RESOLUTION NO. 79-2 CONDITIONS OF APPROVAL CASE NO. TT 14032 STANDARD CONDITIONS: Page Two 1. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and State and Federal statutes now in force, or which hereafter may be in force. 2. Full public improvements including traffic safety lighting as required by Ordinance and the Director of Public Works, shall be installed in accordance with City standards. 3. The C.C.&R's for this development shall be submitted to the Director of Public Works for review and approval prior to the issuance of any building permits. Prior to recordation of the final subdivision map, the applicant shall submit to the Director of Public Works: a. The document to convey title. b. Covenants and restrictions to be recorded. c. Homeowners management plan for maintenance of the private streets and common areas. 4. Improvement plans for water and sewer system shall meet the require- ments of the respective service districts. 5. Area shall be annexed to appropriate Improvement Districts having jurisdiction over the subject area. 6. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert, without cost to the City and free of all liens and encumbrances. 7. All on -site utilities, including any existing overhead facilities, shall be placed underground and shall be completely concealed from view except certain appurtenances as may be approved by the Director of Environmental Services. 8. Complete plans and specifications shall be submitted as required by Ordinance to the Director of Public Works for checking and approval before construction of any improvements is commenced. The sub- divider shall submit "as -built" plans prior to acceptance of the subdivision improvements by the City. 9. In order to maintain reasonable fire protection during the construc- tion period, the subdivider shall maintain passable vehicular access to all.buildings...An adequate number of fire hydrants with the required fire flows shall be installed as recommended by the Fire Marshal. 10. CASE NO. TT 14032 WHEREAS, the City Council of the City of Palm Desert, California, did, on the 25th of January, 1979, hold a duly noticed Public Hearing to consider the request of RIDGEWOOD DEVELOPMENT, INC., for approval of a Tentative Tract Map to create a 238 lot Residential Subdivision to provide for 227 dwelling units on approximately 80 acres located within the R-2 8,000 (8) (Single-family, min. 8,000 sq. ft. lots, min. 8,000 sq. ft. per dwelling unit) zone located at the south- east corner of Portola Avenue and Country Club Drive, more particularly described as: APN 621-230-001 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure, Resolution No. 78-32," in that the Director of Environmental Services has deter- mined that the proposed project will not have a significant adverse impact on the environment and a Negative Declaration has been prepared; and WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said City Council did find the following facts and reasons to exist to approve the Tentative Tract Map: 1. The subject Tentative Map does substantially comply with Chapter 26 of the City of Palm Desert Municipal Code, and the State of California Subdivision Map Act, as amended. 1 2. The subject Tentative Map does comply with the adopted General JPlan and the Palm Desert Zoning Ordinance. 3. The site is physically suitable for the type of development proposed. 4. The design of the subdivision and the proposed improvements are not likely to cause substantial environmental damage or serious health problems. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and consti- tute the findings of the Council in this case; 2. That it does hereby approve the above described Tentative Map No. 14032 for the reasons set forth in this Resolution and subject to the attached conditions. Applicant shall pay $50 per unit toward the City's Signalization Fund. 2. The proposed block wall along Country Club Drive and Portola Avenue(Extended) shall be decorative in design as approved through the Design Review Board process. Said wall shall also be provided along the Hovely Lane frontage and the easterly boundary of the subject property. 3. All cul-de-sacs northerly of IV' street shall be shortened so that all lots abutting the proposed green belt shall back up to said area. Further, pedestrian connections from the cul-de-sacs to the proposed green belt shall be maintained, except for street F & Q. 4. All fencing and/or walls abutting the proposed green belt shall be limited to a maximum height of four feet of solid wall. 5. Access to Hovely Lane shall be limited to a 20 feet wide pedestrian access. 6. All streets, including private streets, shall be built to City Standards as approved by the Director of Public Works. 7. Lot improvements shall include front yard landscaping and irrigation and total lot fencing as approved through the City's Design Review Process. 8. All street names shall be subject to the approval of the Director of Environmental Services. 9. All landscaping installed within the requilp-d parkway area along all public streets shall thereafter be maintained by the owners and/or occupants of the total development through an approved homeowner's association. 10. Public street dedication and improvements shall be as follows: a. The full frontage of Country Club Drive shall be dedicated and improved with curb, gutter, tie-in paving, 8 feet wide meandering bicycle/pedestrian system, center median, and landscaping on the basis of a 55 ft. wide half=street im- provement width plus a 23 feet wide pedestrian easement. b. The full frontage of Portola Avenue shall be dedicated and improved with curb, gutter, tie-in paving, 8 feet wide meandering bicycle/pedestrian system, center median, and landscaping on the basis of a 50 feet wide half -street, plus a 20 ft. wide pedestrian easement. r_ The f„ll frnntaaa of Hovely Lane shall be dedicated and imoroved with RESOLUTION NO. 79-2 Page Four 11. Construction.of a minimum of two entrances to the project. c. Install a water system capable of delivering 1500 GPM fire flow from any fire hydrant for a two hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants located at each street intersection (a) but not greater than 500 feet apart in any direction. A. Exterior surface of hydrant barrels and heads shall be painted chrome yel- low, and the tops and nozzle caps shall be painted green. B. Curbs shall be painted red 15 feec in either direction from each hydrant. 3. Prior to recordation of the final map, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in Tract No. 14032 is in accordance with the require- ments prescribed by the Fire Marshal." Upon approval, the original plan will be returned to the developer. 5. Commissioner Fleshman asked about the setbacks on the units that back onto Florine. Air. Williams suggested that the corner units be deleted and possibly the applicant could take out the interior units and bring the outside units'in further to allow for better setbacks. Commissioner Berkey Rmended his motion to include the addition of Special Condition No. 4 - Off-street parking shall be a combination of a single garage and single carport per unit; and, tte deletion of Special Condition No. 2. Commissioner Kryder agreed and amended his second. Chairman Kelly stated that a PR-4 will provide what the church wRnts and will be compatible with -.he area. Mr. Sweet asked about h^.ving 2 garages at one end of the unit and the 2 carports at the other end. Mr. Williams stated that it would be better to have a gara.-e and a carport with the carport next to the porch area. The motion made by Corunissioner Berkey was carried unanimously C. Case Nos. C/Z 14-78 and TT I.4032 - RIDGEWOOD LTD., Applicant Request for a Change of Zone from PR-4 and O.S. to R-2 8,000(8) and a tentative subdivision for 238 single'family residential lots, one common lot and a Public Park on approximately 80 acres located at the southeast corner or the intersec- tion of Portola Avenue (extended) and Country Club Drive. Mr. Williams reviewed the staff reports and noted a revised site plan. He then reviewed the conditions of approval and the revised Resolutuion to comply with the revised site plan. This would create 233 lots, 6 common lots, and 227 maximum dwelling units. There was some discussion about blowsand, lot widths, and pools for each unit, and whether the applicant will have to apply for a Variance or a Conditional Use Permit with regard to lot lines. Mr. Williams reviewed the staff reports and noted a revised site plan. He then reviewed the conditions of approval and the revised Resolutuion to comply with the revised site plan. This would create 233 lots, 6 common lots, and 227 maximum dwelling units. There was some discussion about blowsand, lot widths, and pools for each unit, and whether the applicant will have to apply for a Variance or a Conditional Use Permit with regard to lot lines. As a part of the City's consideration for this annexation, the subject property was considered for prezoning and a majority of this property was designated PR-4 with approximately 9.7 acres designated as open space. The area designated as open space was all the subject property southerly of Hovely Lane extended and was to be a part of the proposed Sand Dune Park. Further, the PR-4 was established on a majority of the subject property along with all the property easterly of the subject property on the basis of the possibility that said nroperty would develop as a single project. The applicants now intends to develop this 80 acre parcel as a separate project. Since the proposed project is more of a standard single family subdivision, the applicant has requested a change of zone to R-2 8,000 (8) on approximately '71 acres of the subject property and they propose to construct approximately 238 dwelling units on said area for a density of 3.35 dwelling units per acre. The existing zoning would permit a maximum of 286 dwelling units on the subject property. SUBDIVISION - The design of the proposed project consists of 238 residential units on individual 8,000 sq. ft. minimum lots served by a private street system which consists of a loop street accessing a series of cul-de-sacs. A total of three entrances are proposed to the project. The proposed lots will average approximately 8,990 sq. ft. The applicant also proposes a 4.6 acre Green Belt down the center of the subdivision, which will connect most of the proposed cul-de-sacs with a walkway system that will lead to at least one common recreation center at the northerly end of the project. While the Recreation Center area facilities have not been finalized, it is known that it will consist of at least 4-6 tennis courts and a small clubhouse. Further, the applicant is also proposing . a secondary center at the southerly end of the proposed Green Belt wnich will have a common pool. The project is bounded by three major streets (Country Club, Portola Avenue and Hovely Lane) which are all proposed to be improved on the basis of half street width. RESOLUTION NO. 79-39 - A RESOLUTION OF THE CITY COUNCIL OF THE C TY OF PALM DESERT, CALIFORNIA, ADOPTING AN EMPLOYEES' DEFERRED COMPENSATION PLAN AND AUTHORIZING THE EXECUTION OF AGREEMENTS. Mr. Ortega reported that the purpose of this resolution was to enable employees to defer portions of their compensation to this type of plan. The employees' earnings are set aside and remain an asset of the City until the employee chooses to withdraw their funds for retirement or other reasons. The only minor expense to the City would be that of book- keeping. It would be administered by a Plan Administrator, generally an insurance carrier. Mr. Byers pointed out that proposals had been received from both a savings and loan bank and an insurance carrier. Very preliminary earth- work calculations indicate that approximately 385,000 cubic yards of dirt will be moved. 22. A temporary increase in the amount of dust, ash, smoke fumes or odors on the project site can be expected during the construction phase of the project. However, this increase should cease once construction is com- pleted. 24. The quantity of ground water should decrease in the vicinity of the project as a result of the proposed development.
