/ CASE NO. 112 C - CHARLES GIBBS, Applicant.
b Mr. Diaz indicated that Mr. Gibbs had sent him a letter requesting that he be
permitted to substitute the Dwarf Salmon Oleanders for Prostrate Junipers on the
landscaping of his mini -storage building located at the northeast corner of 42nd
Avenue and Eclectic Street..
It was the concensus of the Board that Mr. Gibbs' request be granted on condition
that the Junipers be spaced a minimum of four feet on center.
V. ADJOURNMENT
On a motion by Mr. Holden, seconded by Mr. Cook, the meeting adjourned
at 2:05 p.m.
Motion carried unanimously 6-0.

A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF PALM DESERT, CALIFORNIA,
ANNOUNCING FINDINGS AND APPROVING THE DESIGN
REVIEW BOARD ACTION AT ITS MEETING OF JANUARY
26, 1982.
WHEREAS, the Planning Commission of the City of Palm Desert, California,
did review the Design Review Board actions of January 26, 1982, approving:
CASE NO. 112 C (AMENDMENT) - Preliminary and final plans to add a
mini storage building to an existing facility at the northeast corner of
42nd Avenue and Eclectic Street (private) for CHARLES GIBBS.
WHEREAS, at this time, upon receiving and considering all testimony and
arguments, if any, of all interested persons desiring to be heard, said Commission did find
sufficient facts and reasons to exist to approve the Design Review Board action of
January 26, 1982.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute
the findings of the Commission in this case.
2. That it does hereby approve the Design Review Board actions
of January 26, 1982.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 2nd day of February, 1982, by the following vote, to

FEBRUARY 2, 1982
amended ordinance to include Sections 25.04.108 (Bachelor or Studio Apartments) and
25.56.320 A (1) (Minimum Residential Structure Size); he was opposed to Section 25.76.120
(Relocation of Legal Nonconforming Units).
Chairman Kryder wished to continue the whole matter until a joint session with
City Council can be arranged for review.
Moved by Commissioner Wood, seconded by Commissioner Richards, to continue
Section 25.04.108 (Bachelor or Studio Apts); continue Section 25.56.320 (Minimum
Residential Structure Size) indefinitely to permit discussion with Council; and, deny
Section 25.76.120 (Relocation of Legal Nonconforming Units). Carried unanimously 5-0.

Preliminary plan approvals by the Design Review Board at its meeting of January

A. I Case No. 112 C - CHARLES GIBBS - Preliminary and final approval to add a

Mr. Smith reviewed the plans and recommended approval.
Moved by Commissioner Richards, seconded by Commissioner Miller, to approve
Design Review Board's action by adoption of Planning Commission Resolution No. 780.
Carried unanimously 5-0.
B. Case No. 159 C - T.G.I. FRIDAYS, INC. - Preliminary approval of plans for
a restaurant building including usage of red and white awnings.
Mr. Smith stated that because Commission had some concern about the red and
white awning this matter was continued from the last meeting for further study. Staff
recommended approval.
MR. TOM HOOLIHAN, Applicant, was present and gave a brief presentation and
distributed pictures of existing restaurants. He explained that the awning is a trademark
of the restaurant.
After reviewing the site and information presented by the applicant the
Commission felt the plans were acceptable.
Moved by Commissioner Wood, seconded by Commissioner Crites, to approve the
Design Review Board's action for 159 C by adoption of Planning Commission Resolution
No. 781. Carried unanimously 5-0.
IX. MISCELLANEOUS ITEMS - NONE

XI. COMMENTS
Mr. Diaz reviewed items presented to City Council:
A. Amusement Arcades (Straw Hat) - City Council instructed staff to define
arcades and prepare an Ordinance regulating their use; staff prepared report
defining 3 or more machines would constitute arcade.
B. Hillside Overlay - City Council recommended a joint meeting with Planning
Commission on this matter. Meeting will be set.
C. Subdivision Ordinance revisions - staff is proceeding with proposed
amendments.

DISCUSSION:
This application was before the Board at its January 12, 1982 meeting. At that time Staff
advised the Board that the applicant had requested a continuance.
In the interim, additional plans (structural details) have been provided. The applicant
verbally advised Staff of some measures he proposed to improve the site. Rather than
outline the applicant's intentions here, it is suggested that the Board have the applicant
explain his proposed actions.
Attached is a copy of the January 12, 1982 staff report.

NATURE OF PROJECT/APPROVAL SOUGHT: Preliminary and final approval to add a
mini storage building to an existing facility.
LOCATION: Northeast corner of 42nd Avenue and Eclectic Street (private).

BACKGROUND:
This application was previously presented to the Board at its meeting of April 28, 1981, at
which time the applicant requested and received an indefinite adjournment. The applicant
now requests that the Board review the application.
A copy of the April 28, 1981 staff report is attached. The major concern at that time was
the lack of landscaping and maintenance thereof. A recent visit to the site indicated the
existence of landscaping materials. Most of the landscaping appeared to be alive although
some at the north end appeared to have died. The real problem involved the lack of
maintenance. Along the west wall, bunches of desert scrub were jammed into the wall
resulting in an unattractive appearance. Basically, it is felt that the applicant should be
requested to hire a landscape maintenance firm to maintain the site. In addition, there is
no ground cover provided in the landscape areas.
The Fire Marshal was consulted regarding the installation of water lines and indicated
that it was his understanding that the lines have been installed although they have not
been entirely completed.
STAFF ANALYSIS:
As delineated in the April 28, 1981 report, Staff does not object to the approval of the
additional building and vehicle storage area. However, considering the problem of the
maintenance of the landscaping, Staff would recommend that only preliminary approval be
granted and that the applicant provide a final landscaping and irrigation plan to be
submitted to the Board with the final working drawings.
Staff recommends that if the Board approves this application, that the following
conditions be imposed:
I. Approval to be preliminary only.
2. That a landscape plan be submitted indicating appropriate ground cover for the
landscaped areas as well as replacement of dead materials and intensification
of landscape materials along the south side of the vehicle storage area.
3. That the applicant enter into an agreement with a suitable landscape
maintenance firm to provide continuous maintenance to the landscape areas in
perpetuity and provide a copy of the agreement to the Director of
Environmental Services for his approval.
4. Final working drawings not to be submitted to Department of Building and
Safety until water lines and fire suppression facilities as required by City Fire
Marshal are installed and certified.
5. Final plans to show Coachella Valley TV fence location in relation to north
property line of subject site.

The applicant wishes to add a 30 foot by 220 foot mini -storage building to an
existing facility. This would be Phase III, with Phase I consisting of six
buildings (A-F) and Phase II consisting of three buildings (G-I). The applicant
is also askinq for approval of a 24 foot by 40 foot addition to building E
(Phase I). However, no plans have been submitted. Additionally, approximately
12 new outdoor storage vehicle spaces are proposed east of the new building.
An obvious fact upon inspecting the site is that maintenance of the landscaping
is non-existent. While there are some trees and shrubs the majority of the
landscaping consists of sand and native growth (weeds).
The storage building will match the other buildings in color, materials and
architectural style. There will only be doors on the south side of the building
to facilitate storage of boats.
The perimeter fencing and landscaping along the north property line will be
relocated further to the north to facilitate the proposed construction. The
Coachella Valley TV site to the north presently has a fence along the common
boundary between the two uses. Therefore, it may only be necessary to replace
the landscaping.
The Fire Marshal has voiced a concern that water lines required by previous approvals
have not yet been installed as promised. Therefore, fire flow is not adequate to
protect the developed properties. Staff has been informed by the applicant the
contract to do the installation has been let, but work has not yet begun. Staff
recommends that the final plans not be submitted to Building and Safety Department
until the work has been completed. This will insure compliance.
STAFF ANALYSIS:
Staff recommends that prior to any final DRB approval, a complete landscape plan
for the entire site be submitted to the Board for approval. The landscaping is
completely unacceptable and a poor example for the first industrial facility
built in the City of Palm Desert.
Staff recommends that if the Board approves this that the following conditions be
imposed:
1. Approval to be preliminary only.
2. A final landscaping and irrigation plan for the entire site to be submitted
to the Board with the final working drawings; plans to show all existing
and proposed landscaping with areas outside perimeter wall to be planted with
bermuda lawn and trees.

1. That a patio cover should be installed over the south facing sliding
glass door, in order to reduce direct sun infiltration.
2. That the 4 Pepper trees proposed in the yards adjacent to the streets
should be specified as 2, with minimum 15 gallon size, and 2 with
minimum 24" box.
3. That the names of all plants be delineated on the plan.
4. That construction plans be submitted for approval to the City Fire
Marshal prior to issuance of building permits. All conditions shall
be made a part of construction and no certificate of occupancy shall
be issued until completed.

Mr. Sawa said that the applicant has requested that this matter be
postponed indefinitely.
The Board concurred with the requested postponement.
CASE NO. 146 C - A-1 SURVEYING AND ENGINEERING - Preliminary approval
for commercial building at 74-300 Highway 111 (north side of Highway
111, west of Las Palmas); Charles Martin was present.
Mr. Martin highlighted the proposed development and said that the
required shading of the south facing glass would be further detailed
in the working drawings. He concurred with the landscaping comment
contained in the staff report.
Mr. Cook noted that the handicap parking space may have to be relocated
in order to conform with State requirements.
On a motion by Cook, seconded by Gregory, the Board approved this request
subject to the following conditions:
1. That adequate protection be provided for the glass area on the south
side of the building.
2. That the landscaping plan be revised to specify 1 tree of minimum
36" box and the two other trees be minimum 24" box.
3. That construction plans be submitted for approval to the City Fire
Marshal prior to issuance of building permits. All conditions shall
be made a part of construction and no certificate of occupancy shall
be issued until completed.
4. That final construction drawings, including a final landscaping
grading, lighting, amenities, trash storage, walkway layout,
irrigation plans and sign program be submitted to the Design Review
Board. No final inspection or occupancy permit shall be given by the
Department of Environmental Services to this project until the afore-
mentioned approved plans and construction shall have been completed.

STAFF ANALYSIS:
Staff recommends that prior to any final ORB approval, a complete landscape plan
for the entire site be submitted to the Board for approval. The landscaping is
completely unacceptable and a poor example for the first industrial facility
built in the City of Palm Desert.
Staff recommends that if the Board approves this that the following conditions be
imposed:
1. Approval to be preliminary only.
2. A final landscaping and irrigation plan for the entire site to be submitted
to the Board with the final working drawings; plans to show all existing
and proposed landscaping with areas outside perimeter wall to be planted with
bermuda lawn and trees.

Safety until water lines and fire suppression facilities as required by
City Fire Marshal are installed.
4. Final plans to show Coachella Valley TV fence location in relation to north

prior to issuance of building permits. All conditions shall be made a part
of construction and no certificate of occupancy shall be issued until
completed.
Should the Board feel these plans are acceptable, Staff will forward your approval

On a motion by Commissioner Snyder, seconded by Commissioner
Kryder, the actions of the Design Review Board were approved by
Planning Commission Resolution NO. 472, as presented; carried 3-0-1
(AYES: Fleshman, Kryder, Snyder; ABSTAIN: Berkey).
XI. DISCUSSION ITEMS
A. Mr. Williams presented details on the upcoming APA Cal -
Chapter conference in San Diego for the Planning Commissioners, asking
if there was any interest in attending.
Commissioner Snyder recommended that all Commissioners attend
if possible, and advised Mr. Williams that he would have final answers
by the following Friday, as to who would be attending.
B. Mr. Williams reported on LAFCO decisions at their March 8,
1979 meeting, whereby Annexation Nos. 6 and 8 were approved.
C. Mr. Williams then related that a letter of opposition was
sent to Riverside County regarding their Case No. 2239-E, as directed
by the Commission at the last meeting.

The Board reviewed preliminary plans for the subject case. Particular attention
was given to the site design and traffic circulation on site. The applicant
received directions regarding circulation pattern that should be established
on the site. It was also noted that to satisfy minimum ordinance requirements,
there would need to be an increase in the number of parking spaces.
On a motion by Leung, seconded by Urrutia, the Board continued this case to
allow the applicant to redesign the site plan; carried 4-0 (Johnson, Jackson,
Urrutia, Leung).

The Board reviewed preliminary and final construction drawings for a three -

cluded incorporating an area to the west of the existing development for
temporary outside storage consisting of 63 parking spaces.
Motion was made by Urrutia, seconded by Leung, to approve preliminary and
final plans submitted, subject to the stipulation that:

2. The perimeter screening and landscaping be extended around the outside of
the new storage area

CONDITIONS OF APPROVAL
CASE NO. 58C.
1. The development of this project shall conform substantially to all develop-
ment plans submitted in behalf of this case (Exhibit A-K), and as revised
according to the Design Review Board process. Any minor changes require
approval by the Director of Environmental Services. Any substantial change
requires approval by the Planning Commission.
2. All requirements of any law, ordinance, or regulation of the State, City, and
any other applicable government entity shall be complied with as part of the
development process.
3. This approval is applicable, subject to the development of this project, com-
mencing within one year from approval date and being promptly completed.
4. All service lines for utilities shall be placed underground.
5. Any roof mounted, exhaust, or air conditioning equipment shall be fully con-
cealed from view from any public rights -of -way and adjoining properties by
architecturally integrated means.
6. Final landscaping (with irrigation system) plans indicating plant sizes and
heights shall be provided to the Design Review Board for approval prior to
issuance of a building permit.
7. Lighting of parking areas and premises shall be provided as approved by the Director

IV. INFORMATION SHEET AND/OR PLAN BLOCK: As appropriate, include
an attached sheet to the application and/or specify directly
on the plans, in an information block, the following data:
- Owner's name, address, and phone number
- Designer's name, address, and phone number
- Any special information or conditions pertaining to the
site or to the plans
- Acreage and square footage calcualations
- Ratio of structures to total land area
- Ratioof parking spaces to building square footage
- Parking requirements provided
- Ratio of landscaping to total land area
- Any specific information of special conditions particularly
relevant to the project
V. SITE ANALYSIS & PRELIMINARY DRAINAGE AND GRADING PLAN: Three
(3) copies of a plan indicating the data described below (in-
formation may be incorporated into the plot plan where detail
is not obscurred or prepared as a separate exhibit):
- Vicinity map showing major street names, other reference
points and landmarks (no scale)
- North arrow
- Scale
- General drainage pattern of area to include site and adja-
cent properties within 100' (use arrows to show drainage
flow to and from site).
- Existing contour lines including property corners
- Proposed locations of structures and drives
- Elevations of pads and finished floors
- Finished grades
- Elevations of existing street centerline
- Retaining walls (where applicable)
- Perimeter walls and fences which affect drainage

VI. ARCHITECTURAL ELEVATIONS (all sides of all buildings):
A. Items to be reviewed and approved by the Design Review
Board and Planning Commission require the architectural ele-
vation submittal described below.
1. Three (3) full size drawings (one (1) of which is
to be color keyed -- see "Color and Material Exhibits,
Item No. VIII. Detailed drawings must include:
- Scaled drawings of all sides of all buildings,
with dimensions indicating proposed height (also
show proposed sign locations).
- Roof mounted air conditioning equipment or other
equipment mounted on either the exterior walls or
the roof must be shown if visible in elevation view.
- Complete street elevations including all buildings,
fencing/walls, landscaping and screening; and, peri-
meter treatment on non -street sides.
2. One (1) copy of the elevation drawing(s) containing
all of the general information above, except that it
is to be drafted or photographically reduced to an
8j11xll" or 13" size sheet. (All lettering to be
legible; include graphic scale.)
B. Items to be reviewed and approved by Planning Division
Staff only require three (3) full size copies of the
building elevations, with other information as requested.
VII. SIGN PROGRAM (if applicable): Three (3) copies of drawings
to scale representing all proposed signs, containing the fol-
lowing information:
- Scale used
- Sign shape
- Dimensions and sign area
- All graphics and lettering to appear on the sign
- Style of lettering to be used and width of strokes
- Proposed method of illumination (if appropriate)
- Method of attachement to any structure, or support if
placed on the ground
- Proposed colors and materials (see Item No. VIII)
- Proposed location (see Item No. III)
- Illustration of sign integration in architectural design
(see Item No. VI)
VIII. COLORS AND MATERIAL EXHIBITS: Exhibits are to be submitted
Tor architectural elevations, walls, paving materials, signs,

Detailed written description (1 copy) in addition to actual

colored to represent the selected color combinations, with
symbols keyed to the written description. You may list
the colors and materials in a corner of the elevation draw-
ing or on a separate sheet. Renderings are not required
unless specifically requested by the reviewing body. (See
Item No. VI).
IX. FLOOR AND ROOF PLANS: Three (3) copies of plans of all struc-
tures (to scale) with dimensions. Floor plans should be labeled
with the use of each room. Roof plans should indicate changes
in roof heights, and illustrate any mechanical equipment. Roof
detail could possibly be incorporated in the plot plan.
X. LANDSCAPE PLAN: Three (3) copies of a landscape development
plan at a min. scale of 1" = 20 ft. (1" = 40 feet allowable
if tree plan is on separate sheet from shrub and ground cover
plan), showing the following:"
- Location of all trees, shrubs, plants, and ground cover in
those areas subject to public view
- Botanical name and size of all plant material (labeled)
- One (1) copy of plan to have individual trees and major
shrub forms color -coded by species so that the distribu-
tion may be easily distinguished
- Perimeter treatment of property (fences, walls, vegetation
screens, etc.)
- Street furniture and ornamentation (if applicable) to include:
- rock outcroppings - benches
- fountains - water scape plan
- statues - newspaper stands
- Type of irrigation system to be used (in note form only;
provide complete irrigation plans with construction drawings)

XI, EXTERIOR LIGHTING PLAN: Three (3) copies at the same scale,
or combined with the landscape plan; to show all exterior
lighting, its location, and type of fixtures for illumination
of areas such as driveways, parking lots, storage areas, land-
scape planters, tennis courts, and the building.
XII, APPLICATION FILING FEE: Provide a check payable to the City
of Palm Desert in the specified amount.
A. Applications requiring Design Review Board and Planning
Commission review/approval, fifty dollars ($50.00).
B. Applications that may receive administrative approval from
the Director of Environmental Services (or his appointed
Staff), including single-family dwellings, fifteen dollars
($15.00).

FINAL CONSTRUCTION DRAWINGS
In the final application for a building permit phase, three (3) copies
of construction drawings shall be submitted for items Reviewed/Approved
by the Design Review Board and Planning Commission. Plans must pre-
cisely conform to any Conditions of Approval required by Planning Com-
mission action. Construction drawings shall include the exhibits des-
cribed in the Initial Review, plus any conditioned revisions or addi-
tions, detailed in final form.
NOTE: All plans (except colored exhibits)
are to be folded to a maximum size
of 8j"x13", prior to submitting with
an application.
CITY OF PALM DESERT
DEPARTMENT OF ENVIRONMENTAL SERVICES
PLANNING DIVISION
APPLICANTS' GUIDE TO PROCEDURES
I. FILING PROCEDURE: Prior to submittal the applicant shall discuss his pro-
posal with the Planning staff to determine whether or not the proposal is
in conformance with the General Plan and to determine zoning ordinance,
subdivision ordinance, or other requirements.
II. GENERAL INFORMATION:
A. Meetings: 1) City Council meetings are held on the second and fourth
Thursday of each month, at 7:00 PM in the Council Chambers in the City
Hall, 45-275 Prickly Pear Lane. 2) Planning Commission meetings are
held on Tuesday, nine (9) days prior to the first Council meeting of
the month, also at 7:00 PM in the Council Chambers and Wednesday, eight
(8) days prior to the second Council meeting of the month, at 1:00 PM
in the Council Chambers. 3) The Design Review Board convenes on Tues-
day, a week before the Planning Commission, at 2:30 PM in the Council
Chambers.
B. Public Hearing: Public hearings are held when the City considers re-
quests for a change of zone, variance, conditional use permit, general
plan amendment, etc. Legal notices for these hearings are published
in the Palm Desert Post at least ten (10) days prior to the hearing.
Public hearing items before the Palm Desert Redevelopment Agency are
published in the Desert Sun.
C. Appeals: Where the Zoning Ordinance provides for appeal to the City
Council or Planning Commission, the appeal shall be made within fifteen
(15) days of the date of the decision by filing an application of appeal
with the Director of Environmental Services.
D. Fees: All required fees are listed in the Fee Schedule, as approved by
the City Council, and specifically noted for this application.
E. Building Permits: Building permits are issued by the Department of
Building and Safety and are required before any new construction, re-
construction, plumbing, mechanical work is commenced.
F. Business License: Prior to engaging in an enterprise for profit, zoning
and building code clearance for the proposed use is required and a city
business license obtained. Application should be made to the Code En-
forcement Supervisor.
G. Private Deed Restrictions: Many parcels of land in the City of Palm
Desert are subject to private covenants, conditions, and deed restrictions
which may conflict with the requirements of the City Zoning Ordinance.
The applicant is responsible for resolving conflicts with deed restriction
requirements.
