NATURE OF PROJECT/APPROVAL SOUGHT: Approval of satellite dish and
use of wrought iron around pool area.
LOCATION: Northeast corner of San Carlos and Alessandro Drive.
The applicant was requesting approval of a satellite dish which had
already been installed on the roof. He also was requesting that he
have the option of using wrought iron fencing instead of glass around
the proposed pool area.
Mr. Diaz concurred with the idea of wrought iron as long as persons
would not be able to climb over the fence.
Commissioner Holden was concerned that the visibility for vehicular
traffic would be reduced at the corner if wrought iron fencing was
used. Commissioner Leung was concerned with the liability aspect.
Mr. Wise indicated that he would be willing to paint the satellite
dish to match the building.
Chairman Gregory questioned if the dish could be moved closer to the
center of the building so that it would be less visible from the
street.
Mr. Wise noted that he could move it approximately 4 feet to the east
and farther south.
Moved by Chairman Gregory, seconded by Commissioner Holden to approve
this case with the following conditions to apply:
1. If applicant chooses to utilize wrought iron, a sample should be
submitted to staff so that it may review the visibility factor.

NATURE OF PROJECT/APPROVAL SOUGHT: Amendment to
approved plans for an addition to Kentucky Fried Chicken.

Mr. Smith indicated that the commission at the study session had
reviewed the proposed revisions noted on the plan which involve the
installation of tile in lieu of the shake treatment on the mansard and
the addition of a cupola in the middle of the north elevation which
would be used to relocate the sign from the fascia area below.
The commission did not feel the addition of the cupola would tie in with
the rest of the buildings in the center and were concerned over the
color of the tile shown on the new plan.
Commissioner Gregory noted that the new plans show the deletion of
windows on the left elevations.
Mr. Dave Carlson, of Carlson Design and Construction Company was
present and noted that the tile shown on the plans was the same as that
approved by the commission. The reason for the cupola was to improve
visibility. He felt the building was too hard to find. The windows were
deleted as a requirement of the building department.
Acting Chairman Martin felt that his problem was the frontage road
situation and not visibility.
The commission did not want to set a precedent allowing people to build
cupolas for the purpose of displaying their signs.
Mr. Diaz advised that the sign ordinance does not permit signs above
the eave line which would preclude the signs from being installed on the
cupola.
Mr. Carlson asked if they could retain the cupola and keep the sign
where it presently stands.

Leung, the commission denied the cupola and approved the top cap on
the roof, with the color of that top cap being the same as the beam
fascia (dark brown).
Motion carried unanimously 4-0.
2. CASE NO• 184 C

plans for a commercial office building.

Mr. Smith reviewed the staff report indicating that the applicant had
received preliminary approval of plans for the commercial building in
April of 1981. The new building which is still two stories in height has
been toned down somewhat from the one approved in 1981. The
building is connected at the second floor level and separated on the
first floor to allow for an ingress from Palm Desert Drive 'to the
parking area at the rear.
On a motion by Commissioner Holden, seconded by Commissioner
Gregory, the preliminary plans were approved as presented.
Motion carried 2-0-2, with Commissioner Leung and Commissioner
Martin abstaining.
IV. DISCUSSION ITEMS:
I. Walls Located in Front Yards:
Mr. Diaz indicated that problems have arisen regarding six foot walls along the
front setbacks in the R-1 zone. Unless the commission would like to examine
them individually, staff will be requiring a minimum five foot setback from
the property line when there is a solid wall along the front, so that there can
be landscaping in front of it. Where they are adjacent to driveways, staff will
require a ten to fifteen foot long base and height triangle be developed to
provide visibility when exiting.
Commissioner Holden asked if the condition would still apply if there is an
existing parkway out in the middle of the property line.
Mr. Diaz replied that it would.
Acting Chairman Martin felt that setting back the wall from the driveway for
safety purposes was acceptable but in terms of coming into the front yard, he
didn't have any problem with it being on the property line. If staff told them it
would have to be five feet from the property line and they appealed, he would
have to support the property owner.

On February 8, 1983, the applicant received approval of plans for a 2160 square foot

CURRENT PROPOSAL:
The applicant wishes to change the addition to have only one level yet expand the addition
further to the north so that a similar area will be added to the building.
The exterior elevations are substantially the same at this time as before, in that the
former second level was submerged below ground level.
RECOMMENDATION•

BACKGROUND:
The subject property is the site of the Wise Racquetball and Health Club which was
built in 1981. The existing facility is some 14,544 square feet.
PROPOSAL:
The applicant wishes to add 3432 square feet of office space and a weight training
room. Concurrent with this application an amendment to the existing conditional
/ use permit was processed through the planning commission and approved at its
February 1, 1983, meeting.
DISCUSSION:
The proposed addition is to be located at the southeast corner of the building. The
two level addition will be some 16 feet in height. The lower level (basement) will
be a weight training room while the floor at ground level will be used for office
space.
ELEVATIONS:
The addition has been designed to match the existing building. The addition will be
16 feet in height which is lower than much of the existing building.
SETBACKS:
The addition is to be at the southeast corner of the building adjacent to Alessandro
Drive. The code requires a 10 foot setback and the plan encroaches two feet at two
points of the building. A condition of the planning commission approval of the
conditional use permit requires that the applicant obtain an adjustment to permit
the eight (8)foot setback.
RECOMMENDATION:
That Case No. 147 C (Amendment##) for an addition to the Wise Athletic Club be
approved subject to the following condition:
1. That the applicant receive approval of a setback adjustment to permit
the eight (8) foot setback from the zoning administrator prior to
issuance of the building permit for this addition.

BACKGROUND:
Preliminary approval was granted to the project May 26, 1981. Subsequently on
June 9, 1981, the applicant was given permission to use either slumpstone or
split face block on the east wall; and to create an outdoor spa sunning area
to be enclosed by a 6 foot high wall.
DISCUSSION:
The final plans have incorporated the proposed changes (ie: wall material type
and the spa sunning area). The interior floor space allocations have been changed
and two additional parking spaces are required. These 2 extra spaces can be
accommodated to the south of the existing spaces on the east side of the building.
LANDSCAPING:
At the time of preliminary approval the Board's major concerns with respect to
landscaping were that the proposed materials were generally undersized, that the
ground cover was not specified and that the number of trees on the west and south
side should be increased.
For the most part, these concerns appear to have been addressed in the final plan,
although not all of the proposed plantings are to be increased in size and some
previously proposed species are being replaced.
The Board should review the final landscape plan to determine acceptability.
IRRIGATION PLAN AND LIGHTING PLAN:
No irrigation or lighting plan was provided to Staff at the time of the writing
of this report, however, the applicant's architect indicated that these plans
will be available in time for the meeting.
CONCLUSION:
The previously established Condition of the Conditional Use Permit and preliminary
Design Review approval appear to have been complied with except as noted above.
Provided that the landscaping plan is considered acceptable and that suitable
irrigation and lighting plans are provided, Staff would have no objection to final
approval being granted to this application.

CASE NO. 145 C - CROCKER NATIONAL BANK - Preliminary approval of revised
Plans for a bank building. Mr. Don Forker and Mr. Don Wexler were present.
Mr. Smith outlined the background and process which this application has
followed. The plans have been referred back to the Design Review Board by
the Planning Commission. It was the Planning Commission's position that
either of the plans as presented would be acceptable to that body.
Mr. Wexler showed the Board the revised plans, dated June 8, 1981, and
said the changes involve the relocation of the cooling tower to the area
south of the mechanical room, the cooling tower has been reduced in height
from 11 feet to 6 feet 8 inches and a planter area has been proposed around
the perimeter of the mechanical room. These plans have been endorsed by the
property owner as evidenced by his signature in the plans.
Mr. Forker, representing Crocker Bank stated that the proposed plans were
acceptable to his firm and he urged the Board to grant approval in order
that further delays do not result.
The Board reviewed the revised plans and felt that the revisions improved
the plans. It was suggested that the plaster walls should be changed to a
darker color.
Mr. Wexler said that changing the color should not be a problem.
On a motion by Barton, seconded by Holden, the Board approved the revised
plans for a bank building on the understanding the final plans may indicate
a darker color for the plaster areas.
Motion carried 3-0-2 (Cook and Gregory abstaining).
IV. DISCUSSION ITEMS
CASE N0. 147 C - JACK WISE and JOHN WALLING - Revisions to preliminary
approval for a Racquet Club facility. John Walling was present.
Mr. Smith advised the Board that the applicant is requesting some changes
to the preliminary plans which had been approved by the Board. The applicants
request permission to use either slumpstone or split face block on the
east wall; and to create an outdoor spa -sunning area to be enclosed by a 6'
high wall.
Mr. Walling told the Board that if additional parking is required as a
result of creating the outdoor spa, it can be provided on the vacant portion
of the property to the north.
It was the concensus of the Board, that the requested changes were acceptable.
Motion carried 5-0.
CASE NO. 148 C - COOK STREET INDUSTRIAL PARK.
Mr. Sawa told the Board that the applicant has decided to install retaining
walls on certain areas of the property in order that additional usable area
is created. The applicant is requesting that the required perimeter chain
link fencing be waived by the Board.
It was the opinion of the Board, that at some point in the future when
adjacent lots are developed that the proposed fence may not be necessary.
The perimeter fence could be waived now however, in order that an unsafe

II. Minute Motion approving cases found acceptable at the Study Session: None.
III. CASES
CASE NO. 147 C - JACK WISE - Preliminary approval of plans for a racquet-
ball facility. John Walling was present.
Mr. Smith highlighted the salient points from the staff report. A similar
application had been approved in 1979, however that approval has lapsed.
Mr. Walling told the Board that his client wishes to amend the proposed
wall material to be precision block rather than split -face block. The
proposed wall will be painted a tan color. In response to a question from
the Chairman, Mr. Walling advised the Board that the roof equipment would
not be visible from the street.
Following considerable discussion, the Chairman summarized the feelings
of the Board as follows:
1. The proposed wall changes should not be permitted. The wall should
be retained as split -face concrete block.
2. That on the landscape plan, all proposed 15 gallon species be in-
creased to a 24" box minimum, that planting of the island in the
parking area be increased to a 36" box minimum Jacaranda Mimosaefolia
and a minimum 24" box Schinus Terebinthifous, that the 5 gallon
Eucalyptus Rostrata be increased to a 15 gallon minimum.
3. That the proposed type of ground cover be delineated in all areas
where ground cover is shown.
4. That the proposed ground cover along the west and south of the
building faces be studied for appropriateness in these locations.
5. That the proposed Ilex Vomitoria be planted at 24" on center.
6. That the proposed Carissa Tuttle be planted at 18" on center.
7. That the proposed Dwarf Oleander be planted at 36" on center

8. That the proposed Juniperus Tomarisci folia be planted at 36" on

On a motion by Cook, seconded by Jackson, the Board approved this
request subject to the following conditions:
1. That the wall material be retained as split -face concrete block.
2. That the proposed landscape materials be upgraded in size as described
in the minutes.
3. Final construction drawings, including a final landscaping, grading,
lighting including pole standards, amenities, trash storage, walkway
layout, irrigation plans and sign program shall be submitted to the
Design Review Board. No final inspection or occupancy permit shall be
given by the Department of Environmental Services to this project
until the aforementioned approved plans and construction shall have
been completed.
4. That all conditions established by Planning Commission in its
Resolution No. 705 be provided for in the final drawings.
5. That the height of the wall adjacent to San Carlos be delineated and
not to exceed a maximum of 3.5 feet.
6. That the planters in the parking lot area be provided with an ap-
propriate type of ground cover.
7. That final drawings show that roof equipment will be suitably screened.
8. That a detail be provided showing the 6 foot wall proposed along the
east property line and that said wall be constructed of appropriate
decorative materials.

Request for approval of a 63 lot Tract Map and Residential
Development Plan to allow construction of a 62 unit condo-
minium Development on 13.2 acres generally located on the
south side of Hovley Lane, 500 feet west of Portola Avenue
and a Negative Declaration of Environmental Impact as it
pertains thereto.
Mr. Sawa presented this case describing the design and location of the project.
He noted that this project would be outside the five minute response time for fire
protection, therefore, staff recommended a requirement of a $100 per unit fee. He
reviewed the findings and justifications and recommended approval.
Chairman Miller opened the Public Hearing and asked if the applicant wished
to make a presentation.
MR. HARRY SCHMITZ, 45-900 Paseo Coronado, Indian Wells, concurred with staff's
conditions and requested approval.
Chairman Miller asked if anyone wished to speak in FAVOR or OPPOSITION to
this case. There being none, the Public Hearing was closed.

BACKGROUND:
A Conditional Use Permit was previously approved in 1979 for a similar building
by the same owner. Working drawings were also approved by the City. However,
building permits were never taken out and all approvals were allowed to lapse.
The applicant is now asking for approval of a slightly different design. A new
CUP was granted by Planning Commission at its May 5, 1981, meeting.
ARCHITECTURAL DESIGN:
The architectural style is contemporary with a flat roof and varying planes and
heights, with the maximum height approximately 18 feet 6 inches. Exterior materials
will consist of stucco and splitface block walls, hand some horizontal wood siding
and trim.
One of staff's major concerns is compatibility with the residential zoning to
the east. The building elevation indicates stucco and block faced walls with a
band of wood trim at the top. The setback from the residential zone varies from
69 feet to 115 feet because of the placement of the building on the site. Land-
scaping and a 6 ft high wall is also provided to help screen the use from the east.
It should also be noted that the dwellings on the residential lots are located on
the east end of the lots which are 200 ft. deep.
STAFF ANALYSIS:
Staff feels that the revised site plan, elevation plan and landscape plan are
basically acceptable provided additional information is provided as per the
attached conditions. In addition, the conditions prescribed by Planning Commission
in Resolution No. 705 (see attached copy) must be complied with and delineated on
the final working drawings.
Prior to submission for Design Review Board approval the applicant required Flood
Committee approval because the property is in an AO zone. This approval was
granted, however, the site plan was revised to incorporate some changes required
by Flood Committee. The current site plan then is as shown on the revised grading
plan. The lighting and landscape plan are schematic only. The revised site plan
delineates only 49 parking spaces whereas 50 spaces are required. Appropriate
revisions will be required to provide the required minimum parking spaces.
Adopted development standards for Design Review Board require that all required
• street trees shall be a minimum of 24" box at time of installation. In addition,
on the perimeter of parking areas a minimum 75% of trees shall be 24" box or
larger at time of installation and the remainder shall be a minimum of 15 gallons
at time of installation.
The Board should review the submitted plans and determine acceptability.

the following conditions:

CONDITIONAL USE PERMIT TO ALLOW A RACQUETBALL CLUB ON
PROPERTY LOCATED AT THE NORTHEAST CORNER OF ALESSANDRO DRIVE
AND SAN CARLOS AVENUE.

WHEREAS, the Planning Commission of the City of Palm Desert, California
did on the 5th day of May, 1981, hold a duly noticed Public Hearing to consider
a request by JACK WISE, for approval of a Conditional Use Permit to allow the
construction of a 14,844 sq.ft. private racquetball and health club on approxi-
mately 1.7 acres in the R-3 (4) (Multifamily Residential) zone, located at the
northeast corner of Alessandro Drive and San Carlos Avenue, more particularly
described as:
Lots 6 a 7 Block 153, Palm Village Unit #3
WHEREAS, said application has complied with the requirements of the
"City of Palm Desert Procedures to Implement the California Environmental Quality
Act, Resolution No. 80-89", in that the Director of Environmental Services has
determined that the project will not have a significant adverse impact on the
environment and a Negative Declaration has been prepared; and
WHEREAS, at said Public Hearing, upon hearing and considering all testi-
mony and arguments, if any, of all interested persons desiring to be heard, said
Commission did find the following facts and reasons to exist to justify the
granting of said Conditional Use Permit:
1. The proposed location of the Conditional Use is in accord with
the objectives of the Zoning Ordinance and the purpose of the
district in which the site is located.
2. The proposed location of the Conditional Use and the conditions
under which it will be operated and maintained will not be
detrimental to the public health, safety, or general welfare,
or be materially injurious to properties or improvements in the
vicinity. '
3. The proposed Conditional Use complies with the goals, objectives,
and policies of the City's adopted General Plan.
4. The proposed Conditional Use complies with the goals, objectives,
and policies of the City's adopted Redevelopment Plan.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City
of Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute
the findings of the Commission in this case.

STANDARD CONDITIONS OF APPROVAL
CASE NO. CUP 03-81
1. The development of the property shall conform substantially with Exhibits
(Case No. CUP 03-81) on file with the Department of Environmental Services,
as modified by the following conditions.
2. Prior to the issuance of a building permit for construction of any uses
contemplated by this approval, the applicant shall first complete all the
procedural requirements of the City which includes, but not limited to,
Design Review and building permit procedures.
3. Construction of said project shall commence within one year from the date
of final approval; otherwise, said approval shall become null, void and of
no effect whatsoever.
4. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all
municipal ordinances and State and Federal Statutes now in force, or which
hereafter may be in force.
5. All requirements of the City Fire Marshal shall be met as part of the develop-
ment of this project, per attached letter dated April 24, 1981.
6. Construction plans shall be submitted for approval to the City Fire Marshal
prior to issuance of building permits. All conditions shall be made a part
of construction and no certificate of occupancy shall be -issued until
completed.
7. Traffic control provisions shall be provided as required by the Director of
Public Works.
8. Curb, gutter, sidewalk or approved pathways, and tie-in paving shall be
provided in conformance with City standards to specifications of the
Director of Pulbic Works.
9. Prior to issuance of a building permit for construction of any use contem-
plated by this approval, the applicant shall first obtain permits and/or
clearance from the following agencies:

Evidence of said permit or clearance from the above agencies shall be
presented to the Department of Building and Safety at the time of issuance

10. Drainage and Signalization Fund contributions as required by City Ordinance
shall be made as a part of this development.
11. The hours of private club operation shall be limited to 7 a.m. through
10 p.m. weekdays and 7 a.m. to 11:30 p.m. on weekends.
12. All activities shall be conducted within the building. I
13. The racquetball and health club shall be limited to, and operated as, a L
private club.
14. Safety street lighting as required and approved by the Director of Public
Works shall be installed at each driveway entrance.
15. An additional five (5) feet of right-of-way shall be dedicated on Alessandro,
to specifications of Director of Public Works.

shall be placed underground as a part of construction.
17. All exterior lighting, including but not limited to parking lot and build-
ing lights shall be designed and screened so that there is no light
spillover onto adjacent Residential properties and public rights -of -way.
18. Drainage facilities shall be provided per Ordinance No. 218 and the Master
Drainage Plan to the specifications of the Director of Public Works.
19. The applicant shall initiate vacation proceedings on De Anza Way.
20. Relocate trash enclosure to large landscape area near northeast corner of
building.
21. Vacant area of site shall be used for additional off-street parking for
racquetball club if after 18 months of operation the.Ci,ty.Qf Palm_
Desert determines such parking is necessary to insure the public health,
safety, or general welfare of persons or properties in the vicinity of the
site; no building permit, parcel map, etc., shall be granted until the above
18 month time has passed and the City has determined no -additional parking
is necessary.
22. Any vehicular access to vacant area shall be through parking lot of
racquetball club, with no new or additional driveway curb cuts created.
23. Parking spaces adjacent to east side of building, shall be revised so
that landscape island obstruction (in middle) at end of driving aisle is
eliminated.

line (including undeveloped area) as a part of initial development.

A Conditional Use Permit was previously approved in 1979 for a similar building
by the same owner. Working drawings were also approved by the City. However,
building permits were never taken out and all approvals were allowed to lapse.
The applicant is now asking for approval of a slightly different design. A new
CUP was granted by Planning Commission at its May 5, 1981, meeting.
ARCHITECTURAL DESIGN:
The architectural style is contemporary with a flat roof and varying planes and
heights, with the maximum height approximately 18 feet 6 inches. Exterior materials
will consist of stucco and splitface block walls, and some horizontal wood siding
and trim.
One of staff's major concerns is compatibility with the residential zoning to
the east. The building elevation indicates stucco and block faced walls with a
band of wood trim at the top. The setback from the residential zone varies from
69 feet to 115 feet because of the placement of the building on the site. Land-
scaping and a 6 ft high wall is also provided to help screen the use from the east.
It should also be noted that the dwellings on the residential lots are located on
the east end of the lots which are 200 ft. deep.
STAFF ANALYSIS:
Staff feels that the revised site plan, elevation plan and landscape plan are
basically acceptable provided additional information is provided as per the
attached conditions. In addition, the conditions prescribed by Planning Commission
in Resolution No. 705 (see attached copy) must be complied with and delineated on
the final working drawings.
Prior to submission for Design Review Board approval the applicant required Flood
Committee approval because the property is in an AO zone. This approval was
granted, however, the site plan was revised to incorporate some changes required
by Flood Committee. The current site plan then is as shown on the revised grading
plan. The lighting and landscape plan are schematic only. The revised site plan
delineates only 49 parking spaces whereas 50 spaces are required. Appropriate
revisions will be required to provide the required minimum parking spaces.
Adopted development standards for Design Review Board require that all required
street trees shall be a minimum of 24" box at time of installation. In addition,
on the perimeter of parking areas a minimum 75% of trees shall be 24" box or
larger at time of installation and the remainder shall be a minimum of 15 gallons
at time of installation.
The Board should review the submitted plans and determine acceptability.

Should the Board approve the preliminary plans, the approval should be subject to
the following conditions:
1. Final construction drawings, including a final landscaping, grading, lighting
including pole standards, amenities, trash storage, walkway layout, irrigation
plans and sign program shall be submitted to the Design Review Board. No
final inspection or occupancy permit shall be given by the Department of
Environmental Services to this project until the aforementioned approved plans
and construction shall have been completed.
2. That all conditions established by Planning Commission in its Resolution No.
705 be provided for in the final drawings.
3. That the height of the wall adjacent to San Carlos be delineated and not to
exceed a maximum of 3.5 feet.
4. That the planters in the parking lot area be provided with an appropriate
type of ground cover.
5. That final drawings show that roof equipment will be suitably screened.
6. That a detail be provided showing the 6 foot wall proposed along the east
property line and that said wall be construcred of appropriate decorative
materials.

I hereby acknowledge that I have read and agree, to comply with
all the following requirements, and understand that the Depart-
ment of Building and Safety will not issue a building permit or
allow occupancy on the use permitted until this signed confirma-
tion has been received by the Department of Environmental Services.
The development of this project shall conform substantially to all
development plans submitted in behalf of this case, and as revised
according to the Design Review Board process. Any minor change
requires approval by the Director of Environmental Services. Any
substantial change requires approval by the Design Review Board.
All requirements of any law, ordinance, or regulation of the State,
City, and any other applicable government entity shall be complied
with as part of the development process.
This approval is applicable, subject to the development of this
project, commencing within one year from approval date and being
promptly completed.
Landscaping (with irrigation system) shall be installed prior to
final inspection and receiving certificate of occupancy.
Curb, gutter, curb cuts, and tie-in paving shall be provided along
the full frontage of the lot by means of installation prior to
final inspection or other provisions as approved by the City
Engineer. Construction shall conform to City Standards and all
requirements of the City Engineer.
All new and existing electrical distribution lines, telephone,
cable antenna television, and similar service wires or cables,
which are adjacent to and provide service to the property being
developed shall be installed underground as a part of development
from the nearest existing pole not on the property being developed
�- as required by Municipal Code.
