HomeMy WebLinkAboutRES 2022-050RESOLUTION NO. 2022-50 ' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, CALLING FOR A GENERAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, NOVEMBER 8, 2022, FOR THE ELECTION OF CERTAIN OFFICERS AS REQUIRED BY THE PROVISIONS OF THE CITY CHARTER AND FOR THE SUBMISSION OF A PROPOSED ADVISORY MEASURE WHEREAS, pursuant to the provisions of the Charter of the City of Palm Desert and Chapter 2.38 of the Palm Desert Municipal Code, a General Municipal Election shall be held on November 8, 2022, for the election of two (2) Members of the City Council nominated from District 2 for the full term of four (4) years each using ranked choice voting; and WHEREAS, the City Council also desires to submit to the voters on Tuesday, November 8, 2022, one advisory measure relating to City Council districts; and WHEREAS, pursuant to California Elections Code section 9603, such an advisory measure is intended to allow the voters of Palm Desert to voice their opinion regarding the ballot question, with the results in no manner controlling on the City Council. ' NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, California, as follows: Section 1. That the foregoing Recitals are true and correct and are incorporated herein by this reference. Section 2. That pursuant to the requirements of the Charter of the City of Palm, Palm Desert Municipal Code, and the laws of the State of California relating to elections; a General Municipal Election is hereby called and ordered to be held in the City of Palm Desert, California, on Tuesday, November 8, 2022, for the purpose of electing two (2) Members of the City Council nominated from District 2 for the full term of four years each, using ranked choice voting in accordance with Section 2.38.050 of the Palm Desert Municipal Code. Section 3. That the City Council, pursuant to its rights and authority, does order submitted to the voters at the General Municipal Election to be held on Tuesday, November 8, 2022, in addition to any other matters required by law, there shall be printed in substantially the following advisory question: RESOLUTION NO. 2022-50 Advisory Vote Only Shall the measure relating to City Council districts be adopted? Limited to 75 words) "In Palm Desert now, District 1 (the area surrounding Civic Center with 20% of the population) selects one Council YES representative every four years, and District 2 (the other 80% of the City) votes for a total of four Council representatives, picking two representatives every two years. Should District 2 NO be divided into four smaller districts, with all voters electing a single person from their smaller district every four ears?" Section 4. Pursuant to California Elections Code Section 9603(d), the territory in which the advisory election shall be held shall consist of only the jurisdictional boundary of the City of Palm Desert. Section 5. That in the event of a tie vote (if any two or more persons receive an equal and the highest number of votes for an office) as certified by the Election Official, the City Council, in accordance with California Elections Code Section 15651(a), shall set a date and time and place and summon the candidates who have received the tie votes to appear and will determine the tie by lot. Section 6. That the ballots to be used at the election shall be in form and content as required by law. ' Section 7. That the City Clerk is authorized, instructed, and directed to coordinate with the County of Riverside Registrar of Voters to procure and furnish any and all official ballots, notices, and printed matter and all supplies, equipment, and paraphernalia that may be necessary in order to properly and lawfully conduct the election. In all particulars not recited in this Resolution, the election shall be held and conducted as provided by law for holding municipal elections. Section 8. That the polls for the election shall be open at seven o'clock a.m. (7:00 a.m.) of the day of the election and shall remain open continuously from that time until eight o'clock p.m. (8:00 p.m.) of the same day when the polls shall be closed, pursuant to California Elections Code Section 10242, except as provided in Section 14212 and 14401 of the California Elections Code. Section 9. The Notice of the election is hereby given and the City Clerk is authorized, instructed, and directed to give further or additional notice of the election, in time, form, and manner as required by law. Section 10. The City Clerk is hereby directed to file a certified copy of this resolution with the County of Riverside Board of Supervisors and the County of Riverside Registrar of Voters. IPA RESOLUTION NO. 2022-50 ' Section 11, The City Council authorizes the City Clerk to administer said election and all reasonable and actual election expenses shall be paid by the City upon presentation of a properly submitted bill.
