PLANNING COMMISSION RESOLUTION NO. 477
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING
FINDINGS AND APPROVING THE DESIGN REVIEW BOARD
ACTIONS OF MARCH 20, 1979.
WHEREAS, the Planning Commission of the City of Palm Desert,
California, did review the Design Review Board actions of
March 20, 1979, approving:
Case No. 111C - Request for approval of preliminary,
site plans, landscaping, architectural
elevations, and signing program for
commercial building (bank) for WELLS
FARGO BANK;
Case No. 108C - Request for approval of preliminary
and construction plans for commercial
building for S & J MANAGEMENT;
Case No. 169MF - Request for approval of conceptual site
plan and landscape plan; construction
elevations and floor plans; and colors
and materials for condominium develop-
ment for DAME'-DOTY DEVELOPMENT CO.
WHEREAS, at this time, upon receiving and considering all
testimony and arguments, if any, of all interested persons desiring to
be heard, said Commission did find sufficient facts and reasons to
exist to approve the Design Review Board actions of March 20, 1979.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of
the City of Palm Desert, California, as follows:
1. That the above recitations are true and correct and
constitute the findings of the Commission in this case;
2. That it does hereby approve the Design Review Board
actions of March 20, 1979.
PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm
Desert Planning Commission, held on this 3rd day of April, 1979,
by the following vote, to wit:

Mr. Allen then asked if these mobile homes would be recessed,
and Air. Williams answered yes - - they would be comparable to Palm
Desert Greens.
F. X. MC DONALD, Jr., Long Beach, stated that he owns 40 acres north
of Palm Desert Estates, and last July, the City took 10 acres
from his land for habitat of the Fringe -Toed Lizards.
Mr. McDonald wondered why they have not done the same for
the subject request; shouldn't this be Open Space also.
Shouldn't other developers have to give up a quarter of their
land to Open Space.
Mr. Williams stated that the City has recently developed a
Master Plan of Parks and Recreation, whereby they defined the Sand Dune
Park as the area north of 42nd Avenue. With the adoption of that
plan, the previous designation was deleted.
Chairman Snyder stated that this property falls outside the
jurisdiction of the park requirements of the General Plan. He
sympathizes with the question and hopes that we can solve it some day.
Chairman Snyder declared the Public Hearing closed, asking for
the pleasure of the Commission.
On a motion by Commissioner Kryder, seconded by Commissioner
Berkey, Planning Commission Resolution No. 475 was approved with the
deletion of the words "or any other zone deemed appropriate" where
applicable; carried 3-0-1 (AYES: Berkey, Kryder, Snyder; ABSTAIN: Fleshman).

VIII. NEW BUSINESS
A. Coachella Valley County Water District Projects
in the City of Palm Desert
Mr. Williams reviewed the proposals, noting that that the request
is to find the proposals in compliance with the adopted Palm Desert
General Plan.
Chairman Snyder commented that he hoped Public .Works will
continue to have Coachella Valley County Water District put streets
back in good condition at the conclusion of projects.
On a motion by Commissioner Berkey, seconded by Commissioner
Fleshman, Planning Commission Resolution No. 476 was approved as
presented; carried unanimously (4-0).
B. Consideration of date change for May 1, 1979, Planning
Commission meeting
Mr. Williams explained that a conflict of dates would occur

etween the May 1 meeting and the Planning Commissioners Conference in
Diego for the Cal Chapter of APA.
On a Minute Motion by Commissioner Kryder, the May 1, 1979
Planning Commission meeting was changed to May 3, 1979; carried
unanimously (4-0).
IX. DESIGN REVIEW BOARD ITEMS
Consideration of cases acted upon by the Design Review Board
at their March 20, 1979 meeting
Mr. Crump reviewed the three case OSC; 111C; 169AIF) the
Design Review Board acted upon.

Chairman Snyder asked if any of the applicants wished to make a
presentation.
Mr. Dame' commented on Case No. 169 MF, referring to the
recommendations of the Design Review Board regarding gabled roofs -
he noted that they plan to minimize the use of gabled roofs as much as
possible, and will not use them at all on 5-unit buildings.
On a motion by Commissioner Fleshman, seconded by Commissioner
Kryder, the actions of the Design Review Board at their March 20, 1979
meeting were approved by Planning Commission Resolution No. 477, as
presented; carried unanimously (4-0).
Mr. Williams related that the Planning Commission will be
reviewing a change in the composition of the Design Review Board at
:their next Study Session meeting.

Case No. 111 C - WELLS FARGO BANK (John Outcault, Architect) - Approval
of preliminaryplans for construction of a bank building located on the
southwest corner of E1 Paseo and Lantana. Applicant's representative
present.
The Board reviewed a revised site plan for the site and was also presented
a further revision prepared by the applicant. Discussion followed
relative to planter design and the need for landscape material to soften
the building elevations. Board recommendation for revisions to the
preliminary site plan were recorded on the plan in the file of the
Department of Environmental Services.
Motion was made by Urrutia, seconded by Barton, to approve preliminary
plans subject to the following revisions:
1. Submit revised site plan reflecting the notations on the plan in
the file of the Dept. of Environmental Services, with the construction
drawings.
2. Provide Ordinance requirement for six foot distance from property
line to parking stall by increasing planter width in the southeast
corner of the site.
3. Submit revised landscape plan with final construction drawings to
address changes in planter area design.
4. Submit larger scale (precise) drawings for sign program, with
final construction drawings.

J Case No. 108 C - S & J MANAGEMENT - Approval of preliminary drawings
and final construction drawings for a commercial building located
north of Highway 111, west of DeAnza Way. Applicant was present.
The Board reviewed the previously recommended revisions as they
applied to the site plan and elevations. The landscaping plan was
reviewed in terms of plant material and selection of trees. The Board
noted that several revisions to the landscaping plan would be necessary.
Motion was made by Urrutia, seconded by Barton, to approve preliminary
and final construction drawings, subject to the following revisions:
1. Provide revised final landscape plan for Staff approval incor-
porating the notations contained on the plan in the file of the
Department of Environmental Services.

Case No. 68 MF - PALM DESERT VENTURE, LTD., (Francisco Urrutia, Architect) -
Approval of final construction drawings and revised wall detail for the final
phase of Shadow Mountain development, located on the east side of San
Luis Rey (south of Juniper Circle). Applicant was present.
The Board reviewed the details of the construction site plan and pro-
posed wall amendments. Previous conditions of approval for Development Plan
06-77 were also noted and it was found that they had generally been
complied with.
On a motion by Leung, seconded by Barton, the Board approved final
construction drawings for the 29 unit phase and revised project wall
detail, subject to the following:
1.- That all conditions of Development Plan 06-77 be met; and that
all conditions of the original Design Review be met, with specific
attention to condition No. 9, requiring final landscape plan
submittal.
2. That carport structures for building No. 9 be erected prior to
the request for granting an occupancy permit.
3. Provide overhead storage cabinets in carports.

This item was continued from the February 20, 1979, Board
meeting to allow the applicant to revise preliminary site and
landscape plans (see attached). Revised plans have been
submitted, that are not specifically in line with recommended
revisions. The landscape plan appears to need additional
consideration to provide a faster growing tree if 15 gallon
size is used and the specific variety of shrub needs to be
specified. The driveway entrance may be acceptable as
indicated.
STAFF RECOMMENDATION
Approve preliminary plans subject to the following revisions:

Case No. 104 C - JOHN F. OUTCAULT, A.I.A. FOR J. WELDS - Final construction
drawings for commercial structure and related parking to be located north
of Highway 111, east of Las Palmas. Applicant was present.
The Board reviewed final plans for the project. The applicant submitted
a new set of plans addressing Staff concerns and these were found to be
generally acceptable.
On a motion by Jackson, seconded by Urrutia, the Board approved final
plans, subject to the following revision:
1. Replace Carolina Cherries with Pyracantha, on the west.

Case No. 110 C - J. SEGALL - Final construction drawings for a commercial
addition to be located on the northwest corner of Cabrillo and Highway 111.
Applicant was present.
The Board reviewed various elements of the proposed construction; reviewing
materials of construction, the aesthetic aspects of the structure and
landscaping. Also discussed were structural requirements to support the.
structure and satisfy wind load requirements.
On a motion by Urrutia, seconded by Johnson, Jackson having left the roan,
the Board moved to continue the item to allow the applicant to poet with
the Building Department to discuss structural requirements, and to review
the elevation of the structure and landscaping to screen it; carried 3-0-1
(AYES: Johnson, Urrutia, Williams ABSENT: Jackson).
Case No. 108 MF - AMERICAN WEST - Final construction drawings for a 5-unit
apartment complex to be located on the southwest corner of Driftwood and
Sunset. Applicant was present.
The Board discussed the final construction drawings and landscaping plans,
which were required to be submitted to the Board.
On a motion by Williams, seconded by Jackson, the Board approved the plans,
subject to the following revisions:

2. Specify future pool area to be in lawn.

elevations for a duplex to be located on the northwest corner of Las Palmas
and San Gorgonio Way. Applicant was present.
The Board reviewed the various aspects of the preliminary site plan,
elevations, and project landscaping. There were specific concerns with the
landscaping plan and the site plan.
On a motion by Williams, seconded by Jackson, the Board approved the plan,
subject to the following revisions:
Landscaoe and Site Plan
1. Install sidewalk as required by the Director of Public Works.
2. Extend wall on northerly property line, easterly to garage to create
private patio for northerly units.
3. Extend wall easterly along San Gorgonio Way to enclose patio for south
unit.
4. Provide shade structure for patio area from south unit.
5. Upgrade landscaping in following areas:
A. Along San Gorgonio Way adjacent to wall area and adjacent to garage.
B. Adjacent to southerly garage along Las Palmas.
C. Provide shade trees southerly of pool area in rear yard area (suggest
Sterculia) clustered in a group of three to four trees.
D. Along Las Palms Avenue, add trees and provide low planting to tie
landscaping design together.

On a motion by Urrutia, seconded by Leung, the item was continued to allow
the applicant to respond to - one, the reduction and size of sign, the
change in color or precise color submittal; and two, the number of signs
(deleting the free-standing monument sign);
carried 4-0 (Jackson, Johnson, Leung, Urrutia).
Case No. 108 C - S AND J MANAGE M, INC. - Preliminary site, floor and
elevations for a cannercial structure to be located on the north side of
Highway 111, west of DeAnza Way. Applicant was present.
The Board reviewed the exhibits submitted and discussed the design of the
parking area pedestrian entrance to the rear of the building, and the
landscape planning material on the rear of the site.
The Board noted that, particularly in the front area of the building, several
different architectural approaches had been taken and that they did not relate
to each other, and that there needed to be additional study to produce a
continuous architectural design.
Also noted were equipment locations that might occur on the top of the
structure and it was advised that these needed to be architecturally
screened by a roof element or parapet.
On a motion by Leung, seconded by Urrutia, the item was continued for restudy;
carried 4-0 (Jackson, Johnson, Leung, Urrutia).
Case No. 322 SA - STERLING SIGN CO. - Sign program for a comnercial
structure located on the north side of Highway 111, east of Monterey.
Applicant was present.
The Board reviewed the signing request, noting that provision for sign
above the eave line was not in concert with the sign ordinance. The
Board discussed alternatives to signing placed on top of the front porch
overhang, and determined that it would be acceptable to mount a sign hung
below the front edge of the porch as illustrated on plans in the Department
of Environmental Services. The Board suggested that the sign be
constructed of sandblasted wood and that a planter be located underneath
the sign to avoid any pedestrian conflict.
On a motion by Urrutia, seconded by Jackson, the Board continued the case
for restudy; carried 4-0 (Jackson, Johnson, Leung, Urrutia).
Case No. 101 C - PALM DESERT RACQUEMALL AND HEALTH CLUB - Revised site
plan for racquetball and health club to be located on the northwest corner
of Painters Path and Highway 111. Applicant was present.
The Board noted in the review of the revised Design Review submittal that
the prior approval had been the subject of several discussions. The Board
felt that the.plans, as previously approved, reflected their concerns and
Planning Ccnmission's concerns for reducing the overall mass of the build-
ing, by depressing it below the natural grade, and by providing mounding
and landscaping to further blend the building into its surroundings. The
Board was concerned with the elevation in that it presented a more formal
style of architecture that dominated the site rather than blending it into
the hillside backdrop. There was a discussion among the Board members as
to the proximity of the revised building in relation to the property line
along Painters Path. Board member Urrutia felt that the setback provided
in the previous approval is necessary to allow for mounding and land-
scaping to reduce the height and mass of the building. Board member
Jackson felt that bringing the building forward could be acceptable.
On a motion by Leung, seconded by Jackson,
