I. BACKGROUND:
This request was originally approved by the planning commission at the meeting of
June 30, 1981, subject to conditions. One year time extensions were approved in
1982, 1983, and 1984.
As was the case in 1984, there have been no changes in the city's regulations that
would negatively impact the proposal.
II. RECOMMENDATION:
Staff feels this request is acceptable and recommends approval of an extension to
June 30, 1986.

CONDITIONS OF APPROVAL
CASE NO. CUP 04-81 AND 150 C
1. The development of the property shall conform substantially with Exhibits
(Case No. CUP 04-81 and 150 C) on file with the Department of Environmental
Services, as modified by the following conditions.
2. Construction of said project shall commence within one year from the date of
final approval; otherwise, said approval shall become null, void and of no
effect whatsoever.
3. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all
municipal ordinances and State and Federal Statutes now in force, or which
hereafter may be in force.
4. Construction plans shall be submitted for approval to the City Fire Marshal
prior to issuance of building permits. All conditions shall be made a part
of construction and no certificate of occupancy shall be issued until completed.
5. Curb, gutter, sidewalk, curb cuts, and tie-in paving shall be provided in
conformance with City standards to specifications of the Director of Public
Works.
6. Prior to issuance of a building permit for construction of any use contemplated
by this approval, the applicant shall first obtain permits and/or clearance
from the following agencies:
Riverside County Department of Health
Palm Desert Design Review Board Process
City Fire Marshal
Coachella Valley Water District
Evidence of said permit or clearance from the above agencies shall be pre-
sented to the Department of Building and Safety at the time of issuance of
a building permit for the use contemplated herewith.
7. Existing driveway if relocated, shall be removed and replaced with curb and
gutter.
8. Prior to final occupancy permit being authorized by the Department of Environ-
mental Services, the property owner shall enter into a record agreement
acceptable to the City Attorney and running with the land, to voluntarily be a
part of any undergrounding district which is subsequently established by the
City which includes the subject property within its proposed boundaries.
9. All exterior lighting, including but not limited to parking lot and building
lights shall be designed and screened so that there is no light spillover onto
adjacent residential properties and public rights -of -way.
10. Utility service lines shall be placed underground if addition requires installa-
tion of utility lines at new location on building, per Municipal Code require-
ments.
11. The existing roof equipment visible from the rear of the building shall be
screened as a part of the remodeling.
12. Power pole/guy wires at rear of lot to be relocated so that aisle is not
blocked, if necessary.
13. The applicant shall consolidate the two lots which make up the subject property.
14. Applicant shall submit for the approval of staff a suitable lighting plan for
the parking lot.and a suitable irrigation plan for the landscape areas.
15. Two existing pole signs adjacent to Highway 111 to be removed prior to approval
of occupancy fcr new addition; new sign program to he approved.
16. Directional striping to guide traffic in parking lot to be provided.

DESERT, CALIFORNIA, APPROVING A CUP AND DESIGN REVIEW CASE TO
ALLOW AN ADDITION TO AN EXISTING RESTAURANT IN THE C-1, S.P.
ZONE LOCATED AT 73-340 HIGHWAY 111.

WHEREAS, the Planning Commission of the City of Palm Desert, California,
_. did on the 30th day of June, 1981, hold a duly noticed Public Hearing to consider a
request by ROMEO PULUQI for approval of a Conditional Use Permit and Design Review
Case to allow the addition of 832 sq.ft. of dining area (442 square feet indoors,
390 sq.ft. outdoor patio) to an existing restaurant on .38 acres within the C-1, S.P.
(General Commercial, Scenic Preservation Overlay) zone, located at 73-340 Highway 111,
more particularly described as:

WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 80-89", in that the Director of Fnvirnnmental Services has determined
that the project is categorically exempted under the guiaelines for implementation
of the California Environmental Quality Act of 1970 per Section 15101, Class 1.
WHEREAS, at said Public Hearing, upon hearing and considering all testimony
and arguments, if any, of all interested persons desiring to be heard, said Commission
did find the following facts and reasons to exist to justi`y the granting of said
Conditional Use Permit:
1. The proposed location of the Conditional Use is in accord with
the objectives of the Zoning Ordinance ano the purpose of the
district in which the site is located.
2. The proposed location of the Conditional Use and the conditions
under which it .gill be operated and maintained will not be
detrimental to the public: health, safety, or General welfare,
or be materially injurious to properties or improvements in the
vicinity.
3. The proposed Conditional Use complies with the goals, objectives,
and policies of the City's adopted General Plan.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute
the findings of the Commission in this case.
2. That approval of Conditional Use Permit CUP 04-81 and 150 C is
hereby granted for reasons subject to the attached conditions.

for a six month time extension for the construction of a 47 unit
condominium project on the north side of Hovley Lane, 2600 feet east of
Monterey Avenue.

CONSULTANTS, INC. - Request for a one year time extension for the
construction and sale of a 28 lot subdivision containing 22 condominium
units on 4.75 acres located on the southwest corner of Hovley Lane and
Portola Avenue.
D. Case No. TT 17148 and CUP 02-82 - PIONEER MORTGAGE SALES
COMPANY - Request for a 12-month time extension to convert an existing
nine unit apartment complex to a condominium, located on the south side of
Shadow Mountain Drive, 850 feet east of Lupine Lane.
As requested at the previous meeting, staff explained the policy regarding
extensions of time for the various types of applications.

PALM DESERT PLANNING COMMISSION
JULY 5, 1983
Mr. Diaz explained that in those zoning cases not involving tentative tract or
parcel maps, applicants may request a one-year time extension and no limit was
established on the number of such requests. In those cases involving tentative
maps, the time limits were to run concurrently with the tentative maps. The
commission has established a policy of two continuances on public hearing items in
order to avoid the inconvenience to surrounding property owners of having to
return numerous times to testify on the same case.
Commissioner Richards stated he was satisfied with the clarification as presented.
Moved by Commissioner Richards, seconded by Commissioner Kryder, to approve
the consent calendar items as presented by staff; carried unanimously 4-0.
VII. PUBLIC HEARINGS - NONE
VIII. MISCELLANEOUS ITEMS
A. JOHN HOOTEN - Proposed housing development in the industrial zoned area
south of Hovley Lane, east of Cook Street.
MR. JOHN HOOTEN was present during the study session prior to the meeting for
a discussion of his proposal.
Mr. Hooten's proposal concerned the potential development of an apartment
complex on 7 acres at the south side of Hovley Lane and east of Cook Street. The
property is currently zoned for industrial uses. Among the concerns raised by the
commission were 1) the impact of rezoning on the city's industrial acreage; 2) the
rear elevations of the structures; 3) and the possible use of garages in place of
carports for covered parking.
Mr. Hooten will be submitting appropriate applications in the near future; and will
revise his proposal to address the design issues raised.
It was concluded that the possible rezoning of the acreage involved, because of its
location and the current amount of vacant industrially zoned land, a rezoning would
not impact the city's industrial zoning requirements.
B. LEVINE JANUS, LTD. - Proposed auction gallery in the Palms to Pines
Plaza Shopping Center.
Mr. Diaz presented the request noting that a code amendment is required to allow
an auction house in the C-1 zone. He also noted that the proposed location of this
request had been changed to the Palm Desert Glass Company building on Highway
Ill.
MR. ARTHUR LEVINE, 15580 Desert View Road, Whitewater, explained
that he wished to open a high quality auction house which deals primarily
with estate sales and bankruptcies. Mr. Levine presented a petition signed
by neighboring businesses supporting his proposal.
In response to a question from Commissioner Kryder, Mr. Levine indicated that his
business would primarily be that of an auction house as opposed to a retail store.
MR. ED BERKLEY, 41511 Bob Hope Drive, Rancho Mirage, property owner
of the proposed use, requested approval of the request to initiate a code
amendment to allow auction houses in the C-1 zone.
MS. CONNIE DOUDA, 71621 Mirage Road, Rancho Mirage, manager of the
Palm Desert Glass Co., noted that surrounding businesses favored the
proposed use.

Commissioner Downs, being a member of this lodge, expressed a possible conflict

Requested study session discussion:
A. JOHN D. STILES. -Ordinance revision permitting drive -through restaurants.
MR. JOHN D. STILES, of Smoketree Realty, stated his client, 'Naugles
Restaurant, wants to locate off the northeast -corner of Monterey Avenue
and Frontage Road. He felt this type of restaurant with a drive -through
facility properly designed would benefit the city. Because present
ordinances preclude the use, he was requesting that code be revised to
permit drive -through restaurants.
Commissioner Crites asked Mr. Stiles if he perceived a litter problem with drive -
through restaurants. Mr. Stiles replied that the same litter potential would result
as in nondrive-throughs.
Commissioner Richards felt that since the city had denied drive-throughs to
existing restaurants, it would be unfair to allow competitors to have them now.
Commissioner Crites felt that if the policy was improper it should be changed and
not be continued merely because others were refused. He stated, he would like to
see staff study the matter.
Commissioner Downs noted that. Palm Springs changed their policy recently and
permit drive throughs now.
Commissioner Richards agreed that it was not a good policy and did not know why
it was made to begin with, but major competitors were denied drive-throughs
facilities because of that policy.

WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the 30th day of June, 1981, hold a duly noticed Public Hearing to consider a
request by ROMEO PULUQI for approval of a Conditional Use Permit and Design Review
Case to allow the addition of 832 sq.ft. of dining area (442 square feet indoors,
390 sq.ft, outdoor patio) to an existing restaurant on .38 acres within the C-1, S.P.

WHEREAS, said application has complied with the requirements of the "City

that the project is categorically exempted under the guidelines for implementation
of the California Environmental Quality Act of 1970 per Section 15101, Class 1.
WHEREAS, at said Public Hearing, upon hearing and considering all testimony
and arguments, if any, of all interested persons desiring to be heard, said Commission
did find the following facts and reasons to exist to justify the granting of said
Conditional Use Permit:
1. The proposed location of the Conditional Use is in accord with
the objectives of the Zoning Ordinance and the purpose of the
district in which the site is located.
2. The proposed location of the Conditional Use and the conditions
under which it will be operated and maintained will not be

vicinity.

CONDITIONS OF APPROVAL

1. The development of the property shall conform substantially with Exhibits
(Case No. CUP 04-81 and 150 C) on file with the Department of Environmental
Services, as modified by the following conditions.
2. Construction of said project shall commence within one year from the date of
final approval; otherwise, said approval shall become null, void and of no
effect whatsoever.
3. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all
municipal ordinances and State and Federal Statutes now in force, or which
hereafter may be in force.
4. Construction plans shall be submitted for approval to the City Fire Marshal
prior to issuance of building permits. All conditions shall be made a part
of construction and no certificate of occupancy shall be issued until completed.
5. Curb, gutter, sidewalk, curb cuts, and tie-in paving shall be provided in
conformance with City standards to specifications of the Director of Public
Works.
6. Prior to issuance of a building permit for construction of any use contemplated
by this approval, the applicant shall first obtain permits and/or clearance
from the following agencies:

Evidence of said permit or clearance from the above agencies shall be pre-
sented to the Department of Building and Safety at the time of issuance of

7. Existing driveway if relocated, shall be removed and replaced with curb and

8. Prior to final occupancy permit being authorized by the Department of Environ-
mental Services, the property owner shall enter into a record agreement
acceptable to the City Attorney and running with the land, to voluntarily be a
part of any undergrounding district which is subsequently established by the
City which includes the subject property within its proposed boundaries.
9. All exterior lighting, including but not limited to parking lot and building
lights shall be designed and screened so that there is no light spillover onto
adjacent residential properties and public rights -of -way.
10. Utility service lines shall be placed underground if addition requires installa-
tion of utility lines at new location on building, per Municipal Code require-
ments.
11. The existing roof equipment visible from the rear of the building shall be
screened as a part of the remodeling.
12. Power pole/guy wires at rear of lot to be relocated so that aisle is not
blocked, if necessary.
13. The applicant shall consolidate the two lots which make up the subject property.
14. Applicant shall submit for the approval of staff a suitable lighting plan for

III. DISCUSSION:
The applicant wishes to construct a 1305 sq.ft. addition to his existing
restaurant which is on 1 lot. 832 sq.ft. of the addition would be for
dining purposes with the balance an unroofed patio and new entry area.
The addition will be on a second lot which has been used for extra parking.
The existing entry will be removed with the new architectural style spanish
in nature.
Parking requirements for the building addition will be complied with per-
mitting dining in the enclosed addition and roofed patio area only.
There are two legal nonconforming pole signs on the property. Because of the
major remodeling, staff recommends that the signs be removed and a new sign
program in compliance with the Municipal Code be submitted. The submitted
plans indicate a location on the wall of the remodeled restaurant for a
new sign and the applicants architect stated at the Design Review Board
meeting that a new sign would be provided.
The new addition will incorporate some of the existing materials in order to
provide architectural compatibility.
The required findings and justification for a Conditional Use Permit are as
follows:
Findin A: That the proposed location of the Conditional Use is in accord
with the objectives of the Zoning Ordinance and the purpose of the district
in which the site is located;
Justification A: The location of the restaurant is a conditionally permitted
use in the co—m ercial zone and would be in compliance with Code requirements
since a CUP is being requested.
Finding B: That the proposed location of the conditional use and the conditions
under w ich it would be operated or maintained will not be detrimental to the

improvements in the vicinity;

and since it has been operated without problems for a number of years, the

The findings for approval of a CUP can be made in the case. Therefore, staff
feels the request is acceptable, subject to conditions.
IV. DESIGN REVIEW BOARD:
The Design Review Board reviewed and approved preliminary and final drawings
for the proposed addition at the meeting of June 23, 1981.
The main topics of discussion were the provision of additional landscaping
and screening of roof equipment from the rear. The Board required that the
equipment be screened in order to begin eliminating eye sores on the north
side of Highway 111.
V. STAFF RECOMMENDATION:
Based on findings and justifications contained in this report, staff
recommends approval of CUP 0:4-81 by adoption of Resolution No.
A Resolution of the City of Palm Desert, California,
approving a CUP and Design Review Case to allow an
addition to an existing restaurant in the C-1, S.P.
zone located at 73-340 Highway 111.

3. That the final site plan indicates that double line striping be used
on the parking lot and that the revised plan comply with all provisions
of the Municipal Code relating to parking lots.
4. That the final landscaping plan comply with all provisions of the
Municipal Code including:
a. That a minimum 15% of the parking area be landscaped and that
1/3 of this landscaping be distributed within the interior of the
parking facility.
5. That the final plans provide further information relating to signs
including method of illumination and type of sign to be installed.
6. Full alley to be paved as required by Director of Public Works.
7. That the final plans provide a parapet wall, to run east -west, where
the building rises at the south section to shield the roof equipment
from view.

CASE NO. 150 C - ROMEO PULUQI and GEORGE RITTER & ASSOCIATES - Preliminary
and final approval of plans for an addition to a restaurant at 73-340
Highway 111. George Ritter was present.
Mr. Smith highlighted the salient points from the staff report.
Mr. Ritter advised the Board that the existing parking lot will be brought
up to code although the number of spaces will be deficient for a restaurant
of this total size. In response to questions from the Board, Mr. Ritter
said no parking lot lighting was proposed to be installed and that irri-
gation of the new landscaping will be tied into the existing irrigation
system. Mr. Ritter requested that Condition No. 5 be deleted. He said that
other buildings in the area have not screened the roof equipment from view
from the rear and no new roof equipment is being proposed.
The Chairman explained that it was the Board's desire to alleviate these
unsightly situations as the buildings are improved.
On a motion by Holden, seconded by Jackson, the Board approved application
150 C subject to the following conditions:
1. That the applicant receive approval of necessary CUP.
2. That the applicant enter into the necessary agreement to consolidate
the two lots which make up the subject property.
3. That the applicant submit for the approval of staff a suitable lighting
plan for the parking lot and a suitable irrigation plan for the land-
scape areas.

Proposal: The applicant wishes to construct a 1310 square foot addition to the
existing restaurant known as Romeo's Steak House. Five hundred square feet of this
addition will be enclosed restaurant area, while 832 square feet will be a patio
area having 6'6" walls and a partial roof. A Conditional Use Permit has also been
requested and will be heard June 30, 1981, by the Planning Commission.
Layout: The proposed addition is to be located to the east of the existing building
and having the same depth as the existing building. A 33' wide strip of land will
remain between the building and the east property line. This area will be used for
a driveway, angle parking spaces and landscaping. The majority of the parking will
be located to the rear of the building.
Parking: Parking for the existing restaurant facility is non -conforming with regard
to the Municipal Code requirements. The original restaurant was constructed with 16
spaces located at the rear. Subsequently, 13 spaces were added on the lot to the
east. The Municipal Code requires that additional parking spaces be provided for the
additional square footage of building at a rate of 15 spaces per 1000 square feet.
Concomittant with these additional spaces any spaces lost from the original 16 must
be replaced. Since part of the patio area will be covered this area is being consi-
dered as part of the expansion for parking purposes. The change in the parking layout
will eliminate 3 existing spaces which must be replaced and the expanded portion of
the structure, 864 square feet, requires that 13 spaces be provided. A total of 16
spaces will be provided on the easterly lot. One row of parking enters from Frontage
Road and exits into the alley to the north. The other row enters from the alley and
connects through to the other row of parking.
The proposed parking is acceptable to staff and conforms with the Municipal Code
parking provisions.
Landscaping: Landscaping has been proposed for the new portion of the parking lot.
The —proposed proposed landscaping meets the intent of the Municipal Code and the extent or
area, location, size and choice of species is acceptable to staff.
Elevations: The existing front of the building is faced with board and batten and
some brick veneer to the east of the entry. The proposal indicates that the easterly
182 feet of the existing facia (area of the existing entrance) will be refinished in
red brick veneer with a planter at the base. The addition will provide the new
entrance and at the front will have brick veneer pilasters with a wood beam across
the top. Wrought iron fence and gate will be placed between the pilasters.
Setback some 16 feet from the front pilasters a red tile roof supported by brick
veneer pilasters is proposed. The east wall of the patio area is to be plastered.
The restaurant portion of the addition is to be finished on the side and rear with
board and batten to match the existing on the front of the building.
The elevational treatment proposed appears acceptable to staff.
Conclusion:
The Board should review the proposed plans to determine acceptability. Should the
Board choose to approve the proposed plans, said approval should be subject to the
following conditions:
1. That the applicant receive approval of necessary CUP.
2. That the applicant enter into the necessary agreement to consolidate the two
lots which make up the subject property.
3. That the applicant submit for the approval of staff a suitable lighting
plan for the parking lot and a suitable irrigation plan for the landscape
areas.
4. Construction plans shall be submitted for approval to the City Fire Marshal
prior to issuance of building permits. All conditions shall be made a part
of construction and no certificate of occupancy shall be issued until completed.
5. That the existing roof equipment visible from the rear of the building be
screened as a part of the remodeling.
6. Power pole/guy wires be relocated so that aisle is not blocked, if necessary.

I hereby acknowledge that I have read and agree, to comply with
all the following requirements, and understand that the Depart-
ment of Building and Safety will not issue a building permit or
allow occupancy on the use permitted until this signed confirma-
tion has been received by the Department of Environmental Services.
The development of this project shall conform substantially to all
development plans submitted in behalf of this case, and as revised
according to the Design Review Board process. Any minor change
requires approval by the Director of Environmental Services. Any
substantial change requires approval by the Design Review Board.
All requirements of any law, ordinance, or regulation of the State,
City, and any other applicable government entity shall be complied
with as part of the development process.
This approval is applicable, subject to the development of this
project, commencing within one year from approval date and being
promptly completed.
Landscaping (with irrigation system) shall be installed prior to
final inspection and receiving certificate of occupancy.
Curb, gutter, curb cuts, and tie-in paving shall be provided along
the full frontage of the lot by means of installation prior to
final inspection or other provisions as approved by the City
Engineer. Construction shall conform to City Standards and all
requirements of the City Engineer.
All new and existing electrical distribution lines, telephone,
cable antenna television, and similar service wires or cables,
