Dear Mr. Sweet:
As a result of the dialogue between yourself and the Planning
Commission at the August 1st, Study Session regarding the Bishop
of San Diego's proposed project at Sacred Heart parish, it is
recommended that you pursue a Change of Zone from the present
R-1 9,000 designation to the Planned Residential zone. Staff
would recommend a designation of PR-4 in order to achieve the
density originally contemplated. We have enclosed a copy of
the development standards for the Planned Residential District
which must be adhered to when designing your project, in addition
to the appropriate application forms you will need.

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA, INITIATING AN
AMENDMENT TO THE ZONING MAP AND SETTING A PUBLIC
HEARING FOR SEPTEMBER 5, 1978.
WHEREAS, pursuant to Section 25.84.020 of the Palm Desert
Municipal Code, the Planning Commission may initiate, by resolution,
a change in the boundaries of any district on the Zoning Map; and,
WHEREAS, the Planning Commission of the City of Palm Desert,
California, after having heard evidence of the need for an Amendment
to the Palm Desert Zoning Map, does intend to initiate the process
of amending the Zoning Map.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of
the City of Palm Desert, California, as follows:
1. That the Director of Environmental Services is in-
structed to prepare and publish legal notices adver-
tising a Public Hearing for September 5, 1978, to
consider an Amendment to Section 25.92.010 of the
Palm Desert Municipal Code (the Zoning Map) to change
the zone on the property generally located west of
Deep Canyon Avenue, north of 44th Avenue, more par-
ticularly described as:

request that we r..ay have the opportunity to meet with the Planning
Commission at their nest Study Session which I understand is to be on
August 1, 1978 at 5:00 P11.
The purpose of this request is to seek the assistance of the Commission
and the Staff in working out a solution to our dilemna of the approval
of the propsed "La Paz Villas" of the Catholic Bishop of San Diego at
the sacred heart Church property on Deep Canyon Road.

and the Staff on an informal Ijasis so that we can clearly understa:,d
any objections to the -)reject other than the type of zoning. Perhaps
with su %estions of the Commission we may be able to arrive at a meeting

for this project.

OF PALM DESERT, CALIFORNIA, DENYING A REQUEST FOR A CHANGE OF ZONE
FROM R-1 9,000 -2 ON PROPERTY GENERALLY LOCATED

WHEREAS, the Planning Commission did on the 5th day of July,
1978, hold a duly noticed Public Hearing to consider a Change of Zone
application, filed by the CATHOLIC BISHOP OF SAN DIEGO, from R-1 9,000
(Single-family residential, minimum 9,000 sq. ft. lot size) zoning dis-
trict to R-2 (Single-family residential, minimum 4,000 sq. ft./du) zoning
district on approximately 7.9 acres generally located west of Deep Can-
yon, north of 44th Avenue, and more particularly described as:

WHEREAS, said application has complied with the requirements of
the "City of Palm Desert Environmental Quality Procedure Resolution No.
78-32," in that the Director of Environmental Services has determined
that this project will not have a significant impact on the Environment
and the appeal period has expired; and,
WHEREAS, at said Public Hearing, upon hearing and considering
the testimony and arguments, if any, of all persons desiring to be heard,
said Planning Commission did find the following facts and reasons to
exist to deny the Change of Zone request:
1. The proposed Change of Zone does not conform to the Palm
Desert General Plan.
2. The proposed Change of Zone will adversely effect the
health, safety, or general welfare of the community.
3. The resulting density from the proposed Change of Zone
would not be compatible with existing density in the vicinity.
4. The planned residential zone would better accommodate the
proposed use of the land as contemplated by the applicant.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of Palm Desert, as follows:
1. That the above recitations are true and correct and consti-
tute the findings of the Commission in this case;
2. That it does hereby deny the requested Change of Zone from
R-1 9,000 to R-2.

Mr. Williams reviewed the case and noted that Staff recommended
approval of the Change of Zone.
Chairman Berkey declared the Public Hearing open and asked
if the applicant would like to speak at this time. The applicant was
not present. Chairman Berkey asked if anyone wished to speak in FAVOR
or in OPPOSITION to the proposed Change of Zone. Being none, he de-
clared the Public Hearing closed and asked for the pleasure of the
Commission.
Commissioner Fleshman noted that the R-2 zone was not appro-
priate and that a PR-4 to PR-5 range would be better, also he would
like to see the Development Plan.
Commissioner Kelly stated that the applicant should be sent
the reasons for this case being denied as the zoning is not appropriate.
On a motion by Commissioner Fleshman, seconded by Commissioner
Snyder, the Commission denied the Change of Zone request by Planning
Commission Resolution No. 378; carried unanimously (5-0).
J. Case No. CUP 10-77(Amend) and 131MF - PALM DESERT 210 Ltd.,
Applicant
Request for approval of an Amendment to an approved
Conditional Use Permit to provide for an additional
11 lots within an existing mobilehome subdivision
within the R-M zone.
Mr. Williams reviewed the case and noted the concerns of the
Design Review Board. There was some discussion about the size of the
fairways and the relationships to the greens and tees.
Chairman Berkey declared the Public Hearing open and asked
if the applicant would like to speak at this time. The applicant was
not present. Chairman Berkey then asked if there was anyone wishing
to speak in FAVOR or in OPPOSITION to the proposed cases. Being none,
he declared the Public Hearing closed and asked for the pleasure of
the Commission.
On a motion by Commissioner Kryder, seconded by Commissioner
Kelly, the Commission approved the cases by Planning Commission Resolu-

I. REQUEST:
Request for approval of a Change of Zone from R-1 9,000 (Single-family
residential, minimum 9,000 sq. ft. lots) to R-2 (Single-family residential,
minimum 4,000 sq. ft. lot area/du) on approximately 7.9 acres located west
of Deep Canyon Avenue, north of 44th Avenue.
II. STAFF RECOMMENDATION:

Justification:
1. The proposed Change of Zone does conform to the Palm Desert General Plan.
2. The proposed Change of Zone will not adversely effect the health, safety,
or general welfare of the community.

4. The uses prescribed by the proposed zone designation are compatible with
existing uses of adjacent property.

The density that would result from the proposed Change of Zone would be
approximately 10 du/acre or twice the density now permitted under the
R-1 9,000. However, any potential adverse impacts associated with the
higher density would be offset by the fact that to the south of the sub-
ject site lies a church -school complex and to the east is a date grove
preserve designated on the Zoning Map as (Open Space, Natural factors,
Restricted Development Overlay) District. Additionally, the site is
bordered on the east side by Deep Canyon Road, a secondary artery; a
fact that should discourage the development of a conventional subdivision
along side the artery, a situation which would occur under the present
R-1 9,000 zoning. Access to the site would be restricted to Deep Canyon
Road which would preclude any possible increases in traffic to the re-
sidential neighborhood to the west. Extensive buffering along the peri-
meter of the site combined with restricted access would create an isolated
site which would result in negligible effects on surrounding properties
when development occurs. Staff is recommending approval of the Change
of Zone for a reason that is related to the use permitted under the pro-
posed designation. The applicant intends to construct housing for elderly
parishioners, the subject site, therefore, in terms of its relationship
to the existing church and its proximity to the commercial district and
Deep Canyon is served by public transportation.

This letter is not to be interpreted as a contractual commitment to
serve the proposed project; but only as an information service. Its
intent is to notify you that the Southern California Gas Company has
facilities in the area where the above named project is proposed. Gas
service to the project could be provided from an existing main without
any significant impact on the environment. The service would be in
accordance with the Company's policies and extension rules on file with
the California Public Utilities Commission at the time contractual
arrangements are made.
The availability of natural gas service, as set forth in this letter,
is based upon present conditions of gas supply and regulatory policies.
As a public utility, the Southern California Gas Company is under the
jurisdiction of the California Public Utilities Commission. We can
also be affected by actions of federal regulatory agencies. Should
these agencies take any action which affects gas supply or the condition
under which service is available, gas service will be provided in accordance
with revised conditions.
We have developed several programs which are available, upon request, to
provide assistance in selecting the most effective applications of energy
conservation techniques for a particular project. If you desire further

We have reviewed the request for comments and
conditions of approval for the above referenced project.
On behalf of the Palm Desert Community Services District
we wish to make the following comments:
1. All comments made in our previous letter dated
March 16, 1978, would apply to a development
should the land be developed subsequent to the
approval of the change of zone.
2. Again we would like to emphasize that the
District is willing and able to serve the
proposed development.
3. The District currently serves the church
property with domestic water.
4. It has come to the attention of the District
that the Coachella Valley County Water District
is planning to install a water main to serve
Tract No. 9144 located east of Deep Canyon
Road, south of 44th Avenue. If an attempt is
made by CVCWD to serve the church property from
the main, such action will be considered a
duplication of services and violation of state
statutes in this regard,

approval of a Change of Zone from
R-1 9,000 to R-2 on approximately 7.9 acres located west of
Deep Canyon Avenue, north of 44th Avenue.
The attached data was prepared by the applicant and is being forwarded
to you for comments and recommended Conditions of Approval. The City
is interested in the probable impacts on the natural environment (e.g.
water and air pollution) and on public resources (e.g. demand for
schools, hospitals, parks, power generation, sewage treatment, etc.)
Your comments and recommended conditions of approval must be received
by this office prior to 5:00 p.m. June 23 , 1978, in order to be
discussed by the Land Division Committee at their meeting of June 28th .
The Land Division Committee (comprised of Director of Environmental
Services, City Building Official, City Engineer, Fire Marshal and a
representative of CVCWD) will discuss the comments and recommended
conditions of approval and will forward them to the Planning Commission
through the staff report. Any information received by this office after
the receipt deadline will not be discussed by the Land Division Com-
mittee nor will it be forwarded to the Planning Commission for consid-
eration.

Tuesday June 27, 19789 at the regular meeting of the Planning Commission,
a hearing on the application of the Roman Catholic Bishop of San Diego for
change of zone, R-1-9,000 to PR-50 is on the agenda. The purpose of this
letter is to clear up what may be some misconception as to the type of
project proposed, the quality and the manner in which it will be supervised.
The following are the facts:
1) The proposed project will be solely owned by the Roman Catholic
Bishop of inn Diego.
2) Operation of the project will be by and under the direction of
the i'astor of Sacred :eart Church.
3) The residential use of the ,project is non—profit.
4) 2esidents will be selected by the Pastor. The intent and purpose
is to provide housing for retirees with preference given to local parishioners
5) Rentals charged will be less than the prevailing economic rentals
for equivalent dwelling quarters in the Palm Desert area.
0) The project is to be permanently in the undivided ownership of the
Catholic Bishop of San :.iego, and permanently under the supervision of the
Sacred ;Ieart _arish Pastor.
The Pastor has heard that word has gone about that the proposed project will
house economically distressed people with the a-.pellation "Paupers" applied
to the project. Such is not the truth. The project has been designed by
one of the areas Architects to be an attractive development esthetically and
with excellent recreational amenities in the form of a small recreational
building with lounge, billiard room, card room, Jacuzzi health pool and a
switming pool. 1he site will be completely landscaped with an automatic
watering system and enclosed by masonry walls on the front and sides.
Such a project is not designed as a paupers refuge but as a quality project
to provide dignified and gracious liviL:g for retirees.

It is the belief of the Pastor 11sgr. McNelis and the undersigned that the
proposed project will be consistent with the hish standards of design and
quality that will be a credit to the covaunity, and the purpose of this
letter is to emphasize to the Plaruting Cornission this fact.
As only retirees will occupy La Paz Villasq there will be a minimum of
vehicular traffic into and out of the development, and it will certainly
be a quiet project not conducive to creating any neighborhood nuisance.

10. The applicant offers the following reasons to justify the request for a Change of Zone:

the fact that the dwellings are duplexes. Zoning change is requested so that
the proposed development will be conforming.
The proposed project provides good quality structures with a high ratio of open
landscaped space and a small recreational building with swimming pool and Jacuzzi
health pool, enclosed by a masonry wall. No childred will be permitted as occupancy
will be only for elderly. Use will be low traffic and low pedestriln activity.
