MINUTES It was moved by L. Sullivan and seconded by L. Saindon to approve the minutes of January 12, 2000. Motion was carried to approve the minutes. INFORMATIONAL A. PALM DESERT CRIME-FREE MULTI-HOUSING ITEMS NEWSLETTER Terre La Rocca said that the information provided in the informational items is provided to keep the commission abreast of what is going on. B. ONE QUAIL PLACE - EXTRA PATROL Enclosed with the packet is a letter from Dan Miller indicating that extra patrol will be provided at One Quail Place. C. F.I.N.D. LETTERS OF THANKS Food In Need of Distribution (F.I.N.D.) sent letters of thanks to the properties for their participation in the program. D. LETTERS OF APPRECIATION FOR 1. HEIDI HOBBY, MANAGER CATALINA GARDENS 2. SALLY KEENEY, MANAGER LAS SERENAS Letters were reviewed. 1 Minutes Feb. 9, 2000 HQVS 1TG COMMISSION INFORMATIONAL E. TOYS FOR TOTS COMMANDER'S AWARD ITEMS (CONTD) Certificates were reviewed. F. "WE CARE" RESIDENT SURVEY/LEASE RENEWAL - LAS SERENAS The "We Care" resident surveys were reviewed and discussed. NEW BUSINESS A. REASCO AFFORDABLE HOUSING UNITS ANALYSIS - DISCUSSION An analysis based on the total number of units produced to date compared to the Stipulation was prepared by Leonard Wolk. The analysis was presented, reviewed and discussed. The analysis concluded that based on the Stipulation, 108 very low income and low income units need to be developed by the year 2001. By 2002, another 108 units will need to be developed. In the year 2006, we should be developing another 121 for a total production of 337 units. Once this has been accomplished, the stipulation numbers will be met. t L. Saindon asked about the timeline for the construction of the 108 units which are due by 2001 . Terre said that if the 20 of 40 acres are developed, it would create 144 rental units, and approximately 30 single-family units. Construction should begin within a year. B. AGREEMENT WITH VALENTINE CONSTRUCTION, INC. Rec: By minute motion: 1. Forward to the Redevelopment Agency recommendation for approval of Agreement between Valentine Construction, Inc. and the Palm Desert Redevelopment Agency for Construction Services at One Quail Place 2. Forward to the Housing Authority recommendation for authorization of the expenditure from Bond Funds Action: It was moved by C. McLeod and seconded by L. Saindon to forward to the Redevelopment Agency recommendation to approve agreement with Valentine Construction and to forward to the Housing Authority authorization for the expenditure from Bond funds. Motion carried. Minutes Feb. 9, 2000 EOUS T CO) MISS10N CONTINUED A. ACQUISITION/REHAB/RESALE PROGRAM BUSINESS REBECCA ROAD PROPERTIES - APPRAISAL (ACTION REQUIRED) Rec: By Minute Motion: Review appraisal and establish sales price and forward to the Redevelopment Agency for final action. Action: It was moved by L. Saindon and seconded by L. Sullivan to establish the Sales Price of $115,000 for 42-662 and 42-740 Rebecca Road . Market the homes to families of up to 80%of the County Median Income and provide for up to $22,000 in the form of a deferred silent second if necessary. B. FIVE YEAR IMPLEMENTATION PLAN — REVIEW AND DISCUSSION (NO ACTION REQUIRED) Dennis Coleman provided an overview of the Agency's Five Year Implementation plan and answered questions from the commissioners. Dennis said that the numbers that are necessary for inclusionary housing are different from the numbers required through the Stipulation. The Stipulation is a negotiated agreement. The housing numbers in the plan are based on the number of units produced to date and what is expected to be produced over the life of each of the project areas. In inclusionary housing, if an affordable housing project is built outside of a project area, the homes are counted at one for every two houses built. The plan allows you to make up any housing deficits over the life of the projects. The other part of the plan which pertained to housing is looking at the housing resources and the amount of money available and what types of projects can be funded. The housing fund cash flow is much better off than what it was 3 or 4 years ago. The five year plan does not commit the Agency to developing everything that is listed, but rather these are the projects the Agency hopes to accomplish within the next five years. The plan will be amended in March or April. Staff asked council to adopt the plan so that statutory requirements could be met. 3 Minutes Feb. 9, 2000 HOUSING COMMISSION CONTINUED The plan is mandated in order to inform the State of what the Agency BUSINESS is doing with housing and redevelopment monies. (CONTD) REPORTS A. MISSION STATEMENT A draft Mission Statement stating the goals of the Housing Authority that was prepared by the subcommittee which consists of Charlene Sumpter and commissioners L. Sullivan and L. Saindon was presented to the Commission. The draft Mission Statement was reviewed and will be brought back to the commission in final form to be approved and forwarded to the Housing Authority for approval and adoption. B. SCHEDULED OF REVENUE AND EXPENDITU RES - QUARTERLY Janet Moore of the City's Finance Department provided the commission with an overview of the quarterly housing budget report IIP and answered questions from the commissioners. Janet said that RPM will be preparing a preliminary fiscal year 2000-2001 budget which will be presented to the commission at the next meeting. C. MOBILE HOME PARK ISSUES 1. PORTOLA PALMS MOBILE HOME PARK SALES UPDATE (TERRE) Terre said that there are no sales to report. D. 40 ACRE AFFORDABLE HOUSING SITE Terre said that Manny Sanchez of JMS Engineering will be submitting a proposal to revise the site plan per Agency direction reducing the proposed development to a 20-acre site with a 40-acre overlay. 1111, Minutes Feb. 9, 2000 EOVS N ,r COMMISSION REPORTS E. 73-610 SANTA ROSA — PALM VILLAGE APARTMENTS - (CONTD) UPDATE (CHARLENE) A cost breakdown for the property was distributed to the Commission. The breakdown showed five scenarios and cost involved. The commission recommended that staff look at the acquisition of the adjacent vacant properties and the construction of the maximum units possible for the site. Staff has submitted a Home application to the County for acquisition of the adjacent vacant sites and new construction funds. F. RESERVE STUDY STATUS (TERRY PARKER) Kim Moon said that the reserve study has been compiled. The final report will be provided to the commission at its next meeting. G. HOME IMPROVEMENT PROGRAM Bryce provided the commission with a Home Improvement Program report which summarized the work done to date. He said that a majority of the work which is being done in the following areas: 1) Focus area 1—area south of Fred Waring and north of Highway 111, 2) by Rebecca Road properties, and 3) Focus area 4 — Palm Desert Country Club. Bryce is assisting Overland Resources by contacting property owners along Fred Waring to obtain personal information to be used in the preparation of a relocation plan for the future widening of Fred Waring. H. HOUSING AUTHORITY PROPERTIES (TERRE) 1. ONE QUAIL PLACE - CAPITAL IMPROVEMENT UPDATE — PET POLICY Terre presented the current policy which allows pets of up to 20 pounds at our senior properties. The mayor requested the Commission's input with regard to allowing larger pets at our senior projects. There was a (CONTD) strong resistance to increasing the allowable weight. Discussion followed. SMOKE DETECTORS Kim Moon said that Desert Pointe, Neighbors and Taos are complete. Terry Parker will be scheduling Catalina, Neighbors and Las Serenas soon. Terre La Rocca said that once the properties have been assessed, a report will be provided to the commission on the findings. In addition, the Fire Department is also inspecting the apartments smoke detector systems. MISCELLANEOUS CORRESPONDENCE A letter which went out to the residents of One Quail Place was provided in the packet as information. Also, the carports at Desert Pointe are currently being installed and will be completed by next week. Terre invited the commission to stop by to look at the work which has made a dramatic difference on the property. Various letters and notices were included in the Commission's packet as information. In response to concerns regarding a fire at Desert Pointe, the Commission was advised of the circumstances surrounding the incident and tenant. I. The efforts and little extra touches which you all put into our property shows from the very moment one enters our driveway. (The new entry sign should definitely be considered part of the City of Palm Desert' s "Art in Public Places" theme. ) Having lived here for a little over a year and a half now I couldn' t ask for a more cordial and helpful staff. Your consistently well-groomed appearance, business-like manner and knowledge of the property makes me feel very comfortable and safe. Your individual personalities make one feel part of the family here at Las Serenas . I absolutely adore my "casita" ( little home) as I choose to call it. From entering through the cozy patio right on through the casita, what more could one ask for? . . .Maybe a little more room however, being a hobbyist cook, the kitchen is very well appointed and is a money saver from the large refrigerator through the large gas range, particularly for some Now one of low income. I never hear my neighbors but can and do enjoy socializing up at the clubhouse where there' s always someone to visit with. At times I feel sorry for you, the staff, due to the complaining I hear going on amongst some of the residents. Sometimes I 'm tempted to say, "Get a life ! " , but then I have to consider that most of the residents are retired and/or are on Social Security and don' t have either the transportation or initiative to leave the property and get into outside activities. Their daily life is right here. .day after day after day. . .ad infinitum. This is a sad state of affairs considering all of the activities we have and all of the books, magazines, games and puzzles we have available at the clubhouse. And, as in everyday life there are those who ( 1 ) make their own rules over and above and sometimes in conflict with the established rules and those who ( 2) can' t get along in the "outside" world either ( just observe them in the local market, it' s embarrassing! ) . Sally, Dick, Carlos. . .please don' t get disheartened. Some of us do hear and understand and do appreciate your every effort. Thank you for being here for us and allowing us to make our homes here at Las Serenas . Background: On December 3,1999, staff received a phone call from One Quail Place management advising us that there had been a fire on the property which consumed one of the carports. The Fire Department has investigated the fire and the cause is unknown however the incident report has a witness who says that the fire began in the interior of a 1998 Dodge Shadow which was parked under the carport. That fire spread to four other vehicles. Those claims are being handled by the City's Risk Management office. The carport structure is insured through Robert Driver Company. This policy requires a $5,000 deductible to be paid by the Agency and the balance to be covered by the insurance carrier. Valentine Construction was recommended by the insurance adjuster since they do rehabilitation work for the insurance company on a regular basis, and were available to begin this job immediately. 41ir Staff is requesting authorization to proceed with this contract and authorize the commencement of the work. ARTICLE VL CONTRACTORS'LICENSE LAW Contractors are required by law to be licensed and regulated by the Contractor's State License Board which has jurisdiction to investigate complaints against contractors if a complaint regarding a patent act or omission is filed within four years of the date of the alleged violation. A complaint regarding a latent act or omission pertaining to structural defects must be filed within 10 years of the date of the alleged violation. Any questions concerning a contractor may be referred to the Registrar, Contractor's State License Board, P.O. Box 26000. Sacramento, California 95826. ARTICLE VIL MISCELLANEOUS 1. Acknowledgment. Termination for Default. This means that after a court hearing,your home, land and property could be sold by a court officer and the proceeds of the sale used to satisfy what you owe. This can happen even if you have paid your contractor in full, if the contractor's subcontractors, laborers,or suppliers remain unpaid. To preserve their rights to file a claim or lien against your property. certain claimants such as subcontractors or material suppliers are each required to provide you with a document called a "Preliminary Notice." Contractors and laborers who contract with owners directly do not have to provide such notice since you are aware of their existence as an owner. A preliminary notice is not a lien against your property. Its purpose is to notify you of persons or entities that may have a right to file a lien against your property if they are not paid. In order to protect their lien rights. a contractor, subcontractor, supplier, or laborer must file a mechanics' lien with the county recorder which then becomes a recorded lien against your property. Generally. the maximum time allowed for filing a mechanics'lien against your property is 90 days after substantial completion of your project. TO INSURE EXTRA PROTECTION FOR YOURSELF AND YOUR PROPERTY. YOU MAY WISH TO TAKE ONE OR MORE OF THE FOLLOWING STEPS: (1) Require that your contractor supply you with a payment and performance bond (not a license bond), which provides that the bonding company will either complete the project or pay damages up to the amount of the bond. This payment and performance bond as well as a copy of the construction contract should be filed with the count' recorder for your further protection. The payment and performance bond will usually cost from 1 to 5 percent of the contract amount depending on the contractor's bonding ability. If a contractor cannot obtain such bonding, it may indicate his or her financial incapacity. (2) Require that payments be made directly to subcontractors and material suppliers through a joint control. Funding services may be available. for a fee, in your area which will establish voucher or other means of payment to your contractor. These services may also provide you with lien waivers and other forms of protection. Any joint control agreement should include the addendum approved by the registrar. (3) Issue joint checks for payment. made out to both your contractor and subcontractors or material suppliers involved in the project. The joint checks should be made payable to the persons or entities which send preliminary notices to you. Those persons or entities have indicated that they may have lien rights on your property. therefore you need to protect yourself. This will help to insure that all persons due payment are actually paid. (4) Upon making payment on any completed phase of the project. and before making any further payments. require your contractor to provide you with unconditional "Waiver and Release" forms signed by each material supplier, subcontractor. and laborer involved in that portion of the work for which payment was made. The statutory lien releases are set forth in exact language in Section 3262 of the Civil Code. Most stationery stores will sell the"Waiver and Release"forms if your contractor does not have them. The material suppliers. subcontractors. and laborers that you obtain releases from are those persons or entities who have filed preliminary notices with you. If you are not certain of the material suppliers, subcontractors,and laborers working on your project,you may obtain a list from your contractor. On projects involving improvements to a single-family residence or a duplex owned by the individuals, the person signing these releases lose the right to file a mechanics' lien claim against your property. In other types of construction.this protection may still be important.but may not be as complete. To protect yourself under this option. you must be certain that all material suppliers. subcontractors . and laborers have signed the "Waiver and Release" form. If a mechanics' lien has been filed against your property. it can only be voluntarily released by a recorded "Release of Mechanics' Lien" signed by the person or entity that filed the mechanics' lien against your property unless the lawsuit to enforce the lien was not timely filed. You should not make any final payments until any and all such liens are removed. With the exception of our senior communities, it is our policy not to permit dogs in our communities. We do however, permit dogs, less than 20 pounds, at our senior communities. We do not permit oversized dogs for various reasons; taking into consideration the size of the apartment, and the wear and tear oversized dogs cause. The amount of noise is more excessive from large dogs, as well as the intimidation factor many residents have expressed to us in the past. There is the excessive wear to the property, damage to the grounds and landscaping when the dog is not properly monitored. • In a recent survey conducted by the on-site staff of twenty-four senior communities throughout Riverside County, eight did not permit dogs of any kind, fifteen permitted dogs under 20 pounds and one allowed dogs up to forty pounds with a very high pet deposit. The communities that were surveyed all stated similar reasons as RPM's for not permitting large dogs. We do realize that there is a percentage of people who do properly care for their dogs, but unfortunately this is not the case with the majority of large dog owners. And since Fair Housing does not permit us to manage by exception, we find it necessary to continue to follow our established policy. You will recall that following the conclusion to our negotiations over the first amendment to the Stipulation (which permitted the Agency to acquire the County Housing Authority- owned units and to refinance other de$t) , certain issues remained which we agreed to address at a laterldate. Those issues included primarily the appropriate definition ;of affordable housing cost . 1 In addition, with the recent publication by SCAG of existing and future housing need numbers, the Agency wishes to clarify its obligations in that regard. As a practical matter, it is not possible for the Agency to Teet the existing housing need numbers published by SCAG. As evidenced by the facts described above, the Agency continues its aggrressive efforts to provide housing at an affordable cost, to very low and low income families, and the Agency needs assurance that :these new numbers from SCAG will not interfere with its planned redevelopment projects. 1 The Agency is anxious to resolve the outstanding issues relating to the Stipulation as soon as possible.
