I. The meeting was called to order at 2:30 p.m. after a two and one-half hour
study session.

It was moved by Barton, seconded by Martin, that the minutes of January 29,
1980, be approved as written.
Carried 3-0-2 (Barton, Jackson, Martin, with Cook and Holden abstaining).
II. Minute motion approving cases found acceptable at the study session: None.
III. CASES
Case No. 126 C - SOUTHERN CALIFORNIA EDISON COMPANY - approval of final
landscaping, grading, and screening plans for electrical distribution
substation located 250 feet south of Highway 111 and 120 feet east of Shadow
Hills Road; Kermit Martin was present.
The Board reviewed the submitted plans and felt they were acceptable, inclu-
ding the provision of an eight foot high slump stone wall for security
purposes.
On a motion by Holden, seconded by Martin, the Board granted final approval
of the submitted plans.
Carried 5-0 (Barton, Cook, Holden, Jackson, Martin).
Case No. 127 C - FAR WEST SERVICES, INC. and WILLIAM BLUROCK & PARTNERS,
ARCHITECT - final approval of building plans for restaurant in restaurant
park located at the northwest corner of Highway 111 and 44th Avenue; Matt
Sommers of Blurock & Partners was present.
The Board reviewed the plans submitted by the applicant. The changes
required from the previous review were discussed and deemed acceptable. The
exterior colors, as revised, were discussed. The applicant was advised to
submit a revised material sample board showing exact materials to be used on
the exterior of the building. It was noted that there should be no roof
lighting or lighting of the roof utilized. Additionally, the applicant was
advised that any accent lighting used around the building is to be reviewed
and approved by the Design Review Board.
The applicant then presented a revised site plan which showed a modified
walkway from the parking lot to the restaurant, a raised planter and three
decorative lights which he wished to use around the building. The Board felt
that the revised site plan was acceptable. Staff pointed out that, to date,
only a preliminary final landscaping plan had been received. Additionally,
there were some architectural details and subcontractor details which had
not yet been submitted. It was pointed out to the applicant that until the
final landscaping plan and all other architectural details are received by
Staff, no plans would be approved for submission to Building and Safety.
On a motion by Barton, seconded by Holden, the Board granted approval of the
final working drawings subject to no lighting of the roof being provided and
submission of all other final working drawings showing details.
Carried 5-0 (Barton, Cook, Holden, Jackson, Martin).

This Design Review item, along with a Conditional Use Permit, was approved
by the Planning Commission at the meeting of December 4, 1979. The appli-
cant has submitted final drawings incorporating the changes required.
The submitted plans do incorporate the landscaping changes recommended by
the Board. The applicant indicates that the slump stone wall along the
west and a portion of the south property line will be eight feet tall as
well as the chain link fencing. The specific height of the wall was not
previously mentioned. Therefore, the Board should review this aspect of
the project.
STAFF ANALYSIS:
The Board should review the submitted plans to determine compliance with
preliminary approval.

VI. PUBLIC HEARINGS (Continued)
Chairman Snyder asked if the applicant cared to make a presentation.
KERMIT MARTIN, Area Manager for So. Calif. Edison, 74-000 Highway 111,
added that an additional improvement would be that the service line to the
station would be placed underground. He stated that the conditions were
agreeable.
Chairman Snyder asked Mr. Martin if he was sub -contracting the
landscaping maintenance. Mr. Martin replied that they were.
Commissioner Miller asked if the residents on the west side would
be bothered by the noise. Mr. Martin introduced Mr. Spix, who did the
noise study.
JOHN SPIX, Engineer, Whittier, Ca., gave a lengthy explanation on the
noise levels. He further stated that the station would tiave two transformers
and would not increase the noise.
Chairman Snyder asked Mr. Spix if the company would ever consider
sound proofing the station as the need continues to grow. Mr. Spix
replied that the need had not come up at this point.
Commissioner Berkey indicated that a Special Condition could be added
in regards to the noise level. Mr. Spix assured him that it would not
increase. Mr. Williams pointed out that their report indicated a one
decibel increase at night would occur.
Commissioner Kryder stated that he did not feel it was necessary to
add a Special Condition regarding the noise level if it was stated that it would not
change.
Commissioner Miller asked Mr. Spix if he was aware of how much the
noise bothered the Silver Spur Ranch residents. Mr. Spix stated some
people are sensitive to the sound and assured him it would not be any
greater than it is presently.at the location under consideration.
Mr. Martin also stated that if there was a problem the company
would resolve it.
Chairman Snyder concluded the discussion by stating that it was the
Commission's responsibility to make sure no problems would exist. He
felt sure that if there was a problem the utility company would take care
of it. He then opened the Public Hearing asking if anyone present wished
to speak in FAVOR or OPPOSITION to the case. There being none, the Public
Hearing was closed.
Upon motion made by Commissioner Berkey, seconded by Commissioner
Kryder, case nos. CUP 09-79 and 126 C was approved by adoption of Planning
Commission Resolution No. 553, with amendment and subject to conditions.
Carried unanimously (4-0).
Mr. Williams at this time got an assurance from the Commission that
the wording of Special Condition No. 4 was acceptable.

Mr. Williams presented this case de ning each of the proposed parcels

D. Case Nos. CUP 09-79 an 126 C SOUTHERN CALIFORNIA EDISON
CO., Applicant.
Request for approval of a Conditionl Use Permit and
Design Review case to allow the construction and operation
of an expanded electrical distribution substation in
conjuntion with existing substation facilities on approx-
imately .86 acres within the P (Public/Institutional District)
zone, located 250 feet south of Highway 111 and 120 feet east
of Shadow Hills Road.
Mr. Williams presented this case indicating that this request was to
provide for the growing needs of this area. He also stated that the proposed
expansion would include installation of a Temporary Transformer. Mr.
Williams pointed out that because of the location of the substation, lands-
caping would also be added. The Design Review Board recommended approval
with a few requested changes in landscaping material and a requirement to
see the drainage and grading plans before installation.
Commissioner Berkey asked Mr. Williams what kind of requirements
there were in terms of maintenance of the landscaping. Mr. Williams stated
that the landscaping maintenance was now done by a contracting service.
Commissioner Berkey suggested that it may be stipulated in the Special
Conditions. It was discussed and agreed to add Special Condition No. 4,
to read: "The proposed landscaping shall be installed and well maintained
in perpetuity."

WHEREAS, the Planning Commission of the City of Palm Desert,
California, did hold a duly noticed Public Hearing on December 4, 1979, to
consider an application from SOUTHERN CALIFORNIA EDISON CO. for approval of

construction and operation of an expanded electrical distribution substation
in conjunction with existing substation facilities on approximately .86 acres

WHEREAS, at said Public Hearing, upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring to be
heard, said Commission did find the following facts and reasons to exist to
justify the granting of said Conditional Use Permit:
1. The proposed location of the conditional use and the
conditions under which it will be operated and main-
tained will not be detrimental to the public health,
safety, or general welfare, or be materially injurious
to the properties or improvements in the vicinity.
2. The proposed location of the conditional use is in

CONDITIONS OF APPROVAL

Standard Conditions:
1. The development of the property shall conform substantially with
Exhibit A (Case No. CUP 09-79) on file with the Department of Environ-
mental Services, as modified by the following conditions.
2. Prior to the issuance of a building permit for construction of any uses
contemplated by this approval, the applicant shall first complete all
the procedural requirements of the City which include, but are not
limited to, Design Review, and building permit procedures.
3. Construction of the total development may be done in phases.
4. Construction of a portion of said project shall commence within one
year from the date of final approval otherwise said approval shall
become null, void and of no effect whatsoever.
5. Prior to the issuance of any City permits for the commencement of
construction on said project, the applicant shall agree in writing to
these Conditions of Approval.
6. The development of the property described herein shall be subject to
the restrictions and limitations set forth herein which are in additions
to all municipal ordinances and State and Federal Statutes now in force,
or which hereafter may be in force.
7. All requirements of the City Fire Marshal shall be met as part of the
development of this project.
8. Construction plans shall be submitted for approval to the City Fire
Marshal prior to issuance of building permits. All conditions shall be
made a part of construction and no certificate of occupancy shall be
issued until completed.
9. Prior to issuance of a building permit for construction of any use
contemplated by this approval, the applicant shall first obtain permits
and/or clearance from the following agencies:

III. DISCUSSION:
Page -2-
The subject request concerns an existing electrical substation site which is
not covered by a City -approved Conditional Use Permit. The applicant indi-
cates (in the attached letter) that the purpose of the requested expansion is
to keep pace with present and future service demands. The proposed expansion
of the facility would involve a temporary transformer installation as the first
activity undertaken. Improvements to the site would include additional land-
scaping and fencing.
The Design Review Board considered the site and landscape design at their
November 27, 1979 meeting. With the exception of landscape material substi-
tution, they are recommending approval of the Design Review case.
IV. STAFF RECOMMENDATION:
7T consideration of the use requested and the recommendation of the Design
Review Board, with the justification provided in the draft Resolution:
Approve CUP 09-79 and related Design Review Case,No. 126 C, by adopting
Planning Commission Resolution No. 553 , subject to conditions.

facilities to meet the growing electrical demand of the area. The
substation facilities will be located south of Highway 111 approxi-
mately 200 feet east of Shadow Hill Drive.
The Southern California Edison Company is a regulated public
utility subject to the jurisdiction of the California Public
Utilities Commission pursuant to the California Constitution and
the Public Utilities Code of this state.
As a regulated public utility, Edison has a legal obligation
to furnish adequate, efficient and reliable service to all members
of the public within the City of Palm Desert and throughout its
service territory. This charter is based upon the laws of the
state and the franchise granted to the Southern California Edison
Company by the City of Palm Desert.
To fulfill this public service obligation, Edison must
continually anticipate the needs of its present and future customers
and expand its system, as required, to meet these growing needs.
The expansion at the Palm Village Substation site was planned as
a result of providing for the needs of the area with minimal impact
upon the environment.
The load growth in the area is placing an immediate demand
upon Edison's system which will require us to install a 10 MVA
transformer on the site to help maintain system reliability during
the construction period of the permanent facilities. This 10 MVA
transformer will be temporary in nature and will be removed by
November 15, 1980, the planned operating date of the new facilities.

We are hereby requesting a favorable decision on our applica-
tion for a Conditional Use Permit for the permanent facilities and
approval for the placement of the temporary transformer at the
Palm Village site. '

I hereby acknowledge that I have read and agree, to comply
with all the following requirements, and understand that
the Department of Building and Safety will not issue a
building permit or allow occupancy on the use permitted
until this signed confirmation has been received by the
Department of Environmental Services.
The development of this project shall conform substantially
C to all development plans submitted in behalf of this case,
and as revised according to the Design Review Board process.
Any minor change requires approval by the Director of Envi-
ronmental Services. Any substantial change requires ap-
proval by the Design Review Board.
All requirements of any law, ordinance, or regulation of
the State, City, and any other applicable government entity
shall be complied with as part of the development process.
This approval is applicable, subject to the development of
this project, commencing within one year from approval date
and being promptly completed.
Landscaping (with irrigation system) shall be installed
prior to final inspection and receiving certificate of
occupancy.
Curb, gutter, curb cuts, and tie-in paving shall be provided
along the full frontage of the lot by means of installation
prior to final inspection or other provisions as approved by
the City Engineer. Construction shall conform to City Stan-
dards and all requirements of the City Engineer.
