WHEREAS, the parcel known as the West 1/2 of Lot 4 is presently improved with a building and parking lot, and WHEREAS, Owners desire to improve that parcel known as the East 1/2 of Lot 4 with a similar building and parking lot, and WHEREAS, Owners wish to grant reciprocal rights to the contiguous parcel for ingress and egress to the existing park- ing area and to the proposed parking area and to insure that both parking areas shall exist for the full benefit of either and both parcels which parcels enjoy an undivided one-half interest in and to said parking areas. NOW, THEREFORE, the right is hereby granted to the Owner of the East 1/2 of said Lot 4 to go upon and to use the existing parking area on the West 1/2 of Lot 4 and the right is granted to the Owner of the West 1/2 of Lot 4 to go upon and to use the proposed parking area on the East 1/2 of Lot 4. Phese rights to the use and enjoyment of the parking area e subject property shall inure to and be binding upon the heirs and assigns of the Grantor hereof and upon any and all subsequent Grantees of the East 1/2 and West 1/2 of Lot 4 as described herein. FILING PROCEDURE: Prior to submittal the applicant shall discuss his proposal with the Planning Staff to determine whether or not the pro- posal is in conformance with the General Plan and to determine zoning ordinance, subdivision ordinance, or other requirements. II. GENERAL INFORMATION: A. Meetings: 1) City Council meetings are held on the second and fourth Thursday of each month, at 7:00 p.m. in the Council Chambers in the City Hall, 45-275 Prickly Pear Lane. 2) Planning Commission meetings are held on Tuesday, nine (9) days prior to the first Council meeting of the month, also at 7:00 p.m. in the Council Chambers and Wednesday, eight (8) days prior to the second Council meeting of the month, at 1:00 p.m. in the Council Chambers. 3) The Design Review Board convenes on Tuesday, a week before the Planning Commission, at 2:30 p.m. in the Council Chambers. B. APeals: Where the Zoning Ordinance provides for appeal to the City Council or Planning Commission, the appeal shall be made withing fifteen (15) days of the date of the decision by filing an applica- tion of appeal with the Director of Environmental Services. C. Fees: All required fees are listed in the Fee Schedule, as approved by the City Council, and specifically noted for this application. D. Building Permits: Building permits are issued by the Department of Building and Safety and are required before any new construction, reconstruction is commenced. E. Business License: Prior to engaging in an enterprise for profit, zoning and building code clearance for the proposed use is required and a city business license obtained. Application should be made to the Code Enforcement Supervisor. F. Private Deed Restrictions: Many parcels of land in the City of Palm Desert are subject to private covenants, conditions, and deed restrictions which may conflict with the requirements of the City Zoning Ordinance. Carried 7-0 (JOHNSON, JACKSON, LEUNG, BARTON, HOLDEN, COOK, AND MARTIN). Case No. 375SA (Amendment)- Lyndale Manor and Perry. Waite - endment to approve modification to freestanding sign for commercial building; applicant was present. The background which lead to the erection of the sign as it presently exists was reviewed by Staff. Applicant stated that they wished to leave the sign in its present location and raise it to 10 ft. Mr. Leung discussed the alternative of mounting a sign on the wall and removing the freestanding sign. The Board discussed the possible alternatives to signage for the building. On a motion by Barton, seconded by Holden, the Board approved a modification of this item, subject to the following revisions: 1. The sign may be raised so that the distance between finished grade of the subject parking lot and bottom of the sign is 5 ft. 2. Oleanders shall be densely planted beneath the sign to create a monument look to the base of the sign. Carried 5-1-1 (JACKSON, BARTON, HOLDEN, COOK, MARTIN WITH JOHNSON VOTING NO AND LEUNG ABSTAINING). The Board studied the submitted plans during study session and felt that the working drawings as submitted were acceptable. LOCATION North side of State Highway 111, approximately 350 east of Cabrillo venue. ZONE C-11 S.P. Preliminary Plans for this building were approved on July 10, 1979 by the Design Review Board. The final working drawings are substantially in compliance with preliminary approval with the exception that a recorded easement between the two parcels for circulation, parking, trash use, has not been submitted. Applicant understands that this is a requirement prior to issuance of a building permit. Condition No. 9 of the preliminary approval required that on the lower windows of the existing and proposed buildings, diagonal wood siding be provided to match that indicated in the elevation plan. The applicant now wishes approval to delete the wood siding on the lower portions of the window because of the nature of the business. STAFF RECOMMENDATION: Approve final plans and determine whether wood siding should be utilized on lower portions of the windows. The conditions as recommended by Staff were also discussed. On a motion by Williams, seconded by Barton, the Board approved this item subject to the following revisions: 1. Eliminate proposed chain link enclosure at rear of building, except along West property line. 2. Provide recorded easement between the two parcels for cir- culation, parking, trash use, prior to issuance of building permit. 3. Utilize only one cement plaster color for existing and proposed buildings. 4. Provide all service lines to new building underground. 5. Provide street improvements to satisfaction of Director of Public Works. 6. On parcel where proposed building is to be constructed, provide 3' 6" high decorative or masonary screen wall in planter along Alessandro Drive. 7. DESIGN REVIEW BOARD ITEMS Page Five A. Consideration of continued Case. No. 116C, BEN BARNUM, Applicant. Mr. Williams referenced a letter from Mr. Ben Barnum indicating his desire for a continuance, Mr. Williams noted the next meeting date would be July 31, 1979; and, the matter was continued. Mr. Crump advised the Commission that the agenda and minutes should be revised to reflect an added item "IX. B.", as a result of the rescheduled meeting of the Design Review of July 17, 1979; and, it was so noted. B. Consideration of cases acted on by the Design Review Board at their re -scheduled meeting of July 17, 1979. Mr. Sawa reviewed the cases (176 MF, 180 MF, 117C) and pointed out the revisions requested by the Design Board. On a motion by Commissioner Kryder, seconded by Commissioner Berkey, the actions of the Design Review Board at their meeting of July 17, 1979, were approved by Planning Commission Resolution No. 513; carried unanimously (4-0). X. DISCUSSION ITEM A. Transmittal from Coachella Valley Association of Governments relative to comments on list of possible control measures proposed for inclusion in the AQMP for the Southeast Desert Air Basin. Mr. Williams introduced the item noting that it would be an opportune time to receive Commission comments on the pro- posed control measures. Mr. Crump further explained that there would be a number of additional review steps, and that the Commission would have subsequent review opportunities of a more refined plan. Discussion followed concerning the merits of the approach and the contents of the document. The Commissioners concured that there were control measure subjects which required special technical expertise. Comments from Commissioners closed on a note of reser- vation regarding implementation of the measures. It was determined that no official action need be taken by the Commission, as Staff would forward comments. B. Discussion of the use of Solar panels within the Palm Desert Property Owners Association boundaries. Mr. Williams reviewed correspondence on the subject; followed by brief Commission comments concuring with Mr. Williams response. XI.
