Mejia, City Clerk Subject: City Council Meeting of January 12, 2023 Below you will find questions received from the Mayor or Councilmembers and answers provided by City staff regarding tonight’s City Council meeting: ITEM 1E: REQUEST TO APPROVE FEE WAIVER FOR REMEMBRANCE FOR VICTIMS OF COVID-19 EVENT Q1: What are the open to the public times of this events? A1: The Covid Remembrance be open to the public from 10 a.m. to 4 p.m. on 02/04/2023. ITEM 1F: REQUEST TO APPROVE TEMPORARY WAIVER OF CERTAIN PARK ORDINANCES FOR FUTURE FOOD MARKET AT CIVIC CENTER PARK Q1: What are the open to the public times of this events? A1: The Future Food Market be open to the public from 4 p.m. to 10 p.m. on 01/21/2023. Q2: How will food vendors be treated for future events considering the passage and implementation of Senate Bill 972 A2: All food vendors are required to obtain permits through the Riverside County Department of Environmental Health. For temporary events, it is the organizer’s responsibility to verify that the vendor submits an application. An on-site inspection is performed by the County on the day of the event. This is the County’s process, so any changes to it with regard to SB 972 would be implemented at the County level. Q3: The staff report indicates, “should the City Council deny this approval, the event will be held with only Riverside County Health Department approved food vendors.” Is this intended to say "If the City Council should GRANT this approval ..." I can't understand why denial would lead to use of vendors approved by the health department. If the waiver is denied, presumably there would be no vendors A3: This is a request to waive the prohibition on vendors selling merchandise, as opposed to food vendors. Should the City Council deny the request, goods will not be sold by vendors in the park. Only food vendors will be allowed. The permit issued for the event includes the authorization for food service & sales, provided all Health Department requirements are met. Q & A MEMO - 1 12/15/2022 Question & Answer Memo Page 2 of 3 ITEM 1H: REQUEST TO APPROVE TEMPORARY WAIVER OF CERTAIN PARKS ORDINANCES FOR PALM DESERT YOUTH SPORTS ASSOCIATION OPENING DAY OF BASEBALL & SOFTBALL AT CIVIC CENTER PARK Q1: Will there be camping associated with this event? A1: There will not be any camping associated with this event. The waiver of this section is requested because setup and teardown of the event will require organizers and/or vendors to be in the park between the hours of 11pm and dawn, which is prohibited by section 11.01.080 of the municipal code. The PDYSA plans to begin setup between 4 – 5 a.m. on the day of the event. ITEM 1J: AWARD CONTRACT NO. C44440 TO ECONOLITE SYSTEMS, INC., OF ANAHEIM, CALIFORNIA, FOR TRAFFIC SIGNAL HARDWARE UPGRADE IN THE AMOUNT OF $412,560 (PROJECT NO. 569-23) Q1: How often do we need to do this kind of maintenance and is it related to the synchronization project? A1: The project is an annual contracted maintenance project the city conducts. There are dozens of hardware components at each of our 99 traffic signals. Not all fail at once, so we use these contracts to replace common hardware items at many locations, so we get better pricing. This work focuses on maintaining existing traffic signal hardware and is unrelated to the CVAG signal synchronization project (aka “CV Sync”). Q2: The difference between the two bids submitted is troubling. The accepted bid is half of the other. What is the explanation? A2: Agencies are currently bidding a lot of contracts. Contractors don’t like to not bid on projects, so sometimes they submit a high bid on the off chance they might end up being the sole bidder. We have seen this kind of bidding strategy on other projects in the past. The low bid is from a responsive, responsible contractor with a good work history, and the bid was within a few percent of the engineer’s estimate. There is a lot of traffic signal-related work currently being bid by other agencies, and we see some bidders submit high bids on the off chance they might still be the lowest and which could explain the highest bid. ITEM 1L: AWARD ON-CALL CONTRACTS TO MULTIPLE VENDORS FOR PARK AND FACILITIES REPAIRS AND IMPROVEMENT PROJECTS AND APPROPRIATE FUNDS Q1: How had maintenance of this type been handled in the past? A1: In the past, this type of maintenance was highly reactionary. This new program aims to reduce time inefficiencies of obtaining quotes and executing contracts for several singular issues. This contract will increase ongoing surveys and quickly schedule repairs/improvements. We expect this program to also reduce high emergency repair costs, downtime, and short/long-term expenditures. C32410 WITH DESERT RECREATION DISTRICT FOR ANNUAL PARK AND PORTOLA COMMUNITY CENTER SERVICES AND APPROPRIATE FUNDS Q1: In the second set of parks listed (Future Parks), the first park listed is Portola & 1-10 Park and is listed as a Regional Park and the acreage listed as 20 +/-. Does it need to be updated for this contract? A1: Exhibit C to the City’s Agreement with Desert Recreation District provides a Park Services Matrix. The three Future Parks listed are each in progress and Exhibit C will require updates in the future. As information becomes available, including the specific location and acreage for new parks in the North Sphere, and new amenities at existing parks, staff will endeavor to update this matrix through future contract amendments. ITEM 2A: RECEIVE AND FILE INFORMATIONAL REPORT RELATIVE TO STATE AND LOCAL REGULATIONS OF MARKET RATE HOUSING RENT INCREASES Q1: Do I correctly understand that the Costa-Hawkins Act forecloses city rent regulation for properties that got a certificate of occupancy after 2/1/1995, such that the city regulations described at 2A-5 apply to properties built before that date? A1: Yes, newly-constructed housing issued a certificate of occupancy after February 1, 1995 is exempt from local regulation of rental rates. We are actively contacting HOAs to gain agreements and will build as each approves. •The build is about 35% fiber placement in existing duct or existing poles, and 65% requiring new underground conduit via bore/trench.
