Attached are my comments on the draft ordinance. These comments are my personal perspective, but I am confident that they also reflect the perspective of many other locally- based, responsible property managers. I am pleased that the draft ordinance has an aggressive schedule of fines for violators. I am also pleased that repeated violations can result in the termination of permits. However, none of this matters unless the City is prepared to vigorously enforce the ordinance. The need for vigorous enforcement is one issue on which all parties agreed during the past seven months of committee meetings. I suggest that a portion of City revenue generated by short term rentals be devoted exclusively to the enforcement of the new ordinance. The revenues should include T.O.T., registration fees and revenue from penalties. The number of Code Enforcement Officers should be increased (or cross-trained) and round-the-clock shifts should be instituted for selected portions of the year. I appreciate you getting back to me so quickly. My wife and I are retired and live in San Diego to be near our children and grandchildren. We have a second home in Palm Desert which we use periodically to visit our friends and family, and to enjoy everything that Palm Desert and other desert communities have to offer. We live on a fixed income which is very limited, and the only way we can afford to keep our house in Palm Desert is to rent it out on a short-term basis (permit number 48938) when we are not using it ourselves. As we understand it, the committee is considering increasing the current two-night minimum stay to three nights or more. This possible change concerns us,because many of our guests are families who live elsewhere in Southern California who stay at our house just to get out of town for a weekend.. We have never had a problem with guests staying for only two nights. We worry that increasing the two night minimum on a year- round basis will simply drive visitors who want a "weekend getaway" to stay in adjoining desert cities that don't have minimum requirements of three nights (or more). Not only would this redirect TOT payments to other cities, it would impact us personally. Income associated with two night stays represent a significant portion of our annual revenue, and it is clear to us that increasing the minimum stay above the current requirement of two nights would severely impact our bottom line, possibly forcing us to sell the house. If the committee deems it necessary to increase the minimum stay above two nights, we ask that you limit it only to selected time periods and not make it a year-round requirement. Enjoying our second home and spending time in the desert is an integral part of our "Golden Years" retirement plan. Please don't take this away. I've been trying to think about realistic resolutions after the meeting and what I've come to determine is that this is more of a BASIC RIGHTS issue not an STIR issue.... WHY would the occupancy status of an offender have any relevance on the punishment or enforcement or make a difference on what rights the victim has? A violation is a violation, noise is noise, cars are cars. To say one victim has more rights than another based on who is offending them is unfair. To say an offense is worse because who is committing it is discriminatory. In fact, the law usually allows a level of"ignorance" for people not familiar with the law (i.e. long term renters get this allowance all the time vs. the landlord who are expected to know better). If anyone should be treated harsher, it would be a full-time resident who should be expected to know the rules....but in STR's it's the other way around because the law is shaped by a few loud voices and politics. Victims should have the same rights no matter who the offender is and the offense should have the same consequences no matter who the offender is. Please bring this up at the internal meeting! Increase Short-Term Rentals by 10%? Expect a 10% increase in noise, trash, and complaints. ■ More people in the rental means more noise. In my neighborhood an adjoining rental property sleeps 14. There are a total of 46 renters in four rental properties within 240 ft. More rentals means more homes with rentals nearby. ■ If a property is rented, say, twice a week, that's 100 or more different rental occupants per year. If only 5% of the renters create excessive noise or other problems that's twenty times per year, or several times per month that the neighbors will be disturbed. ■ One house rented out by an owner is a rental. Two or more houses rented by an owner is a business enterprise. In a residential neighborhood. ■ One problem neighbors with noisy renters face is "when do I call? Do I call now, in the middle of the afternoon, or hope that it goes away? Do I wait until the music is still blaring at 8pm? If I do, then most likely law enforcement will come out."This means I will probably sit on my patio or front steps waiting for the officer, and if the the noise stops before the officer arrives, I am left feeling guilty and with egg on my face. ■ When do you call? That's maybe the biggest problem facing the complainer. Most of us don't like conflict, and just wish the disturbance would go away. ■ Many renters may not be aware of PD's rather strict noise/disturbance ordinance. It would be helpful if all renters could get a copy of the ordinance before or when they arrive. Likewise the OWNERs should get a copy. ■ Basically, all of us who live full- or part-time in the desert want a peaceful and quiet neighborhood, with little noise and trash strewn around. Every new rental is another source of noise or other disturbance. ■ Council, please look to Palm Springs to see where this could go. The owners with rental properties will show up at meetings and testify that their livelihood is being usurped. The fact is, rental properties in residential neighborhoods are BUSINESSES in those neighborhoods. From early in the morning to late at night...loud music, screaming... the more the drink the louder the scream. Even with our windows closed we cannot escape the noise. My husband and I are 73 Years old, not in the best of health. The aforementioned situation has affected my health severely. We cannot afford to move. Please help US. The Committee is comprised of firms which rigorously abide by the ordinances and regulations which pertain to vacation rentals in the City of Palm Desert. Many of us were actively engaged with city staff in shaping those regulations. Collectively, we pay a significant amount of Transient Occupancy Tax. We are requesting that the moratorium on the issuance of new rental permits be lifted immediately. It is having a severe adverse effect on our businesses. Moreover, the effect of the moratorium is to motivate property owners to operate "under the radar", depriving the city of regulatory access and the T.O.T. associated with below-radar occupancies. We are open to a constructive dialogue on refinements to existing ordinances and regulations. While that dialogue continues, the current regulations provide powerful tools to deal with any problems which might arise. We endorse vigorous enforcement of current regulations while refinements are discussed. An arbitrary moratorium, however, is damaging and counter- productive. Our experience with vacation rentals has not been a good one, unfortunately. The problems began a little over a year ago when the property directly next to ours (in South Palm Desert) was sold to a developer from Seattle who purchased the property with the specific intention of renting it out. The property is a big one - 5 bedrooms- so that anytime it is rented out it is always to a large group. Visitors to our desert come here largely to be outside, in the sunshine and by the pool. With groups this large there is almost always a noise problem, even when music and drinking are not necessarily involved. This is particularly frustrating because nothing "wrong" is being done; there is no code violation and as such nothing for us to do other than to have to endure it. It is i !, a almost humiliating to be forced inside ourselves time and again just so an out-of-town investor can profit,just as it is taxing to constantly speculate whether our neighbor will have guests again today, tomorrow or next week. This is certainty not what we moved to Palm Desert for. What is scary to us is that our current frustration concerns but a single neighbor. There are two additional houses bordering us that, in my estimation, would be prime candidates as vacation rentals. If these residences were also converted into de facto motels, I seriously suspect we would move, in effect being driven out of our house of 16 years. As I had mentioned previously, we are very encouraged to see that these concerns have reached the Council and that you are taking them seriously. We have thought a lot about what type of vacation rental policy I would like to see in place. The ideal option for us, perhaps unsurprisingly, would be an outright ban. That said I suspect the Council is more interested in finding a workable compromise, so I thought I would offer some ideas: • no more than one vacation rental per owner, • a minimum lease of 7 days, as this would prioritize guests who are vacationers as opposed to partiers, OR • a maximum number of rental contracts in a given month(for instance two). I know Palm Springs has recently sought to introduce a maximum number of contracts in a given year, but I am not sure if this would be as effective in Palm Desert as I suspect homes in general are rented out here much much less in the summertime, so that a yearly cap would only incentivize operators to load up during winter months, • higher registration fees and penalties for violators,both to incentivize good behavior and to fund dedicated enforcement. The calls vary from operational violations, administrative violations, to actual noise disturbances. • Operational violations: consist of cars parked in street, exceeding the maximum number of guests, trash sitting at curb side, no response from the designated contact person. • Administrative violations: consist of failure to submit and pay TOT, improper advertising on websites, operating without a STR permit. • Noise disturbances: consist of loud music, screaming and yelling, people talking loud in the early hours of the morning, splashing and screaming in the pool.... The noise portion of these complaints peak during the weekends of the Coachella festivals. Out of the 79 complaints, less than 10 are for real noise issues that actually do cause a disturbance of the peace. People talking or slashing in the pools are not severe noise disturbance issues that escalate such as the loud music and unruly parties. After driving through various areas of Palm Desert, we selected our home on Pinyon Street in 1995. We chose this location for the following reasons: • low density and large lots zoned R1 • low crime neighborhood • walkability and convenience to shopping, dining, banking, etc. • quiet, peaceful, established neighborhood with older families • rural environment within a city (no sidewalks or street lights) We are year-round residents and appreciate the times during the year when only a few cars travel on our streets due to many second homes in the area. We value our privacy and peace and quiet in the early mornings and evenings. We also know our neighbors and watch out for each other and our homes. In fact I requested and secured a Neighborhood Watch sign posted on our block after our home was burglarized in 2013 by suspects possibly living in one of two drug rental units on San Luis Rey. Unfortunately no one witnessed the burglary and due to a breakdown in department communications, no follow up was made by the Burglary Suppression Unit, and none of our personal and heirloom property was ever recovered. That being said, if we wanted to live in a "hotel-style" neighborhood where visitors book in for only two nights, we would have purchased inside Shadow Mountain Resort or another community in the Valley. But we didn't purchase there. We purchased in an area of Palm Desert where the last thing we expected our elected officials to do was to allow homeowners to rent out rooms to multiple families thus creating a zoning of R-2 or R-3. We have already witnessed multiple families renting these homes. Within a six-block area of our home, there are at least 15 short-term rentals including one directly behind us on Juniper and another across the street from us on Pinyon - both owned by the same homeowner. We have met both the homeowner and property manager and advised them that we enjoy our quiet and peaceful neighborhood and expect the same of their tenants. Our block of Pinyon consists of 10 homes, three of which are short-term rentals - 30%! The block behind us on Juniper also has 30% rentals within 10 homes. We can hear the tennis party shouting from the home on the next corner at Juniper and Burrowweed! Once again, by approving these permits, you are changing the scope and density of Cliff Henderson's Palm Desert. You are also changing zoning from R1-20000 to include a mobile or manufactured home in the rear of the yard at 73605 Juniper, thereby creating R-2 within R-1 zoning or changing it to R1-M zoning. We realize a home can sell to a large, noisy family and we are without recourse. However, we like to know who lives around us. We have known all our neighbors over the past 22 years. We only had one neighbor at 73637 Pinyon who bought the home and ran drugs and prostitution from it. The Sheriff's department "lived" on our street for months till we got him out in 2014. As you see we have reason to distrust renters, and even some homeowners if we see strange and illicit movement occurring on the property. Even if individuals are well- screened and appear fine on the application, they may want to scope out the area. They are only paying $800 to $1,000 for two nights, a small amount considering the information they can gather. Coachella and Stagecoach festivals attract younger renters and some unwanted elements into our neighborhoods. Our personal recommendations for the City are: • Increase the minimum number of nights to at least seven. (We would prefer monthly rentals, but then the City would lose out on the TOT income, and no public official would support that issue.) • Limit the number of permits an individual is allowed • Limit the number of permits per block so as not to destroy the character of our neighborhood. If the City of Palm Desert continues to maintain a two-night minimum rental for multiple families/individuals in a single home, we would like the City to consider a zoning change so we may operate a hotel on our property or start a mobile home community, now that our neighbor has moved one on his property. Palm Desert needs to remember who is here year-round and supports local businesses year-round and contributes to the local tax base. These residents chose their homes for comfort, convenience and peaceful living and should be considered when discussing the Short-Term Rental issues. As discussed more fully below, the City Council will be considering terminating many STR permits in the PR zones unless allowed by the homeowners' association (HOA), including potentially yours. At its meeting of September 10, 2020, the City Council adopted Ordinance No. 1357, which established a temporary moratorium on issuing new STR permits within all PR zoning districts unless approved by the governing HOA. Below are the areas under examination. • Shepherd Lane: The neighborhood is mostly off of Shepherd Lane, north of Frank Sinatra Drive, west of Portola Avenue, and south of Gerald Ford Drive. • Hovley Lane West: This neighborhood is east of Monterey Avenue and west of Portola Avenue. • The Grove: This neighborhood is west of Deep Canyon Road, south of Fred Waring Drive, and north of Highway 111. • North Deep Canyon (Lavender Way, Columbine Drive, Coral Bells Circle, Strawflower Circle, Daylily Circle, Waterlily Circle, Amaryllis Way, and Moss Rose Drive): This neighborhood is east of Deep Canyon Road, west of Palm Desert High School, north of Fred Waring Drive, and south of the Whitewater Storm Channel. • Any other PR zones that do not have HOA approval. Several neighborhoods that have a PR zoning function almost identically as the R1 or R2 single- family zoning districts where STRs are prohibited. Areas such as the Hovley Lane West, Shepherd Lane, and ungated developments along Deep Canyon Road are good examples. Staff noted that there have been significant complaints from residents within those areas that have expressed major concerns regarding STRs (noise, parking, etc.) and want to see them removed. The proposed 2020 schedule for City Council consideration is: • October 29: City Council meeting to present the STR subcommittee recommendation and first reading of proposed Ordinance to implement the amendments • November 19: Second Reading of Ordinance (if approved) • December 20: Ordinance Effective The public hearing will be held before the City Council on October 29, 2020, at 4:00 p.m. via Zoom. The hearing will be conducted in accordance with the City's emergency protocols for social distancing. Since all Councilmembers should have access to the same information when deliberating a matter, I am providing the requested information in the form of this memorandum to all five Councilmembers. The staff report for Short Term Rentals (STRs) is already final and is now being distributed with the agenda packets. Among other things, it requests authorization to create a new position and to hire one additional full-time person for STR enforcement. It contains the cost of the added position (roughly $100,000/year, including benefits), and explains why staff is not asking for authorization to add more full-time employees. In greater detail, that reasoning is as follows. The need for field enforcement is primarily on Friday and Saturday nights in season. Hiring more full-time staff members would only provide a few more bodies during these critical times, and would simultaneously encumber the City with the personnel costs on a year-round basis -- even on weeknights in summer when STIR activity is de minimis. While we could arguably find something else for the added personnel to do during the rest of the week and in low season, it's not a cost-effective way of addressing the problem. Palm Desert strives to hire full-time, professional personnel for needs that are specialized, while contracting out for needs that fluctuate over time, or that can be filled more cost-effectively by the private sector. Therefore, staff is recommending, instead, that the City use vendors for the enforcement work in the field. Just for argument's sake, hiring four Code Compliance Officers would cost about $400,000/year. (This amount varies depending on the length of tenure and the hire date, since there are eight pay steps, and the benefits for existing employees are more costly than the benefits for new employees.) For that same amount, a vendor could furnish seven licensed security guards working evenings, Thursday through Sunday, year round or, better yet, ten security guards for September through the end of May. Either way, it amounts to far greater coverage, and increased flexibility over time, than would be available through the addition of permanent staff. The cost of other enforcement activities, from operating a hotline to canvassing the Internet for unlicensed properties, is more difficult to estimate before clear policy direction is established. For example, if the Council doesn't want any restrictions on density, there will be a much greater need for hotline operations and enforcement in the field, but not much for Internet sleuthing to find unlicensed properties. Conversely, if the Council were to prohibit STR's in single-family residential zones, there would be a greater need for Internet investigation to find those STR's that are driven underground.) Finally, the staff report asks that the City Council give direction to perform a cost impact study so that the City Council can establish a permit fee to cover the cost of the permitting and monitoring activities. The Council's establishment of policy will allow staff to calculate a reasonable cost estimate for administering the STR program, from which a permitting fee can be derived. The amount of the fee would be brought back before the City Council for consideration and adoption. I hope that this information is helpful to you.
