MINUTES of the Architectural Review Commission meeting of May 24, 2022. Rec: Approve as presented. Upon a motion by Vice Chair Lambell, seconded by Commissioner Latkovic, and a 6-0 vote of the Architectural Review Commission, the minutes for May 24, 2022, were approved as presented. (AYES: Lambell, Latkovic, McAuliffe, McIntosh, Vuksic, and Van Vliet; NOES: None; ABSENT: None). V. A. FINAL DRAWINGS 1. CASE NOS: PP/CUP 20-0003, DDA and TPM 38023 NATURE OF PROJECT/APPROVAL SOUGHT: Notice of Action for May 24, 2022 regarding the Chandi mixed-use project located at 73515 Fred Waring Drive. APPLICANT AND ADDRESS: Chandi Group USA, Indio, CA 92203 LOCATION: 73515 Fred Waring Drive ZONE: DE Planning Manager, Rosie Lua, acknowledged the memo before the Commission and provided an oral report for the informational item. Ms. Lua advised Commissioner’s after the ARC meeting held May 24, 2022, the applicant contacted staff and requested clarification as to the legality of the additional conditions placed on the project by the ARC. The City attorney determined conditions listed in the Notice of Action from the May 24, 2022, ARC meeting are unenforceable conditions and will be modified to reflect as recommendations. Ms. Lua further informed the project was found to be in substantial conformance and will be permitted to proceed with building permits. Discussion ensued with commissioner’s providing comments and concerns regarding the matter. After thorough discussion, Ms. Lua confirmed as requested by the Commission, staff will review conditions applied by the Commission during the May 24, 2022 meeting to verify if they were previously conditioned by the ARC and provide an informational update to commissioners. B. PRELIMINARY PLANS None PRELIMINARY MINUTES ARCHITECTURAL REVIEW COMMISSION JUNE 14, 2022 3 C. MISCELLANEOUS ITEMS 1. CASE NO: MISC 22-0013 NATURE OF PROJECT/APPROVAL SOUGHT: Preliminary review and discussion to provide architectural comments for Mechanics Bank a new 4,000 square-foot commercial building located in the Jensen’s Shopping Center at 73611 Highway 111. APPLICANT AND ADDRESS: McAuliffe & Co. Architects, Palm Desert, CA 92260 LOCATION: 73611 Highway 111 ZONE: DO Commissioner McAuliffe informed the Commission of his need to recuse himself due to a conflict of interest as he will be presenting this item on behalf of his client. Associate Planner, Nick Melloni, presented the item noting it is being brought before the Commission as an informational item and no action is required by the ARC. The presentation was turned over to the applicant, Michael McAuliffe, with McAuliffe & Co. Architects who provided a more detailed presentation on the project and answered questions from the Commission. Discussion on the item ensued with Commissioners providing comments and concerns for the project. Planning Manager, Rosie Lua, invited comments from the public, to which there were none. Comments and concerns provided during the discussion include, but are not limited to: • Applicant should be mindful of placement for tenant entries and all entries should be clearly identified. • Provide further details, including placement and architecture of proposed trash enclosure. • Consider adding additional recess for transition in plane between stone veneer and header over window. (SK 2.0) • Revisit architecture for the corner tower element to ensure compatibility with proposed architecture for remainder of building. • Revisit proposed architecture and massing to evaluate compatibility with existing buildings and pedestrian scale. • Explore roof material options which may be more suitable for the thinner roof style. • Revisit transition between stone veneer element and hipped roof. • Provide more articulation for hipped roof; preferably the roof pitch should be as shallow as allowable. • Revisit material transitions including rake tile that abuts cubed forms. • Provide coping details for cap on parapets. PRELIMINARY MINUTES ARCHITECTURAL REVIEW COMMISSION JUNE 14, 2022 4 No formal action was taken on this item as it was brought forth solely for commissioner’s comments to the applicant. Vice Chair Lambell left the meeting at 1:48 p.m. VI. COMMENTS Commissioner Vuksic provided a brief update on the Cultural Arts Committee. He reported the City is considering the purchase of two sculptures currently located on El Paseo and adding them to the City’s permanent collection. There was also discussion regarding the placement of a mural on the former Fitzhenry-Wiefels Funeral Home location (Southeast corner of San Pablo and San Gorgonio Way). Deputy Director of Development Services, Richard Cannone, provided an oral update on actions taken by Planning Commission and City Council. Mr. Cannone reported Planning Commission approved the Spanish Walk project and City Council approved staff’s request to extend the Dining Deck program through June 30, 2024. VII. ADJOURNMENT With Architectural Review Commission concurrence, Chair Van Vliet adjourned the meeting at 1:54 p.m. Rosie Lua, Secretary Melinda Gonzalez, Recording Secretary CITY OF PALM DESERT DEVELOPMENT SERVICES DEPARTMENT ARCHITECTURAL REVIEW COMMISSION MEMORANDUM To: Honorable Chair and Members of the Commission From: Nick Melloni, Associate Planner Date: June 28, 2022 Case No.: MISC 22-0010 Subject: Consideration of a design review for a façade modification to an existing Del- Taco drive-through restaurant located at 34540 Monterey Avenue. BACKGROUND The project site is an existing Del Taco drive-through restaurant located at 34540 Monterey Avenue. The restaurant is located within the Desert Gateway center, a 70+ acre retail- commercial shopping center located at the southeast corner of Monterey Avenue and Dinah Shore Drive. The architectural character of the Desert Gateway center is based on Santa Barbara Mission Style inspired architecture and subject to signage and design guidelines which regulate exterior building materials, paint color, features, and signage. Project Summary The Applicant, Insignia Rising, is proposing exterior façade modifications to the existing Del Taco including: • Addition of three (3) wall light fixtures on tower elements located on the western, eastern, and southern façades (Reference elevations on Attachment #1). • Paint color change – Repainting the existing building from tan and accent colors to a new palette shown on color board. (Reference Attachment #2). • Removal of existing window awnings, branded art, and exterior red neon tubing. No structural modifications are proposed to the existing building and attached trellises. Exterior signage including wall signs and direction signage are shown on the plan set but are not under the purview of the Architectural Review Commission (ARC). Exterior signage will be subject to staff review for conformance with the Desert Gateway Design and Signage Guidelines. Wall Light Fixtures The three wall light fixtures are constructed as illuminated cabinets. Each cabinet is constructed with aluminum structure frames shaped to match the façade element where they are placed and are internally illuminated by 6500K white LED modules. The cabinets project MISC 22-0010 – Del Taco Page 2 of 4 June 28, 2022 0’-5” from the face of the building fascia. The face of the cabinets feature vertical aluminum slats spaced with translucent white vinyl to create a stripe pattern. Building signage will be mounted upon each cabinet. Paint Colors The paint color modifications will replace the existing color scheme with a combination of three colors including: • SW #0077 – French Gray – Wainscotting • BM #2154-70 – Vanilla Ice Cream – Primary building color and cornice • BM #118 – Sherwood Green – Building trim and painted band A darker grey/taupe color is proposed on a portion of the southern and eastern elevations. ANALYSIS Development Standards The project is subject to the development standards set forth by the Palm Desert Municipal Code (PDMC) for the Regional Planned Commercial (PC-3) zone. No changes are proposed to the site plan, landscape plan, or existing parking facilities. That the proposed development conforms to any legally adopted development standards. The proposed project is in conformance with the legally adopted development standards set forth by the PDMC for the Regional Planned Commercial zoning district. A summary of the conformance with these development standards are analyzed above. As no structural modifications are proposed, the structure is deemed conforming. As summarized, the project conforms with all applicable standards of the code. MISC 22-0010 – Del Taco Page 3 of 4 June 28, 2022 B. That the design and location of the proposed development and its relationship to neighboring existing or proposed developments and traffic is such that it will not impair the desirability of investment or occupation in the neighborhood; and that it will not unreasonably interfere with the use and enjoyment of neighboring existing or proposed developments and that it will not create traffic hazards or congestion. The building is located within the Desert Gateway commercial center and subject to requirements of the Desert Gateway Design and Signage Guidelines. The proposed exterior paint colors maintain compatibility with the approved paint color palette for the center by utilizing a neutral (light-tan) building color and compatible accent colors. Colors which are not specifically listed in the design guidelines, such as the proposed grey on the wainscoting and southern and eastern facades is used in a limited amount to maintain compatibility with the overall exterior. The exterior light fixtures are not found within the existing context of the center and serve as exterior decorative lighting. If conditioned appropriately to limit glare and lumen output, the design may not affect the desirability of the center. The modifications to the existing development are aesthetic in nature and do not expand the existing use and are therefore not expected to generate traffic hazards or congestion. C. That the design and location of the proposed development is in keeping with the character of the surrounding neighborhood and is not detrimental to the harmonious, orderly, and attractive development contemplated by this title and the General Plan of the City. The proposed exterior color changes utilize a palette which is consistent with the approved design guidelines for the Desert Gateway center and is therefore in keeping with the character of the surrounding commercial buildings within the center. The exterior lighting fixtures are a unique feature within the context of the existing center. Illuminated cabinets, which are used as building façade elements are not found within existing architecture located in the center and are not typically used in Santa Barbara Mission Style Architecture. The fixtures are not typical of lighting generally used with the architectural style in terms of scale, style, and character. Existing fixtures in the center typically use decorative wall scones styled to match mission style architecture. This element is not in character with the center and staff cannot make an affirmative finding. D. That the design and location of the proposed development would provide a desirable environment for its occupants, as well as for its neighbors, and that it is aesthetically of good composition, materials, textures, and colors. The proposed façade modification utilizes colors which are compatible with the existing center. The use of exterior light fixture cabinets are a departure from the Mission Style inspired architecture of the existing building and throughout the center. The cabinets are formed to match architectural forms of the roofline of the tower elements on the building. MISC 22-0010 – Del Taco Page 4 of 4 June 28, 2022 E. That the proposed use conforms to all the requirements of the zone in which it is located and all other applicable requirements. The proposed project conforms with legally adopted development standards set forth by the Regional Planned Commercial District. A summary of the conformance with these development standards are included above. F. That the overall development of the land shall be designed to ensure the protection of public health, safety, and general welfare. The proposed project did not modify the originally designed site plan, which included hard surface pedestrian pathways and connections from the public right-of-way. In addition, the overall building design does not present any adverse impacts to the protection of public health, safety, and general welfare. Staff Recommendation Staff finds that the exterior color scheme modifications comply with the design guidelines of the center. Staff recommends approval of the paint color with the following condition of approval: 1. The “painted banding” shown on the southern and eastern elevations shall be removed or redesigned to ensure that building color change occurs at changes in building plane, massing, and/or decorative elements. Any change in building plan, massing and/or decorative elements shall substantially match the existing building. 2. Limiting the lumen output of the exterior wall cabinets to be less than four thousand total lumens, or an amount deemed appropriate to prevent undue night-time glare from surrounding public areas including adjacent private parking lots and Monterey Avenue in accordance with Chapter 24.16 of the Palm Desert Municipal Code. 3. Require the sign be subject to a 30-day review period after installation to determine if a reduction in illumination is necessary due to adverse glare impacts caused by the sign on surrounding areas. Alternatively, the ARC may deny the lighting elements based on the findings that the exterior light cabinets are not in character with the existing architecture of the building and surrounding area and do not comply with applicable design guidelines for the center. Desert Gateway – Design and Signage Guidelines CITY OF PALM DESERT DEVELOPMENT SERVICES DEPARTMENT ARCHITECTURAL REVIEW COMMISSION MEMORANDUM To: Honorable Chair and Members of the Commission From: Nick Melloni, Associate Planner Date: June 28, 2022 Case No.: MISC 22-0015 Subject: Consideration of a design review for a building height and side yard exception for a new single-family residence located at 73130 Crosby Lane. Background The project site is Lot #2 of Parcel Map 33943, a vacant 20,787-square-foot (0.477 acre) flag lot located at 73130 Crosby Lane within the Ironwood Community of south Palm Desert. The zoning designation of the site is R-1, 20,000. The areas to the north and east are developed with existing single-family residences. In April 2022, the ARC approved a building height exception for a new single-family residence located on Lot #1 of Parcel Map 33943, located directly to the east of the project site. The property is governed by a Homeowner’s Association (HOA) which provides design overview. Project Summary The Applicant, Stracts Inc, is requesting an exception to the maximum allowable building height and side yard for a new single-family residence. The proposed structure is a single- story 5,641-square-foot, single-family residence, including a 537-square-foot attached casita. The total building height is 18’-0” from finished grade to the top of parapet. The proposed side yard setbacks are 12’-0” with a combined total of 24’-0”, or a 20% reduction. Palm Desert Municipal Code (PDMC) Chapter 25.10 establishes a maximum height of 15’-0” for primary residential structures within the R-1, 20,000 zone. Single-family residences within any R-1 zoning designation may be allow a height of up to 18’-0” with approval of an exception by the Architectural Review Commission (ARC). The proposed architecture is contemporary and characterized by multi-level flat roofs, continuous parapet lines, long horizontal forms, wide overhangs at windows, and clerestory windows on the eastern elevation. The exterior material palette consists of light MISC22-0015 – Crosby Lane Single Family Residence Page 2 of 4 June 28, 2022 tan colored stucco and stone veneer. The building pad is an elevation of 599.00’ above mean sea level (AMSL), which is approximately 5’ lower than Lot #1 to the east. The landscape plan features a combination of low and moderate desert-appropriate planting materials. The tree palette consists of Date Palms and Palo Verde tree species. Shrubs and accents plantings include bougainvillea, yucca, desert spoon, bottlebrush, and the tecoma. Landscape plants are concentrated in the front yard and perimeter of the property. The architecture and landscaping have been approved by Ironwood Association IX, the HOA presiding over the property and surrounding area. The ARC may approve the height subject to findings provided under PDMC Section 25.68.040, which are provided below: A. That the proposed development conforms to any legally adopted development standards. The proposed structure conforms with applicable development standards for setbacks and lot coverage for the R-1, 20,000 zoning designation as summarized below. The side yard setback for any residential structure within the R-1 zone can be reduced by up to 20%, pursuant to PDMC 25.40.020 (E)(2) upon approval of an exception by the ARC. Approval of the setback adjustment is based on the lot being an irregular shape or size and a finding that the reduced setback will not have a detrimental impact on the neighborhood. The proposal features 12’-0” interior side yard setbacks (20% reduction). The lot is a flag lot, with a limited buildable area of 16,750 square-feet, which is less than the 20,000 square-foot minimum required by the zone and establishes a justification to allow setback exceptions. Adjacent parcels will not be adversely impacted by the 3’-0” setback reduction as adjacent structures have large setbacks provided to preserve the neighborhood character. Additionally, the HOA has approved the proposed design. That the design and location of the proposed development and its relationship to neighboring existing or proposed developments and traffic is such that it will not impair the desirability of investment or occupation in the neighborhood; and that it will not unreasonably interfere with the use and enjoyment of neighboring existing or proposed developments and that it will not create traffic hazards or congestion. The proposed structure is a single-family residence located within an area developed with existing single-family residences. The proposed home is a permitted land use and will not impair the desirability of investment or occupation in the neighborhood. Contemporary style architecture featuring flat roofs is commonly found in residential neighborhoods in Ironwood and other areas of south Palm Desert. The home complies with allowable setbacks and will not unreasonably interfere with the use and enjoyment of existing homes in the area. The unit is not anticipated to generate traffic greater than the typical single- family home. C. That the design and location of the proposed development is in keeping with the character of the surrounding neighborhood and is not detrimental to the harmonious, orderly, and attractive development contemplated by this title and the General Plan of the City. The home features contemporary architecture which is commonly used on custom single-family residences within gated communities and other neighborhoods of south Palm Desert. The proposal is compatible and harmonious with surrounding development. D. That the design and location of the proposed development would provide a desirable environment for its occupants, as well as for its neighbors and that it is aesthetically of good composition, materials, textures, and colors. The proposed architecture is contemporary in nature and features an exterior material palette consisting of stucco and stone veneer. The massing of the building is highly varied with a high degree of articulation. E. That the proposed use conforms to all the requirements of the zone in which it is located and all other applicable requirements. That the overall development of the land shall be designed to ensure the protection of the public health, safety, and general welfare. The development of the property is designed to ensure the protection of the public health, safety, and general welfare. The site is adequately served by utilities, the home will grade in accordance with City requirements to ensure drainage does not affect neighboring properties, and setback from adjacent properties is in accordance with zoning requirements. Staff Recommendation Staff recommends the ARC determines that the requirements of the findings have been met based on the aforementioned analysis and approves the request as presented. BACKGROUND On May 11, 2006, the City Council adopted Resolution No. 06-66 approving a 159 single- family residential project on 18.67 acres known as Catavina (PP 05-25 and TT 33719). Conditions of the approved entitlement have since expired. In 2016, the City of Palm Desert adopted a General Plan update and changed this property’s land use designation to Town Center Neighborhood, which allows for seven (7) to 40 dwelling units per acre (du/acre). On June 22, 2017, the City Council approved a subsequent Citywide Zoning Update (ZOA 17-105) which included this property and increased the density from Planned Residential (PR-9), nine (9) du/acre to Planned Residential (PR-22), 22 du/acre. PROJECT SUMMARY The proposed project includes a 394-unit apartment development within 13 three-story buildings. One building consists of 109 units with underground parking that will directly serve those residents. The remaining 285-units are within 12 traditional three-story walk-up buildings each of which contains 21 to 24 units. There are a total of 672 parking spaces throughout the site including underground parking, garages, carports, and surface (open) parking. The parking ratio equates to 1.7 parking spaces per unit which is under the parking requirement of 2 parking spaces per unit. The parking reduction will be reviewed for approval by the Planning Commission. The project amenities include a single-story 17,500 square-foot clubhouse and a two-story 4,500 square-foot fitness building. The indoor amenities consist of a movie theater, pet spa, game room, coffee bar, and clubroom. The outdoor amenities include two swimming pools, spa, grilling stations, fire pits, dog run, putting green, bocce ball, and community park. Additionally, the project site will feature open space amenities. The proposed architecture resembles a Prairie/Contemporary style featuring horizontal and straight-lined modulations. The style is characterized with varying wall planes, large window PP/CUP 22-0006 – 394-units Frank Sinatra Drive and Portola Avenue Page 2 of 2 June 28, 2022 groupings, and balconies. The material palette consists of a variety of textures of stucco, stone veneer, metal accents, trellises, and concrete roofing. This submittal is for preliminary review of the Architectural Review Commission (ARC) to provide design comments and any requests for additional information if desired. It should be noted the applicant’s project submittal is still under review by all City Departments and required outside agencies. STAFF RECOMMENDATION No formal action is required by the ARC as this item is being presented for discussion only.
