Report On: Change of Zone, Development Plan, Parcel Map, and related Pre-
liminary Design Review Request
Case Nos.: C/Z 11-78, DP 14-78, PM 13406, and 148MF
Applicants: G. MARZICOLA (C/Z & PM); and, D. K. KAVANAUGH (DP & MF)
Date: October 3, 1978
I. REQUEST:
The property owner (G. Marzicola) has control of approximately 158.4
gross acres generally located on the east side of Cook Street, northerly
of Merle Drive. The proposal in this series of related applications
seeks to gain preannexation zoning consisting of two Planned Residential
densities (PR-5 and PR-7), and Service Industrial. The site is pro-
posed to be divided into residential and industrial parcels. The initial
development of the site is being carried forward by D. K. Kavanaugh
(applicant) on the largest of the two residential parcels created. The
applications submitted are as follows:
C/Z 11-78 - A Change of Zone from 'S' Study to PR-5(U.A.), 80 acres;
PR-7(U.A.), 35.2 acres; and, S.I.(U.A.) 43.2 acres.
DP 14-78 - A Planned Residential Development encompassing a total
of 115.2 acres (80 acres proposed for initial develop-
ment), and a Service Industrial District of 43.2 acres.
Preliminary design details have only been submitted for
the 80 acre PR-5 development.
PM 13406 - A Parcel Map to create four parcels. Two residential
parcels at 35.2 acres and 80 acres; and, two service
industrial parcels at 34.7 acres and 8.5 acres.
148MF - Preliminary Design Review to provide for 381 single-family
detached units and related recreational amenities on an
80 acre portion of the subject property located in the pro-
posed PR-5 Zone.
II. STAFF RECOMMENDATION:
By Planning Commission Resolution No. 400, recommend to the City Council
approval of a Change of Zone in modifiesform, from 'S' to PR-5(U.A.)
(80 acres), PR-5, S.P.(U.A.) (35.2 acres), S.I., S.P.(U.A.) (approx. 34.7
acres), and S.I.(U.A.) (approx. 8.5 acres), a Development Plan with a maxi-
mum of 381 dwelling units subject to conditions; and, approval of a Tenta-
tive Parcel Map creating four parcels subject to conditions and the Pre-

4. The revised Change of Zone conforms to the intent and purpose
of the City's Zoning Ordinance.
Development Plan -
1. The proposed project (as modified) conforms in concept to the
intent and purpose of the PR and SI zones.
2. The proposed project (as modified) is suited for the specific
site and is compatible with existing and proposed development
in the area.
3. The proposed project (as modified) will not be detrimental to
the health, safety, and general welfare of the community.
Tentative Parcel Map -
1. The proposed Tentative Parcel Map substantially complies with
Chapter 26 of the City of Palm Desert Municipal Code, and the
state of California Subdivision Map Act, as amended.
2. The proposed Tentative Parcel Map does comply with the adopted
General Plan and Palm Desert Zoning Ordinance.
Preliminary Design Review -
1. The proposed project conforms to all legally adopted development
standards.
2. The design and location of the proposed project will not impair
the desirability of investment or occupation in the area in which
it is located.
3. The proposed project is in keeping with the character of the sur-
rounding planned area.
III. BACKGROUND:

- 570' cul-de-sac extending northerly from proposed Hovely Lane
(provides access to residential parcels along proposed pro-
perty line separating parcel numbers 1 and 2).
- 700' private street extension running southerly from proposed
Hovely Lane connecting with street proposed in the tentative
industrial tract to the south (private street follows proposed
property line between service industrial parcels number 3 & 4).

E. Environmental Assessment - Director of Environmental Services has
determined that the subject project will
not have a significant adverse impact on
the environment and the appeal period has
expired.
DISCUSSION:
A. Chanoe of Zone:
The effect of the applicants request would be to establish the northern
limit of the General Plan Service Industrial land use allocation for
this area; and, to use a portion of the medium density residential
allocation (5-7 units/acre), lying to the north. Proposed Hovely Lane

IV. DISCUSSION: (Cont.)
A. Change of Zone:
A Scenic Preservation Overlay District designation (S.P.) is recom-
mended to be added to the proposed S.I. zoning classification on the
parcel immediately adjacent to Cook Street to recognize the "Scenic"
status of Cook Street and to be consistent with S.I., S.P. zoning
on the west side of this street.
B. Overall Development Plan:
The Development Plan consists of approximately 158 acres, with 80
acres of PR-5 being specifically planned for the initial phase.
The project is proposed to contain the following uses:
1. Single-family detached condominium units at 4.76 du/acre on
80 acres for a total of 381 units (initial phase).
2. Medium density residential at 7 du/acre on 35.2 acres for a
total of 246 units.
3. Service Industrial on a total of 43.2 acres.
Major access to the development is proposed from Cook Street. The
interior of the site would be served by an east -west curvilinear
street (proposed Hovely Lane). Hovely Lane begins at the approxi-
mate mid -point of western site boundary along Cook Street and travels
in a southeastern direction to align with 44th Avenue. This 100'
right-of-way forms the spine for two additional proposed streets:
one running northerly termination in a cul-de-sac, to separate and
provide access to the residential parcels; and, a southerly connec-
tion with the proposed industrial street in the tract lying to the
south.
The Staff recommendation for land use mix would suggest that the
following be approved:
1. Single-family detached @ 4.76 du/acre (80 acres as requested).
2. Single-family (low end of medium density range) @ max. of 5
du/acre (35.2 acres).
3. Service Industrial on 43.2 acres (as requested).
C. Initial Phase of the Development Plan:
The applicant has filed detailed conceptual plans for the initial
phase of development, which is the 80 acre single-family detached
area lying north of Hovely Lane (proposed), beginning approximately
850 feet east of Cook Street, extending to the eastern boundary of
the site. A total of 381 single -story units detached are located
predominantly around cul-de-sacs, rearing to common open space/
recreation areas.

D. Parcel Map: (Cont.)
The residential area would further require the filing of a sub-
division map for condominium purposes. The parcel map arrange-
ment and circulation system produces a concern for mixture of
residential and industrial traffic. Recommended conditions of
approval address access to the industrial parcels which would
tend to mitigate this concern.
E. Design Review Case:
The individual units proposed in the initial residential phase
would range from two to four bedrooms (primarily three -bedroom
units), changing between some ten different front elevations sub-
mitted. Roof treatments are proposed to be tile. Since only
front elevations have been received, staff would be concerned
that the roof design be continued on each side of the unit; a
special condition has been suggested for that purpose.
The Design Review Board expressed interest in the construction
design of the perimeter wall, noting that it would have a heavy
sand load to resist. Their conditions also relate to tree plant-
ing along the wall for site protection.

Description of Project:

Finding:
The project will not have a significant adverse effect on the environ-
ment and no further environmental documentation will be required.
Justification:
The project is compatible with the General Plan for the City of Palm
Desert. Based on the findings of the initial study, which study is on file
at the Palm Desert City Hall, no substantial significant environmental
effects will occur as a result of the action proposed by the subject project.
Any interested citizen may appeal this determination to the Planning Commission
within eight (8) days of the date of the posting of public notice by filing an appeal
in accordance with Resolution No. 73Z-R2' with the Department of Environmental

MATELY 158 ACRES. APPROVING A DEVELOPMENT PLAN
AND PRELIMINARY DESIGN REVIEW TO PROVIDE FOR 381
DWELLING UNITS ON AN 80 ACRE PORTION OF THE SITE
AND APPROVING A TENTATIVE PARCEL MAP CREATING
FOUR PARCELS.

WHEREAS, the Planning Commission of the City of Palm Desert,
California, did hold a duly noticed Public Hearing on October 3, 1978,
to consider a request by E. GEORGE MARZICOLA for a Change of Zone
from 'S' Study to PR-5(U.A.) (Planned Residential, max. 5 du/acre,
Upon Annexation), PR-7(U.A.) (Planned Residential, max. 7 du/acre)
and S.I.(U.A.) (Service Industrial, Upon Annexation), on approximately
158 acres on the east side of Cook Street and northerly of Merle
Drive and a related request for approval of a Parcel Map which would
divide the subject site into four parcels, the site being more particu-
larly described as: .

WHEREAS, the Planning Commission at the same Public Hearing did
consider a related request by D. K. Kavanaugh for approval of a Develop-
ment Plan and preliminary Design Review to allow 381 dwelling units on
approximately 80 acres within the PR-5(U.A.) zone being a portion of
the site described above; and,
WHEREAS, said application has complied with the requirements of
the "City of Palm Desert Environmental Quality Procedure Resolution
No. 78-32," in that the Director of Environmental Services has deter-
mined that the project will not have a significant adverse effect on
the environment and no further environmental documentation will be
required; and,
WHEREAS, at said Public Heraing, upon hearing and considering
the testimony and arguments, if any, of all interested persons desir-
ing to be heard, said Planning Commission did find the following facts
and reasons to exist to justify recommending a Change of Zone from
'S' Study to PR-5(U.A.), PR-5, S.P.(U.A.), S.I.(U.A.), and S.I., S.P.
(U.A.):
1. The land uses resulting from a revised Change of Zone
would be more compatible with adjacent and proposed
land uses.
2. The density resulting from the revised Change of Zone
would be compatible with densities permitted in ad-
jacent areas.
3. A revised Change of Zone would be more compatible
with the adopted General Plan and Scenic designation

2. The Commission does hereby recommend to the City Council
approval of a Change of Zone from 'S' Study to PR-5, S.P.(U.A.),
PR-5(U.A.), S.I., S.P.(U.A.), and S.I.(U.A.) as indicated on the
attached Exhibit 'A'.
3. The Commission does hereby approve the above described
Tentative Parcel Map No. 13559 subject to fulfillment of the condi-
tions set forth in the attached Exhibit 'B'.
4. The Commission does hereby recommend to -the City.Council
approval of a Development Plan and Preliminary Design Review subject

Commissioner Berkey suggested that a special meeting be
scheduled between staff and the Commission to dicuss the issues
of this project. Commissioner Kryder suggested that the Commis-
sion have an hour study session prior to the meeting to be held
on October 5, 1978, to discuss these cases. Commissioner Snyder
agreed. The applicant agreed with this and stated that he would
like to be at the study session to explain some of the issues in-
volved a little more thoroughly.
Chairman Kelly declared the Public Hearing reopened and on
a motion by Commissioner Kryder, seconded by Commissioner Fleshman
the cases were continued to October 5, 1978; carried unanimously
(5-0).

The property owner, G. Marzicola, has control of approxi-
mately 158.4 gross acres generally located on the east
side of Cook Street, northerly of Merle Drive. The pro-
posal in this series of related applications seeks to
gain preannexation zoning consisting of two Planned Re-
sidential densities (PR-5 and PR-7), and Service In-
dustrial. The site is proposed to be divided into re-
sidential and industrial parcels. The initial develop-
ment of the site is being carried forward by D. K. Kava-
naugh (applicant) on the largest of the two residential
parcels created. The applications submitted are as fol-
lows:
C/Z 11-78 - A Change of Zone from 'S' Study to PR-5(U.A.)
80 acres; PR-7(U.A.), 35.2 acres; and, S.I.
M .A.) 43.2 acres;
DP 14-78 - A Planned Residential Development encompassing
a total of 115.2 acres (80 acres proposed for
initial development), and a Service Industrial
District of 43.2 acres. Preliminary design
details have only been submitted for the 80
acre PR-5 development;
PM 13406 - A Parcel Map to create four parcels. Two re-
sidential parcels at 35.2 acres and 80 acres;
and, two service industrial parcels at 34.7
acres and 8.5 acres; and,

Commissioner Fleshman noted that he liked the cluster effect
but that he was still not happy with the traffic circulation, the
existing traffic should be considered. He noted his concern for the
need of the traffic signal and whether the City would be liable for
any accidents at this intersection. Commissioner Fleshman stated
that he was not happy with the location of the back of the market on
E1 Paseo. He also felt that there are other alternatives possible.
Commissioner Berkey noted that the Conditions could be changed
to reflect a restudy of the traffic circulation and that with good
landscaping the project would be good.
Commissioner Snyder stated that this is a good design for the
area and for Sandpiper and he hoped that the applicant would take the
suggestions of the Commission into consideration.
Commissioner Kryder stated that if the project were treated pro-
perly it could be attractive and the applicant has done a good job.
Also, the Commission should take the applicant at his word that he has
tried everything to make this a fine and workable project.
Chairman Kelly stated that she would like to have the project
sent back to the Design Review Board and she would like a better design
and more study done on the traffic ciruclation pattern. She also noted
that the proposed commercial area will add to the traffic problem that
already exists.
There was some more discussion on the traffic signal and how
long it would take to get it installed. Mr. Beebe stated that the State
waits until the traffic is generated before considering installing a
a traffic signal and the State makes the decisions,nobody else.
Mr. Burnett stated again that they have done
the best design possible and have gone to
great lengths to comply with the City require-
ments. He stated that he would like to know
what the problem is and just what the Commission
wants.
Commissioner Fleshman stated that the Design Review Boards'
comments on circulation and the loading area for the market and his
suggestion to explore other alternatives for the location of the build-
ings which might create better ciruclation are his main concern. He
also suggested that the market be moved and get a common loading area.
Commissioner Berkey stated that the project should not be delayed
until November but perhaps it could be continued until the October 31st
meeting.

Vice -Chairman Snyder declared the Public Hearing open and
asked if the applicant wished to speak at this time.
DON KAVANAUGH, applicant, noted that there will be
a storage lot that will hold 12-30 recreational
vehicles; there will be staggered setbacks; and, he
noted that he had met with the Fire Marshal and they
have complied with his concerns.
E. GEORGE MARZICOLA, applicant, noted reasons for
requesting PR-7 zoning as being the need for a buffer
between the road and the single-family area.
Vice -Chairman Snyder asked if there was anyone wishing to speak
in FAVOR or in OPPOSITION to the proposed project.
CHARLES GIBBS, owner of 120 acres west of the
proposed project, noted that he is in favor of
annexation, and does not oppose the PR request
but he does oppose the S.I. designation. He
stated that half of the S.I. should have to
be O.S. as he was required on his project.
Mr. Williams noted that the Park and Recreation Master Plan had
recently been updated and that there is no need for a park in this area.
He also noted that S.I. is the zoning on the east side of Cook Street
and that this designation allows offices as well as industrial.
Vice -Chairman Snyder declared the Public Hearing closed and asked
for the pleasure of the Commission.
Commissioner Kryder had no comment.
Commissioner Berkey stated that the request is not in accordance
with the General Plan and that he does not agree with the request for
an increase in density. The City needs to take a fresh look at the
General Plan.
There was some discussion about increasing the density or not
increasing the density in this area.
Vice -Chairman Snyder and Commissioner Kryder both noted that
they felt that a decision should not be made at this time until the
joint meeting with the City Council and this area has been discussed
mare fully.
Commissioner Fleshman noted that this puts the staff in a bad
position as they tell the applicant what is recommended in the General
Plan and then the Commission feels otherwise.

Condition No. 12 would be added to read: Prior to preparation of
construction drawings, the applicant shall provide expanded recrea-
tional amenities, as expressed in detailed plans for each specific
area. The additional recreational amenities shall relate specifical-
ly to the proposed orientation of the units said areas will serve.
On a motion by Commissioner Berkey, seconded by Commissioner
Kryder, the Commission approved the Change of Zone in modified form
from 'S' to PR-5(U.A.) (approximately 115.2 acres) and S.I., S.P.
(U.A.) (approximately 43.2 acres), a Development Plan with a maximum
of 381 dwelling units and the Tentative Parcel Map creating 4 parcels
and the Preliminary Design Review of the initial 80 acre residential
development all subject to compliance with conditions including the
noted addition of Special Conditions No. 8 through 12, by Planning
Commission Resolution No. 408; carried (4-0-1) AYES: Berkey, Flesh -
man, Kryder, Snyder; ABSTAIN: Kelly.
F. Case No. CUP 11-78, ROMITTI'S WINE CELLAR, Applicant
Request for approval of a Conditional Use Permit
to allow fine wine sales, imported cheeses and a
deli sandwich bar within the C-1, S.P. zone at
the northeast corner of E1 Paseo and Larkspur Lane
and a related Variance to reduce the .number of parking
spaces from 14 spaces required by the Municipal Code
to 6 spaces.
Mr. Cipriani reviewed the case and noted the parking Variance
request could be approved due to the joint use parking section.
Chairman Kelly declared the Public Hearing open and asked if
the applicant wished to speak at this time.
NANCY RICARD, partner in the project, noted her
agreement with the Staff's recommendations.
Chairman Kelly asked if there was anyone wishing to speak in
FAVOR or in OPPOSITION to the project.
BILL HOBBS, noted his approval of the project.
CHARLES RILEY, leasing agent, stated that all the
local tenants are in favor of the project.
Chairman Kelly declared the Public Hearing closed and asked for
the pleasure of the Commission.
Chairman Kelly asked that a condition be added that would have
the Staff check back at a later time to see if the parking situation
has become a nrohlem. so that if there is a nrohlem the Commission f
not war* to consolidate parcels, then single family resi-
dences ild still be built on eac ndividual lot.
)" Mayor Mullins declared the Public Hearing open and invited
input in FAVOR of the rezoning.
MR. KENNETH BARBIER, 72-879 Arbolita, Palm Desert, addressed
Council stating his appreciation for the consideration of the
City and the Planning Commission. He pointed out, however,
that the rezoning from R-1-12,000 to R-2-7,000 did not
solve his problem, only complicates it. The lots vary in
size from 12,000 - 15,000 sq. ft., and he wished to build
duplexes and triplexes. To combine the property would be
impossible from an expense standpoint. The Coachella Valley
County Water District had advised him that if he built on
the lots as they exist now, the cost for water and sewer
will be the normal cost. However, if the lots are to be
combined into one area, the cost would be $32,000 for
sewers and $1,600 to $1,700 per unit for water service.
He respectfully requested the Council's approval of the
R-2-6,000 which would allow duplexes.
Mayor Mullins invited input in OPPOSITION to the rezoning,
and none was offered. He declared the Public Hearing closed.
Councilman Wilson stated his preference to leave the
zoning as it was because of the close proximity of the
property to existing homes.
Councilman Newbrander stated that she had been contacted
by many homeowners near this property who were opposed to
this rezoning.
Councilman McPherson stated that he could not support an
R-2-6,000 designation inasmuch as Council was looking for
every opportunity to upgrade the area by the College, and
he did not feel this was a solution.
Councilman McPherson moved to approve a Change of Zone from
R-1-12,000 to R-2(7) by waiving further reading and passing Ordinance
No. 196 to second reading. Mayor Mullins seconded the motion.
Councilman Wilson pointed out that the applicant had indicated
that the R-2(7) designation would not resolve his problems, but
create a bigger one. Mr. Barbier agreed and stated his con-
currence that a continuance to consult with Staff would be
helpful to him.
Councilman McPherson withdrew his motion, and Mayor Mullins
withdrew his second of the motion.
Councilman Brush moved to continue the matter to the meeting
of November 9, 1978. Councilman Wilson seconded the motion; carried
unanimously.

that portion of the property along Cook Street. From
the standpoint of the General Plan, the request is a
major consideration because the proposed S.I. Zone dis-
trict request establishes the maximum northerly limits
of said area to something less than specified on the land
use map of the General Plan and defines the easterly limits
of the service industrial area. Also, the request provides
for the transition from Industrial to Residential at
Hovely and 42nd Avenue, very similar to the northerly
limits of Service Industrial west of Cook Street.
Mr. Williams reviewed two major changes the Commission
had felt necessary to the Development Plan which had been
resolved in Special Condition No. 3 and No. 12 of the
proposed Ordinance No. 195.
In conclusion, Mr. Williams stated that it was Staff's
recommendation to approve the Change of Zone to PR-5
and the Development Plan limiting the number of units
to 380, subject to compliance with conditions.
Councilman Newbrander asked Mr. Williams if this was a
sand dune area, and he replied that it was.
Mayor Mullins declared the Public Hearing open and invited
input in FAVOR of the project.
MR. GEORGE MARZICOLA, 73-743 Highway 111, Palm Desert,
addressed Council as the applicant. He stated their
substantial concurrence with the Staff and Planning
Commission.
MR. DON KAVANAUGH, 1143 Kiberly Place, Redlands, California,
addressed Council as the applicant, stating his concurrence
with Staff. In response to Councilman Wilson's question,
he stated that the houses proposed will range in price
from $43,000 to $53,000.
Councilman Newbrander asked Mr. Kavanaugh if he didn't
feel that a 3 bedroom home would be really jammed into
1,153 sq. ft. He stated that he did not feel it would.
Councilman McPherson asked whether or not the developer
had any clients for the Service Industrial area. Mr.
Marzicola stated that there were no specific commitments
as yet, but a great deal of interest. .
Mayor Mullins invited input in OPPOSITION to the project, and
none was offered. He declared the Public Hearing closed.
Councilman Wilson moved and Councilman McPherson seconded to
waive further reading and pass Ordinance No. 195 to second reading,
approving a Change of Zone from S to PR-5 (U.A.), PR-5, S.P. (U.A.),
S.I., S.P. (U.A.) and S.I. (U.A.) and a Development Plan for a maxi-
mum of 380 dwelling units, subject to compliance with conditions.
Motion carried unanimously.

CONDITIONS OF APPROVAL
EXHIBIT B
Standard Conditions:
1. The development of this project shall conform substantially to
all plans submitted in behalf of this case and as revised
according to the Design Review Board process and/or Planning
Commission action. Any minor changes requires approval by the
Director of Environmental Services. Any substantial change
- requires approval by the Planning Commission.
2. All requirements of any law, ordinance, or regulation of the
State, City, and any other applicable government entity shall
be complied with as part of the development process.
3. This approval is applicable, subject to the development of this
project, commencing within one year from approval date and being
promptly completed.
4. Any roof mounted, exhaust, or air conditioning equipment shall
be fully concealed from view from any public rights -of -way and
adjoining properties by architecturally integrated means.
5. Construction plans shall be submitted for approval to the City
Fire Marshal prior to issuance of building permits. All con-
ditions shall be made a part of construction and no certificate
of occupancy shall be issued until completed.
6. All utility service and distribution lines on or abutting the
subject property, shall be placed underground prior to occupancy
clearance.
7. Traffic control provisions shall be provided as required by
the Director of Public Works.
8. Curb, gutter, sidewalk or approved pathways, and tie-in paving
shall be provided in conformance with City Standards and/or
as required by the Director of Public Works.
9. The Fire Protection Requirements as specified in the Fire Mar-
shal's memo dated September 14, 1978, attached hereto, shall
apply.
10. Prior to issuance of a building permit for construction of any
use contemplated by this approval, the applicant shall first
obtain permits and/or clearance from the following agencies:
Riverside County Department of Health
Palm Desert Design Review Board Process
City Fire Marshal
Coachella Valley County Water District
Evidence of said permit or clearance from the Above agencies
shall be presented to the Dept. of Building and Safety at the
time of issuance of a building permit for the use contemplated

Special Conditions:
1. Eleven feet of right-of-way shall,be dedicated along the easterly
side of Cook Street.
2. That roof treatments on dwelling units be carried around on all
building elevations.
3. That dwelling unit arrangements shall be varied to break-up the
visual front yard regimentation along street frontages. This may it
be accomplished by staggering front yard setbacks, curving streets,
or any combination of techniques to achieve this design objective.
4. A common area shall be designated and improved for the storage of
homeowner recreational vehicles. r
5. Where dwelling units back directly to the rear of other units,

opposite ends of the buildings, so that no two patio areas are
directly across from each other.
6. The first two corner dwelling units on each cul-de-sac shall have
radial driveways.with garage doors oriented to the side, rather
than the street frontage.
7. Adequate turning radius shall be provided on all cul-de-sacs as
required by the City Fire Marshal.
8. All cul-de-sacs shall be modified to permit a 40' radius.
9. A detailed drawing of the perimeter wall shall be submitted for
further review.
10. Landscaping of the perimeter wall shall include a double row plant)
ing of tamarisks and facing of oleanders.
11. Substitute plants for pines and locusts shall be provided. The
landscaping plan shall place greater emphasis on trees and vines,
rather than shrubs.
12. Prior to preparation of construction drawings, the applicant shall
provide expanded recreational amenities, as expressed in detailed
plans for each specific area. The additional recreational amenities
shall relate specifically to the proposed orientation of the units
said areas will serve.

supply main from which the flow is measured at the time of measurement.
2. Install Riverside County super fire hydrants located at each street intersection
(a) but not greater than 400 feet apart in any direction.
A. Exterior surface of hydrant barrels and heads shall be painted chrome yellow,
and the tops and nozzle caps shall be painted orange.
B. Curbs shall be painted red 15 feet in either direction froareach hydrant.
3. Prior to recordation of the final map, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
4. The water system plan shall be signed by a registered civil engineer and approved
by the water company, with the following certification: "I certify that the design
of the water system in Parcel Map No. 13406 is in accordance with the requirements
prescribed by the Fire Marshal." Upon approval, the original plan will be returned

Thursday of each month, at 7:00 PM in the Council Chambers in the City
Hall, 45-275 Prickly Pear Lane. 2) Planning Commission meetings are
held on Tuesday, nine (9) days prior to the first Council meeting of
the month, also at 7:00 PM in the Council Chambers and Wednesday, eight
(8) days prior to the second Council meeting of the month, at 1:00 PM
in the Council Chambers. 3) The Design Review Board convenes on Tues-
day, a week before the Planning Commission, at 5:30 PM in the Council
Chambers.
Public Hearing: Public hearings are held when the City considers re-
quests for a change of zone, variance, conditional use permit, general
plan amendment, etc. Legal notices for these hearings are published
in the Palm Desert Post at least ten (10) days prior to the hearing.
Public hearing items before the Palm Desert Redevelopment Agency are
published in the Desert Sun.
Appeals: Where the Zoning Ordinance provides for appeal to the City
Council or Planning Commission, the appeal shall be made within fifteen
(15) days of the date of the decision by filing an application of appeal
with the Director of Environmental Services.

Building Permits: Building permits are issued by the Department of
Building and Safety and are required before any new construction, re-

and building code clearance for the proposed use is required and a city
