File STAN SAWA, Acting Secretary PALM DESERT PLANNING COMMISSION PLANNING COMMISSION RESOLUTION NO. 656 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND APPROVING A CONDITIONAL USE PERMIT AND JOINT USE PARKING TO ALLOW AN ADDITION TO AN EXISTING RESTAURANT ON PROPERTY LOCATED AT THE NORTHEAST CORNER OF DE ANZA WAY AND PALM DESERT DRIVE. CASE NO. CUP 16-80 AND 136 C WHEREAS, pursuant to the provisions of the Palm Desert Zoning Ordinance, the Planning Commission of the City of Palm Desert, California, did on November 5, 1980, hold a duly noticed Public Hearing to consider an application from CLEVE LEONARD for approval of a Conditional Use Permit and Joint Use Parking Agreement to allow the addition of 238 sq.ft. to an existing 3,433 sq.ft. restaurant, located within the C-1, S.P. (General Commercial, Scenic Preservation Overlay) zone located at the north- east corner of De Anza Way and Palm Desert Drive (74-450 Highway 111), more particularly described as: Lots 1, 2, and portion of Lot 3, Palma Village Unit #8 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the Director of Environmental Services has determined that the project is categorically exempted under the guidelines for implementation of CEQA per Section 15101, and no further documentation is deemed necessary. WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Commission did find the following facts and reasons to exist to justify the granting of said Conditional Use Permit: 1. The proposed location of the Conditional Use is in accord with the objectives of the Zoning Ordinance and the purpose of the district in which the site is located. 2. The proposed location of the Conditional Use and the conditions under which it will be operated and maintained will not be detrimental to the public health, safety, or general welfare, or be materially injurious to properties or improvements in the vicinity. 3. The proposed Conditional Use complies with the goals, objectives, and policies of the City's adopted General Plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case. 2. That approval of Conditional Use Permit CUP 16-80 is hereby granted to CLEVE LEONARD for reasons subject to the attached conditions. 3. That the Planning Commission does hereby authorize employment of Joint Use Parking, pursuant to the provisions of Municipal Code Section 25.58.320. CUP 16-80 AND 136 C 1. The development of the property shall conform substantially with that as shown on plot plan marked Exhibit A on file with the Department of Environmental Services, Case No. CUP 16-80, unless otherwise amended by the following conditions. 2. The development and use of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations, and restrictions of all municipal ordinances and State and Federal statutes now in force, or which hereafter may be in force. 3. All conditions required as a part of future review shall have equal force and effect as those approved at time of original approval. 4. Applicant shall agree to these conditions in writing and they shall be binding on all successors operating this use. DESIGN REVIEW CONDITIONS 1. All open parking stalls to be clearly marked with double lines. 2. A gate to be attached to the trash enclosure to screen the area from view; Screening for the outdoor service/storage area of the rear of the restaurant to also be provided. 3. A minimum six inch wide concrete curb shall surround the planting area surrounding the bar and parking expansion areas. 4. Ground cover, such as gazenias, to be planted in the planter area surrounding the bar expansion. 5. Existing plaster wall on west side of south elevation to remain as is. 6. Parking lot lights to be provided with lights no higher than 10 feet, and down shining to minimize glare; lighting type to be approved by Department of Environmental Services prior to installation. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the Conditions set forth, and understand that the Department of Building and Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services. LOCATION: NE corner of Palm Desert Drive and DeAnza Way ZONE: C-1, S.P. DESIGN REVIEW BOARD ACTION: Upon reviewing the submitted plans and the presentations by the Staff and by the applicant, the Design Review Board Approved this project, subject to revisions. Date of Action: October 28, 1980 Vote: 6-0 (An appeal of the above action may be made in writing to the City Clerk of the City of Palm Desert within fifteen (15) days of the date of the decision.) STAFF COMMENTS: See attached minutes for conditions UESIGN REVIEW BOARD MEETING OCTOBER 28, 1980 Page Three ***************************************** Case No. 522 SA- JOHN HUWENSTINE for FARWLST SERVICES- Approval of Sign Program for restaurant at 72-291 Hwy. 111; Eric Strictland was present. The Board reviewed the plans for two 4 Ft. high 9 Ft. 6 in. long signs facing Highway 111 and 44th. Ave. The Board found the design of the sign acceptable but felt that the size should be scaled down to 3 Ft. high by 8 Ft. long. Also ground lighting should be kept to a minimum intensity. On a motion by Leung, seconded by Cook, the Board moved to approve a 3 Ft. by 8 Ft. sign with the design as submitted. Carried 5-1 (Cook, Leung, Martin, Johnson, Jackson in favor, Holden against) CASE No. 497 SA- CROCKER BANK c/o HOFFMAN BUILDERS- Approval of a canvas awning over the front entry, and amendment to sign program; applicant was not present. Bernard Leung expressed dissatisfaction with the entire concept of a canvas addition. Al Cook questioned how the awning would be architecturally integrated into the building. Phyllis Jackson felt that the entire building should be landscaped. On a motion by Cook, seconded by Jackson, the Board moved to continue this item and request the applicant to submit architectural elevations and a landscaping plan for all sides of the building, showing how awning is to be integrated into building design. Carried 6-0 (Holden, Leung, Martin, Jackson, Johnson, Cook) Case No. 214 MF - KAUFMAN & BROAD - Approval of Final Working Urawings for condo- minium project at the southwest corner of Hovley Lane and Portola Avenue. Ken Glant was present. The Board reviewed the submitted plans and found them acceptable. Eric Johnson made several recommendations for changes on the landscape plan. On a motion by Johnson, seconded by Jackson, the Board moved to approve the submit- ted plans subject to the following conditions: 1. Alternate Eucalyptus Cameldulensis (15 Gal.) with Pinus Llderica in blowsand treatment. 2. Increase level of screening on east side of Tennis Court, with additional Pinus Elderica; delete Sterculia uiversifolia. 3. Substitute Rhds Lancea for Callistemon Citrinus 4. Substitute for Abellia "Ed Goucher" and Arctotheca Calendula. 5. Sterculia to be 60% - 24 in. box, 40% - 15 gal. 6. Vinca Minor to tie planted in shaded areas only. 7. Eucalyptus throughout interior to be mixed gal, and 15 gal. dt�tL & - p ,J Case No. 136 C - CLEVE LEONARD c/o WALLING AND MC CALLUM- Preliminary and Final Approval of working drawings for addition to restaurant at northeast corner of Palm Desert Drive and De Anza way; John Walling present. Staff described the proposal and the recommended conditions. The Board reviewed the submitted plans and found them to be acceptable. John Walling explained that the applicant no longer plans to change the west elevation, other than painting the stucco to match the addition. He also requested that the continuation of the Oleander hedge be removed from condition #1. A dense DESIGN REVIEW BOARD MEETING •i UCTOBER 28, 1980 Page Four hedge can cause security problems. Otherwise he did not have any problems with the other conditions. The Board suggested that a short hedge or wall would satisfy screening requirements. Bernard Leung suggested that adequate parking lot lighting would solve some security problems. On a motion by Jackson, seconded by Cook, the Board moved to approve the submitted plans subject to the following conditions: 1. 42" High wall or shrub hedge to be provided, to screen existing parking spaces along De Anza Way, with screening to commence twenty five feet north from the property line intersection of De Anza Way and Palm Desert Drive to a point twenty five feet south of the property line intersection of De Anza Way and Alessandro Drive. 2. All open parking stalls to be clearly marked with double lines. 3. A gate to be attached to the trash enclosure to screen the area from view. DISCUSSION ITEMS Case No. TT13715 - GEORGETOWN INDSUTRIAL PARK - Discussion of preliminary landscaping plan for perimeter of Industrial Park; Fred Arbuckle was present. The applicant sought clarification of revisions previously requested by the Design Review Board. The Board reviewed the minutes from the meeting in question and offered the following suggestions: 1. The applicant should submit a more detailed plan showing up- graded plant sizes, ground cover species, shrubs, etc. 2. Mondell Pine, Lucalyptus Rudis and Polyanthemos should be considered for use. Case No. 178 MF - TRANSCOPIC DEVELOPMENT CORPORATION - Review of Energy Conservation Measures; Bill Lo was present. The uoard reviewed the plans and found them acceptable. Charles Martin suggested that additional insulation be used in walls and ceiling. Case No. CUP 15-80 - JIM SHARP- Discussion of 10 unit residential condo- minium project; Rick Holden was present. The Board reviewed the submitted plans and found them to be acceptable. r AGENDA ITEM NO. III B-1 DATE: October 28, 1980 DESIGN REVIEW BOARD CASE NO. 136 C APPLICANT (AND ADDRESS) CLEVE LEONARD (74-450 Highway 111, Palm Desert, Calif. 92260) WALLING & MC CALLUM (45-260 Club Drive, Indian Wells, Calif. 92260) NATURE OF PROJECT/APPROVAL SOUGHT Preliminary and final approval of plans for addition to existing lounge and joint use parking. LOCATION N. E. corner of Palm Desert Drive and DeAnza Way ZONE C-1. S.P. The applicant is requesting preliminary and final design approval of plans for the expansion of an existing lounge and joint use parking. The Planning Commis- sion will be considering a Conditional Use Permit application for said uses on November 5, 1980. The project submitted is a 238 square foot lounge addition to an existing bar area of Cleve's Restaurant. The proposed lounge area will look out onto a plant- ing area, which will also be constructed. The applicant is proposing to relocate three existing parking spaces and to add four new parking stalls; 3.57 spaces are required by the addition. The material to be used for the bar/lounge area expansion is board and batten; the color will be dark brown to match roof shakes. STAFF ANALYSIS: Staff has reviewed the submitted plans and would offer the following comments: 1. Sections 25.56.310 and 25.58.110 of the Zoning Ordinance, requires that all off street parking shall be screened to minimize the visual impacts on adjacent streets and properties. The parking area is currently screened on Alessandro Drive and the eastern boundary of the property. The applicant is proposing new oleander hedges on the southern boundary of the parking lot expansion. Staff recommends that this landscape treatment be extended along De Anza Way. Staff further recommends that the landscape treatment be 5 gallon oleander five feet on center. The Oleander planting shall commence twenty five feet north from the property line intersection of De Anza Way and Palm Desert Drive to a point twenty five feet south of the property line intersection of De Anza Way and Alessandro Drive (per Section 25.56.200 of the Zoning Ordinance). 2. As required by Section 25.58.160 of the Zoning Ordinance, all open parking stalls should be clearly outlined with double lines. 3. Staff recommends that a gate be attached to the trash enclosure to screen the area from view. Staff further recommends that the applicant provide screen- ing for the outdoor service/storage area of the rear of the restaurant. 4. A minimum six inch wide concrete curb shall surround the planting area surround- ing the bar and parking expansion areas. (Per Section 25.58.290 of the Zoning Ordinance). 5. Existing stucco structure shall be repainted to match the bar expansion. 7. The applicant should either fill in existing pot holes or completely repave the existing parking lot. Based upon the Staff comments above, the Board should review this request, to determine acceptability.
