Please approve the proposed Zoning Ordinance Amendment 22-0001 changes.
Fractional Ownership Homes such as Pacaso belong in areas zoned for such, and not in residential
neighborhoods.

This letter is to encourage you to approve the proposed Zoning Ordinance Amendment 22-0001.
Several neighbors have met and discussed the Pacaso model. (We have three within two blocks of
my house. ) We are very concerned about 1/8 ownership by an LLC that mimics a timeshare
and/or a business.
The City of Palm Springs voted to maintain their ban on timeshares in residential neighborhoods and
to rewire their ordinance to more explicitly apply to fractional ownership…Pacaso. (Desert Sun
March 11, 2022) Other cities are challenging Pacaso as well. In Napa, CA “ Pacaso agreed to sell
the Napa home (after much resistance from neighbors) in a traditional manner ‘to a whole home
buyer’ rather than convert it into a corporation and sell it to multiple people” (from an article “A
Startup Is Turning Houses Into Corporations, And The Neighbors Are Fighting Back” by Greg Rosalsky
Augus 24, 2021)
Residents of Palm Desert should also be able to live in our residential neighborhoods without
intrusion of fractional ownership, timeshares, businesses and short term rentals.

To Mayor Harnik and City Councilmembers:
I urge you to approve proposed Zoning Ordinance Amendment 22-0001 regarding Pacaso-type fractionally-owned
properties.
The proposed amendment recognizes that properties of this type are not homes. It provides for them in zones more
appropriate to this type of accommodation – specifically, accommodations with intermittent occupancy for specified
times, in units managed, furnished and maintained by third parties. This is similar to the operating model used by
hotels, motels, inns, B&Bs, resort villas and other commercial properties. They don’t belong in residential
neighborhoods.
Neighborhoods need to be preserved for people who want to live there for months, years or for life. People who
make up and enjoy the social fabric of the neighborhood. People who recognize and know each other as neighbors.
People who work nearby, attend school locally, participate in local civic and religious organizations, volunteer their
time, make regular use of local businesses and professional services, and all the other aspects of community life.
I appreciate that Palm Desert is taking steps already to shape how this emerging form of fractional property
ownership will be managed within the city’s jurisdiction. Your action now can prevent erosion of our
neighborhoods, preserve scarce housing for long-term residents and help avoid the quality-of-life issues and
nuisances that we saw with short-term rentals. Please approve the proposed amendment on April 28th.

Subject:Multi-Owner residential properties in the City

Respectfully I encourage the Mayor and City Council investigate the effect
multi-owner residential properties will have on the neighborhoods they are
situated within. Specifically, PACASO properties, which are not time-shares,
however function as such. In my neighborhood there are now two of these
residences within a 2-3 block area South of Haystack.
Palm Springs has much concern about the effect of these on neighborhoods.
Prices escalate, single family residences become more scarce, plus we loose the
potential of active community residents who can contribute to the health and
welfare of Palm Desert.
Much more can be said of the disturbance of increased noise, trash and parking
issues with visitors who arrive frequently with many more inhabitants than
normal for a single family residence. These visitors frequently arrive with a
"party" attitude.
As I understand the issue, the multiple owners may allow their family members
to use the home, making these properties potentially like short term rentals.
Please investigate how these properties will effect all of us, and how they can be
controlled.
