APPLICANT: Watt Industries
Enclosed please find materials describing a project for which the following
is being requested:
Approval of a Change of Zone from PR-7, S.P. (Planned Residential, 7
d.u./acre max. density, Scenic Preservation) to R-2 (6000), S.P.
(Single family Residential, 6000 sq.ft./d.u. max. density) and, a
Conditional Use Permit to allow the construction of 128 single family
zero lot line dwelling units and associated recreational amenities
on 18.72 acres located at the northeast intersection of 44th Avenue
and the Palm Valley Storm Channel, more particularly described as
APN 621-320-009 and 621-320-010.
The attached data was prepared by the applicant and is being forwarded to you
for comments and recommended Conditions of Approval. The City is interested
in the probable impacts on the natural environment (e.g. water and air pollution)
and on public resources (e.g. demand for schools, hospitals, parks, power gener-
ation, sewage treatment, etc.).
Your comments and recommended conditions of approval must be received by this
office prior to 5:00 p.m. Sept. 19 , 1980, in order to be discussed by
the Land Division Committee at their meeting of Sept. 24 , 1980.
The Land Division Committee (comprised of Director of Environmental Services,
City Building Official, City Engineer, Fire Marshal and a representative of
CVWD) will discuss the comments and recommended conditions of approval and will
forward them to the Planning Commission through the staff report. Any informa-
tion received by this office after the receipt deadline will not be discussed
by the Land Division Committee nor will it be forwarded to the Planning Commission
for consideration.

PALM DESERT ZONING MAP BY CHANGING THE ZONE FROM PR-

The City Council of the City of Palm Desert, California, DOES HEREBY
ORDAIN, as follows:
-"- SECTION 1: That a portion of Ordinance No. 107 referencing Section
25.46-1 of the Zoning Ordinance, the Zoning Map (Chapter 25.46 of the Palm Desert
Municipal Code) is hereby amended to read as shown on the attached Exhibit "A".
SECTION 2: The City Clerk of the City of Palm Desert, California, is
hereby directed to publish this Ordinance in the Palm Desert Post, a newspaper of
general circulation, published and circulated in the City of Palm Desert, California,
and shall be in full force and effect thirty (30) days after its adoption.
SECTION 3: That a Conditional Use Permit and Preliminary Design Review
Case on 18.72 acres is hereby granted to WATT INDUSTRIES/PALM SPRINGS,INC., subject
to compliance with conditions attached hereto, labeled Exhibit "B".
PASSED, APPROVED, and ADOPTED by the Palm Desert City Council this
4th day of December, 1980, by the following vote, to wit:

CONDITIONS OF APPROVAL
CASE NOS. CUP 02-80 AND 219 MF
Standard Conditions:
I. The development of the property shall conform substantially with Exhibit A
through E (Case Nos. CUP 02-80 and 219 MF) on file with the Department of
Environmental Services, as modified by the following conditions.
2. Prior to the issuance of a building permit for construction of any uses contem-
plated by this approval, the applicant shall first complete all the procedural
requirements of the City which include, but are not limited to, Design Review, M._..
Subdivision process, and building permits procedures.
3. Construction of the total development may be done in phases; however, each
individual phase shall meet or exceed all Municipal Code requirements to the
degree that the City could consider each phase as a single project.
4. -Prior to the issuance of any City permits for the commencement of construction
on said project, the applicant shall agree in writing to these Conditions of
Approval.
5. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all
municipal ordinances and State and Federal Statutes now in force, or which
hereafter may be in force.
6. All existing electrical distribution lines, telephone, cable antenna television,
and similar service wires or cables, which are adjacent to the property being
developed shall be installed underground as a part of development from the
nearest existing pole not on the property being developed.
7. All requirements of the City Fire Marshal shall be met as part of the develop-
ment of this project per attached letter dated September 11, 1980.
J8. Construction plans shall be submitted for approval to the City Fire Marshal
prior to issuance of building permits. All conditions shall be made a part of
construction and no certificate of occupancy shall be issued until completed.
9. Traffic control provisions shall be provided as required by the Director of
Public Works.
10. Curb, gutter, sidewalk or approved pathways, and tie-in paving shall be provided
in conformance with City Standards and/or as required by the Director of Public
Works.
11. Prior to issuance of a building permit for construction of any use contemplated
by this approval, the applicant shall first obtain permits and/or clearance
from the following agencies:
Riverside County Department of Health
Palm Desert Design Review Board Process
City Fire Marshal
Coachella Valley Water District
Evidence of said permit or clearance from the above agencies shall be presented
to the Department of Building and Safety at the time of issuance of a building
permit for the use contemplated herewith.

Special Conditions
1. The design and improvement of 44th Avenue public right -Of -way shall be
as required by the Director of Public Works in accordance with plans
developed by Southwest Engineering and accepted by the City.
2. The effective data of this approval shall coincide with the approval
by the City Council of a Tentative Tract Map and shall remain in force
for one year from that date; or, in the event that a Tentative Tract Map
is not approved, CUP 02-80 shall become null, void and of no effect
whatsoever. I - --
3. Developer shall mitigate erosion of the stormwater channel banks during
periods of unusual rainfall by providing channel landscaping or bank
rip -rap and shall relocated any existing district facilities as required
by the Coachella Valley Water District and City Public Works Director.
4. -Tennis court lighting to be down shining black box type on a maximum 20'
high pole.
5. Entry to project on 44th Avenue to be revised to align with proposed plans
developed by Southwest Engineering for E1 Paseo extension, subject to City
- Public Works Director.
6. Provide additional pool in area north of tennis courts with both pools to
use solar hearing.
7. 6 foot high block wall as approved by Design Review Board to be provided
around entire site.
8. Fencing between lots to be reviewed with final working drawings.
9. Overhangs over glass areas to be a minimum of three feet.
10. Study reduction of water element adjacent to recreation area.

'Prior to construction of any of the proposed buildings, the following conditions
must be met:
1. Install a water system capable of delivering 2500 GPM fire flow for a two (2)
hour duration in addition to domestic or other supply. The computation
shall be based upon a minimum of 20 psi residual operating pressure in the
supply main from which the flow is measured at the time of measurement.
2. Install Riverside County super fire hydrants so that no point of any building
is more than 250 feet from a fire hydrant measured along approved vehicular
travel ways.
A. Hydrants shall not be located closer than 25 feet to any building.
B. Exterior surfaces of hydrant barrels and heads shall be painted chrome
yellow, and the tops and nozzle caps shall be painted green.
C. Curbs (if installed), shall be painted red 15 feet in either direction
from each hydrant.
3. Prior to issuance of a building permit, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
Upon approval, one copy will be sgnt to the Building Department, and the original
will be returned to the developer.
4. The water system plan shall be signed by a registered civil engineer, and
approved by the water company, with the following certification: "I certify -that
the design of the water system in Case Number CUP 12-80, C/Z 02-80 is in
accordance with the requirements prescribed by the Fire Marshal."

A. STAFF RECOMMENDATION:
Waive further reading and based on the justification and findings in draft
Ordinance, pass Ordinance No. 235 to second reading, approving a change
of Zone from PR-Z, S.P. (Planned Residential, 7 d.u./acre max. density,
Scenic Preservation overlay, to R-2 (6), S.P. (Single Family Residential,
6000 sq.ft./d.u. maximum density Scenic Preservation overlay) or other zone

B. DISCUSSION:
The Planning Commission reviewed and approved this request at the meeting of
October 15, 1980. During the hearing, the Commission asked questions of staff
about protection from the Palm Valley Channel and available on -street parking
within the project. There was no audience participation about the project
during the hearing. Thereafter, the commission approved the request on a
unanimous vote (4-0 with Commissioner Kryder absent).
Attached is a draft Ordinance which would approve this request as submitted.

Mr. Don assured everyone that every means will be considered for the
drainage problem nd that they would divert the water in a proper fashion. He also
pointed out that i would not be economically feasible to move the athletic building
75 feet from the eas property line.
Chairman Miller igosed the Public Hearing. '
Commissioner Berkey xplained that when Palm Desert incorporated and the
new General Plan was adopted, the lots on the west side of the City had not been
developed over 10 years. He s ted that someone came along and wanted the PC zone,
Public Hearings were made and t re were no arguments at that time. He, therefore,
felt that strict attention should ve given to the existing zoning. He motioned to
approve this case with the followin revisions:
Standard Condition No. 10: "Cur gutter, sidewalk or approved pathways,
and tie-in paving and drainage shall be p vided in conformance with City Standards
and/or as required by the Director of Publi Works."
Add Special Condition No. 13: "IncreaseNketback between Athletic Club and
east property line from 45 feet to 46 feet."

Mr. Sawa presented this case reviewing the staff report. He stated that the
proposed zoning would allow a variety in housing choice and would be consistent
with the Housing Element. He described the proposed project design pointing out that
this project would have to coordinate with the street improvement designs being
prepared for the Regional Shopping Center. He further explained the dwelling unit
approach, driveways, and the architectural design. Mr. Sawa stated that the Design
Review Board reviewed this case and continued it because of concerns; he reviewed
those concerns and stated that .the.,revised plans were approved subject to conditions.
He reconriiended approval.
Commissioner Richards was concerned for the units that are next to the
channel. He asked Mr. Sawa what type of protection would be provided. Mr. Sawa
explained that there would be a 6 foot block wall and in addition to that there would
be channel landscaping or bank rip -rap.

MR. STAN MORRIS, Consulting Engineer, 73-255 E1 Paseo, also explained how the
project would be protected from the storm channel.
Chairman Miller aksed if there was anyone present who wished to speak in
FAVOR or OPPOSITION to this case. There being none, the Public Hearing was closed.
Motion was made by Commissioner Richards, seconded by Commissioner McLachlan,
to approve this case by adoption of Planning Commission Resolution No. 648. Carried
unanimously (4-0).

WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the 30th day of September, 1980, hold a duly noticed Public Hearing and

WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Procedure for Implementation of the California Environmental Quality
Act, Resolution No. 80-89", in that the Director of Environmental Services has deter-
mined that the project will not have a significant adverse impact on the environment
and a Negative Declaration has been prepared. Said Negative Declaration is hereby
approved by the Commission.
WHEREAS, at said Public Hearing, upon hearing and considering all testimony
and arguments, if any, of all interested persons desiring to be heard, said Planning
Commission did find the following facts to justify their actions, as described below:
1. Change of Zone:
a. The land use resulting from the Change of Zone would be
compatible with adjacent existing and proposed land uses.
b. The density resulting from the Change of Zone would be
compatible with densities permitted in the adjacent areas.
C. The proposed Change of Zone would be compatible with the
adopted Palm Desert General Plan.
2. Conditional Use Permit:
The proposed location of the conditional use and the
conditions under which it will be operated and maintained
will not be detrimental to the public health, safety, or
general welfare, or'be materially injurious to the pro-
perties or improvements in the vicinity.
The proposed location of the conditional use is in accord
with the objectives of the Zoning Ordinance and the purpose
of the district in which the site is located.

Standard Conditions:
1. The development of the property shall conform substantially with Exhibit
A through E (Case Nos. CUP 02-80 and 219 MF) on file with the Department
of Environmental Services, as modified by the following conditions.
2. Prior to the issuance of a building permit for construction of any
uses contemplated by this approval, the applicant shall first complete
all the procedural requirements of the City which include, but are not
limited to, Design Review, Subdivision process, and building permits
procedures.
3. Construction of the total development may be done in phases; however,
each individual phase shall meet or exceed all Municipal Code require-
ments to the degree that the City could consider each phase as a
single project.
4. Prior to the issuance of any City permits for the commencement of
construction on said project, the applicant shall agree in writing to
these Conditions of Approval.
5. The development of the property described herein shall be subject to
the restrictions and limitations set forth herein which are in addition
to all municipal ordinances and State and Federal Statutes now in force,
or which hereafter may be in force.
6. All existing electrical distribution lines, telephone, cable antenna
television, and similar service wires or cables, which are adjacent
to the property being developed shall be installed underground as a
part of development from the nearest existing pole not on the property
being developed.
7. All requirements of the City Fire Marshal shall be met as part of the
development of this project per attached letter dated September 11, 1980.
8. Construction plans shall be submitted for approval to the City Fire
Marshal prior to issuance of building permits. All conditions shall
be made a part of construction and no certificate of occupancy shall
be issued until completed.
9. Traffic control provisions shall be provided as required by the Director
of Public Works.
10. Curb, gutter, sidewalk or approved pathways, and tie-in paving shall be
provided in conformance with City Standards and/or as required by the
Director of Public Works.
11. Prior to issuance of a building permit for construction of any use
contemplated by this approval, the applicant shall first obtain permits
and/or clearance from the following agencies:

by the City Council of a Tentative Tract Map and shall remain in
force for one year from that date; or, in the event that a Tentative
Tract Map is not approved, CUP 02-80 shall become null, void and of
no effect whatsoever.
3. Developer shall mitigate erosion of the stormwater channel banks
during periods of unusual rainfall by providing channel landscaping
or bank rip -rap and shall relocate any existing district facilities
as required by the Coachella Valley Water District and City Public
Works Director.
4. Tennis court lighting to be down shining black box type on a maximum
20' high pole.
5. Entry to project on 44th Avenue to be revised to align with proposed
plans developed by Southwest Engineering for E1 Paseo extension,
subject to City Public Works Director.
6. Provide additional pool in area north of tennis courts with both pools
to use solar heating.
7. 6 foot high block wall as approved by Design Review Board to be provided
around entire site.

Prior to construction of any of the proposed buildings, the following conditions
must be met:
I. Install a water system capable of delivering 2500 GPM fire flow for a two (2)
hour duration'in addition to domestic or other supply. The computation
shall be based upon a minimum of 20 psi residual operating pressure in the
supply main from which the flow is measured at the time of measurement.
2. Install Riverside County super fire hydrants so that no point of any building
is more than 250 feet from a fire hydrant measured along approved vehicular
travel ways.
A. Hydrants shall not be located closer than 25 feet to any building.
B. Exterior surfaces of hydrant barrels and heads shall be painted chrome
yellow, and the tops and nozzle caps shall be painted green.
C. Curbs (if installed), shall be painted red 15 feet in either direction
from each hydrant.
3. Prior to issuance of a building permit, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
Upon approval, one copy will be sent to the Building Department, and the original
will be returned to the developer.
4. The water system plan shall be signed by a registered civil engineer, and
approved by the water company, with the following certification: "I certify that
the design of the water system in Case Number CUP 12-80, C/Z 02-80 is in
accordance with the requirements prescribed by the Fire Marshal."

III. DISCUSSION:
A. ZONE CHANGE
The requested Change of Zoning is sought to allow implementation
of a specific development design. The present zoning (PR-7,S.P.)
results in a project which has 50% of its open space in common
use and ownership; whereas, the objective of the proposed project
is to have individual lots and private yard areas.
The proposed zoning R=2 (6) allows variety in housing choice
which is consistent with the goals of the Housing Element of the
General Plan, and the resulting number of dwelling units is also
in concert with the density range established in the Land Use
Element.
B. CONDITIONAL USE PERMIT
The companion Conditional Use Permit allows the proposed zone to
be used for "Planned Residential Developments" at a density of
one dwelling unit for each 6,000 sq.ft. of site area. The number
of dwelling units proposed in this application is less than the
maximum allowed under the present zoning.
C. PROJECT DESIGN
1. Circulation/Access - The project features an internal private
street system, with a north -south collector street connecting

2. Dwelling Unit Arrangement - The project design consists of what
is referred to as a "zero lot line" approach where one side of
the dwelling has a blank wall and is placed directly on the side
property line, versus a more conventional approach which employs
two side yards.
Each unit is provided with a two car garage which accesses, in
some cases, directly to the private street without driveway
space to temporarily park in front of the garage. Driveway
lengths are from 5 to 10 or 17 feet. In this instance, it
becomes important to provide street parking (as has been done
in this plan) for guests and deliveries.
3. Architectural Approach - As noted, the prominant feature of the
street elevation is the unit's garage. The proposed architect-
ural design shows a variation in this elevation between the
three basic models, to lessen the monotony of the street eleva-
tions. Basic materials of construction include frame and stucco
walls and tile roofs.
D. DESIGN REVIEW BOARD EVALUATION
The Design Review Board reviewed this item on September 23, 1980, and
continued the request to October 7, 1980. The continuance was to
address concerns of the Board and Staff. Those concerns generally
pertained to the following:
1. Window shading of glass areas.
2. Varying setbacks to provide driveway aprons.
3. Providing duplex units (side to side).
The applicant submitted revised exhibits which were approved by the
Board, subject to revisions. These revisions are contained in the
attached Resolution as Special Conditions No. 5-10.
IV. STAFF RECOMMENDATION:
Based on the justification and findings contained in Draft Resolution:
Recommend to City Council approval of Case No. C/Z 02-80, and approve
Case Nos. CUP 12-80 and 219 MF, subject to the conditions attached thereto.

and may be considered safe from stormwater flows except in rare instances.
This area is designated Zone B on Federal Flood Insurace rate maps which are
in effect at this time.
There may be erosion of the banks of the stormwater channel during periods of
unusual rainfall and discharge; however, the degree of erosion can be mini-
mized or eliminated by either channel landscaping or bank rip -rap. These pro-
tective measures shall be constructed to minimize potential erosive damage to
tract improvements.
Plans for stormwater protective works shall be submitted to Coachella Valley
Water District for review.
The District will furnish domestic water and sanitation service to this area
in accordance with the regulations of this District.
This area shall be annexed to Improvement District Nos. 54 and 80 of Coachella

There may be conflicts with existing District facilities. We request the

The following data is submitted regarding your request for
an expanded statement on justification for a change of zone.
The basic reason for the zone change is to provide for the
residential needs of locally employed, year-round residents.
The existing zoning encourages clustered units on open greens
which are suited more for the short term seasonal resident with
a relative simpler privacy requirement. Year-round family
residents must have homes which allow for a high level of privacy
and easy access to the community recreational facilities. To
provide for these needs, zero lot line residences have been
designed that strongly relate the interior space of the houses to
their enclosed yards and thereby provides both privacy and space
for outdoor family activities.
The land plan relates the single story homes on individual lots
to the centrally located recreational area. This area includes
tennis courts and swimming pool facilities. Binding the plan
together is the landscape program which unifies all community
visual areas and the use of a select palette of plant materials
and provides a visual buffer zone between the development and
the outside community.

Mr. Donat assured everyone that every means will be considered for the
drainage problem and that they would divert the water in a proper fashion. He also
pointed out that it would not be economically feasible to move the athletic building
75 feet from the east property line.
Chairman Miller closed the Public Hearing.
Commissioner Berkey explained that when Palm Desert incorporated and the
new General Plan was adopted, the lots on the west side of the City had not been
developed over 10 years. He stated that someone came along and wanted the PC zone,
Public Hearings were made and there were no arguments at that time. He, therefore,

Mr. Sawa presented this case reviewing the staff report. He stated that the
proposed zoning would allow a variety in housing choice and would be consistent
with the Housing Element. He described the proposed project design pointing out that
this project would have to coordinate with the street improvement designs being
prepared for the Regional Shopping Center. He further explained the dwelling unit
approach, driveways, and the architectural design. Mr. Sawa stated that the Design
Review Board reviewed this case and continued it because of concerns; he reviewed
those concerns and stated that the .revised plans were approved subject to conditions.
He recommended approval.
Commissioner Richards was concerned for the units that are next to the
channel. He asked Mr. Sawa what type of protection would be provided. Mr. Sawa
explained that there would be a 6 foot block wall and in addition to that there would
be channel landscaping or bank rip -rap.

III. DISCUSSION:
A. ZONE CHANGE
The requested Change of Zoning is sought to allow implementation
of a specific development design. The present zoning (PR-7,S.P.)
results in a project which has 50% of its open space in common
use and ownership; whereas, the objective of the proposed project
is to have individual lots and private yard areas.
The proposed zoning R=2 (6) allows variety in housing choice
which is consistent with the goals of the Housing Element of the
General Plan, and the resulting number of dwelling units is also
in concert with the density range established in the Land Use
Element.
B. CONDITIONAL USE PERMIT
The companion Conditional Use Permit allows the proposed zone to
be used for "Planned Residential Developments" at a density of
one dwelling unit for each 6,000 sq.ft. of site area. The number
of dwelling units proposed in this application is less than the
maximum allowed under the present zoning.
C. PROJECT DESIGN
1. Circulation/Access - The project features an internal private
street system, with a north -south collector street connecting
entrances to Parkview Drive and 44th Avenue. as well as internal

2. Dwelling Unit Arrangement - The project design consists of what
is referred to as a "zero lot line" approach where one side of
the dwelling has a blank wall and is placed directly on the side
property line, versus a more conventional approach which employs
two side yards.
Each unit is provided with a two car garage which accesses, in
some cases, directly to the private street without driveway
space to temporarily park in front of the garage. Driveway
lengths are from 5 to 10 or 17 feet. In this instance, it
becomes important to provide street parking (as has been done
in this plan) for guests and deliveries.
3. Architectural Approach - As noted, the prominant feature of the
street elevation is the unit's garage. The proposed architect-
ural design shows a variation in this elevation between the
three basic models, to lessen the monotony of the street eleva-
tions. Basic materials of construction include frame and stucco
walls and tile roofs.
D. DESIGN REVIEW BOARD EVALUATION
The Design Review Board reviewed this item on September 23, 1980, and
continued the request to October 7, 1980. The continuance was to
address concerns of the Board and Staff. Those concerns generally
pertained to the following:
1. Window shading of glass areas.
2. Varying setbacks to provide driveway aprons.
3. Providing duplex units (side to side).
The applicant submitted revised exhibits which were approved by the
Board, subject to revisions. These revisions are contained in the
attached Resolution as Special Conditions No. 5-10.
IV. STAFF RECOMMENDATION:
Based on the justification and findings contained in Draft Resolution:
Recommend to City Council approval of Case No. C/Z 02-80, and approve
Case Nos. CUP 12-80 and 219 MF, subject to the conditions attached thereto.

This area is designated Zone B on Federal Flood Insurace rate maps which are
in effect at this time.
There may be erosion of the banks of the stormwater channel during periods of
unusual rainfall and discharge; however, the degree of erosion can be mini-
mized or eliminated by either channel landscaping or bank rip -rap. These pro-
tective measures shall be constructed to minimize potential erosive damage to

Plans for stormwater protective works shall be submitted to Coachella Valley
Water District for review.
The District will furnish domestic water and sanitation service to this area

There may be conflicts with existing District facilities. We request the
appropriate public agency to withhold the issuance of a building permit until

Dear Mr. Crump:
The following data is submitted regarding your request for
an expanded statement on justification for a change of zone.
The basic reason for the zone change is to provide for the
residential needs of locally employed, year-round residents.
The existing zoning encourages clustered units on open greens
which are suited more for the short term seasonal resident with
a relative simpler privacy requirement. Year-round family
residents must have homes which allow for a high level of privacy
and easy access to the community recreational facilities. To
provide for these needs, zero lot line residences have been
designed that strongly relate the interior space of the houses to
their enclosed yards and thereby provides both privacy and space
for outdoor family activities.
The land plan relates the single story homes on individual lots
to the centrally located recreational area. This area includes
tennis courts and swimming pool facilities. Binding the plan
together is the landscape program which unifies all community
visual areas and the use of a select palette of plant materials
and provides a visual buffer zone between the development and
the outside community.

Standard Conditions:
1. The development of the property shall conform substantially with Exhibit
A through E (Case Nos. CUP 02-80 and 219 MF) on file with the Department
of Environmental Services, as modified by the following conditions.
2. Prior to the issuance of a building permit for construction of any
uses contemplated by this approval, the applicant shall first complete
all the procedural requirements of the City which include, but are not
limited to, Design Review, Subdivision process, and building permits
procedures.
3. Construction of the total development may be done in phases; however,
each individual phase shall meet or exceed all Municipal Code require-
ments to the degree that the City could consider each phase as a
single project.
4. Prior to the issuance of any City permits for the commencement of
construction on said project, the applicant shall agree in writing to
these Conditions of Approval.
5. The development of the property described herein shall be subject to
the restrictions and limitations set forth herein which are in addition
to all municipal ordinances and State and Federal Statutes now in force,
or which hereafter may be in force.
6. All existing electrical distribution lines, telephone, cable antenna
television, and similar service wires or cables, which are adjacent
to the property being developed shall be installed underground as a
part of development from the nearest existing pole not on the property
being developed.
l 7. All requirements of the City Fire Marshal shall be met as part of the
l development of this project per attached letter dated September 11, 1980.
8. Construction plans shall be submitted for approval to the City Fire
Marshal prior to issuance of building permits. All conditions shall
be made a part of construction and no certificate of occupancy shall
be issued until completed.
9. Traffic control provisions shall be provided as required by the Director
of Public Works.
10. Curb, gutter, sidewalk or approved pathways, and tie-in paving shall be
provided in conformance with City Standards and/or as required by the
Director of Public Works.
11. Prior to issuance of a building permit for construction of any use
contemplated by this approval, the applicant shall first obtain permits

1. The design and improvement of 44th Avenue public right-of-way
shall be as required by the Director of Public Works in accordance
with plans developed by Southwest Engineering and accepted by the

2. The effective data of this approval shall coincide with the approval
by the City Council of a Tentative Tract Map and shall remain in
force for one year from that date; or, in the event that a Tentative
Tract Map is not approved, CUP 02-80 shall become null, void and of
no effect whatsoever.
3. Developer shall mitigate erosion of the stormwater channel banks
during periods of unusual rainfall by providing channel landscaping
or bank rip -rap and shall relocate any existing district facilities
as required by the Coachella Valley Water District and City Public
Works Director.
4. Tennis court lighting to be down shining black box type on a maximum
20' high pole.
5. Entry to project on 44th Avenue to be revised to align with proposed

Prior to construction of any of the proposed buildings, the following conditions
must be met:
I. Install a water system capable of delivering 2500 GPM fire flow for a two (2)
hour duration in addition to domestic or other supply. The computation
shall be based upon a minimum of 20 psi residual operatin
g pressure in supply main from which the flow is measured at the time of measurement.the
2. Install Riverside County super fire hydrants so that no point of any building
is more than 250 feet from a fire hydrant measured along approved vehicular
travel ways.
A. Hydrants shall not be located closer than 25 feet to any building.
B. Exterior surfaces of hydrant barrels and heads shall be painted chrome
yellow, and the tops and nozzle caps shall be painted green.
C. Curbs (if installed), shall be painted red 15 feet in either direction
from each hydrant.
3. Prior to issuance of a building permit, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
Upon approval, one copy will be sent to the Building Department, and the original
will be returned to the developer.
4. The water system plan shall be signed by a registered civil engineer, and
approved by the water company, with the following certification: "I certify that
the design of the water system in Case Number CUP 12-80, C/Z 02-80 is in
accordance with the requirements prescribed by the Fire Marshal."
