrical cabinets, a backup diesel generator, and two (2) HVAC units. The majority of the cabinets and equipment will be located within an existing vacant storage unit. The HVAC equipment will be ground-mounted in an area directly adjacent to the tower. The backup generator is located adjacent to a drive-aisle where it is separated from the drive area with concrete bollards. This project appeared before the Architectural Review Commission (ARC) in August 2020. The ARC continued the case and directed the applicant to make changes that included the following: agreeing to long-term maintenance of the tower’s faux fronds, better screening of the antenna, maintaining the required 24-foot fire lane width for the drive-aisle, and planting live palms. Changes from the previous submittal include the following: removal of two circular microwave antennas, additional screening of the panel antennas and RRUs. No live palms are proposed as the applicant states there is no room on the property as the majority of the property has been paved over. Analysis The Palm Desert Municipal Code (PDMC) establishes development and design standards for WTFs under Section 25.34.130. These standards are intended to minimize the visual impact of towers by establishing maximum height, minimum separation distances between towers, stealth design guidelines, and screening requirements for antenna and equipment. The PDMC encourages stealth WTF designs and requires the ARC approval to ensure the facility blends in with the existing natural environment per PDMC Section 25.34.130 (O). The applicant has redesigned the tower to incorporate better screening of the equipment; however, staff is concerned over the lack of live plantings. Live palms are encouraged by PDMC Section 25.34.130 (O) and historically have been required as a part of the approval for new stealth tower installations. Coverage Gap The applicant has provided plots showing a significant gap in cell signal coverage in this vicinity and requiring a new facility. The applicant has also explored alternative locations within this coverage gap; however, due to the lack of a property owner agreement and other zoning restrictions, these alternative locations have proven infeasible. Burden of Proof - Applicant To Meet Code of Compliance 25.34.130 Communication Tower and Antenna Regulations Monopalm Design The new 65 FT. Monopalm design is proposed to be in compliance with wireless code 25.34.130 Communication Towers and Antenna regulations; to minimize adverse visual impacts, to include foliage socks colored to blend with palm fronds. The new Monopalm will include 80 Fronds total. Monopalm fronds to extend from 18 inches minimum up to 46 inches beyond the antennas. Monopalm Faux tree bark, textured and colored to match live palm tree. Project Objectives There are several reasons why a wireless carrier requires the installation of a cell site within a specified area to close a “significant gap in coverage:” • The radio signal must be of sufficient strength to achieve consistent, sustainable, and reliable service to customers at a level sufficient for outdoor, in-vehicle, and in-building penetration with good voice quality (Threshold, -76db). • When nearby other sites become overloaded, and more enhanced voice and data services are used (4G and other high-speed data services) signal contracts and a gap is created. With heavy use it is intensified due to the unique properties of digital radio transmissions. In this specific case, this location was selected because AT&T’s radio-frequency engineers (RF) have identified a significant gap in coverage in the vicinity of Monterey Ave. and Interstate 10, in the City of Palm Desert and the surrounding community as demonstrated on the submitted radio-signal propagation maps. Response to Comments from Architectural Design Review Meeting – August 25, 2020 • Long term maintenance, which will be in the Permit Conditions if approved. Issue raised because they were looking at photos of the nearby ATC site on the same property where the fronds are dead and falling off. Idea to include in the Conditions of Approval a maintenance schedule to meet minimum standards. • Better stealth of the antennas. Attached updated photosims attached. Project will include antenna socks, fronds to extend beyond antennas, higher density of fronds. • Microwave exposure; Microwave has been removed from the project. • Cluster of other live palms This property and space do not provide for that since it is all driveway and storage units, to the property line. • Width required for the driveway, minimum 24 Ft per Fire Code. We have updated the plans and moved the generator to allow for the correct access requirements per the Fire code. Ref Page A-2-1 and A-2-2 Findings The site for the proposed use is adequate in size and shape. AT&T is proposing a mono-palm design for this project which is a stealth design. The requested height of the mono-palm design is the minimum height needed in order to fill the significant gap in coverage for this project. The height restriction for the wireless facilities is 65’. AT&T uses the most advanced technology and design when constructing the mono-palm so as to blend the facility with the surrounding community and landscaping and thereby minimizing the visual impact of the site. The proposed location has sufficient access to streets and highways that are adequate in width and pavement type to carry the quantity and quality of traffic generated by the proposed use. The access to this site is immediately off Dinah Shore Dr. There are adequate access routes directly to the proposed facility. All the roadways and access ways within the facility are in compliance with local, state and federal regulations concerning width and pavement. The proposed use will not have an adverse effect upon adjacent or abutting properties. The project will not have an adverse effect upon adjacent or abutting properties as it is a stealth design that will blend naturally with the subject property and is far away from any residential areas outside the ring. The project will provide a public benefit of better wireless telecommunications and data services to the surrounding neighborhoods and community. The proposed use is deemed essential and desirable to the public convenience or welfare. The new wireless telecommunications facility is in high demand to the residents and visitors of the County of Riverside. Wireless communications are vastly used in this area and the need for this site was established entirely from increased usage of AT&T services in the vicinity of the requested project. 1. There are currently no existing AT&T or “Colo” available tower in the area designated within or within the vicinity of search ring designating a gap in coverage and services. 2. The proposed height requested is the minimum height required to fulfill the required minimal services in this area where the topography is relatively flat. 3. We have included Propagation Maps demonstrating the significant gap in coverage AT&T intends to improve should this proposal be approved. GENERAL INFORMATION Location In compliance with wireless code 25.34.130, communications towers may be approved within the zone district of Service Industrial (SI). AT&T proposed facility is located within a Service Industrial zone included in the guidelines as preferred. Site Selection Customer demand drives the need for new cell sites. Data relating to incomplete and dropped calls is gathered, drive-tests are conducted, and scientific modeling using sophisticated software is evaluated. Once the area requiring a new site is identified, a target ring on a map is provided to a real estate professional to begin a search for a suitable location. During an initial reconnaissance, properties for consideration for the installation of a cell site must be located in the general vicinity of the ring, with an appropriate zoning designation, and appear to have enough space to accommodate an antenna structure and the supporting radio equipment. The size of this space will vary depending on the objective of the site. The owners of each prospective location are notified to assess their interest in partnering with AT&T. Four key elements are considered in the selection process: • Leasing: The property must have an owner who is willing to enter into a long-term lease agreement under very specific terms and conditions. • Zoning: It must be suitably zoned in accordance with local land-use codes to allow for a successful permitting process. • Construction: Construction constraints and costs must be reasonable from a business perspective, and the proposed project must be capable of being constructed in accordance with local building codes and safety standards. • RF: It must be strategically located to be able to achieve the RF engineer’s objective to close the significant gap with antennas at a height to clear nearby obstructions. Alternative Site Analysis Other sites considered and approached by Smartlink leasing specialist include the list below and the reasons they were either rejected or unavailable for this project’s facilities. This was a very difficult search in respect to the size of our search ring, size of industrial and commercial lots in the area, and meeting set back requirements. Other, larger lots in the area were contacted, we could not locate a landlord with firm interest to have an agreement. We expanded our search ring to locate possible prospects without luck. We were also limited to the outer edges of the search ring to the west and south due to residential zoning. It is not unusual within a small, dense primarily commercial search ring, that we only get a few responses to work with. Space is limited within the search ring individual properties that would enable this type of project and meet the codes for development, setbacks and separation. AT&T made every effort to meet all setbacks, separation and height guidelines according to 24.34.130 Communications Tower and Antenna Regulations. We changed our antennas array from 4 antennas per sector to 3 antennas, 3 antennas per sector to improve the design and stealth screening of the facility. The existing American Tower 65 Ft. Monopalm would not provide for colocation due to height limitations and design. Monopalm design is the preferred design to match existing landscape characteristics. Proposing a co-locatable faux pine tree or eucalyptus tree would not be consistent with environment. Monopalm facilities do not provide for colocation in regard to height requirement and RF requirements to service all technologies. Exception Within 25.34.130 Communication Tower and Antenna Regulations, Section M. and N., the commission may approve exceptions relative to separation distances between communication towers. 25.34.130 Communication Tower and Antenna Regulations, Section O. item 1. and 2., also apply in that our facility does not exceed the height minimum, the commission may waive the separation requirements from residential zoned properties and use, and between other communication towers if determined that the tower utilizes an approved stealth design like a artificial palm tree as ours does. Due to the very limited space available described above and unwilling landlords, AT&T was provided with a single property where the property owner is willing to work with AT&T for a potential site. On the same property there is existing American Tower Monopalm facility. AT&T would like to request an Exception be considered by the Planning Commission for AT&T facility to be within the standard separation minimums of 1000 ft. in order to provide the needed coverage and services to the local area, including industrial, retail and emergency services. We have been searching for an opportunity in this search ring for a minimum of two years. The search had been discontinued only to be brought back to life through extended efforts reaching out to the property owners. The proposed property runs adjacent to the 10 Freeway among an industrial park. The location itself does not have heavy customer or pedestrian foot traffic. We are not limited by the topography, geographic features as our design of a faux palm tree blends well with existing palms trees on the same and adjacent properties in all directions. Our single limitation, again due to the limited space in this area including this property; it is not possible to propose a “cluster” effect of adjacent live palm trees immediately next to the proposed faux palm. This is not always possible when the existing facilities maximize the use of their property for their business. The Benefits to the Community Approximately 90-percent of American adults subscribe to cell phone service. People of all ages rely increasingly on their cell phones to talk, text, send media, and search the Internet for both personal and business reasons. More and more, they are doing these things in their homes, therefore, becoming reliant on adequate service within residential neighborhoods. In fact, 50-percent of people relocating are not signing up for landline service at their new location and are using their cell phone as their primary communication method. The installation and operation of the proposed facility will offer improved: • Communications for local, state, and federal emergency services providers, such as police, fire, paramedics, and other first-responders. • Personal safety and security for community members in an emergency, or when there is an urgent need to reach family members or friends. Safety is the primary reason parents provide cell phones to their children. The applicant implemented the ARC’s comments, revised the plans, and presented them at the meeting of September 22, 2020. The ARC all stated that the architecture is ready for approval; however, they had some concerns on locations of utilities and requested that the applicant provide renderings showing all utilities. The applicant has updated the plans and submitted a narrative of the changes, which is attached to this memo. The project is a mixed-use three-story building located on the southeast corner of Fred Waring Drive and San Pablo Avenue. The project includes approximately 16,500 square feet of commercial space on the ground floor and 60 residential apartment units on the second and third floors. The 60 residential units range from one- to three-bedroom units ranging in size from 711 to 1,369 square feet. The project includes an open plaza area at the corner to alleviate building massing and to create outdoor open space for restaurant patios. The building also incorporates residential patios to break-up the large building and to provide an active open space use for the residents. The building features a contemporary design characterized by desert appropriate colors, stone veneer finishes, and the use of metal louvers. The project includes a desert landscape plan that will blend in with the newly landscaped design along San Pablo Avenue. Zoning Ordinance Summary The property is zoned Downtown Edge (DE), which allows for mixed-use developments, subject to a Precise Plan and Conditional Use Permit. The DE zone allows for a maximum building height of three stories at 40 feet, with up to 12 additional feet for architectural projections. The parking standards are 1.25 parking spaces for one-bedroom units, and two parking spaces for two-plus bedroom units. The project, as designed, complies with the development standards, including the building height and parking. These revisions are reflected in the resubmitted set entitled "Palm Desert Mixed Use — Entitlement Set R-3" and dated October 26, 2020. Comment #1: Showing layout and locations of all utilities and how they blend with the Architecture. Response: All utility placements have been accounted for per consultation with project engineers and utility company representatives. 1.) Water: Two points of connection for domestic water supply are proposed. The supply line for the Retail areas will occur at the Northeast corner of the site coming from Fred Waring, into a utility room at the ground level. The backflow preventer will be placed in the right of way at that corner. The supply line for the Residential areas will occur at the west end of Santa Rosa Way. A backflow preventer will be placed outside of the Booster Pump room where the domestic line enters. Landscaping will be added to provide visual screening to the extent permissible by local authorities. A main house meter from both supply lines will be provided and enclosed within the utility rooms. Sub -meters for the retail and residential units will be provided within each individual space. 2.) Fire: The point of connection for fire suppression supply will occur in the same general area as domestic water. A DCDA (Double Check Detector Assembly) will be placed in that area as well. Landscaping will be added to provide visual screening to the extent permissible by local authorities. The main fire riser to the building will be housed in an enclosed utility room. 3.) Irrigation: The point of connection for irrigation supply will occur in the same general area as domestic water. A backflow preventer will be placed in the same area. Landscaping will be added to provide visual screening to the extent permissible by local authorities. 4.) Electrical power supply: The project electrical engineer has performed preliminary power demand calculations, which in turn determined that two electrical transformers, and related switch gear will need to be provided. We are very limited with location options for placement of this apparatus and have located them collectively at the south end of the open parking area, directly adjacent to the east property lines. This will be the least obtrusive location from a visual and functional standpoint. Landscaping will be added to provide visual screening to the extent permissible by local authorities. The power supply from the transformers will feed an electrical room at the east side of the parking garage and has been conservatively sized by the project electrical engineer. Direct access to the electrical room will be provided from the parking garage side of the room. Gas supply: A three -tiered gas meter bank will be placed on the ground level directly adjacent to an exterior wall that separates the first level parking from the second level parking vehicle access ramp. This meter bank will not be visible from public view and has been approved by a representative from SoCal Gas. 6.) Trash service: We have consulted with the trash service company (Burtec) and confirmed the size and configuration of the trash room to be adequate. Trash chutes at each level will allow for direct discharge into bins in the Trash Room. Oversize items will require manual placement into the trash room, which will require an interface program between landlord and tenant, to be developed. Per request of Burtec, modification to the parking area was requested to allow for better maneuverability of the trash trucks. We have added a loading zone that can be used for this function, in addition to provide a loading space for the retail areas. 7.) Mechanical Ventilation: Per coordination with the project mechanical engineer, a fan room will be required to provide ventilation from the parking garage. The size and location as indicated is appropriate. The air exhaust will vented through a vertical shaft and discharged above the 41h floor roof. Comment #2: Provide a more detailed roof plan showing the parapet walls. All parapet walls need to be extended/return back more than 3'. Response: The roof plan has been revised to indicate return of parapet walls as requested. The revision is also evident in the updated 3D views. Comment #3: Look at the block choice on the east elevation. Response: We have selected what we believe to be the appropriate block color and texture to compliment the architecture which has been indicated on the materials board. Additionally, we have added the proposed metal screen design which will be recessed in the openings to the parking garage. The metal screen material has also been referenced on the material board sheet. In addition, a smaller eyebrow canopy similar to those over the residential units have been added to further "tie in" the parking level fagade with the residential unit fagades.
