JANUARY 26, 1982
2. CASE NO. 155 C - B.P.S. DEVELOPMENT COMPANY - Mr. Bernie Solomon
was present.
Mr. Smith reviewed the staff report indicating that this application was for
preliminary and final approval of the landscape and irrigation plans for the
Granada Royale Hotel at the north side of Highway 111, east of Deep Canyon.
The Board reviewed the plans and found them acceptable although they felt
that the type of irrigation at the trees and specifcally the Palms should be
improved.
On a motion by Mr. Holden, seconded by Mr. Gregory, the landscape and
irrigation plans were approved with a Condition that the applicant provide a
bubbler or drip irrigation for all of the trees, specifically the Palms.
Motion carried 4-0.
3. CASE NO. 112 C - CHARLES GIBBS - Mr. Gibbs was present and Mr. Cook
arrived at the meeting at this point.
Mr. Smith reviewed the report and indicated that Staff is recommending
preliminary approval to add a mini storage facility to an existing building,
providing Mr. Gibbs can assure that there will be proper landscaping and
maintenance thereof.
Ms. Jackson was concerned over the fact that there were no lights in the back
units. Mr. Gibbs replied that lights were not required in the smaller units but
he added that he would see that the area is properly illuminated.
Mr. Gibbs indicated that the reason the landscaping looks so bad is due to poor
water pressure received from the main water lines. When this is resolved, the
landscaping and maintenance will be no problem.
On a motion by Mr. Gregory, seconded by Mr. Barton, preliminary and final
approval was granted subject to the conditions listed in the January 12, 1982,
staff report with the following revisions:
Condition No.3 shall be amended to read that "The applicant shall submit a
letter stating that he will maintain the landscape plan". Condition No.2 was
amended to read subject to submission of a revised landscape plan with the
applicant listing the changes on same.
Motion carried unanimously 5-0.
4. CASE NO. 230 MF - BALLEW - ARBUCKLE and MARTIN - The applicants
were not present.
Mr. Smith reviewed the staff report and indicated that this was an application
for preliminary and final approval of landscape plans and a recreation building
plan.
The Board found the recreation plans were acceptable but felt the landscape
plans needed to be re -studied.
Mr. Gregory didn't feel that a 15 foot wide strip of "Dwarf Rosemary" around
the whole perimeter of the site as ground cover would be a good idea. He also
felt that extensive use of Eucalyptus trees would be un-interesting and added
that they grow too big and too fast.

DISCUSSION:
The building plans for the proposed hotel development were approved by the Planning
Commission subject to conditions.
One of the conditions required the submission to the Board and approval of a landscape
plan prior to the issuance of a building permit. This plan has been submitted and is
acceptable to Staff.
The applicant advised that the irrigation plan will be available at the time of the meeting
on Tuesday.
The Board should review the plans and determine acceptability.
RECOMMENDATION:
That the landscape plan for B.P.S. Development Company for application 155C be granted
preliminary and final approval.

PLANNING COMMISSION RESOLUTION NO. 763
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF PALM DESERT, CALIFORNIA, ASSUMING
AUTHORITY OVER A DESIGN REVIEW CASE, AND
APPROVING SAID CASE.
CASE NO. 155 C
WHEREAS, the City Design Review Board did consider the application of BPS
DEVELOPMENT COMPANY at its meeting of November 10, 1981;
WHEREAS, it is City policy to refer Design Review cases to the Planning
Commission for affirmation of Design Review Board actions;
WHEREAS, the Design Review Board voted on a motion of approval of the plans
which resulted in a 2-2 tie vote with one abstention;
WHEREAS, the Planning Commission did at its November 18, 1981, meeting
consider the merits of the case along with justification provided by the applicant, and did
elect to assume authority over the case; and,
WHEREAS, the Planning Commission did at said meeting find the following facts
and reasons to justify conditional approval of the preliminary and final working drawings:
a. The intent and spirit of the adopted Design Review criteria will
be fulfilled by approval of the plans as submitted.
b. The elevations, as submitted, will not be detrimental to the
health, safety and general welfare of the community.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute
the findings of the Commission in this matter.
2. That the Planning Commission does hereby approve preliminary and
final working drawings for Design Review Case No. 155 C, as submitted.

allow construction of a 172 unit condotel on 7.27 acres in
the PC (4), S.P. zone located on the south side of Highway
111, approximately 300 feet east of Shadow hills Road.
Mr. Diaz explained that some questions have still not been addressed regarding this
project, therefore, staff concurs with applicants request for a continuance to the meeting
of December 1, 1981.
Commissioner Richards asked if the main problem was still with Cal Trans. Mr.
Diaz replied that it was.
Commissioner Wood asked what the status was with Cal Trans. Mr. Sawa replied
that Cal Trans would probably allow access to Highway III if it was signalized and
aligned with the project across the street.
Moved by Commissioner Miller, seconded by Commissioner Richards, to continue
this case to December 1, 1981. Carried 4-0.
B. Continued Case No. CUP 08-81 - FLYING J., INC., Applicants
Request for approval of a Conditional Use Permit to allow
construction of a gasoline service station and convenience
food store on .55 acres in the PC (4) S.P. zone, located at
the southeast corner of Fred Waring Drive (44th Avenue)
and Highway 111.
Mr. Diaz explained the status of the service station and concurred with the
applicant's request to continue indefinitely, but not to exceed a period of one year.
Moved by Commissioner Richards, seconded by Commissioner Miller, to continue
this matter indefinitely for a maximum period of one year. Carried 4-0.
VIII. DESIGN REVIEW BOARD ITEMS
Preliminary plan approvals by the Design Review Board at its meeting of November
10, 1981, requiring Planning Commission confirmation.
A. Case No. 226 MF - CGO ENTERPRISES - Request for preliminary approval
of plans for a 10 unit apartment complex at the northwest corner of
Driftwood Avenue and Shadow Hills Road.
Mr. Diaz reviewed the case noting that the Design Review Board had made a
recommendation for approval on a 4-0-1 vote. However, variances in unit sizes would be
necessary. Therefore, staff recommended that the Planning Commission refrain from
reviewing this Design Review Board case until the Commission reviews the variance
request.
Moved by Commissioner Wood, seconded by Commissioner Richards, to continue
this matter indefinitely. Carried 4-0.
B. Case No. 155 C - BPS DEVELOPMENT CO. - Preliminary and final approval
of revised plans for a 204 room hotel, restaurant, ancillary uses on the north
side of Highway 111, 650 feet east of Deep Canyon Road.
Mr. Diaz explained that after review of this project by the Design Review Board
members, some members felt that there was no unity in the architecture. The end result
was a 2-2-1 vote. Staff felt that concerns were addressed by the applicant and
recommended approval to the Design Review Board subject to the conditions set forth in
the staff report to the Design Review Board dated November 10, 1981.
Commissioner Miller asked what buildings would be built first. Mr. Diaz replied
that Mr. Solomon was present and could answer his question.
Chairman Kryder asked Mr. Solomon to make a presentation.
MR. BERNARD SOLOMON, explained that there were no grading plans as yet, but
once submitted grading and building would take place all at once.

He discussed the issue of architectural continuity between buildings and felt that it was
not necessary in this case.
Commissioner Wood felt the design was good and emphasized his concerns were
with the landscaping and north property line buffering.
Moved by Commissioner Wood, seconded by Commissioner Richards, to approve
plans as submitted, subject to conditions. Carried 4-0.
IX. MISCELLANEOUS ITEMS
A. A Resolution of the Planning Commission of the City of Palm Desert,
California, approving a Redevelopment Plan, as amended.
Mr. Carlos Ortega gave a brief presentation on the proposed Redevelopment Plan
and requested adoption of a Resolution approving amendments.
Moved by Commissioner Wood, seconded by Commissioner Miller, to adopt Planning
Commission Resolution No. 762, recommending approval to the City Council of proposed
amendments to Redevelopment Plan. Carried 4-0.
X. ORAL COMMUNICATIONS - NONE
XI. COMMENTS
Commissioner Richards asked for an update on the Portola Dip situation. Mr. Diaz
replied that presently there were injunctions stopping anyone from repairing the dip.

I. BACKGROUND•
Design Review Board, on November 10, 1981, reviewed construction plans for a 204
unit hotel development. A motion to approve the submitted plans ended in a 2-2
vote with one Commissioner abstaining because of a possible conflict of interest.
The matter is therefore before Commission without a recommendation from the
Design Review Board.
ff. DISCUSSION:
The staff report, to the Board, dated November 10, 1981, and herein attached
identified the modifications made by the applicant to his original plans submitted
on September 8, 1981. The staff report concluded that the concerns originally
identified by staff had been addressed and the plans should be approved.
The members of the Board voting against the proposal felt that the design of the
hotel wings were not consistent with the architectural style of the restaurant and
lobby areas; and that some unifying elements should be incorporated in the design.
Those members voting in favor and the one member abstaining felt that the
substantial setbacks from Hwy 111, the offset between the hotel and main building
wings, and landscaping should address any concerns relating to consistency of
design among the project's elements.
III. STAFF RECOMMENDATION:
Staff recommends approval of the proposed design, subject to the conditions set
forth in the staff report to the Design Review Board dated November 10, 1981.

NATURE OF PROJECT/APPROVAL SOUGHT: Preliminary and final approval of revised
plans for a 204 room hotel, restaurant and ancillary uses.
LOCATION: North side of Highway111, 650 feet East of Deept Canyon.
ZONE: PC-4 and PR-5
CURRENT REQUEST:
The applicant is requesting preliminary approval of plans for the development of part of
the total site. A 5,456 square foot restaurant, 204 unit hotel and ancillary uses are
proposed on 6.41 acres.
BACKGROUND:
On June 2, 1981, Planning Commission approved a Development Plan and Tentative Tract
Map for a 20.5 acre site located at the north side of Highway 111, some 650 feet east of
Deep Canyon. The total Development Plan involves the construction of a 396 unit hotel
(204 hotel rooms and 192 "Casita Units"), restaurant and 14,700 square foot commercial
offices.
On September 8, 1981, plans were before the Board for preliminary approval at which
time three basic areas of concern were delineated:
Building height of 34 feet exceeded height permitted in the zone.
2. The lack of solar protection provided in the design of the buildings.
3. The elevational treatment proposed for the three story buildings.
DISCI ISSTON.
Revised plans have been submitted which indicate some additional architectural detail.
Specifically on Building "K", a full width balcony is proposed accross the end of the
building at the second floor level. A planter, approximately 3-4 feet in height will act as
the guard-rail. The material of the planter is not noted. On the wall below the balcony, a
band of mosaic tile is proposed. The proposed treatment on the wall should serve to
reduce the apparent height of the wall as well as mitigate the blandness of the former
blank wall.
Along the end of the building "G", a band of mosaic tile is proposed along the eave -line
and in the middle of the wall extending from ground level to the top. Again, the blandness
of a blank stucco wall is being improved.
On Building "K", a new balcony area is proposed with planter area to serve as the guard-
rail. On the wall area below the balcony, mosaic tile is proposed.
It is felt that the proposed revisions to the elevations adequately address the architectural
concerns which were raised previously.
In a meeting with the applicant, the matter of the 34 foot building height, was discussed.
The only way in which the 30 foot limit could be complied with, would be to go to a flat or
mansard roof. It was felt that a flat or mansard roof on buildings of this size,
ti
would not be appropriate.
The applicant indicated that he was looking into possible solar protection measures. •
Subsequent to the meeting, a letter outlining proposed solar protection measures was
received. (Copy attached).
ANALYSIS:
The Board should review the revised plans and proposed solar protection measures and
determine acceptability.
A proposed amendment to the Municipal Code to increase the permitted building height in
the PC-4 zone from 30 feet to 35 feet, was before Planning Commission November 3, 1981.
Planning Commission recommended approval of the amendment to the City Council.
Considering the favorable response of the Planning Commission to the height amendment,
it is felt that it would not be inappropriate to grant approval of the proposed structures,
subject to a condition that no building permit will be issued until and unless the building
height conforms with the code.
Should the height limit not be amended to permit 35 feet, the applicant will have to
submit revised drawings for Board approval.
The applicant has indicated to Staff that due to certain time constraints, he will be asking
for both preliminary and final plan approval. The applicant has indicated that substantially
complete drawings will be available for review by the Board.
The usual conditions imposed for preliminary approval have been altered to reflect the
request for preliminary and final approval.
STAFF RECOMMENDATION:
That application 155 C, BPS Development Company, for a 204 room hotel, restaurant and
ancillary uses for property located on the north side of Highway 111, some 650 feet east
of Deep Canyon, be given preliminary and final approval subject to the following
conditions:
1. Construction plans shall be submitted for approval to the City Fire
Marshall prior to issuance of building permits. All conditions shall
be made a part of construction and no certificate of occupancy shall be
issued until completed.
2. That a final landscape plan be submitted and approved by the Board
prior to issuance of building permit.
3. That a building permit for the proposed buildings not be issued until
the height of the buildings are in conformity with the Municipal Code.
4. That the applicant submit for the approval of the Director of
Environmental Services, a parking lot plan conforming to the
requirements of Planning Commission Resolution No. 725 and
indicating the location of trash areas, handicap spaces and
parking lot lighting.

Dear Mr. Solomon:
In designing Granada Royale Hometels, throughout the United
States, we have become familiar with the climatic problems
in the various areas. Being aware of the constantly
increasing energy costs for heating, and especially cooling,
we are constantly searching for better ways to insulate
these buildings. To that end, we recommend the following
steps be taken to minimize the use of energy:
All windows facing West equipped as follows:
(6-OX6-8 sliding glass doors): Double glazing with
tinted glass (Standard Hometel design);
Kaiser aluminum shade screens; electric interlock
device that turns off the cooling unit when the
balcony doors are opened.
As a standard all Hometels are designed with R-19 insulation
in exterior walls, and a minimum R value of 17 in the roof.
In your case, with the gable roof over all parts (which gives
us an attic space) we will provide additional insulation above
the ceiling.

NATURE OF PROJECT/APPROVAL SOUGHT: Preliminary and final approval of revised
plans for a 204 room hotel, restaurant and ancillary uses.
LOCATION: North side of Highway 111, 650 feet East of Deep Canyon.

CURRENT REQUEST:
The applicant is requesting preliminary approval of plans for the development of part of
the total site. A 5,456 square foot restaurant, 204 unit hotel and ancillary uses are
proposed on 6.41 acres.
BACKGROUND:
On June 2, 1981, Planning Commission approved a Development Plan and Tentative Tract
Map for a 20.5 acre site located at the north side of Highway 111, some 650 feet east of
Deep Canyon. The total Development Plan involves the construction of a 396 unit hotel
(204 hotel rooms and 192 "Casita Units"), restaurant and 14,700 square foot commercial
offices.
On September 8, 1981, plans were before the Board for preliminary approval at which
time three basic areas of concern were delineated:
1. Building height of 34 feet exceeded height permitted in the zone.
2. The lack of solar protection provided in the design of the buildings.
3. The elevational treatment proposed for the three story buildings.
DISCUSSION:
Revised plans have been submitted which indicate some additional architectural detail.
Specifically on Building "K", a full width balcony is proposed accross the end of the
building at the second floor level. A planter, approximately 3-4 feet in height will act as
the guard-rail. The material of the planter is not noted. On the wall below the balcony, a
band of mosaic tile is proposed. The proposed treatment on the wall should serve to
reduce the apparent height of the wall as well as mitigate the blandness of the former
blank wall.
Along the end of the building "G", a band of mosaic tile is proposed along the eave -line
and in the middle of the wall extending from ground level to the top. Again, the blandness
of a blank stucco wall is being improved.
On Building "K", a new balcony area is proposed with planter area to serve as the guard-
rail. On the wall area below the balcony, mosaic tile is proposed.
It is felt that the proposed revisions to the elevations adequately address the architectural
concerns which were raised previously.
In a meeting with the applicant, the matter of the 34 foot building height, was discussed.
The only way in which the 30 foot limit could be complied with, would be to go to a flat or
mansard roof. It was felt that a flat or mansard roof on buildings of this size,
would not be appropriate.
The applicant indicated that he was looking into possible solar protection measures.
Subsequent to the meeting, a letter outlining proposed solar protection measures was
received. (Copy attached).
ANALYSIS:
The Board should review the revised plans and proposed solar protection measures and
determine acceptability.
A proposed amendment to the Municipal Code to increase the permitted building height in
the PC-4 zone from 30 feet to 35 feet, was before Planning Commission November 3, 1981.
Planning Commission recommended approval of the amendment to the City Council.
Considering the favorable response of the Planning Commission to the height amendment,
it is felt that it would not be inappropriate to grant approval of the proposed structures,
subject to a condition that no building permit will be issued until and unless the building
height conforms with the code.
Should the height limit not be amended to permit 35 feet, the applicant will have to
submit revised drawings for Board approval.
The applicant has indicated to Staff that due to certain time constraints, he will be asking
for both preliminary and final plan approval. The applicant has indicated that substantially
complete drawings will be available for review by the Board.
The usual conditions imposed for preliminary approval have been altered to reflect the
request for preliminary and final approval.
STAFF RECOMMENDATION:
That application 155 C, BPS Development Company, for a 204 room hotel, restaurant and
ancillary uses for property located on the north side of Highway 111, some 650 feet east
of Deep Canyon, be given preliminary and final approval subject to the following
conditions:
1. Construction plans shall be submitted for approval to the City Fire
Marshall prior to issuance of building permits. All conditions shall
be made a part of construction and no certificate of occupancy shall be
issued until completed.
2. That a final landscape plan be submitted and approved by the Board
prior to issuance of building permit.
3. That a building permit for the proposed buildings not be issued until
the height of the buildings are in conformity with the Municipal Code.
4. That the applicant submit for the approval of the Director of
Environmental Services, a parking lot plan conforming to the
requirements of Planning Commission Resolution No. 725 and
indicating the location of trash areas, handicap spaces and
parking lot lighting.

in the various areas. Being aware of the constantly
increasing energy costs for heating, and especially cooling,
we are constantly searching for better ways to insulate
these buildings. To that end, we recommend the following
steps be taken to minimize the use of energy:
All windows facing West equipped as follows:
(6-OX6-8 sliding glass doors): Double glazing with
tinted glass (Standard Hometel design);
Kaiser aluminum shade screens; electric interlock
device that turns off the cooling unit when the
balcony doors are opened.
As a standard all Hometels are designed with R-19 insulation
in exterior walls, and a minimum R value of 17 in the roof.
In your case, with the gable roof over all parts (which gives
us an attic space) we will provide additional insulation above
the ceiling.

j CASE NO. 155C - BPS DEVELOPMENT COMPANY, Applicants - Preliminary
approval of plans for a 204 room hotel, a restaurant and ancillary
uses. Bernard Solomon was present.
Mr. Diaz reviewed the report and indicated the project's location.
He mentioned that preliminary landscape plans would be submitted
later. The Staff's concerns centered on the west, south and a
portion of the north elevations. He recommended that plans be given
a preliminary approval subject to the design being revised to resolve
the areas of concern.
Chairman Martin mentioned that the building height being above code
was a major area of concern.
Mr. Solomon indicated that landscape plans would be forthcoming. He
indicated concern over the fact that he would have to keep 2/3rd's
of the Date Palm Trees, to which Mr. Diaz replied that this was incorrect.
Commissioner Leung expressed concern over the glass exposure on the East,
West and South sides of the building, indicating that he would prefer
the sliding doors to be either recessed 12 to 18 inches or the walls
brought out on the sides of the windows to resolve the problem and help
the building aesthetically.
Chairman Martin asked when they would have the working drawings; Mr.
Solomon replied that it would be in 45 days.
Commissioner Jackson indicated that the plans were not acceptable be-
cause of the height limit and that it would be up to the proper Agency
to grant the Variance.
Mr. Diaz stated that the sliding door areas should be recessed about
18 inches, or that there should be some type of solar protection on the
glass; Mr. Solomon replied that they would go "tinted double glass".
Commissioner Leung felt this was insufficient. Commissioner Holden
indicated that there was a section showing an overhang which might help.

In response to a remark by Mr. Solomon, Mr. Barton stated "This is
not a matter of aesthetics but one of energy conservation, that this
is a matter of the utmost importance".
Mr. Diaz indicated that since the height limit is the major problem,
that he would like to recommend that the Board continue this matter
for two weeks to allow Staff and the applicant to resolve this and
the other issues which had arisen. These two weeks would allow Staff
an opportunity to approach the appropriate bodies and determine their
receptiveness to an amendment to the height limit.
Commissioner Jackson moved and Commissioner Barton seconded to continue
this case to the meeting of September 22nd.

CASE NO. 225MF - SAN CLEMENTE GROUP DEVELOPMENT CORPORATION, Applicants -
Approval of preliminary plans for a 51 unit residential condominium
project, BOB KROUSE of SAN CLEMENTE GROUP DEVELOPMENT CORPORATION,
WILLIAM CRAWFORD of VITO CETTA AND ASSOCIATES, JACK NEWVILLE of ENGINEERING
SERVICES CORPORATION and ROGER PRESBURGER of PRESBURGER & ASSOCIATES were
present at the meeting.
Mr. Sawa reviewed the staff report and discussed the events that had
taken place at the last meeting for the benefit of the Board members
who were not present at the time. He indicated that Staff would recommend
,preliminary approval subject to the conditions listed in the staff report.
Chairman Martin asked what was planned for the entry. The applicant
indicated that two entry gates were provided to facilitate circulation
and avoid stacking and that crash gate details would be forthcoming.
Commission expressed concern that only one pool was provided. Chairman
Martin stated that since the project provided other amenities, that the
applicant should be given the option of eliminating some recreation
feature if another pool was required.
Discussion ensued regarding the color scheme. The applicant indicated
that only window trims would be a rust color; the Board then requested
a sample.
To concern over the proximity of the units along the creek, the applicant
responded that they had attempted to line up the units to provide a
view of green areas and assure privacy.
Chairman Martin asked how the sun -shade awnings would be handled . The
applicant replied that they would be metal with a fiberglass filling.
Applicants were then asked if all the units would have covered patios,
to which they replied that they all would.
Commissioner Gregory moved and Commissioner Jackson seconded that
Preliminary Plans be approved subject to a proper sample of the trim
being presented along with a detail of the awning installation and an
overlay showing the addition of a second pool, be submitted to Staff for
discussion at the next Design Review Board Meeting and that the approval
be subject to all Staff conditions except those relating to security
(Nos. 5 and 6 in staff report dated September 18th, 1981.)

The site plan is in accordance with the overall Development Plan approved by
Planning Commission.
LANDSCAPE PLAN:
A landscape plan was not provided however, the site plan does indicate the areas
to be landscaped. The areas to be landscaped and the amount of landscaping conforms
to that required by the Municipal Code. The final landscape plan will have to
delineate species and sizes of materials to be planted.
A concern in the Development Plan review involved the proper screening of the hotel
parking area by use of berming and extensive planting. This matter should be
reflected on the final landscape plan.
BUILDING ELEVATI
The proposed hotel buildings will be three (3) stories in height (30 feet maximum)
and will have a contemporary Spanish architectural theme. The roof will be red
Spanish tile while the walls will be Malibu (beige) stucco. The various buildings
and their elevations each have some interesting architectural features. Perhaps the
most interesting feature is the 55 foot high clock tower located adjacent to the
main hotel entry. Other features include balconies with wrought iron railings and
a series of arches on the south elevation of building "K".

Staff would suggest that the developer and the Board look at various means of
reducing the apparent height of the buildings. The proposed balcony areas could
be expanded so that there is not a continuous expanse of wall between the balconies
from ground level to the roof. The railings for the balconies could be altered to
attract more attention. Additional roof overhang could be considered as well as
appropriate landscape treatment.
The elevations proposed are basically acceptable to staff.
SIGNS:
The plans submitted indicated that one freestanding sign is proposed. The sign
near the access driveway from Highway 111. The sign is to be plexiglass set in
a dark brown wood frame. The letters will be white on a royal purple background
and will be internally illuminated.
The sign itself will be 6 feet by 15 while the total frame is some 12 feet high
and 20 feet wide. A formal sign application will be necessary however, the Board
may wish to comment on the sign as presented.
ANALYSIS:
The Board should review the plans and determine acceptability. Staff recommends
that the plans be given preliminary approval.
STAFF RECOMMENDATION:

project, commencing within one year from approval date and being
promptly completed.
Landscaping (with irrigation system) shall be installed prior to
final inspection and receiving certificate of occupancy.
Curb, gutter, curb cuts, and tie-in paving shall be provided along
the full frontage of the lot by means of installation prior to
final inspection or other provisions as approved by the City
Engineer. Construction shall conform to City Standards and all
requirements of the City Engineer.
All new and existing electrical distribution lines, telephone,
cable antenna television, and similar service wires or cables,
which are adjacent to and provide service to the property being
develo ed shall be installed underground as a part of development
from: a nearest existing pole not on the property being developed
a, -equired by Munic'pal Code.
