3. The applicant shall revise the color scheme for existing units painted in Color
Scheme 8 to ensure colors are compatible with the red roof color.

to the Planning Commission for approval of a Precise Plan, Conditional Use Permit, and
a Mitigated Negative Declaration to construct a 394-unit market-rate multifamily
community consisting of thirteen three-story apartment buildings, a two-story fitness
center, a single-story clubhouse, two (2) pool areas, and private outdoor recreation areas
on an 18.67-acre site located at the southwest corner of Frank Sinatra Drive and Portola
Avenue (APNs: 620-400-030 and 620-400-031).

Senior Planner, Nick Melloni, narrated a PowerPoint presentation on the item and
responded to Commission inquiries. Cody Dietrich and Calvin Hayes, Applicant(s),
and their team including, Christine Pecard, with ESG Architecture and Design, and
Mike Rowe, with MSA Consulting, presented additional details on the project and
answered questions from the Commission.
Discussion on the item ensued with Commissioners providing comments and
concerns for the project. Chair Vuksic opened the public comment period. The
following comments were provided:
Edith Taylor, a Palm Desert resident, asked if there were any changes to the proposed
Type C building and voiced concerns regarding existing external guide poles and
added there was discussion about having electrical installed underground.
Jeff Cameron, a Palm Desert resident, voiced opposition for the project, stating the
design appeared “corporate,” and not community. Further concerns included massing

of buildings and the sound of traversing vehicles bouncing off building walls that are
too close to the street.
Cameron Cameron, a Palm Desert resident, voiced opposition for the project, noting
concerns regarding overall building height including revised parapets which add
height. Further concerns were regarding the project design which was compared to a
school dormitory and presented utilitarian and boxy.
Linda James, a Palm Desert resident, voiced concerns regarding the building height
which will block her views.
Pam Hoekstra, a Palm Desert resident, voiced concerns regarding added height to
three story buildings placed on a grade that sits higher than the curb. Further concerns
were the building design which presented as industrial and requested assurance the
proposed landscaping will be part of the final landscape plan.
There being no others desiring to speak, the public comment period was closed.
Following discussion, MOTION BY CHAIR VUKSIC, SECOND BY COMMISSIONER
MCAULIFFE, CARRIED 6-0 to:
1. Recommendation of denial of Case No. PP/CUP22-0006 with comments.
2. Balconies should be better integrated into the architectural design.
3. Revisit horizontal eyebrow element.
4. Revisit sloped parapets, including visibility of backside of parapet at its peak,
ensure it cannot be seen by the public from all vantage points. If peak is visible
ensure its massing is such that it appears as three-dimensional architecture.
5. Revisit and improve massing along street frontages to break down massing, create
better hierarchy, and variation.
6. Create more interest through use of one and two-story elements that overlap
different vertical sections of the building.
During the course of deliberation, individual Commissioner(s) offered commentary as
follows. The below points do not necessarily reflect consensus:
• Support for incorporating more green space as shown in alternative parking option
plan provided by applicant.
• Revisit horizontal eyebrow element incorporated into the balconies, integrate
element into building versus it appearing as an extension to the building.
• Consider variation in building types and setbacks to avoid repetition and allow relief
of large masses along street frontages.
• Reconsider sloped parapets, they do not enhance architecture, high corners are
not cohesive with desert architecture, and add height that is unnecessary.
• Building walls appear flat, add more depth in between planes.
• Revisit metal panel elements and how they terminate into window.
• Walls at stairwells and balconies need to be thickened.
2. CASE NOS: MISC22-0009

for a new front entry façade modification and minor addition to the Palm Desert
Community Center located within the Civic Center Park.

Acton with Holt Architecture, presented additional details on the project and answered
questions from the Commission.
Discussion on the item ensued with Commissioners providing comments and
concerns for the project. Chair Vuksic opened and closed the public comment period.

Following discussion, MOTION BY VICE CHAIR MCINTOSH, SECOND BY
COMMISSIONER LATKOVIC, CARRIED 6-0 to:
1. Approve Case No. MISC22-0009 with conditions.
2. Narrow entry signage a minimum of six inches from top and bottom.
3. Revisit size, scale, and placement of Desert Recreation District logo placed in
recess next to the entry door to avoid overcrowding of area.
During the course of deliberation, individual Commissioner(s) offered commentary as
follows. The below points do not necessarily reflect consensus:
• Recommend “Palm Desert Community Center” be placed in a single line on entry
signage.
• Consider use of light or light fixtures to accent building walls.
• Consider removing spokes on back of entry signage and make it a solid cover.
• Consider extending spokes past front of entry signage to add an additional element
of design.
3. CASE NOS: PP/EA 22-0005
NATURE OF PROJECT/APPROVAL SOUGHT: Consideration of a recommendation
to the Planning Commission for approval of a Precise Plan for West Coast Storage
Facility, a 53,604 square-foot personal storage facility located at the northwest corner
of Dick Kelly Drive and Dinah Shore Drive.

Commission.

Discussion on the item ensued with Commissioners providing comments and
concerns for the project. Chair Vuksic opened and closed the public comment period.

Following discussion, MOTION BY COMMISSIONER MCAULIFFE, SECOND BY
COMMISSIONER LATKOVIC, CARRIED 6-0 to:
1. Approve Case No. PP/EA22-0005 with conditions.
2. Remove the four storage units which connect the east and west building segments
and replace with a further recessed screen wall and additional landscaping.
3. Remove sloped metal panel detail and change to a vertical detail which stops
approximately 12 inches from the top of parapet. (Reference Pg. A-9)
4. Cobble be further studied per Commission’s comments as to the layout. The
design should incorporate a more continuous undulating design.
5. Signage shall comply with the Palm Desert Municipal Code and not utilize
raceways, backers, or phone numbers.
6. The walls of the trash enclosure shall be finished with stucco to match the primary
building.
7. All roof mounted mechanical equipment should be screened from all vantages of
surrounding public areas with consideration to the varying parapet heights.
8. The offsets of the masses shown in the presentation be maintained as the project
is developed into construction documents.
9. Any glass not under an awning be recessed a minimum of six inches from any and
all adjacent surfaces.
During the course of deliberation, individual Commissioner(s) offered commentary as
follows. The below points do not necessarily reflect consensus:
• Be mindful of ribbed line detail of metal panels used for tower element as this will
be reviewed in the project’s final construction documents.

6. INFORMATIONAL REPORTS & COMMENTS
A. ARCHITECTURAL REVIEW COMMISSIONERS
In response to inquiry, Deputy Director of Development Services, Rosie Lua, informed the
ARC’s comments regarding the denied case would be conveyed to the next body who
reviews and takes action on the project. Because the case is a Precise Plan Application
and a Condition Use Permit Application staff will seek clarification from the City attorney
as to whether the project will be reviewed by the Planning Commission or City Council.
Brief discussion was held on the sculptures that are planned to be installed and those that
are already installed on the roundabouts on San Pablo.
Vice Chair McIntosh left the meeting at 3:45 p.m. due to a conflicting obligation.
Regarding inquiry of a potential project near the entrance of Desert Willow, Deputy
Director Lua and Senior Planner, Nick Melloni, reported this area has been used for
different purposes including a staging area for DSRT Surf, a storage area for the City

during a rehabilitation project for Cook street, and a storage area for a rehabilitation
project for Southern California Edison.
Deputy Director Lua and Senior Planner Melloni provided explanation as to Palm Desert
Municipal Code Ordinance 25.68.40 Findings of the ARC, Section C, and general purview
of the ARC, in response to request for clarification.
B. CITY STAFF
Deputy Director Lua and Senior Planner Melloni provided an update on Palm Villas
Apartments, Refuge Specific Plan which was approved through the Planning Commission
and the Smartlink Group AT&T monopalm cell tower.
C. ATTENDANCE REPORT
The attendance report was provided with the agenda materials. The Commission took no
action on this matter.

Case No: MISC 21-0019 – Amendment #1
Subject: Consideration of a revision to the Design Review approval for the Lennar University
Park Tract 36342 to allow a modification of propose roofing materials and fascia
trim material.
BACKGROUND
On August 24, 2021, the Architectural Review Commission (ARC) approved Case No. MISC21-
0019 for a design review of the architecture for a 196-unit residential tract located at the northwest
corner of University Park Drive and College Drive. The project was approved in a 6-0 vote subject
to the following condition of approval:
1) Applicant will provide accurate color samples for the revised color schemes to Planning
Staff.
Per the requirement of the condition, the applicant provided the revised color scheme containing
eight total schemes to Planning Staff. Staff received the update and granted approval of a building
permit. During development, the applicant selected an alternative roof tile for each of the eight
approved color schemes. This revision will require the approval of a design review amendment by
the ARC. Staff has reviewed the color schemes and finds the colors substantially conform with the
ARC approval, which the exceptions of the roofing for scheme 2 and scheme 8. Staff has provided
further analysis and recommendations in this staff report.
In addition to the revision to the color scheme, the applicant is requesting the ARC approve a
change to the existing building fascia trim from a Hardie board material to a wooden fascia trim.
PROJECT SUMMARY
Project Description
The project is a request by the applicant, Lennar, to revise the roof tile and fascia trim of an
approved residential tract. The tract is a non-gated community comprised of a mix of two-story
residential product types including 64 duplex units, 84 cluster units, and 48 single-family
detached lots, totaling 196 dwelling units.

The applicant has proposed an alternative roof tile for each of the eight-unit types. Staff has
reviewed the proposed tiles and found them to be in substantial conformance with the original
approval with the exception of Color Scheme 2 and Color Scheme 8.
The community is presently under construction and nearing completion of its first phase consisting
of 24 units. There are some instances of Color Schemes 2 and 8 which are nearly completed with
the new roof tiles.

The proposed color of the new tile for Color Scheme 2 is notably redder than the original
approval. Staff finds that, though there is a variation, the color is consistent with the
traditional Spanish style roof color and recommends approval.

Original Final
The proposed tile is notably different in terms of shape and color. The original roof tile was
a flatter tile finished in a blend of grey, brown and taupe. The proposed tile is an “S” shape
and features an earthen red color.
Staff recommends the ARC direct the applicant to revise the roof tile for Scheme 8 to a
more consistent color consisting of greys and browns on all future units. Staff also

recommends that the ARC direct the applicant to prepare an alternative color scheme for
any existing units developed with Color Scheme 8 to ensure the existing roof color is
compatible with exterior paint colors.
Fascia Trim Modification
The residential architecture of the tract was approved with fascia trim constructed using
cementitious fiber boards (Hardie Board). During construction, the applicant has found that this
material breaks easily and is causing delays and repairs to units. This also creates a concern for
the long-term maintenance of the trim as future homeowners cannot alter the trim. The image
below (Figure 3) shows an instance where the hard facia has been damaged on an existing unit.

In response to this issue, the applicant is requesting ARC approval to utilize wood instead of the
Hardie Board for the fascia trim. The ARC has voiced concerns over the maintenance issues
associated with wood due to sun damage. The applicant finds that the maintenance of wood will
lead to fewer issues than Hardie Board for future homeowners and will rely upon the Homeowner’s
Association (HOA) to ensure the wood is maintained.

ANALYSIS
Development Standards
The proposed changes do not alter the development standards of the existing units. The changes
are only exterior material changes, and the project is still in conformance with the original approval.
ZONING ORDINANCE SUMMARY
ARC approval is required for all design reviews applications per PDMC Section 25.68.020 (A). The
original case was approved by the ARC and therefore, substantial alterations to the plan must
return for ARC approval.
STAFF RECOMMENDATION
Staff recommends the ARC determines that the requirements of the findings have been met based
on the analysis and approves the request as presented with the following condition:
1. The applicant shall select a new roof tile color for Color Scheme 8 – Adobe Ranch, which
substantially conforms with the original approval.
2. The applicant shall revise the color scheme for existing units painted in Color Scheme 8
to ensure colors are compatible with the red roof color.
If major design comments arise during the discussion, Staff recommends the ARC clearly outline
the requested changes and incorporate the comments as conditions of approval.

RE: University Park by Lennar
It has come to our attention that the color and materials the city has on file for the
community University Park by Lennar Homes have not been updated after a necessary change to
the manufacturer of the roof tiles. The roof tiles on the approved color and materials boards are
manufactured by Eagle. As construction approached because of availability, lead time and
generally supply chain issues it was necessary to change to Boral roofing. Boral is able to commit
to Lennar to deliver the type, color and quantities within the construction schedule with an
agreeable contract.
KTGY facilitated this change in manufacture by selecting comparable types and colors by
Boral. We believe the change of manufacturer does not affect the character, aesthetic, or design
vision of the homes or community as approved by the city. The selected colors and type of roof
tiles for the construction of the homes are substantially equivalent to those approved by the city of

VI. COMMENTS
Associate Planner, Kevin Swartz, provided an update for the Chandi Project on San
Pablo and Fred Waring. Mr. Swartz advised the applicant submitted their construction
drawings which has gone through its first round of review and was returned to the
applicant. The applicant is currently working on revisions for their second submittal.
Mr. Swartz provided an update for Avenida Palm Desert. Avenida Palm Desert,
recently submitted renderings for the screening of the roof top equipment. It is
anticipated the applicant will present their request to the ARC in September.
Mr. Swartz provided an update for Sinclair Gas Station. Sinclair has indicated they
would like to keep the current landscape modifications as is. Mr. Swartz stated he will
take photos of the modifications and present them to the Commission at a future ARC
meeting for consideration.
Associate Planner, Nick Melloni, provided an update for the Abronia Trail 4-plex. Mr.
Melloni reported the applicant appealed the ARC’s denial and is scheduled to go
before City Council on August 26, 2021. The staff report provided to City Council is
available for Commissioners to review. Mr. Melloni explained City Council can either
deny their request or approve it, which would allow the project to move forward to the
Planning Commission.
Principal Planner, Rosie Lua, provided the Commission with an update regarding
recent City staff promotions, transfers, and changes. At the request of Commissioner
McAuliffe, a final staff organization chart will be provided to Commissioners.

Subject: Consideration to approve a revision to the Design Review approval for Mechanic’s
Bank, a new 3,830 square-foot building located within the Jensen’s Shopping
Center at 73611 Highway 111, and review of Architectural Review Commission
conditions of approval.
BACKGROUND
On August 23, 2022, the Applicant, McAuliffe & Co. Architects received approval by the
Architectural Review Commission (ARC) for Case No. MISC22-0013 for the development of a new
multi-tenant commercial building located at 73611 Highway 111, for the Merchant’s Bank. The
project was approved in a 4-0-1 vote (Commissioner McAuliffe Absent) with the following
comments:
1) Add landscape in the area between the proposed block wall and public sidewalk on the
north and east portions of the property; and
2) Applicant will return to the ARC for review of a more developed illustration of rake detail
including how detail terminates into the surrounding element prior to building permit
issuance and specific details for proposed wood fascia siding.
In accordance with the ARC conditions set forth on August 23, 2022, the applicant has prepared
responses and illustrations to the comments. A summary of the responses is included below.
In addition, the applicant is requesting the ARC consider a revision to the exterior façade that
replaces the tile roof material with standing seam metal roof material.
PROJECT SUMMARY
A. Property Description:
The project site is a vacant pad located at 73611 Highway 111, within the Jensen’s Shopping
Center at the southwest corner of Highway 111 and Larkspur Lane. The pad is located on a 0.41-
acre parcel which is improved with parking and vehicular drive aisles. The frontage of the parcel is
fully improved with curb, gutter, and sidewalk. The parcel was previously developed as a gas

station which was demolished in 2018. The buildings within the shopping center were originally
constructed in the late 1960’s and underwent a façade improvement in 2019.

Project Description
The overall project is to construct a 3,830 square-foot building to be occupied by Mechanics Bank.
The building will be occupied by a single tenant at this time, however, the space is designed to
accommodate up to two tenant spaces and may be subdivided in the future. The ARC approved
the project subject to conditions on August 23, 2022.
The applicant has responded to the following conditions of the ARC as follows:
1) Add landscape in the area between the proposed block wall and public sidewalk on the
north and east portions of the property;
Original Final
The applicant has amended the landscape plan to include additional landscape plantings
between the block wall and sidewalk along Highway 111, reference Sheets L1.0 (color and
black and white). These plantings include red tipped yucca, smooth agave, aloe vera,
thunder cloud and Mediterranean fan palm. A comparison of the original plan and the
proposed plan is shown above. Staff finds the condition is satisfied by the additional
plantings.

2) Applicant will return to the ARC for review of a more developed illustration of rake detail

Original Final
The applicant has provided three details for the roof rake detail on Sheet A-501, which
includes a section detail of the rake at the building corner, a section of where the rake
adjoins the wall (tower element), and a perspective view.
In addition to the updates in accordance with the conditions of approval, the applicant has
proposed a revision to the roof material of the building. The change is from a concrete roof tile to
a standing seam metal. Staff finds the change improves the architecture as the low roof pitch and
contemporary building forms are better suited to the new material.
Original Amendment
Site Plan and Parking
No changes are proposed to the approved site plan. The building is proposed on an existing rough
graded building pad located at the northeast corner of the existing parking lot. The building will be

designed with frontages oriented towards the western parking lot, Highway 111, and Larkspur
Lane. The site plan is referenced below.

ZONING ORDINANCE SUMMARY
ARC approval is required for all design review applications per PDMC Section 25.68.020 (A). The
proposal is a revision to the design review and therefore require ARC approval. The change is not
substantial as only the material of the roof is changing.
STAFF RECOMMENDATION
Staff recommends the ARC determines that the requirements of the findings have been met based
on the analysis and approves the request as presented.
If major design comments arise during the discussion, Staff recommends the ARC clearly outline
the requested changes and incorporate the comments as conditions of approval.

The Project is the development of a new free-standing commercial shell building and site improvements
within the Jensen's Plaza multi-tenant, multi-building shopping center. The design of the building will
have updated form complimentary to the architecture of the center.
Improvements include new foundation/slab, building envelope, exterior finishes, roofing, and utility
infrastructure. The Work of this project will develop the building to a cold-grey shell condition. The
building will be equipped with fire sprinkers.
Site improvements include new parking, side walks, curb and gutter improvements, site drainange, and
construction of a multi-bin trash enclosure. Parking is shared with the shopping center.
Additional improvements include landscaping, irrigation, and landscape lighting. The landscape palette is
desert compatible and is drawn from the establish materials used currently at the shopping center.
The building will be approximately 3,800 SF and will be initially occupied by Mechanics Bank. Tenant
Improvements for the Bank are NOT part of this Poject and will be under separate permit by others.
The building is designed to accommodate two distinct tenants should future subdivision of the building
be entertained by the Building Owner.

All Contractors and subcontractors shall have a current City of Palm Desert business license prior to
permit issuance per Palm Desert Municipal Code, Title 5.
All Contractors and/or owner-builders must submit Certificate of Workers Compensation insurance
coverage prior to the issuance of a building permit per California Labor Code section 1800.
Contractor and/or Owner shall provide a trash bin to insure proper clean-up of all
building materials per ordinance of the Palm Desert Municipal Code. Storage of building materials or
debris shall be confined to the lot for which the permit is issued. Adjacent vacant properties may not be
utilized for this purpose unless written permission of the Owner of the adjacent property is on file with
the permitting authority. The public Right-of-Way shall be maintained in a clear condition at all times.
Comply with the City of Palm Desert Municipal Code.
Address numerals shall comply with Palm Desert Ordinance No.1265, Municipal Code Section 15.28
School Tax Fees must be paid prior to the issuance of your building permit.
The Traffic Uniform Mitigation Fees (TUMF) must be paid at time of issuing the building permit.
Block walls, trash enclosures, temporary power poles, pools, spas, site lighting, signage, etc. require
separate permits.
General contractors and/or owner-builders shall submit a completed sub-contractor's list to the Building
& Safety Department prior to requesting a final inspection per Palm Desert Ordinance No. 60. Absolutely
no sub-contractor's lists will be accepted unless all required information is provided on the appropriate
City of Palm Desert form.
Contractor to complete section 1 of the Construction Waste Management Plan prior to permit issuance,
and complete section 2 at final inspection.

Construction Hours: Comply with Construction Hours as established by City of Palm Desert.
Receipt/Storage of Materials: No material is to be delivered and placed in the street. Material is not to
be stockpiled on adjacent property. Contractors will be required to place all materials in the Tenant's
suite or secure the appropriate temporary storage location from the Property Manager.
Trash and Debris: all trash and debris is to be picked up and the parking lot cleaned daily.
Parking of Vehicles: During the course of work, all vehicles shall be parked at locations as designated by
the Property Manager.
This construction site conjoined with a multi-tenant complex. Tenants in other, adjacent suites will be
conducting business during the course of construction. The contractor and the contractor's
subcontractors shall not impede the operations of adjacent tenants.
The General Contractor shall notify the Property Manager if utility service connections need to be
temporarily interrupted during the course of the Work. The general contractor shall provide 48 hour
written notice to the Property Manager in advance of any proposed interruption.
Radios: Radios and stereo equipment may not be played at the worksite.

The General Contractor shall furnish all materials, labor, equipment, transportation and services
necessary for the satisfactory completion of the Work unless designated specifically otherwise. Work
shown in these drawings designated Not In Contract (N.I.C.) is shown for informational purposes only
and is NOT the responsibility of the General Contractor. All equipment, work, and materials shall
comply with all current applicable model codes, local municipal codes, ordinances, and governing
regulations, and the Contract Documents.
The Contractor shall coordinate the installation of the various trade items within the space above all
ceilings (including, but not limited to: structural members, mechanical ducts and insulation, conduits,
raceways, sprinkler systems, light fixtures, ceiling systems, and any special structural supports required)
and shall be responsible for maintaining the finish ceiling height indicated in the Drawings and the Finish
Schedule. Ceiling heights dimensions are to the finish surface of the ceiling unless noted otherwise.
Access panels shall be provided and installed wherever required by the Building Code or for the proper
operation or maintenance of mechanical, electrical or other concealed equipment, whether or not
indicated on the Drawings. The General Contractor shall coordinate the size, location, and type of
access panel(s) with other Subcontractors' work and with the Architect prior to installation of any access
panels.
When it is necessary to interrupt any existing utility service(s) to make connections and/or corrections, a
minimum of 48 hours advanced notice shall be given to the Owner. Interruptions in utility services shall
be of the shortest possible duration for the Work at hand and shall be approved in advance by the
Owner.
In the event the utility service is interrupted without the required 48 hour advanced notice, then the
General Contractor shall be financially liable for all damages suffered by the Owner due to unauthorized
interruption. Reconnection shall be made immediately.
The General Contractor shall protect all finish work and surfaces from damage during the course of
construction and shall replace and/or repair all damaged surfaces caused by the General Contractor or
Subcontractor personnel to the satisfaction of the Owner and the Architect.
The General Contractor shall provide and install all stiffeners, bracings, back-plates, strapping, and
supporting brackets required for the installation of all casework, toilet accessories and of all
floor/wall/ceiling mounted or suspended mechanical and electrical equipment.
Only new materials and equipment of recent manufacture, of the quality specified, and free from defects
shall be permitted for the Work.
Bracing, shoring, and temporary supports shall be provided as required to hold the Work securely in
place and to sustain all loads including those that may occur during erection and until subsequent
construction is adequate to replace the temporary bracing. The General Contractor shall be solely
responsible for these temporary elements.
The General Contractor shall exercise extreme caution throughout the construction period to protect
any landscaping, utilities, structures or other facilities intended to remain. Damage, destruction, or
removal of these items shall be repair/replaced/restored at the General Contractor's expense and to the
satisfaction of the Owner.
Final Clean-Up and Disposal: the General Contractor shall remove debris, rubbish and waste material
from the Owner’s property and common areas to a lawful disposal area and pay all hauling and dumping
costs. The General Contractor shall conform to pertinent Federal, State, and Local laws, regulations and
orders upon completion of Work. All construction areas shall be left vacuum-clean and free from debris.
Clean all dust, dirt, stains, hand marks, paint spots, droppings and other blemishes.
The General Contractor shall exercise extreme caution during the construction period to protect the
existing building facility including the exterior and interior finishes, furniture and equipment.
The General Contractor to provide approved temporary sanitary facilities (I.E. chemical toilets) on the
construction site prior to commencement of the Work.
The General Contractor shall have sole control over and charge of and responsibility for construction
means, methods, techniques, sequences or procedures, and for safety precautions and programs in
connection with the Work.
The Architect shall not be responsible for the Contractor's failure to carry out the Work in accordance
with the Contract Documents.
The Architect shall have authority to reject Work that does not conform to the Contract Documents.
If concealed or unknown physical conditions are encountered at the site that differ materially from those
indicated in the Contract Documents or from those conditions ordinarily found to exist, these conditions
shall be brought to the attention of the Architect and the Owner prior to continuing with the Work.
Structures in the course of construction, alteration or demolition shall comply with Chapter 14 of the
2019 California Fire Code and NFPA 241.

These Project Notes are not all-inclusive and DO NOT relieve the Contractor(s) on this Project of their
responsibility to review all relevant codes. The Contractor shall ask questions, call to the attention of the
Architect and Owner any and all discrepancies, omissions and errors in these documents.
INSPECTIONS
The Contractor shall be responsible to make application for, secure and pay for all permits and fees
required by the various permitting agencies and utility purveyors.
The Contractor shall be responsible to schedule all inspections. Normal inspections by the building,
engineering, fire and other permitting agency departments shall be conducted as required by those
respective agencies. All re-inspection fees shall be paid by the contractor.
CONSTRUCTION DOCUMENTS
Contract Drawings and Specifications are mutually inclusive and what is required by one is required by
the other. There is no precedence intended or implied between Drawings and Specifications and, in the
event of a conflict, the Architect shall be their interpreter. Any work installed prior to and/or in conflict
with such interpretation shall be corrected by the Contractor at the Contractor's expense and at no
additional cost to the Owner.
In no case shall dimensions be scaled from Drawings. The Contractor shall verify all conditions and
dimensions in the field before proceeding with subsequent work. Any discrepancies between conditions
indicated and actual field conditions shall be brought the attention of the Architect for clarification prior
to proceeding. Any work installed prior to and/or in conflict with such clarification shall be corrected by
the Contractor at the Contractor's expense and at no additional cost to the Owner.
All dimensions are to face of stud or centerline of walls, columns and beams unless otherwise noted.
Floor elevations are to top of concrete slab unless otherwise noted.
All symbols and abbreviations used on the Drawings are considered to be construction standards. Any
questions regarding the exact meaning of a symbol or abbreviation shall be brought to the attention of
the Architect for clarification.
Details marked "TYPICAL" shall apply in reasonably inferable similar conditions unless indicated
otherwise.
Notes contained within these documents which use the words "PROVIDE" or "INSTALL" shall be
interpreted to mean "THE GENERAL CONTRACTOR SHALL PROVIDE AND INSTALL" unless noted
otherwise.
The Specifications and ALL Consultant Drawings are supplemental to the Architectural Drawings. It shall
be the Contractor's responsibility to coordinate with the Architectural Drawings before the installation
of any of the Consultant's work and to bring any discrepancies or conflicts to the attention of the
Architect in writing for clarification. Improperly installed work shall be corrected by the General
Contractor at the General Contractor's expense and at no expense to the Architect, the Architect's
Consultants, or the Owner.
The General Contractor and the General Contractor's Subcontractors are responsible for reviewing,
bidding, coordinating and performing their work based on the ENTIRE set of Contract Documents.
Improperly installed work or contract requirements identified by these Documents excluded by the
Contractor without prior written approval of the Architect shall be corrected by the General Contractor
at the General Contractor's expense and at no expense to the Architect, his Consultants, or the Owner.
It is the General Contractors responsibility for distribution of the ENTIRE set of Contract Documents to
all of the General Contractors forces and Subcontractors.
Any Work installed in conflict with the Contract Documents shall be corrected by the Contractor at the
Contractor's expense and at no additional expense to the Owner, the Architect, or the Architect's
Consultants.
Drawings of existing conditions have been compiled from existing data supplied by the Owner to the
Architect. The Architect makes no warranty either expressed or implied for the accuracy or
completeness of the existing information recorded. The General Contractor shall field verify ALL
existing conditions. The General Contractor shall notify in writing any discrepancies for clarification
prior to proceeding with work.

Subject: Consideration of a recommendation to the Planning Commission for approval to
construct Mechanics Bank, a new 3,830 square-foot commercial building located in the
Jensen’s Shopping Center at 73611 Highway 111.
The Architectural Review Commission of the City of Palm Desert considered your request and
took the following action at its meeting of August 23, 2022:
By Minute Motion, the Architectural Review Commission approved Case No. MISC22-
0013 subject to the following: 1) Add landscape in the area between the proposed block
wall and public sidewalk on the north and east portions of the property; and 2) Applicant
will return to the ARC for review of a more developed illustration of rake detail including
how detail terminates into the surrounding element prior to building permit issuance and
specific details for proposed wood fascia siding. The motion carried with a 4-0-1 vote.
(AYES: Colvard, Latkovic, McIntosh, and Vuksic; NOES: None; ABSENT: None;
ABSTAIN: McAuliffe).

Subject: Final Review of Landscape Plans for Chandi Mixed Use
BACKGROUND
On May 27, 2021, the City Council adopted Resolution 2021-28 approving the Chandi Mixed-Use
Development, a three-story, mixed-use development containing 60 residential dwelling units and
16,500 square-feet of ground floor commercial space located on the southeast corner of Fred
Waring Drive and San Pablo Avenue. The applicant has prepared final landscape construction
drawings for the project in accordance with condition of approval #17 of the Council Resolution:
PLANNING COMMISSION:
17. The applicant shall revise the landscape plan to include pedestrian-friendly plants on
all sides of the property, add additional landscape screening to the southeast portion of
the lot, and consider using non-deciduous landscaping. The City’s Architectural Review
Commission (ARC) shall review the landscape plan at the time that the ARC reviews the
construction drawings.
The landscape plan is being presented to the ARC to satisfy this condition of approval. The
applicant has incorporated additional landscape shrub plantings along the street frontages of the
project. These plantings will be in curb-adjacent landscape planters and building adjacent planters
to line both sides of the sidewalk.
The preliminary approved plans are attached for reference. The final landscape construction plans
will be provided at the meeting.
The Architectural Review Commission will not take action on this item as it is informational to
demonstrate the landscape plan is in conformance with the preliminary approval.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT,
CALIFORNIA, CONSIDERING APPROVAL OF A PRECISE PLAN,
CONDITIONAL USE PERMIT, AND TENTATIVE PARCEL MAP 38023 TO
CONSTRUCT A THREE-STORY MIXED -USE BUILDING CONSISTING OF
RETAIL AND OFFICE USES ON THE GROUND FLOOR, AND 60 TOTAL
RESIDENTIAL APARTMENT UNITS ON THE SECOND AND THIRD
FLOORS LOCATED ON THE SOUTHEAST CORNER OF SAN PABLO
AVENUE AND FRED WARING DRIVE; AND ADOPTION OF A NOTICE OF
EXEMPTION IN ACCORDANCE WITH THE CALIFORNIA
ENVIRONMENTAL QUALITY ACT (CEQA)
CASE NOS: PP/CUP 20-0003 and TPM 38023
WHEREAS, the City Council of the City of Palm Desert, California, did on the 27th day
of May 2021, hold a duly noticed public hearing to consider the request by Chandi Group
USA, for approval of the above -noted project request; and
WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 15'h day of December 2020, hold a duly noticed public hearing to consider the request by
Chandi Group USA, for a recommendation to the City Council for approval of the above -noted
project request; and
WHEREAS, according to the CEQA, the City must determine whether a proposed
activity is a project subject to CEQA. If the project is subject to CEQA, staff must conduct a
preliminary assessment of the project to determine whether the project is exempt from CEQA
review. If a project is not exempt, further environmental review is necessary. The application
has complied with the requirements of the "City of Palm Desert Procedure for Implementation
of the California Environmental Quality Act," Resolution No. 2019-41, and the Deputy Director
of Development Services has determined that the proposed project is an Article 19 Class 32:
Infill Development Projects Categorical Exemption for purposes of CEQA and no further
review is necessary; and
WHEREAS, at the said public hearing, upon hearing and considering all testimony
and arguments, if any, of all interested persons desiring to be heard, the City Council did find
the following facts and reasons to exist to justify approval of said request:
1. The proposed project is located in the Downtown Edge (DE) zoning district, which
allows "mixed -use developments" as permitted uses, subject to the approval of a
Precise Plan application (PP) and Conditional Use Permit (CUP).
2. The proposed project conforms to the DE zone and One Eleven Development
Code design guidelines since the project provides a mixture of residential densities
and uses. It is also intended to provide for the integration of urban designs by
encouraging front -facing buildings closer to the street that creates a building line
on the ground floor to create a more walkable neighborhood.
3. The proposed project conforms to the Downtown (D) designation within the
General Plan by creating a walkable neighborhood building. The purpose of the D

designation is to provide high -intensity mixed -use development anchored by
civic, cultural, entertainment, retail, and dining activity that features a variety of building
sizes and housing choices. Ground floor uses include retail, restaurant, service, and
office uses, while upper floors accommodate residential and office uses.
4. The project complies with all development standards including setbacks, building
height, density parking, lot coverage, and land use compatibility.
5. The building as designed offers an upscale architectural design.
6. One of the City's overall goals identified in the Strategic Plan is to focus on creating
a city center/downtown that provides high -intensity mixed -use developments
anchored by civic, cultural, entertainment, retail, and dining activity along walkable
streetscapes.
FINDINGS FOR APPROVAL:
1. That the density of the proposed subdivision is consistent with applicable general
and specific plans.
The land use designation is D within the General Plan, which allows a density of
up to 40 units per acre. The proposed project of 60 market -rate apartment units on
1.54 acres is consistent with the density within the General Plan. The purpose of
the D designation is to provide high -intensity mixed -use development anchored by
civic, cultural, entertainment, retail, and dining activity that features a variety of
building sizes and housing choices. Ground floor uses include retail, restaurant,
service, and office uses, while upper floors accommodate residential and office
uses.
Buildings are encouraged near or at the sidewalk to shape the commercial
streetscapes, support outdoor dining, and for easy view of storefronts. Buildings
are typically mixed -use up to three stories with taller buildings up to five stories
focused at key intersections and/or public open space.
The proposed mixed -use development with commercial uses on the ground floor
and a mixture of residential apartment units (one to three bedrooms) meets the
intent of the General Plan designations.
The project is also consistent with the City's overall vision for San Pablo Avenue,
and with the City's Strategic Plan.
Land Use - Priority 4: "Create a mixed -use city core integrating shopping,
dining, lodging, and housing."
Tourism and Marketing — Priority 1: "Improve access to Palm Desert and its
attractions to enhance the ease of lifestyle."
Transportation — Priority 1: "Create walkable neighborhoods and areas
within Palm Desert that would include residential, retail, services and
employment centers, and parks, recreation, and open space to reduce the
use of low occupancy vehicles."

Land uses within the surrounding area are compatible with the proposed use, and
maintain the same General Plan designations. Furthermore, the project does not
physically divide an existing community and does not conflict with any applicable
land use plan, policy, or regulation outlined in the General Plan.
2. That the design or improvement of the proposed subdivision is consistent with
applicable general and specific plans.
The Land Development (Planning/Engineering) Division, Economic Development
Department, Fire Department, and Public Works Department have reviewed the
design and improvements of the proposed subdivision for consistency with the
General Plan and emergency services. The street and utility improvements,
circulation patterns, and drainage improvements meet all requirements of the
General Plan. All existing perimeter streets are in conformance with the General
Plan. All external project streets that serve the project conform to City standards.
There are no specific plans for the property.
3. That the site is physically suitable for the type of development.
The 1.54 acres are suitable for the development proposed. No environmental or
traffic concerns were identified that would indicate that development in this area
would be unsuitable. in addition, existing commercial and residential
developments have successfully constructed similar types of development in the
immediate vicinity. No obstacles to the development of surrounding subdivisions
were experienced and, due to the proximity and similarity of the proposed
development, it is reasonable to conclude that the site is physically suitable for it.
The property is suitable for the proposed development as conditioned.
4. That the site is physically suitable for the proposed density of development.
As proposed, the site layout and density are consistent with the General Plan. The
property allows for 40 DU/acre, and the project density of 60 units on 1.54 acres
complies. The project density is necessary to carry out the vision of creating an
urban development within the DE zone.
5. That the design of the subdivision and the proposed improvements are not likely
to cause substantial environmental damage or substantially and unavoidably injury
to fish or wildlife or their habitat.
For purposes of CEQA, the project will not have a significant negative impact on
the environment, and is categorically exempt, under Class 32: Infill Development
Projects.
The design of the project will not cause substantial environmental damage or injure
fish or wildlife or their habitat since the surrounding area has been developed. In
addition, the project will pay into the Coachella Valley Multi -Species Habitat
Conservation fund for the development of raw land.

6. That the design of the subdivision or the type of improvements is not likely to cause
serious public health problems.
The design and layout of the mixed -use development complies with all grading
requirements and the project will be developed in accordance with the Uniform
California Building Code. Pedestrian access is provided to adjoining land uses
along San Pablo Avenue where other residents would be able to walk to the retail
uses, which decreases the need for vehicular traffic between adjoining properties.
7. That the design of the subdivision or the type of improvements will not conflict with
easements, acquired by the public at large, for access through or use of, property
within the proposed subdivision.
The proposed project will construct an underground retention drainage. The parcel
map identifies the use of this area and will record an easement for drainage
purposes. In addition, the applicant is responsible for the maintenance of the
retention basin outlined in the conditions of approval. Surrounding perimeter City
streets are built out to the General Plan designation.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PALM DESERT, CALIFORNIA, AS FOLLOWS:
1. That the above recitations are true and correct and constitute the findings of the
City Council in this case.
2. That the City Council approval of the Precise Plan, Conditional Use Permit, and
Tentative Parcel Map 38023 as proposed.

CONDITIONS OF APPROVAL
CASE NOS: PP/CUP 20-0003 and TPM 38023
LAND DEVELOPMENT (PLANNING/ENGINNERING) DIVISION:
1. The development of the property shall conform substantially with exhibits on file with the
Land Development Division, as modified by the following conditions.
2. The applicant shall record Parcel Map 38023 within two (2) years of project approval.
3. All construction documentation shall be coordinated for consistency, including, but not
limited to, architectural, structural, mechanical, electrical, plumbing, landscape and
irrigation, grading, and street improvement plans. All such plans shall be consistent with
the approved entitlement plans on file with the Land Development Division.
4. Construction of said project shall commence as outlined with the Disposition and
Development Agreement from the date of final approval unless an extension of time is
granted; otherwise, said approval shall become null, void, and of no effect whatsoever.
5. The development of the property described herein shall be subject to the restrictions and
limitations set forth herein which are in addition to the approved project and all Palm Desert
Municipal ordinances and state and federal statutes now in force, or which hereafter may
be in force.
6. Prior to issuance of a building permit for construction of any use or structure
contemplated by this approval, the applicant shall first obtain permits and/or clearance
from the following agencies:
Building & Safety Division
Public Works Department
Fire Department
Coachella Valley Water District (CVWD)
The applicant shall present evidence of said permit or clearance from the above agencies
to the Department of Building & Safety at the time of issuance of a building permit for the
use contemplated herewith.
7. The Applicant shall agree to defend, indemnify, and hold harmless the City of Palm
Desert or its agents, officers, and employees from any claim, action, or proceeding
against the City of Palm Desert or its agents, officers or employees, to attack, set aside,
void, or annul, any approval of the City of Palm Desert, whether by its City Council,
Planning Commission, or other authorized board or officer of the City.
8. If the presence of cultural resources is identified in the cultural resources inventory, an
approved Native Cultural Resource Monitor shall be on -site during ground -disturbing
activities.
9. Should human remains be discovered during the construction of the proposed project,
the project coordinator would be subject to either the State Law regarding the discovery
and disturbance of human remains or the Tribal burial protocol. In either circumstance, all
destructive activity in the immediate vicinity shall halt, and the County Coroner shall be
contacted pursuant to State Health and Sa-ety Code 7050.5. If the remains are determined

to be of Native American origin, the Native American Heritage Commission (NAHC) shall be
contacted. The NAHC will make a determination of the Most Likely Descendant (MLD). The
City and developer will work with the designated MLD to determine the final disposition of the
remains.
10. All sidewalk plans shall be reviewed and approved by the Department of Public Works.
11. Developer shall enter into a recordable Disposition and Development Agreement to
memorialize these, and other conditions stated within the Disposition and Development
Agreement placed on the project.
12. The project shall have a density of 60 dwelling units on the 1.54 acres.
13. The project land uses shall conform to the DE zone. Restaurant uses are permitted
throughout the mixed -use project as a part of the CUP approval.
14. Lighting plans shall be submitted in accordance with Palm Desert Municipal Code
PDMC) Section 24.16 for any landscape, architectural, street, or other lighting types
within the project area.
15. The property shall be maintained in accordance with landscape maintenance
requirements contained in the PDMC.
16. The applicant or any successor in interest shall comply with all applicable local, state,
and federal laws and regulations.
PLANNING COMMISSION:
17. The applicant shall revise the landscape plan to include pedestrian -friendly plants on all
sides of the property, add additional landscape screening to the southeast portion of the
lot, and consider using non -deciduous landscaping. The City's Architectural Review
Commission (ARC) shall review the landscape plan at the time that the ARC reviews the
construction drawings.
PUBLIC WORKS DEPARTMENT:
Prior to recordation of the Parcel Map and any permits:
18. The parcel map shall be submitted to the City Engineer for review and approval.
19. Easements for drainage, pedestrian, and public utility purposes shall be provided as
needed on the final parcel map.
20. Utilities shall be relocated and easements abandoned as needed so as not to conflict with
the proposed infrastructure.
21. The applicant shall pay the appropriate signalization fee in accordance with City of Palm
Desert Resolution Nos. 79-17 and 79-55 and drainage fee in accordance with Section
26.49 of the PDMC and Palm Desert Ordinance Number 653.
22 Park fees in accordance with PDMC Section 26.48.060 shall be paid prior to the
recordation of the tract map.

23. The applicant shall submit Covenants, Conditions, & Restrictions (CC&Rs) concurrently
with the final map for review and approval. Once approved by the City, the CC&Rs shall
be recorded with the County Recorder's Office.
24. Horizontal control requirements shall apply to this map, including state plane coordinates,
which shall conform to City of Palm Desert specifications.
Prior to the issuance of a grading permit:
25. The applicant shall submit a grading plan to the Public Works Department for review and
approval. Any changes to the approved civil or landscape plans must be reviewed for
approval prior to work commencing.
26. The applicant shall submit a PM10 application for approval. The applicant shall comply with
all provisions of PDMC Section 24.12 regarding Fugitive Dust Control.
27. The applicant shall abide by all provisions of City of Palm Desert Ordinance 843, Section
24.20 Stormwater Management and Discharge Ordinance.
28. The applicant shall abide by PDMC Section 27.12.56, and retain stormwater on -site to
the 100-year, 24-hour storm.
29. The applicant shall submit a final Water Quality Management Plan (WQMP) for review
and approval. The WQMP shall identify the Best Management Practices (BMPs) that will
be used on the site to control predictable pollutant runoff. Prior to the issuance of the
grading permit, the Operation and Maintenance Section of the approved final WQMP
shall be recorded with County's Recorder Office and a conformed copy shall be provided
to the Public Works Department.
30. Provide the City Engineer with evidence that a Notice of Intent (NOI) has been filed with
the State Water Resources Control Board. Such evidence shall consist of a copy of the
NOI stamped by the State Water Resources Control Board or the Regional Water Quality
Control Board, or a letter from either agency stating that the NOI has been filed.
31. The applicant shall enter into an agreement and post security, in a form and amount
acceptable to the City Engineer, guaranteeing the construction of all off -site
improvements. Plans shall be submitted for review and approval prior to construction.
Improvements shall include, but are not limited to:
A. The installation of a driveway on Fred Waring Drive.
B. The installation of a driveway on Santa Rosa Way.
C. The modification of an existing curb ramp on the corner of San Pablo Drive and
Santa Rosa Way.
D. The installation of an ADA compliant sidewalk on Santa Rosa Way.
E. The installation of a full -capture trash device in the catch basin on San Pablo
Avenue.

BUILDING AND SAFETY DIVISION:
32. This project shall comply with the latest adopted edition of the following codes:
A. 2019 California Building Code and its appendices and standards
B. 2019 California Plumbing Code and its appendices and standards
C. 2019 California Mechanical Code and its appendices and standards
D. 2019 California Electrical Code
E. 2019 California Energy Code
F. 2019 California Green Building Standards Code
G. 2019 California Administrative Code
H. 2019 California Fire Code and its appendices and standards
33. Provide building height and area analysis to determine compliance with CBC Section 503.
Justify any area increases to height and area as permitted per CBC Sections 504 and506.
34. Provide a complete set of scaled or fully dimension elevations to determine the number of
stories for the proposed project. CBC Section 503 (Definition of "Grade Plan" "Story" and
Story above gradeplane").
35. Provide an area analysis on the first sheet of the plans to justify the allowable floor areas for a
mixed occupancy building. The sum of the ratios of the actual area for each occupancy
divided by the allowable area for each occupancy must not exceed 1.00. For buildings with
fire walls, use the floor area of each separate "building" to justify the area. CBC Section
508.4.2 and 706.1.
36. Submit an exit plan that labels and clearly shows compliance with all required egress features
such as, but not limited to, common path of travel, the required number of exits and
separation, occupant load, required width, continuity, travel distance, elevators, etc. CBC
1001.1.
37. An approved automatic fire sprinkler system shall be installed as required per the City of Palm
Desert Code Adoption Ordinance 1351.
38. A disabled access overlay of the precise grading plan is required to be submitted to the
Department of Building and Safety for plan review of the site accessibility requirements as
per 2016 CBC Chapters 11A & B (as applicable) and Chapter 10.
39. All exits must provide an accessible path of travel to the public way. (CBC 1027.5 & 11B-
206).
40. Detectable warnings shall be provided where required per CBC 11B-705.1.2.5 and 11B-
705.1.2.2. The designer is also required to meet all ADA requirements. Where an ADA
requirement is more restrictive than the State of California, the ADA requirement shall
supersede the State requirement.
41. Provide an accessible path of travel to the trash enclosure. The trash enclosure is required
to be accessible. Please obtain a detail from the Building and Safety Division.

42. Public pools and spas must be first approved by the Riverside County Department of
Environmental Health and then submitted to the Building and Safety Division. Pools and Spas
for public use are required to be accessible.
43. All contractors and subcontractors shall have a current City of Palm Desert Business License
prior to permit issuance per Palm desert Municipal Code, Title 5.
44. All contractors and/or owner -builders must submit a valid Certificate of Worker's
Compensation Insurance coverage prior to the issuance of a building permit per California
Labor Code, Section 3700.
45. Address numerals shall comply with Palm Desert Ordinance No. 1351 (Palm Desert Municipal
Code 15.28. Compliance with Ordinance 1351 regarding street address location, dimension,
a stroke of line, distance from the street, height from grade, height from street, etc. shall be
shown on all architectural building elevations in detail. Any possible obstructions, shadows,
lighting, landscaping, backgrounds or other reasons that may render the building address
unreadable shall be addressed during the plan review process. You may request a copy of
Ordinance 1351 or Municipal Code Section 15.28 from the Department of Building and Safety
counterstaff.
46. Please contact Tameca Williams, Management Specialists II, at the Building and Safety
Division (760-776-6420) regarding the addressing of all buildings and/orsuites.
FIRE DEPARTMENT:
47. Final fire and life safety conditions will be addressed when building plans are reviewed
by the Fire Prevention Bureau. These conditions will be based on occupancy, use, the
California Building Code (CBC), California Fire Code (CFC), and related codes, which
are in force at the time of building plan submittal.
48. The proposed project may have a cumulative adverse impact on the Fire Department's
ability to provide an acceptable level of service. These impacts include an increasing
number of emergency and public service calls due to the increased presence of
structures, traffic, and population. The project proponents/developers will be expected to
provide for a proportional mitigation to these impacts via capital improvements and/or
impact fees.
49. Fire Department emergency vehicle apparatus access road location and design shall be
in accordance with the current California Fire Code, PDMC, and Riverside County Fire
Department Standards. Plans must be submitted to the Fire Department for review and
approval prior to building permit issuance.
50. Fire Department water systems(s) for fire protection shall be in accordance with the
current California Fire Code, City of Palm Desert, and Riverside County Fire Department
Standards. Plans must be submitted to the Fire Department for review and approval prior
to building permit issuance.

BACKGROUND
On August 25, 2021, the City Council adopted Resolution 2021-57 approving the Vitalia
Apartments, a 269-unit affordable apartment development located on the southwest corner of
Gerald Ford Drive and Planned Extension of Rembrandt Parkway. The notice of action and
minutes are attached to this memorandum for reference as well as the final resolution of the
project. The final construction drawings have been submitted for plan check with Building and
Safety Division and are pending building permit issuance. The Architectural Review Commission
is to review the architectural plans for substantial conforms with the preliminary exhibits approved
for the above noted Vitalia Apartments.
The preliminary approved plans are attached for reference. The final construction plans will be
provided at the meeting.
The Architectural Review Commission will not take action on this item as it is informational to
demonstrate the plans are in conformance with the preliminary approval.

Upon a motion by Commissioner Levin, seconded by Commissioner McAuliffe, and
a 5-0 vote of the Architectural Review Commission, the minutes were approved with
corrections. (AYES: Lambell, Levin, McAuliffe, McIntosh, and Van Vliet; NOES: None;
ABSENT: Vuksic).

NATURE OF PROJECT/APPROVAL SOUGHT: Consideration of a
recommendation to the Planning Commission for approval of PP 21-0004 for a
269 unit apartment project.
APPLICANT AND ADDRESS: Pacific West Communities, Inc., Eagle, ID.
LOCATION: APN 694-310-006, Southwest corner of Gerald Ford Drive and
Rembrandt Parkway
ZONE: PR-20
Associate Planner, Nick Melloni, presented the item. Mr. Melloni noted this item
was brought before the Commission at the Architectural Review Commission
meeting held April 27, 2021. He stated staff recommends approval of the
project with comments from the Commission being added as conditions of
approval. Mr. Melloni introduced the applicant who provided a detailed
presentation on the revisions to the project. Discussion on the item ensued with
Commissioners providing comments and concerns for the project.
Upon a motion by Commissioner McAuliffe, seconded by Commissioner
Levin, and a 3-2 vote of the Architectural Review Commission, Case No. PP
21-0004, was approved subject to the following: 1) The building entrance
elements for all two and three-story buildings should be differentiated from the
balcony elements; 2) The hours of operation for the dog park should be
restricted to prevent adverse impacts to adjacent apartment units; 3) Colors A
(SW 7138 “Lavender Wisp”) and E (SW 6479 “Drizzle”) of the color palette shall
be revisited to better align with the desert color palette; 4) Applicant should be
attentive as to how the color patterns are distributed throughout the project site;
5) All downspouts for roof element drainage shall be concealed within the
building and not exposed; 6) The detail of the drip edge at the apartment

balconies shall be carefully considered to prevent drainage overrun over the
building’s vertical surfaces; 7) The final location of all fire risers and utility
connections shall be coordinated so that it is concealed from direct view and

VI. COMMENTS
Associate Planner, Kevin Swartz, advised the Commission as of the current meeting
and moving forward, minutes will be completed in action minute format, noting this
change was approved by City Council in November 2020.

took the following action at its meeting of May 11, 2021:
By Minute Motion, the Architectural Review Commission approved Case No. PP
