MINUTES It was moved by L. Sullivan and seconded by L. Saindon to approve the minutes of October 11, 2000. Motion carried to approve the minutes. INFORMATIONAL A. RPM WEEKLY STATUS REPORT ITEMS Terry Parker discussed the RPM Weekly Status Report with the Commission. B. REPORT #1 - MONTHLY OCCUPANCY AND AVERAGE RENT STATEMENT (OCTOBER REPORT) Terry Parker summarized Report#1. INFORMATIONAL C. REPORT #2 - MONTHLY NET OPERATING INCOME ITEMS (CONTD) STATEMENT (SEPTEMBER) Terry Parker discussed the Monthly Net Operating Income Statement for September. 1 Minutes Nov. 8, 2000 NOV SING COMMISSION INFORMATIONAL D. HOUSING AUTHORITY PROPERTIES NEWSLETTER ITEMS (CONTD) (NOVEMBER 2000) Terry Parker provided the commission with copies of the newsletter. Terry said that she has received a great deal of positive response from the tenants with regard to the newsletter. E. HOUSING AUTHORITY PROPERTIES - FOLLOW-UP ITEMS Terry Parker said that the gas bar-b-ques at the properties were converted from gas to charcoal. At the last meeting, a dumpster for hot coals was recommended and RPM is still looking at pricing, however, there doesn't seem to be any problems with any back ups. A table was installed and someone stole the table. RPM is in the process of receiving bids for the clean up crews and the power washing of the buildings and all the roofs have been cleaned up. It is expected that the resurfacing of the pools will take 6-8 weeks. F. LAND MAPS (CHARLENE) Charlene presented land maps. She said that the maps were prepared by the City's Geographic Information Systems (GIS) person, Bob Riches. The maps are utilized identify and plan property acquisitions and project expansions for creation of housing necessary to comply with the required housing production. NEW BUSINESS A. ACCEPTANCE OF LETTER OF RESIGNATION SUBMITTED BY JIM THORNESS Rec: By Minute Motion: Forward to the Housing Authority recommendation of acceptance of letter of resignation submitted by Jim Thorness. Action: It was moved by R. Dash and seconded by L. Saindon to forward acceptance of letter of resignation submitted by Jim Thorness. Motion carried. sow Minutes Nov. 8, 2000 NOW SING COMMISSION NEW BUSINESS Carrie McLeod asked about the existing vacancies on the Housing (CONTD) Commission. Terre said that the city is accepting applications for Housing Commission Members an opening exists for a member from the properties. Council woman Jean Benson presented an award of appreciation of service to Mr. Thorness for serving on the Housing Commission. B. SILENT SECOND AFFORDABLE PROGRAM Carrie McLeod said that she wanted to share information she received from Mr. Ken Feenstra from the City of Indio regarding a Silent Second Affordable Housing Program for properties that do not have to be City- owned properties. Terre advised that she had spoken to Mr. Feenstra and had an opportunity to review this program. She concluded that the program could not be implemented in Palm Desert because it targets incomes at the 115% and above the County median and this Agency's target %kw group is those families with income below 80% of the County median. The City of Palm Desert does not receive credit against our Stipulation for providing housing to moderate income households. Therefore, at this time, the program would not be suited for the City of Palm Desert. Staff will investigate the possibility of creating a similar program within the City at a future date. C. ONE QUAIL LANDSCAPING REDESIGN Rec: By Minute Motion: Review and forward recommendation to Housing Authority to approve request to re-bid One Quail Landscaping Redesign Action: It was moved by L. Sullivan and seconded by L. Saindon to forward recommendation to Housing Authority to approve request to reject the bid received and Authorize the City Clerk to re-bid One Quail Landscaping Redesign. Motion carried. 4410. Minutes Nov. 8, 2000 EEOTISING COMMISSION NEW BUSINESS Charlene introduced Jim Shorpe,a representative from Ron Gregory and (CONTD) Associates who presented the preliminary design for the retrofit of landscaping for Catalina Gardens. The design was discussed and the Commission requested that the design be re-drafted and presented at the next Housing Commission meeting of December 13, 2000. D. PORTOLA PALMS MOBILE HOME PARK Rec: By Minute Motion: Forward recommendation to Redevelopment Agency to approve the increase of purchase price for Portola Palms Mobile Home park Agency-owned lots. Action: It was moved by L. Sullivan and seconded by L. Saindon to leave the current purchase price for Portola Palms Mobile Home park Agency-owned lots as is. Motion carried. E. RPM CONTRACT (CONTINUED) Rec: By Minute Motion: Review and forward recommendation to Housing Authority to approve contract with RPM Company to provide property management to the seven Housing Authority properties. Action: Continued to Housing Commission meeting of January 10, 2000. CONTINUED BUSINESS A. 40 ACRE SITE DEVELOPMENT - UPDATE The Developer and Terre have met with the Portola Palms Country Club Homeowners Association to discuss the project. At the meeting, the requirements for the mandate and the type of buyer/tenant who will occupy the project. Legal Counsel is preparing the Development and Disposition Agreement. 4 Minutes Nov. 8, 2000 HausENG COMMISSION REPORTS A. PALM VILLAGE APARTMENTS UPDATE (TERRE) Terre said that the Redevelopment Agency made an offer to purchase to the owner of the adjacent property. The owner has declined the offer and has indicated that he would like to develop the site by combining his property with the Agency site. He will be presenting a proposal to staff to develop the property in the near future. DEMOLITION (BRYCE) Bryce said that Council will be reviewing the request to go out for bid for the demolition of Palm Village Apartments will be presented to the Council on December 14, 2000. Award of the bid will be requested at the first Council meeting in January. B. HOME IMPROVEMENT PROGRAM UPDATE (BRYCE) When the guidelines were expanded, a $25,000 maximum loan with a 30-year deferred loan element added to it was included. At this time there are 4 households who qualify for this type of loan and these households can be counted towards our Stipulation. At this time,there are 14 loan applications being processed. The deferred loan is set up that if the owner sells, at that point the 3% along with the principal is returned to the Agency. The money helps with the mitigation measures and it takes care of what needs to be done by the program. Bryce said that he will be presenting the inclusion of duplexes to the Housing Commission at a future meeting for discussion and recommendation. MAKE A DIFFERENCE DAY EVENT (OCTOBER 28, 2000) - UPDATE Because Habitat for Humanity requested that the Make a Difference Day which was scheduled for October 28 be re-scheduled for the first part of December, Jim Battin's office was unable to coordinate the project. However, Habitat will be moving forward with the construction a single-family home on Catalina Way. Date of the Make A Difference Day will be announced at a later date. ONE QUAIL PLACE - REPAIR AND RESURFACING OF PARKING LOTS - UPDATE (CHARLENE) Charlene said that the project is on scheduled and that on the 24th of December the three engineering drawings will be completed for Taos Palms, Las Serenas and One Quail Place. She expects to have the bid package complete by the next meeting at which time she will be asking the Commission for authorization to go out to bid. - PALM DESERT HOUSING AUTHORITY PROPERTIES AFFORDABLE PROGRAM (TERRY PARKER) Terry Parker said that she added the 2002 and 2006 stipulated goals to show what the variances are and where the Authority needs to be in relation to the ,a, stipulation. C. McLeod asked if the information presented should be forwarded to the Council for their information. Terre said that she would share it with Carlos Ortega to see if he would like the information forwarded. - REVISING OF SITES - DISCUSSION (TERRE) A brief discussion was held. Terre said that Councilman Spiegel requested that the sites be revisited. Terre said that the sites will be revisited after the first o f the year. - LETTER RECEIVED FROM CATALINA GARDENS RESIDENT A copy of the letter received was distributed to the Housing Commission. r.. One bid was received from All Cities Enterprises in the amount of$1,294,053.00.References were checked by staff. It appears that the sub-contractor listed CLS Landscaping has not performed work of this magnitude. The highest dollar amount received for work performed by CLS is$300,000.00. All Cities Enterprises, the General Contractor, has experience in performing large jobs with only a minimal amount of Landscape experience, if any. References were checked and it seems that most of their work has been installing fencing around prisons and Air Force bases. I would like to recommend that this project be presented to council with a request to re-bid the project. REPAIR AND RESURFACING Contract was awarded to JMS Engineering. They are currently working on plans and specifications. Completion due date is November 24,2000. The project remains on schedule and will go out to bid on or around December 15, 2000. Background: The City of Palm Desert proposes to widen Fred Waring Drive as part of a valley-wide program to provide a six-lane arterial corridor for east-west traffic. The City has completed environmental studies and conceptual design of the proposed widening between San Pascual Avenue and Deep Canyon Road, and anticipates that property acquisition will be necessary in this area to provide sufficient right-of-way to widen the road. The City Council has authorized staff to make offers to purchase all property on the north side of Fred Waring between San Pascual and Deep Canyon Road. They further authorized staff to provide full relocation benefits to impacted families at this time. When a public agency undertakes a project such as the widening of Fred Waring Drive that results in the displacement of people from their homes, they are required to provide the displaced persons with specific benefits. These benefits include advisory assistance, reimbursement of moving costs, help finding a replacement home, and payment of specific amounts associated with buying a comparable replacement home. Palm Desert Resolution 99-105 established the Housing Commission as the body to review all staff recommendations regarding relocation benefits. A claim for additional relocation benefits made by Mr. and Mrs. Alberto Loza is hereby brought forward to the Housing Commission for review. In April 2000, the owner-occupants of the subject homes were notified in writing of the relocation benefits to which they are entitled. The monetary benefits varied according to the particular situation of each family; they were calculated separately for each home. The largest portion of the monetary benefits is comprised of a Purchase Price Differential, which is intended to compensate for the fact that comparable replacement homes that are currently on the market cost more than the homes that the City is buying on Fred Waring. The amount of the Purchase Price Differential was derived from a housing survey performed in March 2000. Overland Resources, the City's relocation consultants, determined the cost of purchasing a house of similar size, with the same number of bedrooms, and with comparable amenities (such as pools) by reviewing all homes on the market in Palm Desert and selecting those most similar. Because the housing market is so active, the housing survey was updated in late June, and the results of that survey were used to update the Purchase Price Differential component of the relocation benefits entitlement. Mr. and Mrs. Loza own a 1,865 square foot four-bedroom three-bathroom home built in 1959. It has a two-car carport and a swimming pool. The home is located at 74-038 Fred Waring Drive; photographs will be made available at the Housing Commission meeting. Mason & Mason Real Estate Appraisers opined that the fair market value for this property as of 1 February 2000 was $118,000. (That appraisal is currently being updated to reflect present market conditions.) The Loza's home is atypical of others in the area because a former garage has been converted into a separate living space, including a bedroom, bathroom, and kitchen area. Overland Resources, the City's relocation consultant, prepared a housing survey in March 2000 that identified comparable replacement housing that was available on the open market. They determined that 1,800 to 2,500 square foot houses in average condition with four bedrooms were available for $170,000 to $175,000 in Palm Desert. Because of their pool and the configuration of separate guest space, the consultants recommended that the Lozas be entitled to $175,000 for purchase of a replacement home. When the housing survey was updated to reflect changes in market conditions, the entitlement was changed to $185,000. The $185,000 entitlement was based upon the listing prices of three houses on the market at that time that were judged to be comparable replacement homes. Mr. and Mrs. Loza report that they have been unable to find a comparable replacement home for the $185,000 that is satisfactory to them. Although they have not found a home that they believe is acceptable, they have requested that their entitlement for a replacement home be increased to $210,000. They believe that this amount will be sufficient for the purchase of an existing home, or for the construction of a new replacement home. Relocation law requires that a "comparable replacement home" be, to the greatest extent possible, "functionally equivalent and substantially the same" as the home that the City purchases. In the case of the Lozas, finding comparable replacement homes is complicated because there are so few homes that function the same as their home with the garage converted to separate living quarters. The most recent search for comparable replacement homes was performed in June, and none of the homes found are still available. Consequently, Overland Resources has initiated another survey of the market to identify the most comparable homes currently available. The value of these homes will be used to establish a recommended entitlement amount. That recommendation will be presented at the 8 November 2000 meeting of the Housing Commission.
