She said she was very concerned about the school situation, fire protection, traffic increase, and water shortage, and yet we have gone ahead and built and built. She reminded that over a year ago, she had made a motion for a moratorium which had died for lack of a second. She concluded by saying that it was obvious how fast ground is being used up when developers start building on storm channels. Councilman Wilson stated his concurrence with Councilman i Newbrander's concerns, but pointed out that the issue was what to do with this piece of property. He felt that in order to provide proper flood control, this piece of property must be zoned Planned Residential. He also stated that he felt strongly that we needed some citizens of Palm Desert going to the School District expressing everyone's concerns. Mayor Mullins declared the Public Hearing closed. Councilman Wilson stated that the EIR presented here was the most complete and comprehensive report he had seen and moved to cer- tify the EIR as complete by adopting Resolution No. 78-97. Councilman McPherson seconded the motion; carried unanimously with the members present. Councilman McPherson stated that he agreed with Councilman Wilson's comments that the issue at hand was land use and zoning. In his opinion, he had to go along with the Planning Commission and their recommendation for PR-3. He felt 140 units is too many for the property, and the PR-3 is better than R-1-20,000 as it provides for open space, storm water protection, etc. Councilman McPherson moved to waive further reading and pass Ordinance No. 188 to second reading, approving the change of Zone from R-1-20,000 to PR-3. Councilman Wilson seconded the motion. The motion carried on a 3-1 vote with Councilman Newbrander voting NOE and Councilm g absent. B. CASE NO. CZ 04-78 Q2VE CONSTRUCTION, Applicant: Considera- on of a Re u or a Change of Zone from PR-5, S.P. and PR- --12,000 on a Parcel Approximately 75 Acres in Size, Generally Located East of Highway 74, Between Homestead and Portola. Mayor Mullins declared the Public Hearing open. Mr. Williams presented the Staff Report indicating that the property is presently zoned for PR-5. The request, which is for R-1-12,000, would be a reduction in density of approximately 3 units to the acre. The Planning Com- mission and Staff believes that this is more compatible with the surrounding zoning, and therefore recommends approval of the change of zone by Ordinance No. 189. Mayor Mullins invited input in FAVOR of the change of zone. i Mayor Mullins invited input in OPPOSITION to the zoning, and none was offered. He declared the Public Hearing closed. Councilman McPherson moved and Councilman Newbrander seconded to waive further reading and pass Ordinance No. 189 to second reading, approving a Change of Zone from PR-5. S.P. and PR-5 to R-1-12,000 and R-1-12,000 S.P. Motion carried unanimously with the members present. C. CASE NO. CA 06-78, HAROLD KAPP, Applicant: Consideration of a Request for Approval of a Change of Zone from R-1 and R-3 (4) to R-3 (9) on Approximately .25 Acres Located on the East Side of Portola Between San Marino Circle and Alessandro Street. Mayor Mullins declared the Public Hearing open. Mr. Williams presented the Staff Report stating that the reason for the request was to provide the applicant with the ability to apply for a Conditional Use Permit for a parking lot. The City is acquiring additional right-of-way or 14' of this property, which will have a drastic effect on the width of the lot. In review of the CUP, the Planning Commission did stipulate that the exit on San Marino must be closed and properly landscaped to provide safety. The Commission, by Resolution No. 380, did recommend Council approval for the change of zone requested. Mayor Mullins invited input in FAVOR of the rezoning. MR. HAL KAPP, 46-850 Amira, Palm Desert, stated that in order for him to do this project and still give the 14' dedication, he needed the change of zone. Mayor Mullins invited input in OPPOSITION to the rezoning. MISS MAGGIE LEON, 74-046 Alessandro, Palm Desert, expressed opposition inasmuch as her home was directly adjacent to the proposed parking lot, and she felt it would create a noise problem and nuisance problem. She stated that it was a poor place for a parking lot and that it would create a traffic problem. Mayor Mullins declared the Public Hearing closed. Councilman McPherson stated that because of the widening of Portola and the fact that there is thus not much use available for that lot but parking, he would move to waive further reading and pass Ordinance No. 190 to second reading. Councilman Wilson seconded the motion. The motion carried on a 3-1 vote, with Councilman Newbrander voting NOE and Councilman Brush being absent. D. CASE NO. Unless the demand for electrical generating capacity exceeds our estimates, and provided that there are no unexpected outages to major sources of electrical supply, we expect to meet our electrical load requirements for the next several years. Our total system demand is expected to continue to increase annually; and, if our plans to proceed with future construction of new generat- ing facilities are delayed, our ability to serve all customer loads during peak demand periods could become marginal by 1981. In addition, the major fuel used in Edison's generating facilities is low sulfur fuel oil. We now believe our low sulfur fuel oil inventory, together with our contractual commitments for delivery, and our customers' conservation efforts, will permit us to meet the forecasted demand for electricity during 1978. It is our intention to continue to do everything that can reasonably be accomplished to provide our customers with a continuous and sufficient supply of electricity. REQUEST: Request for a Change of Zone from PR-5, S.P. and PR-5 to R-1 12,000 S.P. on a parcel approximately 75 acres in size generally located east of Highway 74, between Homestead Road and Portola Avenue. II. STAFF RECOMMENDATION: That the Planning Commission recommend approval of the Change of Zone to the City Council by adopting Resolution No. 377. Justification: 1. The proposed Change of Zone does conform to the Palm Desert General Plan. 2. The proposed Change of Zone will not adversely effect the health, safety, or general welfare of the community. 3. The proposed Change of Zone will result in a density and land use compatible with adjacent densities and land use. III. BACKGROUND: A. Parcel Size: Approximately 75 acres B. Location: Generally located east of Highway 74, between Homestead Road and Portola Avenue. C. Existing Zoning: PR-5, PR-5, S.P. D. Adjacent Zoning: North - R-1 13,000 S.P. and R-1 10,000 South - PR-6 and PR-7 East - R-1 10,000 and PR-7 West - PR-8, PR-7, R-1 S.P. E. EIR Finding: The Director of Environmental Services has determined Case No. C/Z 04-78 July 5, 1978 IV. DISCUSSION: (Cont.) Page Two The only recommended modification to the proposed Change of Zone, Staff feels is warranted, would be the designation of the most westerly 300 feet of the site which borders Highway 74 as a scenic preservation over- lay along Highway 74, a designated Scenic Highway. Therefore, the Staff's recommendation to the Commission would be to recommend to the Council approval of the Change of Zone with the added Scenic Preservation overlay designation for the westerly 300 feet of the site. Chairman Berkey noted that since the Desiti_n Review Board had continued the case, the Commission should not be considerinv it and Special Condition No. 8 should be deleted and left up to the Design Review Board. Commissioner Fleshman noted that the spire should be left as proposed or not at all, the building will speak for itself. Commissioner Kryder stated that the 77 ft. spire is necessary for the architecture of the building and to eliminate it the building might loose impact, and noted his approval of the Variance request. Commissioner Snyder stated that he agreed that the spire was an important part of the church but that we do have an ordinance and a Design Review Board, so let the architect work it out with them. Commissioner Kelly suggested that just the CUP be approved and eliminate the Variance. Commissioner Snyder stated that the Variance should be denied and adopt the Resolution as written but leave the spire up to the Design Review Board. Mr. Williams adviged the applicant that the nest Design Review Board meeting was July 11, 1978, at 5:30 p.m. and that they would need a sample material board. On a motion by Commissioner Snyder, seconded by Commissioner Fleshman, the Commission approve the Conditional Use Permit with Il the noted changes to the Conditions of Approval and denied the re- quest for a Variance by Planning Commission Resolution No. 376; carried (4-1) (AYES: Berkey, Fleshman, Kelly, Snyder; NOES: Kryder).
