DESIGN REVIEW BOARD
CASE NO: 125 C (AMENDMENT)
APPLICANT (AND ADDRESS): DESERT DESSERT COMPANY, 72-655 Highway 111,
Palm Desert, CA 92260.
NATURE OF PROJECT/APPROVAL SOUGHT: Addition of a shade structure for outdoor
dining.
LOCATION: Palms to Pines West - South side of Highway 111.
ZONE: PC-3 (S.P.)
DISCUSSION:
The applicant wishes to create an outdoor dining area for a maximum of 8 tables. The
dining area will not obstruct pedestrian traffic on the perimeter sidewalk. Pedestrian
traffic from this phase of Palms to Pines into the phase to the west, will have to pass to
the south of the structure.
The gazebo -like freestanding structure is to be 32 feet by 16 feet and 10 feet high. The
roof is to be a flat trellis of 4x4 cedar at 7" on center. The trellis is supported on 6x6
posts.
A portion of the wall area will be open, while at the top and bottom, verticle 2x2 cedar is
to be installed 3 inches on center.
Should the board grant approval of this proposed addition, the applicant will still require
an amendment to the approved development plan for this center. The amendment to the
development plan would be reviewed by planning commission at a public hearing.
STAFF CONCERNS:
Staff has a series of concerns which probably can be satisfactorily addressed to permit the
construction of a shade structure in this area. The concerns are as follows:
1. The drawings submitted do not adequately provide evidence of
integration of this freestanding structure with the main building.
2. Proposed structure should be lower than the eave overhang of the
main building.
3. Style of roof should be reviewed to determine if a flat roof is
appropriate.
4. The design of the structure proposes to have 4x4 cedar span 16
feet. Deflection due to dead load of the structure itself could
be a problem.
RECOMMENDATION:
That the board review the proposal to determine acceptability. Should the board
determine that there are no major impediments, staff would recommend that the board
grant preliminary approval subject to the following conditions:
1. That the applicant obtain an amendment to the approved
development plan from the planning commission.

2. That construction plans shall be submitted for approval
to the city fire marshal prior to issuance of building
permits. All conditions shall be made a part of construction
and no certificate of occupancy shall be issued until
completed.
