IV. APPROVAL OF MINUTES: September 29, 1981
Moved by Commisioner Richards, seconded by Commissioner Wood, to approve the
minutes as submitted. Carried 5-0.
V. SUMMARY OF COUNCIL ACTION
Mr. Diaz reviewed the actions of the Council from the meeting of October 8, 1981.
VI. CONSENT CALENDAR
All matters listed on the Consent Calendar are considered to be routine and will be
enacted by one roll call vote. There will be no separate discussion of these items
unless members of the Planning Commission or audience request specific items be
removed from the consent-Galendar for separate discussion and action.
A. DP 10-80 a 8 138 C - ROBERT McLACHLAN - Request for approval of a
one year ext ussion-of-tune for a Development Plan and Design Review Case
for a 49 unit motel and athletic club located 900 feet east of Highway 111,
between Park View Drive and Cactus Drive.
B. DP 03-80 - WARMINGTON-KARMA - Request for approval of a one year
extension of time for a Development Plan for 438 unit (876 rentable rooms)
hotel and associated commercial uses in the PC (4) S.P. zone on the west
side of Highway 111, south of 44th Avenue.
Moved by Commissioner Wood, seconded by Commissioner Richards, to approve the
one year time extensions. Carried 5-0.
VII. PUBLIC HEARINGS
A. Continued Case No. DP 08-81 - JDF FINANCIAL CORPORATION and
WILLIAM E. SEXTON, Applicants
Request for approval of a commercial development plan to allow
construction of a 172 unit condotel on 7.27 acres in the PC (4) S.P. zone
located on the south side of Highway Ill, approximately 300 feet east of
Shadow Hills Road.
Mr. Diaz briefly summarized this case and stated that because this project would

CALIFORNIA, APPROVING A DEVELOPMENT PLAN TO ALLOW THE CONSTRUCTION
OF A 49 UNIT MOTEL AND ATHLETIC CLUB LOCATED 900 FEET EAST OF
HIGHWAY 111, BETWEEN PARK VIEW DRIVE AND CACTUS DRIVE.
CASE NO. DP 10-80
WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the 30th day of September, 1980, hold a duly noticed Public Hearing and
continued Public Hearing on October 15, 1980, to consider a request by ROBERT R.
MCLACHLAN for approval of a Development Plan to allow construction of a 49 unit
motel and associated 30,000 sq.ft. athletic club on 3.92 acres within the PC (4), S.P.
(Resort Commercial, Scenic Preservation Overlay) zone generally located 900 feet east
of Hwy 111, between Park View Drive and Cactus Drive, more particularly described as:

APN 621-312-024 through 029
WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedures to Implement the California Environmental Quality Act, Resolu-
tion No. 80-89", in that the Director of Environmental Services has determined that
the project will not have a significant adverse impact on the environment and a
Negative Declaration has been prepared.
WHEREAS, at said Public Hearing, upon hearing and considering all testimony
and arguments, if any, of all interested persons desiring to be heard, said Planning
Commission did find the following facts to justify their actions, as described below:
a. The proposed project generally conforms to the intent and purpose
of the PC (4) Zone District.
b. The proposed project is adequately suited for the specific site and
is compatible with existing and proposed development in the area.
C. The proposed project will not be detrimental to the health, safety
and general welfare of the community.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the
findings of the Commission in this case.
2. That the Planning Commission does hereby approve Conceptual Development
Plan No. 10-80, subject to those conditions attached hereto.

Planning Commission, held on this 15th day of October, 1980, by the following vote,

STANDARD CONDITIONS OF APPROVAL
CASE NO. DP 10-80
1. The development of the property shall conform with Exhibit A (Case No. DP 10-80)
on file with the Department of Environmental Services, as modified by the
following conditions and as superceded by subsequent revisions to the site plan.
2. Prior to the issuance of a building permit for construction of any uses con-
templated by this approval, the applicant shall first complete all the procedural
requirements of the City which includes, but not limited to, Design Review,
Subdivision process and building permit procedures.
3. Construction of the total development shall be done in one phase.
4. Construction of a portion of said project shall commence within one year from
the date of final approval; otherwise, said approval shall become null, void
and of no effect whatsoever.
5. The development of the property described herein shall be subject to the restric-
tions and limitations set forth herein which are in addition to all municipal
ordinances and State and Federal Statutes now in force, or which hereafter may
be in force.
6. All existing electrical distribution lines, telephone, cable antenna television,
and similar service wires or cables, which are adjacent to the property being
developed shall be installed underground as a part of development from the nearest
existing pole not on the property being developed.
7. All requirements of the City Fire Marshal shall be met as part of the development
of this project per attached letter dated September 11, 1980.
8. Construction plans shall be submitted for approval to the City Fire Marshal
prior to issuance of building permits. All conditions shall be made a part of
construction and no certificate of occupancy shall be issued until completed.
9. Traffic control provisions and safety street lighting shall be provided as
required by the Director of Public Works.
10. Curb, gutter, sidewalk or approved pathways, and tie-in paving and drainage shall
be provided in conformance with City Standards and/or as required by the Director
of Public Works.
11. Prior to issuance of a building permit for construction of any use contemplated
by this approval, the applicant shall first obtain permits and/or clearance
from the following agencies:
Riverside County Department of Health
Palm Desert Design Review Board Process
City Fire Marshal
Coachella Valley Water District
Evidence of said permit or clearance from the above agencies shall be presented
to the Department of Building and Safety at the time of issuance of a building
permit for the use contemplated herewith.
SPECIAL CONDITIONS
1. No building permits to be issued until vacation of Cholla Drive is approved and
finalized.
2. Prior to issuance of a building/grading permit, a final map shall be recorded
consolidating the existing lots into two lots as proposed by this project.
3. Restaurant in athletic club to be "private" (not open to general public) and
limited to juice bar/sandwich type of operation.

4. Impact of athletic club on existing residences to east to be studied by
Design Review Board to insure compatibility with adjacent residences.
5. Parking lot lights not to exceed ten feet in height per Municipal Code require-
ments and be down shining and shielded to eliminate glare to adjacent properties
and public right-of-ways.
6. Right-of-way dedication and street improvement to provide 44 foot half street
on Park View Drive per Department of Public Works requirements.

7. 25 foot half street improvements shall be provided on Cactus Drive per
Department of Public Works requirements.
8. Access to Cactus Drive be for "emergency" vehicles only and provided with
approved barrier.
9. Hereby authorized as a part of this Development Plan approval are the exceptions
as listed in the following:
a. Minimum building setback of 20 feet for south property line of resort
motel is approved with minimum 10 feet (average over 20 feet).
b. Minimum development site of 3.92 acres gross.
10. Motel use to be limited to temporary or overnight accomodations for guests only
and not for permanent occupancy, with the exception of manager's unit.
11. Applicant to dedicate land to provide additional facilities for orderly
expansion of East Magnesia Canyon Stormwater Channel as required by the
Coachella Valley Water District.
12. Easements to be recorded prior to issuance of any building or grading permits
to provide for common parking, circulation, and access between the two proposed
parcels. I
13. Increase setback between Athletic Club and east property line from 45 feetto 46 feet.

Prior to construction of any of the proposed buildings, the following conditions
must be met:
1. Install a water system capable of delivering 4000 GPM fire flow for a four (4)
hour duration in addition to domestic or other supply. The computation shall
be based upon a minimum of 20 psi residual operating pressure in the supply
main from which the flow is measured at the time of measurement.
2. Install Riverside County super fire hydrants so that no point of any building
is more than 150 feet from a fire hydrant measured along approved vehicular
travel ways.
A. Hydrants shall not be located closer than 25 feet to any building.
B. Exterior surfaces of hydrant barrels and heads shall be painted chrome
yellow, and the tops and nozzle caps shall be painted green.
C. Curbs (if installed), shall be painted red 15 feet in either direction from
each hydrant.
3. Prior to issuance of a building permit, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
Upon approval, one copy will be sent to the Building Department, and the original
will be returned to the developer.
4. The water system plan shall be signed by a registered civil engineer, and approved
by the water company, with the following certification: "I certify that the
design of the water system in Case Number DP 10-80 is in accordance with the
requirements prescribed by the Fire Marshal."

5. Prior to delivery of combustible materials to the building site, the required
water system shall be installed, operating and delivering the required flow.
6. All buildings to be protected with automatic sprinklers.

III. CASES (cont.)
Case No. TT 13915 - GEORGETOWN INDUSTRIAL PARK - Approval of landscaping
plans for perimeter of Industrial park at the southwest corner of Cook
Street and Hovley Lane; Fred Arbuckle and Pat Martin were present.
The Board noted that Pinus Eldarica should be substituted for the Pinus
Pinea. There was additional discussion pertaining to perimeter wall height,
landscaping and when perimeter treatment is to be done. The possible use of
drip irrigation was discussed and determined not feasible for this project.
On a motion by Jackson, seconded by Holden, the Board approved this request
subject of the following conditions:
1. Pinus Pinea to be changed to 20" box size Pinus Eldarica.
2. Perimeter walls to be 6 feet in height, measured at rear of insert in
wall; top of wall height to be level around entire perimeter.
3. Prior to recordation of final tract map, CC&R's shall be submitted
to the Department of Environmental Services for approval, to insure
compliance with all conditions of Resolution No. 78-172 and to insure
that provisions are made for perpetual maintenance of private streets
and perimeter landscaping.
4. Perimeter walls and landscaping to be completed prior to issuance of
Certificate of Occupancy for first building.

Case No. 138 C - ROBERT MCLACHLAN - Preliminary approval of plans for athletic
club and 49 unit motel, 900 feet east of Hwy 111, between Park View Drive and
Cactus Drive; Kurt Donat and Bill Fitch were present.
The Board reviewed the submitted plans and discussed concerns regarding
shading of glass, landscaping, drainage, circulation, and trash pickup.
It was determined that shading of glass on the south, east and west was
inadequate.
The applicant explained how they felt their project would help alleviate
flooding of the adjacent neighborhood. It was noted that the applicant had
previously stated to the Planning Commission that the site would drain to
Park View Drive.
With regard to circulation, the Board felt it may be advisable to provide
turnarounds at the end of the parking lot and circulation around the athletic
club. Also, the question of trash pickup was discussed.
The applicant stated that the parking lot lights would be downshining black -
box lights.
The applicant was advised to use Hybrid Bermuda instead of Bluegrass, and
Star Jasimine instead of Ivy. Also, Bottle Trees should be substituted for
Eucalyptus.
On a motion by Jackson, seconded by Cook, the Board continued this request
to December 9, with all the above items of concern to be studied prior to
a reconsideration.

The grading plan as submitted drains less than ten percent of the site to Park -
view Drive. The remainder drains to Cholla Drive and Cactus Drive which is the
natural drainage, at this time, but with more drainage being concentrated at
Cactus Drive per this plan.
To answer your specific question, the site could be graded in such a manner to
completely drain towards Parkview Drive. However, this would quite probably
create a minimum of a 3-foot fill to the rear of the site. Fill material
would probably have to be imported to accomplish this.
The conditions of approval established by Resolution No. 647 appear adequate.
My only suggestion would be to add the requirement that if the grading plan
is approved as submitted, that the applicant's civil engineer provide hydraulic
calculations that Cactus Drive can accommodate the total runoff. And if it
can't, offsite facilities shall be constructed to carry the increased runoff.
I would only question Special Condition No. 8 which specifies a 25-foot half
street. Is this a minimum City standard or is 30-foot half street the mini-
mum with curb face at 20-feet from centerline instead of 18-feet from centerline?

The area 1 thru 4 shown on the attached map, indicates the
desired flow of surface drainage concerned with the Desert
Athletic Club.
All existing surface flow north of Park View drain in
the Palm Valley Channel.
The City of :3aiicho Mirage is planning an open channel along
the north side of Park View to provide for the control of storm
waters west of Highway 111. Therefore the only water contribution
to the site in question is area 1 shown on the attached sketch.
On the site of the Athletic Club, area 2 will drain to
Park View, area 3 will drain to Cholla Drive, and area 4 will
drain to Cactus Drive. Total quanity of surface flow to Cactus
Drive is 14.5 C.F.S. Street capacity is about 15 C.F.S.

NATURE OF PROJECT/APPROVAL SOUGHT Preliminary approval of plans for athletic club
and 49 unit motel.
LOCATION 900 feet east of Hiahwav 111. between Park View Drive and Cactus Drive.

This case received conceptual approval by the Planning Commission, as DP 10-80, on
October 15, 1980. Attached is Resolution No. 647 with the conditions of approval.
The preliminary plans submitted, comply with the conceptual approval. The attached
plans and specifications reflect the proposed project.
Major concerns raised by the Commission, were compatibility with the residential
uses to the east, directing drainage away from the residential areas, and vacation
of Cholla Drive to allow the project.
STAFF ANALYSIS:
Staff has reviewed the plans and would offer the following comments:
1. Some landscaping materials are not appropriate for desert environment, and
should be changed.
2. Protection or shading of glass areas is inadequate on most exposures, and
therefore, should be increased.
3. Parking lot light fixtures must be a type that directs the rays downward and
away from adjacent residences.
4. On site drainage should be directed to Park View Drive.
Staff recommends that if these plans are approved, that the following conditions
be imposed:
1. 3 foot wide planter along west property line, be increased to 4 feet.
2. Blank wall on south elevation of athletic club to be planted with clinging vines.
3. Parking lot lights (10 feet high) not approved at this time; applicant to submit
light fixture specs and drawing for approval with final drawings; light to be
type in which light is downshining and source is recessed in box.
4. No 8 foot high sphere lights to be used between parking lot and first row of
motel units.
5. Prior to submission of final working drawings to Design Review Board, proof
of compliance with special condition Nos. 1,2,8,11, and 12 of Resolution
647 to be presented to staff.

6. Wall screening parking area on Park View Drive, to be 3 feet 2 inches in
height.
7. Submit sign color samples for approval, with final working drawings.
Based on the staff comments, conditions of approval and development standards,
the Board should determine acceptability of submitted plans. Should these plans
be acceptable, staff will forward your recommendation with any conditions, to
the Planning Commission for confirmation.

SUBJECT: CASE NO. DP 10-80 and 138 C DATE: NOVEMBER 20, 1980
DP 10-80 was approved by the Planning Commission October 15, 1980. At that time,
the Acting Director of Public Works had no comments on the project because a grading
plan was not available. Grading plans and information have been submitted for
design approval and are attached.
At the Public Hearing for this item, the applicant's representative assured the
neighbors and Planning Commission that on -site water would be directed to Park View
Drive. The submitted information does not seem to do that. Can you please review
and let me know if that can be done.
Attached is the Planning Commission Resolution with the conditions of approval. Any
other comments or conditions are welcome at this time since they are now asking for
preliminary design approval. We can require new conditions or modifications to
their plans.
This is scheduled for the Design Review Board Tuesday, November 25, at 2:30 p.m.
If you can respond by then, it would be appreciated. I know it is short notice.
If you cannot make it Tuesday, a response by Friday, November 28, would suffice.

I hereby acknowledge that I have read and agree, to comply with
all the following requirements, and understand that the Depart-
ment of Building and Safety will not issue a building permit or
allow occupancy on the use permitted until this signed confirma-
tion has been received by the Department of Environmental Services.
The development of this project shall conform substantially to all
development plans submitted in behalf of this case, and as revised
according to the Design Review Board process. Any minor change
requires approval by the Director of Environmental Services. Any
substantial change requires approval by the Design Review Board.
All requirements of any law, ordinance, or regulation of the State,
City, and any other appTicable government entity shall be complied
with as part of the development process.
This approval is applicable, subject to the development of this
project, commencing within one year from approval date and being
promptly completed.
Landscaping (with irrigation system) shall be installed prior to
final inspection and receiving certificate of occupancy.
Curb, gutter, curb cuts, and tie-in paving shall be provided along
the full frontage of the lot by means of installation prior to
final inspection or other provisions as approved by the City
Engineer. Construction shall conform to City Standards and all
requirements of the City Engineer.
All new and existing electrical distribution lines, telephone,
cable antenna television, and similar service wires or cables,
which are adjacent to and provide service to the property being

lx, LABELS FOR PROJECT (Application) SPONSORS: One (1) set
ICJ of gummed address labels shall be typed and submitted with
the name and address of all persons to whom the Planning
Commission action is to be sent (owner, architect, engineer,
etc.). NOT required for a single-family residence on` an
individual lot, or staff approval of signs.
III. DETAILED PLOT PLAN:
A. Items to be reviewed and approved by the Design Review
Board and Planning Commission require the plot plan
submittal described below.
1. Three (3) full size plans completely dimensioned
and at a scale not smaller than 1 inch = 40 feet,
showing the following data:
- Scale
' - North arrow
- Property lines
- Lot dimensions
- Public rights -of -way with existing and proposed
dimensions (include street names)
- Existing or proposed curb lines
- Any and all easements
- All utility line locations (gas, electric, cable,
water, and sewer)
- Adjacent property uses (showing approximate loca-
tion of structures and other pertinent features)
- Major vehicle, bicycle, and pedestrian access points
to and from site (use arrows of different widths to
show direction and intensity of use)
- Setback areas
- All existing and proposed structures
- Interior vehicle, bicycle, and pedestrian circula-
tion patterns (if applicable)
- Off-street parking (to include spaces, regulatory
devices, provisions for accessory vehicle storage
where applicable, etc.)
- Parking areas for bicycles and carts (if applicable)
- Service areas and facilities to include:
1) trash storage areas
2) mail delivery boxes
3) loading areas

- Perimeter fencing and screening
- Proposed sign locations (if applicable)
- Project phasing, showing the stages of construc-
tion for the entire development
- One (1) copy of the plot plan multi -colored in-
dicating open space/landscaping, buildings, park-
ing, and driveways. Where more than one height
of building is proposed, show each in a different
color. DO NOT MOUNT THIS COPY ON A BOARD.
2. One (1) copy of the plot plan containing all of the
general information described above, except that it
is to be drafted or photographically reduced to an
8A11xll" or 13" size sheet. (All lettering to be
legible; include graphic scale).
B. Items to be reviewed and approved by Planning Division
Staff only require three (3) full size copies of the plot
plan described above. (i.e. single-family dwelling and
signs valued under $1,000.)
IV. INFORMATION SHEET AND/OR PLAN BLOCK: As appropriate, include
an attached sheet to the application and/or specify directly
on the plans, in an information block, the following data:
- Owner's name, address, and phone number
- Designer's name, address, and phone number
- Any special information or conditions pertaining to the
site or to the plans
- Acreage and square footage calcualations
- Ratio of structures to total land area
- Ratioof parking spaces to building square footage
- Parking requirements provided
- Ratio of landscaping to total land area
- Any specific information of special conditions particularly
relevant to the project
V. SITE ANALYSIS & PRELIMINARY DRAINAGE AND GRADING PLAN: Three
(3) copies of a plan indicating the data described below (in-
formation may be incorporated into the plot plan where detail
is not obscurred or prepared as a separate exhibit):
- Vicinity map showing major street names, other reference
points and landmarks (no scale)
- North arrow
- Scale
- General drainage pattern of area to include site and adja-
cent properties within 100' (use arrows to show drainage
flow to and from site).
- Existing contour lines including property corners
- Proposed locations of structures and drives
- Elevations of pads and finished floors
- Finished grades
- Elevations of existing street centerline
- Retaining walls (where applicable)
- Perimeter walls and fences which affect drainage
