Glaab Dear Paul: Subject: November 4, 2014, Palm Desert General Municipal Election - Campaign Disclosure Filing The first Pre -election Campaign Disclosure Statement filing of the November 4, 2014, Election for the period of July 1 - September 30 was due Monday, October 6, by personal delivery or first-class mail (postmarked on or before October 6). Your Campaign Disclosure Statement, which was due on October 6, has not been received by my office. By September 30, the candidate needed to determine whether or not they would raise or spend $1,000 or more and file the appropriate paperwork. Please refer to your Candidate's Manual for more detailed information in this regard. Option 1 - To raise or spend more than $1,000, a Committee needed to be established by filing a Fair Political Practices Commission (FPPC) Form 410 with the Secretary of State, including the $50 filing fee, with a copy to be provided to the City Clerk's Office. Further, a corresponding FPPC Form 460 needed to be filed, reporting the contributions received and expenditures made for the period of July 1 - September 30, 2014. The Form 460 was the due to the City Clerk's Office by October 6, delivered in the aforementioned manner. Option 2 - To spend $1,000 or less of the candidate's own funds (only) requires filing of an FPPC Form 470 with the City Clerk's Office, and it fulfills all Campaign Disclosure filing requirements for calendar 2014. No other reports are required unless the candidate goes over the $1,000 limit, at which time a Form 470 Supplement is necessary, including very specific notification requirements that are outlined on the Form itself; and you must then also complete the steps listed above in Option 1. Government Code Section 91013 imposes a fine of $10 per day after the filing deadline until the Statement is filed. The liability is limited to the cumulative amount of the contributions or expenditures for the period covered by the late Statement or $100, whichever is greater. However, if you file your Campaign Disclosure Statement within 10 days of receiving this letter and have a good reason for filing late, all or part of the fine can be waived. Please file your Campaign Disclosure Statement within 10 days. The fine cannot be waived if the Statement is filed after this time.
