DISCUSSION: This request was reviewed and approved by the Planning Commission at the meeting of January 14, 1981. The applicants asked for flexibility in the parking requirements for the clubhouse because it would not be open to the public. The Planning Commission amended the condition regarding the parking to require detailed review at the Design Review Board level. A letter of protest was presented to the Planning Commission from Pacific Coast Builders who are developing a condominium project at the southeast corner of Frank Sinatra Drive and Cook Street. The letter is attached for your review. There were no Planning Commission questions regarding the proposed pre - annexation zoning and golf course mobile home subdivision. The Planning Commission then unanimously adopted Plannin Commission Resolution Nos. 676 and 677 (3-0, McLachlan, Kryder, Miller . ORDINANCE NO. 250 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, AMENDING ORDINANCE NO. 107, THE PALM DESERT ZONING MAP BY CHANGING THE ZONE FROM R-1, 12,000 (RIVERSIDE COUNTY ZONE) TO R.M. The development of the property shall conform substantially with Exhibits on file with the Department of Environmental Services, as modified by the following conditions. 2. Prior to the issuance of a building permit for construction of any uses contemplated by this approval, the applicant shall first complete all the procedural requirements of the City which include, but are not limited to, Design Review, Subdivision process, and building permits procedures. 3. Construction of the total development may be done in phases; however, each individual phase shall meet or exceed all Municipal Code requirements to the degree that the City could consider each phase as a single project. 4. Effective date of this approval shall be from time property is annexed to City. 5. Prior to the issuance of any City permits for the commencement of construction on said project, the applicant shall agree in writing to these Conditions of Approval. 6. All requirements of the City Fire Marshal shall be met as part of the deve- lopment of this project per attached letter dated December 12, 1980. 9. Construction plans shall be submitted for approval to the City Fire Marshal prior to issuance of building permits. All conditions shall be made a part of construction and no certificate of occupancy shall be issued until completed. 10. Traffic control provisions shall be provided as required by the Director of Public Works. 11. Curb, gutter, sidewalk or approved pathways, and tie-in paving shall be provided in conformance with City Standards and/or as required by the Director of Public Works. 12. Install a water system capable of delivering 2750 GPM fire flow for a two (2) hour duration in addition to domestic or other supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the lsupply main from which the flow is measured at the time of measurement. 1 2. Install Riverside County super fire hydrants so that no point of any building is more than 250 feet from a fire hydrant measured along approved vehicular travel ways. - A. Hydrants shall not be located closer than 25 feet to any building. B. -Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. C. Curbs (if installed) shall be painted red 15 feet in either direction from each hydrant. 3. Prior to issuance of a building permit, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. Upon approval, one copy will be sent to the Building Department, and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer, and approved by the water company, with the following certification: " I certify that the design of the water system in Case Number CUP 18-80/ CZ 04-80 is in accordance with the requirements prescribed by the Fire Marshal." 1 5. Mr. Diaz asked Mr. McFarland if any of the facilities would be used by the public. Mr. McFarland stated that when that decision is made it would be presented to the Design Review Board. After considerable discussion on this matter, Commissioner Kryder recommended that Special Condition No. 2 4e amended to read: "Breakdown of clubhouse square footage to be submitted to Design Review Board to verify that it complies with the City of Palm Desert's parking requirements." Chairman Miller asked if there was anyone present who wished to speak in FAVOR or OPPOSITION to this case. There being none, the Public Hearing was closed. Mr. Diaz noted a letter was received from Pacific Coast Builders, Inc., protesting the proposed project; he reviewed the letter. PALM DESERT ESTATE HOMES PLANNING OBIECTIVES The proposed plan is a mobile home subdivision, intended for home -ownership by families with moderate income. It is designed as a golf course community with a main clubhouse facility and golf course fairways linking all areas of the Project. The primary circulation system is a loop collector street which circles the property near its perimeter. The main entrance is security gated and provides direct access to the loop collector street as well as to the recreation center. Local circulation is provided -by residential loop streets which extend from the loop collector inward to the golf course. Nearly every street in this Project leads to and provides access _to the golf course. The Amenity Package consists of a main clubhouse of approximately 10,000 sq. ft. and parking for 136 cars. There are satellite recreation areas consisting of pool, cabana and sun terrace. The golf course is designed as an executive length, recreation course. It has a maximum length of 3,700 yards from the back tees -f and a par of 62. The course is intended to provide both recreation and environmental amenity for the residents of the mobile home subdivision, and is not intended for the use of non residents. It is expected that residents will use golf carts for a significant portion of circulation within the Project, both to and from the clubhouse and recreation areas, and on the cart paths within the golf course. The golf course serves the dual purpose of providing a landscaped open space/recreation area, as well as providing a storm water retention basin as required for containing a 25 year storm run-off within the property. The site consists of 263 acres of undeveloped land. Half -street dedication for Portola Avenue and Frank Sinatra Drive will amount to approximately 7.3 acres, leaving a net area of 255.7 acres for the mobile home subdivision. STAFF RECOMMENDATION: Based on findings and justification contained in draft Resolution: Recommend approval to City Council of C/Z 04-80, by adoption of Planning Commission Resolution No. ; and, approve CUP 18-80, by adoption of Planrring Commission Resolution No._, subject to the conditions attached thereto. PALM DESERT ESTATE HOMES PLANNING OBIECTIVES The proposed plan is a mobile home subdivision, intended for home -ownership by families with moderate income. It is designed as a golf course community with a main clubhouse facility and golf course fairways linking all areas of the Project. The primary circulation system is a loop collector street which circles the property near its perimeter. The main entrance is security gated and provides direct access to the loop collector street as well as to the recreation center. Local circulation is provided by residential - loop streets which extend from the loop collector inward to the golf course. Nearly every street in this Project leads to and provides access to the golf course. The Amenity Package consists of a main clubhouse of approximately ' 10,000 sq. ft. and parking for 136 cars. There are satellite recreation areas consisting of pool, cabana and sun terrace. The golf course is designed as an executive length, recreation course. It has a maximum length of 3,700 yards from the back tees it and a par of 62. The course is intended to provide both recreation and environmental amenity for the residents of the mobile home subdivision, and is not intended for the use of non residents. It is expected that residents will use golf carts for a significant portion of circulation J within the Project, both to and from the clubhouse and recreation areas, and on the cart paths within the golf course. The golf course serves the dual purpose of providing a landscaped J open space/recreation area, as well as providing a storm water retention basin as required for containing a 25 year storm run-off within the Jproperty. The site consists of 263 acres of undeveloped land. Half -street dedication for Portola Avenue and Frank Sinatra Drive will amount to approximately 7.3 acres, leaving a net area of 255.7 acres for the mobile home subdivision. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants so that no point of any building is more than 250 feet from a fire hydrant measured along approved vehicular travel ways. A. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. C. Prior to issuance of a building permit, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. Upon approval, one copy will be sent to the Building Department, and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer, and approved by the water company, with the following certification: " I certify that the design of the water system in Case Number CUP 18-80/ CZ 04-80 is in accordance with the requirements prescribed by the Fire Marshal." 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. Full public improvements including traffic safety lighting as required by ordinance and the Public Works Director shall be installed in accordance with City standards. 12. Improvement plans for water and sewer systems shall be approved by the respective service districts. 13. Complete improvement plans and specifications shall be submitted as required by ordinance to the City Engineer for checking and approval before construc- tion of any improvements is commenced. The subdivider shall submit "as -built" plans prior to acceptance of the subdivision improvements by the City. 14. All private streets shall be inspected by the Engineering Department and a standard inspection fee shall be paid. 15. Additional storm drain construction shall be contingent upon a drainage study by the private engineer. 16. Access to property to be via a minimum two (2) lane road, permanently paved to the specifications of Director of Public Works. 17.
