CASE NO: MISC 21-0029 NATURE OF PROJECT/APPROVAL SOUGHT: Consideration for a request to alter the paint color of an existing commercial retail suite located at 73399 El Paseo, Suite 105. APPLICANT AND ADDRESS: Wendy Martello, Palm Desert, CA 92260 LOCATION: 73399 El Paseo, Suite 105 ZONE: D Associate Planner, Nick Melloni, presented the item. The request is for a façade modification which consists of the application of paint to the building, requiring approval of the Architectural Review Commission (ARC). Mr. Melloni noted the signage shown in the presentation is for reference only as its location currently does not conform to the current sign program. Mr. Melloni turned the presentation over to the applicant and artist, Kellie Pellegrini, who provided additional information on the proposal. Discussion on the item ensued with Commissioners providing comments and concerns for the project. It was determined by the ARC that this item should be continued to allow the applicant and artist time to consider comments from the Commission. Additionally, with Commission consent, an advisory committee was selected including Commissioner McAuliffe, Commissioner Vuksic and Commissioner McIntosh, to provide design feedback on options for potential modifications to the artwork. Director of Development Services, Martin Alvarez, queried as to whether the Commission would consider and potentially approve the placement of the signage as the business will be opening prior to the continued matt er being heard. The Commission confirmed they were okay with the proposed location of the signage and were amenable to the applicant working with staff on the approval of the signage in the proposed location. Upon a motion by Commissioner McIntosh, seconded by Commissioner Vuksic, and a 7-0 vote of the Architectural Review Commission, Case No. MISC 21-0029, was continued subject to the following: 1) Explore other options with consideration to the scale of the artwork and proportion of the tenant storefront area; 2) Consider framing out the artwork or other options which PRELIMINARY MINUTES ARCHITECTURAL REVIEW COMMISSION OCTOBER 26, 2021 3 would allow for a more harmonious integration with the existing architecture; 3) Consider a darker shade of color for the plane in which the signage is applied; and 4) Applicant shall work with staff on proposed signage. CASE NO: SARC 21-0010 NATURE OF PROJECT/APPROVAL SOUGHT: Consideration for a request to approve the installation of a new awning for J’s Deli located at 74225 Highway 111, Suite B. APPLICANT AND ADDRESS: Neil Thigpen, Anaheim, CA 92806 LOCATION: 74225 Highway 111, Suite B ZONE: D Commissioner Vuksic advised the Commission his firm was the architect for J’s Deli. Commissioner Vuksic recused himself from this item due to a conflict of interest. Commissioner McAuliffe advised the Commission his firm reviewed this item as well. Commissioner McAuliffe recused himself from this item due to a conflict of interest. Associate Planner, Nick Melloni, presented the item. Mr. Melloni noted the ordinance allows for up to two words on the awning, however, the applicant is requesting an allowance of four words. Discussion on the item ensued with Commissioners providing comments and concerns for the project. Commissioner Latkovic and Vice Chair Lambell expressed concern with setting precedence for the allowance of four words versus conformance to the ordinance. Vice Chair Lambell noted the awning material should be Sunbrella fabric or a comparable material approved by staff. Vice Chair Lambell stated should the applicant choose to deviate from the proposed material, another ARC review will be required. Upon a motion by Commissioner McIntosh, seconded by Commissioner Mireles, and a 3-2 vote of the Architectural Review Commission, Case No. SARC 21-0010, was approved subject to the following: 1) Awning material should be Sunbrella fabric or comparable material approved by Planning staff; and 2) Awning is permitted to reflect four words. (AYES:, McIntosh, Mireles, and Van Vliet; NOES: Lambell and Latkovic; ABSENT: Vuksic and McAuliffe). B. PRELIMINARY PLANS None PRELIMINARY MINUTES ARCHITECTURAL REVIEW COMMISSION OCTOBER 26, 2021 4 C. MISCELLANEOUS ITEMS 1. CASE NO: MISC 21-0023 NATURE OF PROJECT/APPROVAL SOUGHT: Preliminary review and discussion to provide architectural comments on the proposed four-story Staybridge Suites hotel. APPLICANT AND ADDRESS: ACE Design, LLC, Folsom, CA 95630 LOCATION: 74755 Technology Drive ZONE: PC-2 Commissioner Vuksic and Commissioner McAuliffe rejoined the meeting. Commissioner Vuksic advised the Commission his firm is an architect for this item. Commissioner Vuksic recused himself due to a conflict of interest. Associate Planner, Kevin Swartz, presented the item. Mr. Swartz informed the Commission in March 2015 the City Council approved the Millennium Specific Plan which encompassed 152 acres. In July 2018, the Planning Commission approved Precise Plan 18-0002, including two hotels on parcel 5 of the Millennium Specific Plan. This item was reviewed and approved by the Architectural Review Commission in March 2019. Since then, the applicant has changed architects and the item is being resubmitted for approval of the revisions made to the originally approved plan. Mr. Swartz turned the presentation over to the project architect, ACE Designs, who provided a detailed presentation on the proposed revisions. Jaspal, of ACE Designs, advised the Commission the main reason for the revised proposal is to conform with the hotel brand’s new design released in October 2019. Mr. Jaspal provided a summary of the elevations and revisions made to the layout. Discussion on the item ensued with Commissioners providing design comments and concerns for the project. No formal action was taken on this item as it was brought forth solely for commissioner’s comments to the applicant. VI. COMMENTS Commissioner Vuksic rejoined the meeting. Mr. Swartz provided an update on Dining Decks. Mr. Swartz reported City Council requested staff work with restaurants to modify their dining decks to comply with the current safety and design guideline standards, with a deadline of October 31, 2021. Staff received approximately four applications, two of which were approved. With the deadline approaching and several restaurants still not in compliance, staff requested an extension which was approved by City Council, provided the restaurant is working in good faith with staff. Mr. Swartz stated it is anticipated most of the dining decks on El Paseo will be in compliance by the end of November. PRELIMINARY MINUTES ARCHITECTURAL REVIEW COMMISSION OCTOBER 26, 2021 5 Commissioner Vuksic provided an update on Arts In Public Places Commission (AIPP) and advised the Commission the City has created a website, Engage Palm Desert, which allows the public to vote on the finalist for the San Pablo roundabout sculpture. Commissioner Mireles inquired about the status of the Portola / I-10 interchange project noting this will be important considering all the newly proposed development around this area. In response to inquiry by Chair Van Vliet, Mr. Swartz stated staff is still working with Sinclair on their landscape plan. Vice Chair Lambell, expressed concern regarding reports that the Westfield Mall is closing. Principal Planner, Rosie Lua, advised the City is following the mall’s progress closely and the Economic Development department is meeting with them weekly. Additionally, the City has consulted with local firms to keep the City informed on this matter. There are several owners for this property and some have contacted the City to inquire about potential uses for the future. Ms. Lua stated she would provide the Commission with an update on this item at a future meeting. VII. ADJOURNMENT With Architectural Review Commission concurrence, Chair Van Vliet adjourned the meeting at 2:26 p.m. Rosie Lua, Secretary Melinda Gonzalez, Recording Secretary CITY OF PALM DESERT DEVELOPMENT SERVICES DEPARTMENT ARCHITECTURAL REVIEW COMMISSION MEMORANDUM To: Honorable Chair and Members of the Commission From: Nick Melloni, Associate Planner Date: November 9, 2021 Subject: MISC 21-0029 – Martello Jeweler’s Façade Color Change Project Summary The project is a proposal by Wendy Martello (applicant) for a building façade paint color change to an existing commercial tenant suite located at 73399 El Paseo, Suite 105. The proposal will apply acrylic paint to the façade to create the appearance of drapes at the entrance of the suite. This item previously appeared before the Architectural Review Commission on October 26, 2021. The ARC continued the case to allow the applicant to meet with three (3) commissioners and planning staff at the site to discuss the proposal and go over comments pertaining to the transition detail between the proposed color change and the existing building. On November 1, 2021, the applicant met with commissioners Michael McAuliffe, Jim McIntosh, and John Vuksic, at the project site to discuss the proposal with planning staff present. Points of discussion included: • The need for the proposed paint changes to relate well to the existing building architecture and possibly limit where the new paint was applied. • The design could better integrate if pulled down from the line of the upper bulkhead of the suite entry. • The proposal’s creativity, uniqueness, and bold addition to the character of the El Paseo area. In response to the discussion points, the applicant has provided four (4) options attached here: Option #1 shows a design similar to the previous version, with modification to remove the signage for clarity, a dark paint for the lower portion to improve vantages, and distinction between the drapes and façade. Options #2-4 feature a design where the drape is pulled several inches down from the roof line of the architecture feature. Each feature had a slightly different variation for the drape design. MISC 21-0029 – Martello Paint Color Page 2 of 2 November 9, 2021 Zoning Ordinance Summary Pursuant to Palm Desert Municipal Code (PDMC) Section 25.40.110, significant color changes to existing buildings which are visible from public-right-of-way require approval by the Architectural Review Commission (ARC). The proposed change constitutes a significant color change and directly faces the public-right-of-way. The applicant is proposing to construct a 5-foot tall masonry block wall at a setback of 8 feet from the face of curb in the front yard of an existing residence located at 45820 Mountain View Avenue. The property line begins 7 feet back from the face of curb. This proposal previously appeared before the Architectural Review Commission (ARC) on July 13, 2021. The ARC continued the case to allow the applicant to update the plans and: 1) Provide a more detailed plan and rendering which accurately reflected proposed materials and overall request; 2) Redesign the wall to incorporate more design interest through the inclusion of materials which are compatible with the existing home, increase the undulation to break up the plane of the wall, and potentially add a decorative wall cap; and 3) Consider options to increase the wall setback from the curb face such as modifying the pool size, and shape to allow for more conformance to requirements of the Fence and Wall Ordinance under Palm Desert Municipal Code (PDMC) 25.40.080 In response to these comments, the applicant has: 1) Revised their site plan so that it is easier to interpret and more detailed. 2) Revised the design to feature a tan stucco finish applied to the walls and pilasters. 3) Increased the number of pilasters from five (5) to eight (8) and added a decorative cap. 4) Designed the wall to feature a 6-inch plane offset between the front of the pilaster and wall. 5) Incorporated additional landscaping for the area between the wall and face of curb consisting of golden barrel cacti, Perry’s agave, and barrel cacti. 6) Provided elevations and details for the pedestrian gate and driveway sliding gate. a. The gate is constructed from a powder-coated metal frame and composite wood. MISC 21-0017 – Gottwald Residence Page 2 of 2 November 9, 2021 Zoning Ordinance Summary The Palm Desert Municipal Code (PDMC) requires Architectural Review Commission (ARC) approval for all wall exceptions for height and material subject to findings listed under PDMC 25.40.080. The subject property is zoned R-1, which establishes a minimum lot size of 8,000 square-feet. The area of the property is approximately 7,600 square-feet, which is 5% below the minimum requirement and therefore legal non-conforming. The dimensions of the lot and building setbacks conform to the requirements of the R-1 zone. The circumstances raised are based on the applicant’s plans for development of a pool in the front yard, which requires a minimum 5-foot high wall to provide a barrier as required by the California Health and Safety Code. The applicant intends to build the pool in the front yard to preserve the rear yard for a future home addition. Additionally, the applicant intends to install a security gate at the driveway and the proposed setback is necessary for the length of a vehicle to park in the driveway and accommodate a swinging gate. Additionally, the exception will not result in apparent or immediate damages to adjacent properties. Owners within 300 feet of the property have been notified and staff has received no comments to date. Additionally, the applicant has previously provided letters of support from six (6) neighbors. Staff Discussion The revised plans show the requested details in a plan that is provided clearly in the plan. Staff has also recommended that the applicant provide three-dimensional (3D) renderings or color perspectives to demonstrate the design of the wall and its relation to the home. The applicant has not expressed their intent to modify the design of the home. Staff’s findings support the granting of the exception and recommends approval as presented. Attachment: 1. The applicant, Carmen Becerra, is seeking approval to attach a decorative metal screen to the top of an existing 6-foot,1-inch, tall slump stone block wall located on the interior side yard of a single-family residence located at 43550 Vanda Circle. The decorative metal screen is constructed from an 18-inch tall, weathered steel panel structure which is bolted to the top of the existing wall. The front face of the screen, which faces the property, features decorative geometric patterns. The rear portion, which faces the neighboring property to the south, is the rear of the structure. This screen increases the height of the existing wall to 7-feet, 7-inches, from grade, along a 40-foot portion of the wall. The decorative metal is already installed. Photos of the current condition have been provided by the applicant. Zoning Ordinance Summary The Palm Desert Municipal Code (PDMC) requires Architectural Review Commission (ARC) approval for all fence and wall exceptions. The code limits the maximum allowed height for fences along interior property line to 6-feet, 0-inches, from grade. Additionally, the Fence and Wall ordinance requires the fence or wall be constructed from blocks, decay resistant wood, or wrought iron. The metal panels are not specifically listed as an approved material and require approval of an exception. Exceptions to the standards of the Ordinance may be granted subject to ARC approval based on the following findings: 1. That unusual circumstances exist which make the literal interpretation and enforcement of the standards impractical or contrary to the purpose of the ordinance codified in this section. MISC 21-0030 – Becerra Residence Page 2 of 2 November 9, 2021 There are no unusual circumstances based on the existing lot characteristics or topography that make the literal interpretation and enforcement of the standards impractical or contrary to the purpose of the ordinance codified in this section. The existing lot has a recorded lot area of 0.23-acres, or 10,019-square-feet, and conforms with minimum parcel dimensions. The parcel is located within a residential subdivision with a flat topography. The property is not located within an area subject to regular exposure to high decibel levels which would require a sound barrier for noise attenuation. The screen is requested for additional privacy in the rear yard of the property. 2. The exception shall not result in damage to adjacent properties. The exception would not result in damage to adjacent properties. The additional height would not cause damage to existing properties as the metal screen addition would require documentation and permitting to ensure it is structurally safe. The additional height does not adversely affect scenic vista for surrounding properties as primary mountain views are located to the south and southeast of the site. The screen blocks views for rear yard of the property. The height of the wall is not tall enough to block or prevent solar access for rooftop photovoltaic systems on neighboring properties. These photovoltaic systems would be located on southerly roof exposures where sunlight is most direct. 3. Property owners adjacent to the proposed exception shall be informed of the application at least 10 days prior to the ARC meeting. A notice for the ARC meeting was sent to all property owners within 300 feet of the project site. 4. Exceptions for nonconforming materials, including wood and vinyl fences, shall be based on architectural merit and compatibility with the home’s architectural style. The material is decorative and compatible with the existing home. Historic street view photos show the same material has been used on gates located on the northern Primrose Drive Street frontage. These existing gates were approved by Planning Staff in 2005 at the time the block wall was constructed. Staff Recommendation Staff is unable to make finding #1 as required by PDMC 25.40.080 (E). I am writing to request an exception be granted for the decorative metal screen that my father installed on my existing block wall due to privacy reasons, as the total hedge height currently exceeds the height maximum allowed per Palm Desert Municipal Code. The metal screen was created and built to match all the existing gates that currently surround my home. The metal is made out of 16-gauge sheet metal, and the decorative sheet metal is a 14-gauge that consists of (2)16 ft. sections, and one 8 ft. section, a total of 40 lineal feet. The framing is 1" inch square tubing that has been fastened down with 4-inch-long winged concrete screws that are % inch in width. Each screw was drilled directly into the block wall to secure the metal screen. I have included pictures of my hedge wall for the committee to review and to demonstrate how the decorative art on the metal screen makes the hedge stand out by adding style and personality. The pictures will also show that no views, or objects are obstructed, and you are not able to view the metal screen from the street. To further add, the cost of block wall was not shared. My family and I have paid 100% for all the permitting and construction of the block wall, and all the footings currently lie within my property line. I have reached out to numerous local engineers and architects, but unfortunately, they are all 3 to 4 months out before they are able to provide me with the structural calculations that are needed to further demonstrate that the metal screen is structurally safe and can withstand the mile per hour winds that we experience here in the City of Palm Desert. If you should need the structural calculations to fully consider my request for an exception, please grant me an extension to hire a licensed Architect, or Structural Engineer that can verify the structural integrity of the wall, the footing location, and to provide the structural calculations that are needed to demonstrate that the metal screen is structurally safe and meets all wall/screen requirements set by the City of Palm Desert. In summary, please grant me the exception of the metal screen height that currently exceeds the height maximum per the Palm Desert Municipal Code for the height maximum for the Residential Community. BACKGROUND On March 26, 2015, the City Council adopted Ordinance No. 1281 approving the Millennium Specific Plan (MSP). The MSP is designated for a 152-acre area generally located north of Gerald Ford Drive, east of Technology Drive, west of Portola Avenue, and south of Union Pacific Railroad. The MSP establishes nine (9) planning areas/parcels, as shown on the exhibit below. The proposal is located on Parcel 8 (PA 8) of the MSP, which is a 10-acre site planned for 220-units of affordable multi-family housing. The ENA requires the applicant to submit planning and land entitlements for the development of the site. At this time, no formal application has been submitted so no formal action is requested at this time. The proposed site plan shows 13 total buildings consisting of ten (10) three-story apartment buildings, one (1) community building, one (1) maintenance building, and one (1) communal laundry building. The site plan includes 350 parking spaces, pedestrian walkways, and six (6) retention areas. Resident amenities include a centralized multi-sport court, playground area, and shaded picnic benches.
