II. REQUEST: That the Planning Commission approve and forward to the City Council a Change of Zone from 'S' (Study) to PC(4), S.P. (Planned Commercial Resort, Scenic Preservation Overlay) and PR-5, N,S.P. (Planned Residential - 5 dwelling units per acre, Scenic Preservation and Natural Factor Overlay) on property located at the northeast corner of the intersection of Deep Canyon Road and Highway 111. III. STAFF RECOMMENDATION: That the Planning Commission recommend by Planning Commission Resolution No. 2_U, the adoption of an Ordinance approving the Change of Zone request. Justification is based upon the following: The proposed re -zoning is in conformance with the General Plan of the City of Palm Desert as recently amended. 2. The proposed re -zoning meets the intent of the Redevelopment Plan of the City of Palm Desert in that the area in question is noted as Core Area Com- mercial which provides for the range of uses specified in the two zonings proposed to be applied to the property in question. 3. The proposed zoning designations conform to the adjacent zoning and would provide for compatible development in relationship to the surrounding area if specific concern is provided for the area adjacent to Deep Canyon in close proximity to the existing residential lots which are located on the west side of Deep Canyon Road, northerly of Alessandro Drive. IV. DESCRIPTION: A. Size: Total property consists of 15.57 acres divided into seven separate Case No. C/Z 09-77 November 1, 1977 IV. DESCRIPTION: (Cont.) Page Two D. Adjacent Zoning: North - PR-5, N South - C-1, S.P. and PC(4), S.P. West - R-1-13,000, R-3(4) and C-1, S.P. East - H-W (Indian Wells/Highway Commercial) E. Distinguishing Features: The 5 acre parcel adjacent to the intersection is flat, cleared land with no distinguishing natural features. The 2 5-acre parcels north and east of the corner are covered by date and citrus trees. Previous Actions: The study zone was first initiated on February 12, 1976, at the time of the adoption of the City Zoning Map. It was later extended for an additional year by Ordinance No. 149. V. DISCUSSION: The proposed zoning reflects the most appropriate solution for the following design concerns: A. Sin le family homes on the west side of Deep Canyon Road. The surrounding R-1-13,000, R-3(4), and PR-5 zones require a complementary residential de- signation to ensure compatibility to existing development in the neighbor- hood. This can be achieved by a continuation of the PR-5 designation which offers a similar unit yield and maximum design control. Adjacent commercial zoning in Palm Desert. The existing commercial pattern at the intersection of Deep Canyon Road and Highway 111, combined with the noise and traffic volumes, makes a residential use at the corner inappro- priate. The PC(4) district was selected as being the most compatible with the proposed adjacent residential uses. The City of Indian Wells has previously expressed its support for a limited use of this zone in this area. C. Minimize strip commercial development on Hi hwa 111. The 5.3 acres between the corner parcel and the City boundary is recommen ed as residential to minimize the continuation of strip commercial along a scenic highway, to help create a discrete boundary between Palm Desert and Indian Wells, and to provide a uniform zone designation for those parcels near the city boundary. D. Date grove preservation. The extreme differences in existing vegetation within the overall 15 acres of the project re-emphasize the split between commercial and residential uses. It is anticipated that fewer trees will be lost through conversion to residential rather than commercial use. Circulation. Somewhere along the 720 feet where the project area is contig- ous to Deep Canyon Road, an access road will have to be provided to reach the properties near the city boundary. The staff completely rejects any notion that access could be provided from Highway 111. There appear to be 3 general locations for this new opening. C/Z 09-77 November 1, 1977 V. DISCUSSION: (Cont.) Page Three As potential alternatives, the staff recommends the possibility of substitut- ing C-1, S.P. for the 5-acres of PC(4), S.P. The site is well suited to a professional or medical office use and the CUP requirement would prevent other undesirable uses such as gas stations and liquor stores. The C-1 zone, however, might still permit some uses that may be inappropriate for that site. The second alternative involves designating the entire 15 acres as PR-S,N,S.P. This proposal does conflict with the recent amendments to the General Plan which provided for some commercial element within the study area. Noise from Highway Ill still represents a design obstacle for residential use, although some community facilities, such as a church site, could mitigate this conern. In the last analysis, however, the prevailing land costs make complete residen- tial use impractical. MINUTES CITY OF INDIAN WELLS CITY COUNCIL JANUARY 6, 1977 Planning Director stated that the third referral is a change of zone request for 15.5 acres on the north side of Highway 111 between Deep Canyon Road and the Indian Wells City Limits from n4- "S" (Study) to PC(4), S.P. (Planned Commercial -Resort, Scenic Preservation Overlay) and PR-4, S.P. (Planned Residential, 4 dwelling units per acre, Scenic Preservation Overlay), or other appropriate zones. �r 0 Director Schmitz reported that the Planning Commission recommended= approval of PC(4), S.P. (Planned Commercial, Resort, Scenic Preservation Overlay) at the northeast corner of Deep Canyon Road and Highway 111, and PR-4 S.P. (Planned Residential, 4 dwelling units per acre, Scenic Preservation Overlay) for the property lying on Highway 111 and easterly of the Deep Canyon Road parcel. It was the Planning Commission's opinion that commercial adjoining the City limits would not be compatible. and also that such proposed zoning at a depth of only 300 feet_ would encourage requests for additional depth rezoning.' Following discussion, it was moved by Councilman Buss, seconded by Councilman Hall and carried to recommend that the property on the north side of Highway 111 be rezoned as follows: (a) Approximately 10 acres at the northeast corner of Deep Canyon Road and Highway 111 as PC(4), S.P. (Planned Commercial -Resort, Scenic Preservation Overlay) rather than PR-4 as proposed, based on the following findings: (I) There is 'commercial existing on the south side of Highway 111 across the street. (2) The site is located on a major intersection with a proposed traffic signal and across the street on Deep Canyon Road from property zoned commercial. (b) Approximately 5 acres (300' deep) on the north side of Highway Ill adjoining the Indian Wells City Limits as PR--4, S.P. GILLIGAN, CITY CLERK CITY OF PALM DESERT, CALIFORNIA _ REVIEW OF MAJOR ISSUES DISCUSSED BY THE PLANNING COMMISSION: One of the property owners spoke to the Commission indicating his pre- ference to have the Commission continue the 'S' Study zoning designation rather than zone his portion of the property in question Planned -Residential as he and others he represented favored Planned -Commercial. The Commission asked the Staff if a continuance of the 'S' Study Zoning designation would create hardship on any of the property owners. The Staff indicated that they had been in contact with only one property owner who owned a small parcel and that this particular property owner favored the Staff's recom- mendation as contained in the Staff Report. The Commission came close to recommending a continuance of the 'S' Study zoning designation, but then one of the Commissioners indicated he would like to see some progress made, indicating the Commission might act on the two westerly parcels and continue the 'S' on the easterly parcel since the most appropriate zoning for the easterly parcel seemed unresolved. Staff indicated that land use and circulation were interrelated elements for all of the parcels and the Commission should probably act on all of the parcels simultaneously. After considerable discussion, the Commission decided that a Planned - Commercial Resort designation for those parcels fronting on Highway 111 would be most favorable. The P.C. (4) designation would be compatible with both the Highway Zone in Indian Wells and the Palm Desert Redevelop- ment Plan. The property owner present concurred with this recommendation, In addition, the proposal to zone those parcels on Highway 111 P.C.(4) and the northwesterly parcel PR-5, would insure that the residential nature of the west side of Deep Canyon would be protected. The surrounding R-1-13,000, R-3(4), and PR-5 zones require a complementary residential de- signation to ensure compatibility to existing development in the neighbor- hood. This can be achieved by a continuation of the PR-5 designation which offers a similar unit yield and maximum design control. B. Adjacent commercial zoning in Palm Desert. The existing commercial pattern at the intersection of Deep Canyon Road and Highway 111, combined with the noise and traffic volumes, makes a residential use at the corner inappro- priate. The PC(4) district was selected as being the most compatible with the proposed adjacent residential uses. The City of Indian Wells has previously expressed its support for a limited use of this zone in this area. C. Minimize strip commercial development on Hi hwa 111. The 5.3 acres between dary is recom the corner parcel and the City bounmen ed as residential to minimize the continuation of strip commercial along a scenic highway, to help create a discrete boundary between Palm Desert and Indian Wells, and to provide a uniform zone designation for those parcels near the city boundary. D. Date grove preservation. The extreme differences in existing vegetation within the overall 15 acres of the project re-emphasize the split between commercial and residential uses. It is anticipated that fewer trees will be lost through conversion to residential rather than commercial use. E. Circulation. Somewhere along the 720 feet where the project area is contig- ous to Deep Canyon Road, an access road will have to be provided to reach the properties near the city boundary. The staff completely rejects any notion that access could be provided from Highway 111. There appear to be 3 general locations for this new opening. One possibiliy would be to extend Alessandro directly east of its present T-intersection with Deep Canyon Road. This has been rejected by the City Engineer as unsafe. A second possibility would be to place the road near the northern edge of the subject property. This is undesirable since it makes effective separation of any adjacent re- sidential and commercials very difficult. The last possibility would be to locate the road roughly midway between Highway Ill and the northernmost boundary of the site. This would provide a safe access point which would help to separate the adjacent PR-5 and PC(4). F. Highway noise. The Palm Desert General Plan indicates that a narrow strip adjacent to Highway 111 is clearly unacceptable for residential use. How- ever, the significant depth of the lots next to the City boundary would allow residential zoning, within the high noise strip being reserved for recrea- tional use. Case NO. C/Z 09-77 November 1, 1977 V. DISCUSSION: (Cont.) Page Three As potential alternatives, the staff recommends the possibility of substitut- ing C-1, S.P. for the 5-acres of PC(4), S.P. The site is well suited to a professional or medical office use and the CUP requirement would prevent other undesirable uses such as gas stations and liquor stores. The C-1 zone, however, might still permit some uses that may be inappropriate for that site. The second alternative involves designating the entire 15 acres as PR-5,N,S.P. This proposal does conflict with the recent amendments to the General Plan which provided for some commercial element within the study area. Noise from Highway 111 still represents a design obstacle for residential use, although some community facilities, such as a church site, could mitigate this conern. In the last analysis, however, the prevailing land costs make complete residen- tial use impractical. in and what his concerns should be. III. STAFF RECOMMENDAT That the Planning Commission recommend by Planning Commission Resolution No. —, the adoption of an Ordinance approving the Change of Zone request. Justification is based upon the following: 1. The proposed re -zoning is in conformance with the General Plan of the City of Palm Desert as recently amended. 2. The proposed re -zoning meets the intent of the Redevelopment Plan of the City of Palm Desert in that the area in question is noted as Core Area Com- mercial which provides for the range of uses specified in the two zonings proposed to be applied to the property in question. 3. The proposed zoning designations conform to the adjacent zoning and would provide for compatible development in relationship to the surrounding area if specific concern is provided for the area adjacent to Deep Canyon in close proximity to the existing residential lots which are located on the west side of Deep Canyon Road, northerly of Alessandro Drive. IV. DESCRIPTION: A. Size: Total property consists of 15.57 acres divided into seven separate lots ranging in size from as small as 625 square feet to 8.4 acres. B. Proposed Zoning: The 5 acres immediately adjacent to the intersection will be designated PC(4), S.P. Directly to the north (across from the R-1 lots on the west side of Deep Canyon), 5.3 acres will be zoned PR-5, N, S.P., as will the 5.3 acres immediately adjacent to the Palm Desert - Indian Wells boundary on the north side of Highway 111. Distinguishing Features: The 5 acre parcel adjace�he-intersection is flat, cleared land with no distinguishing natural features. The 2 5-acre parcels north and east of the corner are covered by date and citrus trees. Previous Actions V. DISCUSSION: The study zone was first initiated on February 12, 1976, at the time of the adoption of the City Zoning Map. It was later extended for an additional year by Ordinance No. 149. The proposed zoning reflects the most appropriate solution for the following design concerns: A. Single family homes on the west side of Deep Canyon Road. The surrounding R-1-13,000, R-3(4), and PR-5 zones require a complementary residential de- signation to ensure compatibility to existing development in the neighbor- hood. This can be achieved by a continuation of the PR-5 designation which offers a similar unit yield and maximum design control.. Adjacent commercial zoning in Palm Desert. The existing commercial pattern at the intersection of Deep Canyon Road and Highway 111, combined with the noise and traffic volumes, makes a residential use at the corner inappro- priate. The PC(4) district was selected as being the most compatible with the proposed adjacent residential uses. The City of Indian Wells has previously expressed its support for a limited use of this zone in this area. C. Minimize strip commercial development on Highway 111. The 5.3 acres between the corner parcel and the City boundary is recommended as residential to minimize the continuation of strip commercial along a scenic highway, to help create a discrete boundary between Palm Desert and Indian Wells, and to provide a uniform zone designation for those parcels near the city boundary. D. Date grove preservation. The extreme differences in existing vegetation within the overall 15 acres of the project re-emphasize the split between i commercial and residential uses. It is anticipated that fewer trees will be lost through conversion to residential rather than commercial use. Circulation. Somewhere along the 720 feet where the project area is contig- ous to Deep Canyon Road, an access road will have to be provided to reach the properties near the city boundary. The staff completely rejects any notion that access could be provided from Highway 111. There appear to be 3 general locations for this new opening. One possibiliy would be to extend Alessandro directly east of its present T-intersection with Deep Canyon Road. This has been rejected by the City Engineer as unsafe. A second possibility which provided for some commercial element within the study area. Noise from Highway Ill still represents a design obstacle for residential use, although some community facilities, such as a church site, could mitigate this conern. In the last analysis, however, the prevailing land costs make complete residen- tial use impractical. Review of public hearing draft of COD Area Specific Plan and Citizen Input Program. Mr. Williams noted that if the draft was approved at the October 19th meeting the plan would be circulated. The Commission complimented staff on their work and had only one suggestion on the letter to the citizens. Commissioner Kelly also noted that the size of the COD campus might make people leary of attend- ing the neighborhood meetings and with school in session at night there might also be a parking problem. Commissioner Kelly suggested that the Middle School might be a better location and the citizens would also be able to see the new school. The report was continued to the October 19th meeting. VIII. NEW BUSINESS A. Consideration of a Resolution announcing findings and making recommendations to the City Council regarding two reports submitted to the City by the Coachella Valley Association of Governments.
