Please submit to the Agency Board. ti.• Thank you. cc: Carlos Ortega %' ' Minutes CONVENE 3:30 p.m., Wednesday, August 9, 2000 ROLL CALL Members Present: Ben Kurtz, Jim Thorness, Leo Sullivan, Larry Saindon, Linda Ward Members Absent: Carrie McLeod, Roger Dash Others Present: Teresa La Rocca, Charlene Sumpter, Bryce White, Janet Moore, Mary Bleecker Guest(s): Terry Parker, Regional Supervisor RPM Company Donnis Thompson, Palm Desert Resident ORAL COMMUNICATIONS Donnis Thompson, a resident of Palm Desert introduced herself to the Commission and said that she is interested in participating as a Housing Commission member. She spoke about her experience as a member in various committees/commissions and as a state superintendent while she lived in Hawaii. She was welcomed by the Commission. Terre introduced Lauri Aylaian, Project Manager for the Redevelopment Agency who joined the meeting to present and discuss the closed session item listed on the agenda. MINUTES It was moved by L. Sullivan and seconded by L. Saindon to approve the minutes of July 12, 2000. Motion carried to approve the minutes. INFORMATIONAL A. RPM WEEKLY STATUS REPORT (JULY) ITEMS After L. Sullivan requested clarification of the document, Terry Parker explained the RPM Weekly Status Report to the Commission. She said that the report would be provided on a monthly basis. 1 Minutes Aug. 9, 2000 HO TS NG COMMISSION INFORMATIONAL B. REPORT #1 - MONTHLY OCCUPANCY AND AVERAGE ITEMS (CONTD) RENT STATEMENT (JULY) Terry Parker summarized Report #1 and Terre La Rocca said that Report #1 would be provided on a monthly basis. C. REPORT #2 - MONTHLY NET OPERATING INCOME STATEMENT (MAY) Terry Parker said that because the June report is a year-end report it is not available at this time and that Report#2 runs 30 days in arrears because it is based on a profit and loss statement. The June report should be ready by the next Housing Commission meeting. L. Saindon asked if the status of reserve funds could be added to Report #2. Terre said that there is reserve funds, however, it is not shown in the budget, as the reserve funds are held by Finance. Janet said that all of the money that has been earned to date on the properties has been placed in net operating income (NOI) and it has been reserved for replacement purposes. Everything as of last year has been reserved ($2 million). A report will be brought to the commission indicating what staff would like to do with the reserves. Terre said that a meeting between the Agency, finance staff and RPM will take place to take a look at fund balances and what is considered reasonable as a starting balance for the reserve funds taking into consideration life expectancy of the fixtures and equipment, etc. Because there is $2 million in NOI at this time, a determination needs to be made as to what amount needs to be placed in reserves. Janet said that, a while back, Jim Foley provided the commission with a report that stated that if the reserves were funded at 30% of the recommended reserves, there would be enough money to fund deferred maintenance. Another thing to consider is that the reserve study is only good for one year. Terre said that she has received a letter from Association Reserves,the company who did the reserve study, asking if the Authority was going to do another reserve study to update the numbers. Proposal will be scheduled for review at the next meeting. 2 Minutes Aug. 9, 2000 SOUS NTG COMMISSIO11'P INFORMATIONAL L. Saindon said that he would like to see a financial report that shows ITEMS (CONTD) all the budget items, i.e. capital improvements, reserves and debt service as well as the 20% set aside to get a better picture of the overall housing program. D. HOUSING AUTHORITY PROPERTIES NEWSLETTER (AUGUST 2000) Terre said that one of the things she and Jim Foley spoke about was that the tenants tend to not remember what the rules and regulations are as they do not see the rules frequently. There will be a section in the newsletter reminding people that there are house rules which need to be followed. In addition, particularly with the improvements which will be made at One Quail, there should be an update informing the tenants of what is happening on a regular basis. Terry Parker said that she could do a maintenance reminder once a month. NEW BUSINESS A. RPM PROPERTY MANAGEMENT Rec: By Minute Motion: Review subcommittee recommendation and forward to Agency for Action Action: Item was tabled until the subcommittee has the opportunity to tour all of the properties. B. NEW BUSINESS Action: It was moved by L. Sullivan and seconded by (CONTD) L. Saindon that the Commission forward to the Redevelopment Agency recommendation to approve the resale of 75-357 Kelsey Circle South and 42-740 Rebecca Road. Motion carried. At the request of L. Sullivan, Terre explained that a silent second is a second trust deed that secures the promissory note which is recorded. No monthly installments are paid for the term of the note which is for a period of 30 years. At the end of 30 years, if the unit stays in compliance with the program guidelines the note is forgiven. The note can be rolled to another qualified buyer during the 30 year period. If the home is sold out of compliance with the program, then the second trust deed is paid back to the Agency along with 25% of the equity. C. HABITAT FOR HUMANITY Rec: By Minute Motion: Review staff report and make recommendation for City Council consideration of the transfer of a vacant lot on Catalina Way to Habitat for Humanity for the construction of a single family residence. Action: It was moved by L. Sullivan and seconded by L. Saindon to forward to the City Council the transfer of a vacant lot on Catalina Way to Habitat for Humanity. Motion carried. Terre said that Habitat for Humanity will be coordinating the construction groundbreaking of the home on Catalina Way with the National Make a Difference Day in October. Staff will identify additional homes in the neighborhood that will also receive volunteer repairs at the October event. 4 Minutes Aug. 9, 2000 HOUSING COMMISSION 1. CONTINUED A. 40 ACRE SITE DEVELOPMENT - REVIEW OF SITE BUSINESS UPDATE The site plan attached to the report shows the Corporation Yard expansion of 3.32 acres and the location of the 12.5 acre multi-family located at the northwest corner of the 40 acre site. The staff report, as recommended by the subcommittee, describes the project and asks for conceptual preliminary site plan approval and authorization to enter into an exclusive right to negotiate for a period not to exceed six months with the Palm Desert Development Company for the development of 144 affordable multi-family housing units on 12.5 acres. One of the conditions of the project will be that the developer must have commitment of tax credits. The developer needs to have control of the site in order to submit his tax credit application. Further, controls will be built into the Disposition Development Agreement which states that if the developer does not obtain tax credits, the property will revert back to the Agency. L. Sullivan asked if at the end of the six months the developer has not obtained the funding due to the normal delays, if the developer would be given an extension. Terre stated that at that time staff would make a recommendation to either extend the period or pursue the funding through the issuance of bonds. There are only two times a year when someone can apply for tax credits. Mr. Horn has been successful in obtaining tax credits in the past. He has built projects in Indio, La Quinta, Cathedral City and Moreno Valley. REPORTS A. 73-610 SANTA ROSA — PALM VILLAGE APARTMENTS - UPDATE (CHARLENE/TERRE) An offer to purchase has been sent to the owner and no response has been received. ACQUISITION/REHAB/RESALE PROGRAM UPDATE (CONTD) (CHARLENE) REBECCA ROAD PROPERTIES One home is in escrow which will be sold with a silent second. The agent is continuing to identify and qualify buyers for the resales. C. HOME IMPROVEMENT PROGRAM UPDATE (BRYCE) A Home Improvement Program Update report was provided to the Commission. Bryce said that he has received 4 applications within the last couple of weeks. Some of the major work which was approved by the commission will be done in the near future which will include a room addition and a bathroom addition. Monies have been budgeted, however the revised and expanded program will be going before the Council the latter part of this month. The Council recently appropriated $300,000 from the 20% set aside to allow staff to do larger projects. Recently, Terre and Bryce made a presentation to Joslyn Senior Center to promote the Home Improvement Program. Bryce informed the commission that the Church of Jesus Christ Latter Day Saints which helped on a recent Make a Difference Day have re- contacted Bryce and let him know that they want to continue to work on future Make a Difference Days. D. HOUSING AUTHORITY PROPERTIES (TERRE) 1. ONE QUAIL PLACE - Landscaping Redesign - Update (Charlene) Contracts for the landscape architect have been approved. Plans were returned. Changes were made to the specifications and drawings. The project will be ready to be advertised shortly. 6 Minutes Aug. 9, 2000 HOUSING COMMISSION REPORTS - Repair and Resurfacing of Parking Lots - (CONTD) Update (Charlene) Charlene said that the engineer is working on the project. The project is expected to be approximately 2 months away before the drawings are returned. Commissioner J. Thorness said that he wanted to clarify that One Quail Place does not allow pets, hence a pet policy is not in effect. E. DESERT ROSE RESALES UPDATE (TERRE) A list was provided to the commission which lists the available resales. Terre said that there are available homes on lots#20, #93, #108, #110 and #153. That the City Council adopt Resolution No. 00- authorizing the Palm Desert Redevelopment Agency to sell 75-357 Kelsey Circle South and 42-740 Rebecca Road at Fair Market Value. 2 That the Redevelopment Agency adopt Resolution No. making a finding that the sale price for 75-357 Kelsey Circle South and 42-740 Rebecca Road are not less than fair market value in accordance with highest and best use under the Redevelopment Plan for Project Area No. 1, Amended. Background: Health and Safety Code Section 33433 requires that before any property of the Agency is sold or leased, the conveyance must first be approved by the Redevelopment Agency by resolution at a public hearing. The purpose of the public hearing is to receive public testimony as prescribed by law. Notice of the time and place of public hearing must be published in a newspaper of general circulation in the community for at least two weeks prior to the public hearing. Fair market value has been established for both properties based on either comparable sales in the neighborhood or by certified appraisal. L G:\RDA\Maria Hunt\WPDATA\LAROCCA\STFRPTS 82400 sale.wpd 75-357 Kelsey Circle South On February 22, 2000, the Agency purchased 75-357 Kelsey Circle South from Eiichi Ono who purchased the Desert Rose home in 1997. Upon notification of the owner's intent to sell, the Agency has the right of first refusal to either purchase the property or identify another qualified buyer. A qualified buyer could not be identified in a specified time prescribed in the Unit Regulatory Agreement. As a result, it executed its option to purchase the property in order to keep the unit affordable and in compliance with the program guidelines. The Agency purchased the unit for$86,000. The seller had not received a second trust deed from the Agency upon initial purchase of the property in 1997 as a family is a moderate income household, hence, a rollover second trust deed was not available to a future buyer.. The Agency offered the unit for sale at the allowable resale price of$91,500 which includes closing costs and commission. A qualified lower income family has been qualified to purchase the property, but will require a$5,000 second trust deed in order to purchase the property. The second trust deed will allow the Agency to carry over the terms and conditions of the Unit Regulatory Agreement to the new buyer. Staff recommends approval of the sale and authorization of the $5,000 silent second trust deed and authorize the Executive Director to execute all necessary documents on the sale of the subject property. 42-740 Rebecca Road The Agency purchased 42-740 Rebecca Road in 1998, a dilapidated run down rental property, for the purpose of rehabilitating and offering for sale to a lower income family. On February 24, 2000, the Agency authorized a resales price of$115,000 based on appraised value and offered a silent second trust deed of up to $22,000 to a qualified lower income buyer, thereby making the home affordable to a family of below 70% of the County median income. In exchange for the second trust deed, the buyer will execute a 30 year affordability covenant against the property in favor of the Agency. A family of five with an income at 62% of the County median has been identified and qualified. The family will require the full $22,000 second trust deed in order to purchase the home. Staff recommends approval of the sale and authorization of the S22,000 second trust deed, and authorize the Executive Director to execute all necessary documents on the subject sale. Funds are available in the Housing Set-aside Fund balance for second trust deed on both sales. The property was in a blighted condition at time of purchase and the Palm Desert Redevelopment Agency completed a total rehabilitation and made the unit available for sale to lower income families. Background: r__ Under certain conditions, when a public agency undertakes a project that results in the displacement of people from their homes, they are required to provide the displaced persons with specific benefits. These benefits include advisory assistance, reimbursement of moving costs, help finding a replacement home, and payment of specific amounts associated with buying a comparable replacement home. The Housing Commission was established by City of Palm Desert Resolution 99-105 as the body to review all staff recommendations regarding the denial or refusal to consider claims for relocation benefits. The staff denial of a claim for relocation benefits made by Mr. and Mrs. Duane Strohl is hereby brought forward to the Housing Commission for review. The City of Palm Desert proposes to widen Fred Waring Drive as part of a valley-wide program to provide a six-lane arterial corridor for east-west traffic. The City has commenced environmental studies and conceptual design of the proposed widening between San Pascual Avenue and Deep Canyon Road, and anticipates that property acquisition will he necessary in this area to provide sufficient right-of-way to widen the road. In an effort to accommodate those property owners who want to move now, without waiting for the outcome of the feasibility and environmental studies, the City Council authorized staff to make offers to purchase all property on the north side of Fred Waring between San Pascual and Deep Canyon. They further authorized staff to provide full relocation benefits to families who choose to move at this time, in advance of the City's commitment to the proposed project. In April 2000, the owner-occupants of the subject homes were notified in writing of the relocation benefits to which they are entitled. The monetary benefits varied according to the particular situation of each family; they were calculated separately for each home. The largest portion of the monetary benefits is comprised of a Purchase Price Differential. which is intended to compensate for the fact that comparable replacement homes that are currently on the market cost more than the homes that the City is buying on Fred Waring. The amount of the Purchase Price Differential was derived from a housing survey performed in March 2000. Specialty relocation consultants determined the cost of purchasing a ,taw house of similar size, with the same number of bedrooms, and with comparable amenities(such as pools) by reviewing all homes on the market in Palm Desert and selecting those most similar. Because the housing market is so active, the housing survey was updated in late June, and the results of that survey were used to update the Purchase Price Differential component of the relocation benefits entitlement. Mr. and Mrs. Duane Strohl own a 1,432 square foot three-bedroom two-bath home built in 1962. It has a one-car carport and a pool and spa that were added in 1996. The home is located at 74-296 Fred Waring Drive; photographs will be made available at the Housing Commission meeting. Mason & Mason Real Estate Appraisers opined that the fair market value for this property as of 1 February 2000 was $125,000. Overland Resources, the City's relocation consultant, prepared a housing survey in March 2000 that identified comparable replacement housing that was available on the open market. They determined that 1,300 to 1,500 square foot houses in average condition with three bedrooms and two baths were available for $160,000 to $170,000 in Palm Desert. Because of their pool and spa, the consultants recommended that the Strohl's be entitled to $170,000 for purchase of a replacement home. When the housing survey was updated to reflect changes in market conditions, the entitlement was changed to $175,000. The $175,000 entitlement was based upon the listing prices of three houses on the market at that time that were judged to be comparable replacement homes. This home is in the same neighborhood as the Strohl's home on Fred Waring Drive and has both a pool and spa. It is slightly larger, 25 years newer, and has a block wall around the yard. Photographs of the properties judged to be comparable replacement homes will be made available at the Housing Commission meeting. Mr. and Mrs. Strohl have selected a new home to replace their existing home. The home they have chosen is located at 74-555 Coral Bells Court; the purchase price is $211,000. The Strohls acknowledge that the home that they have chosen is superior to their home on Fred Waring Drive, and they have agreed to pay the difference between the $175,000 entitlement and the $211,000 purchase price in order to upgrade their standard of living. However,the new home has no pool or spa, and they have requested that the City pay for the installation of these amenities. The cost would likely be $17,000 to $20,000. In stating their case for this request, the Strohls assert that: 1) the entitlement offered by the City was insufficient to provide a suitable replacement home that meets their particular needs; 2) that the City is forcing them out of their home; and 3)that they decided to construct a pool and spa at their existing home four years ago based upon assurances that the City would not widen Fred Waring Drive before the year 2004. Had they known that they would only get four years of use of their pool,they would not have taken out an equity loan for the home improvements they made. In response to the third argument, staff acknowledges that the City Council, by minute motion on 14 October 1993, guaranteed to the residents of Fred Waring Drive that the road would not be widened for ten years. Unfortunately, traffic volumes have increased much faster than was projected at that time, and the City is contemplating widening the street in 2001, two years sooner than was anticipated in 1993. However, staff responds to the Strohl's first two arguments by stating that the $175,000 entitlement was adequate to purchase a comparable replacement home inclusive of pool and spa, and that all property acquisitions and relocations are purely voluntary. All acquisitions made now are to accommodate the wishes of those homeowners who want to sell at this early date. Staff recommends that the value for the Strohl's replacement home be capped at $175,000, and that their request for construction of a pool and spa be denied. The entitlement amount is adequate to purchase a comparable home in Palm Desert. By approving this entitlement, the City is in keeping with both the letter and the spirit of the relocation law. The decision of Mr. and Mrs. Strohl to upgrade their lifestyle by purchasing a $211,000 home (or $231,000 with a pool and spa) is a personal one, and should not be financed by the City's taxpayers.
