BACKGROUND:
November 8, 1983 commission reviewed revised plans for this property.
On February 8, 1983 the commission had granted preliminary approval of revised plans for
these same buildings. At that time the commission was shown a model of the proposed
development.
CURRENT PROPOSAL:
The final plans reflect the preliminary plans reviewed by commission November 8, 1983.
At this time the applicant is proposing three retail buildings having a total area of 25,980
square feet. Building "A" and "B" will be connected while Building "C" will be separate
yet connected at the roof.

informally, revised plans for the center.
The final plans have included a landscape plan for the courtyard area. Commission should
review the elevations and sections to determine if condition 4, regarding the relative

in the area of the 12 foot wide passageway between building "B" and "C" have been
adequately addressed.

Mr. Smith indicated that the plans for the same building had been before
the commission on two previous occasions. The buildings in question will
be located west and south of T.G.I. Friday's Restaurant. The proposal at
this time would be to approve the elevations for this building.
The commissioners were concerned that a landscape plan for the
courtyard area was not provided.
Mr. Craig Combs, architect for the building assured the commission one
would be provided shortly.
The commission was also concerned relative to the length of the building
and its apparent lack of undulation, i.e. roof support columns in same
plane. It was also felt that the twelve foot wide passageway between
Buildings B & C could be an opportunity to provide an architectural
statement which could possibly alter the roof design.
Mr. Combs thanked the commission for their constructive comments.
Chairman Gregory was concerned that in front of Buildings A, B and C
where people park at a 900 angle they would have to traverse a seven foot
planting area before getting to the sidewalk. The planter should be
redesigned so that it could be traversed without damaging the plantings.
On a motion by Commissioner Holden, seconded by Commissioner Martin
the preliminary plans were approved subject to the following conditions:
1. Construction plans shall be submitted for approval to the
city fire marshal prior to issuance of building permits.
All conditions shall be made a part of construction and no
certificate of occupancy shall be issued until completed.
2. Final construction drawings, including a final landscaping,
grading, lighting, amenities, trash storage, walkway layout,
irrigation plans and sign program shall be submitted to the
architectural review commission. No final inspection or
occupancy permit shall be given by the department of
environmental services to this project until the aforementioned
approved plans and construction shall have been completed.
3. That the landscape plan address the central courtyard area
as well as perimeter parking lot planters between the
parking lot and the buildings.
4. That the revised plans address the commission's concerns
regarding the relative length of the building, apparent lack
of undulation and the opportunity to create a statement in
the area of the twelve foot wide passageway between buildings
"B" and "C".
Mr. Combs was cautioned that he may wish to return with his revisions prior
to commencing preparation of the working drawings. This would be an option
open to him although not a requirement.

CASE NO 247 MF (CONTINUED):
LOCATION: East side of San Rafael, south of Catalina.

Mr. Smith reviewed the staff report and the revised plans submitted by
the applicant and referred to a letter which addressed the concerns
raised at the meeting of October 11, 1983 at which time the applicant had
been requested to restudy the elevations, solar protection and
landscaping.
The commissioners were in agreement that the landscaping would not be
sufficient to screen the car stalls from the street; therefore, they
recommended that there should be some form of architectural barrier
between the street and the three open car stalls.
Mr. James N. Ewart, 5873 Vista Del Fuente, Indian Wells, CA, indicated
that he had originally planned to put in a block wall but was told a five
foot wall would not be possible.
Mr. Smith indicated that the wall could go to five feet if it were set back
15 feet from the driveway to provide adequate visibility.
Chairman Gregory felt the planter could be incorporated on the west end
of the carport walls so that vines could be used to soften the view from
the street. The dwarf oleanders on the north street side should be raised
to a five gallon size instead of one gallon.
Mr. Ewart felt these changes would be acceptable.
On a motion by Commissioner Cook, seconded by Commissioner Leung,
the preliminary plans were approved subject to the following conditions:
1. Uncovered car stalls shall be visually screened
from street view utilizing a 36 to 42 inch masonry
wall on the property line.
2. Dwarf oleander shall be increased in size from one
to five gallon.
3. A planter (minimum two feet in depth) shall be added
at the base of the end wall of the carport structures
to permit vine material to be used to screen the carport
walls.
Motion carried 4-1 with Commissioner Holden voting nay.

BACKGROUND:
On February 8, 1983 the commission granted preliminary approval of revised plans for
these same buildings. At that time the commission was shown a model of the proposed
development.
CURRENT PROPOSAL:
At this time the applicant is proposing three retail buildings having a total area of 25,980
square feet. Buildings "A" and "B" will be connected while Building "C" will be separate
yet connected at the roof.
ROOF:
The roof is now proposed as terra Gotta tile as was shown in the original October 1983
submittal.
ELEVATIONS:
The buildings are one story in height (14 feet). The structures are conte;nporary and will
utilize stucco fascias. The unit fronts will be primarily glass and will be set back as much
as 14 feet from the edge of the roof overhang. The covered walk around the perimeter of
the buildings should provide adequate solar protection.
LANDSCAPING:
A detailed landscape plan has not been provided with this submittal. The previous
landscape plans had been reviewed and revisions suggested. A detailed landscape plan will
need to be submitted and approved prior to or concurrent with final plan approval.
RECOMMENDATION:
That the revised plans for Case No. 157 C be granted preliminary approval subject to the
following conditions:
1. Construction plans shall be submitted for approval to the city fire
marshal prior to issuance of building permits. All conditions shall
be made a part of construction and no certificate of occupancy shall
be issued until completed.
2. Final construction drawings, including a final landscaping, grading,
lighting, amenities, trash storage, walkway layout, irrigation plans
and sign program shall be submitted to the architectural review

CONDITIONS OF APPROVAL
Case No. CUP 03-82 Amendment $1
1. The development of the property shall conform substantially with exhibits on file
with the department of environmental services, as modified by the following
conditions.
2. Prior to the issuance of a building permit for remodeling of any uses contemplated
by this approval, the applicant shall first complete all the procedural requirements
of the city which include, but are not limited to, design review and building permit
procedures.
3. Use of the permit shall commence within one year from the date of final approval
otherwise said approval shall become null, void and of no effect whatsoever, unless
a time extension is granted.
4. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all municipal
ordinances and state and federal statutes now in force, or which hereafter may be
in force.
5. Prior to issuance of a building permit for construction of any use contemplated by
this approval, the applicant shall first obtain permits and/or clearance from the
following agencies:

City Fire Marshal
Coachella Valley Water District
Evidence of said permit or clearance from the above agencies shall be presented to
the department of building and safety at the time of issuance of a building permit
for the use contemplated herewith.
6. Valet parking shall be allowed at night with clearance from the technical traffic
advisory committee.
7. Said use will be reviewed after a period of one year.

Preliminary plans requiring planning commission confirmation at its meeting of February
15, 1983:
1. CASE NO: 157 C

Angeles, CA 90026.
NATURE OF PROJECT/APPROVAL SOUGHT: Preliminary approval of
revised plans for a retail building at Palms to Pines West, Phase II.
LOCATION: Palms to Pines West, Phase II

Mr. Smith indicated that there had been a substantial change from the plans
submitted at the meeting of October 27, 1981. As stated in the previous
report, T.G.I. Friday's has been moved from building pad "B" to the pad to
the east, pad "C" and former pads "B", "D" and "E" are now proposed to be
combined to provide two buildings all under one roof.
The board was concerned over the height of the parapets and the window
treatments and arches as presented.
Mr. Hal Richardson of the Jerde Partnership indicated that the parapets will
be a minimum of two feet high and would then slope to follow the drainage
of the roof to a maximum of six feet high, he added that it was their
intention to screen all the mechanical equipment. The arches would have
open screening or a trellised opening and the window treatments would have
a painted wood lattice. The building walls and the trim would be a "sand
finish" with the walls painted Navajo white and the trim painted China pink.
The roof tile would be terra cotta and not concrete tile as noted on the
plans.
Mr. Cook asked if the signs would be placed on the awnings and if so, would
the center have control of their usage.
Mr. Richardson replied that the awnings would be a fortrel polyester fabric
on aluminum frames, the color being terra cotta and blue. The tenant signs
would be V - O" x 8' - 0" and would require approval by the board.
The applicant responding to a question regarding the location of the trash
bins, indicated that there are two trash enclosures shown on the site plan.
Mr. Gregory reviewed the landscape plans and recommended the following
changes:
On E1 Paseo Parkway:
1. Substitute bottle trees for floss silk.
2. Substitute dwarf oleander "petite pink" for oleander.
3. Substitute a more sun resistant plant for the mock orange.
4. Substitute another groundcover for star jasmine.
5. Substitute another vine for Ficus repens.

1. The trees should be a minimum size of 24" box size with
the exception that if bottle trees are planted in lieu
of floss silk that they be 15 gallon (up to 50%).

were approved subject to the following Conditions, Nos 1 and 2 as listed in
the staff report and added conditions 3 and 4.

Mr. Joy reviewed the staff report and recommended approval.
Chairman Wood opened the public hearing and asked if the applicant cared to make
a presentation. The applicant was not present.
Chairman Wood asked if anyone present wished to speak in FAVOR or OPPOSITION
to this case. There being none, the public hearing was closed.
Moved by Commissioner Crites, seconded by Commissioner Richards, to adopt
findings as recommended by staff; carried unanimously 4-0.
Moved by Commissioner Richards, seconded by Commissioner Kryder, to adopt
Planning Commission Resolution No. 841, approving CUP 02-83; carried unanimously 4-0.

Mr. Smith reviewed the plans and noted that TGI Fridays is not included in this
project but is shown together in the model; design review board approved this case with
minor concern relative to landscaping and rooftop equipment visibility.
Commissioner Crites stated that he observed in the San Fernando Valley similar
awnings as proposed for the TGI Fridays and they inevitably became rundown and an
eyesore. He asked what assurance the city has that it would not happen here.
Mr. Diaz replied that a Commercial Property Maintenance Ordinance could be
required if the problem arose.
Commissioner Richards believed that would not happen because the tenants would
be paying high rent cost in this commercial area and believes they would properly
maintain them.
Moved by Commissioner Richards, seconded by Commissioner Kryder, to approve
design review board's actions for Case No. 157 C; carried unanimously 4-0.
IX. MISCELLANEOUS ITEMS
A. Change of date of March 1, 1983, meeting to February 28, 1983
This meeting has been changed due to lack of a quorum on March 1, 1983.
Commission concurred.
B. Review of parking demands in shopping centers.
Mr. Diaz noted that review of parking demands in all shopping centers should be
observed between now and March 15, 1983; there will be a joint study session with council
at that time.
C. ZOA 10-82 - Urgent Care Facility.
Mr. Diaz explained that the city council at their last meeting indicated they may
pass a motion to approve an amendment to the zoning ordinance relating to urgent care
facilities. Prior to that meeting, the council in their October meeting where this item
was discussed, had made a motion to approve but the motion failed due to lack of a second
and was then tabled. According to city attorney this matter could be reconsidered by
council. The council felt that the definition of "urgent care facility" as provided in the
code was sufficiently different than a medical office to constitute additional signage.
The council felt that this amendment should proceed but a planning commission report
must be submitted.
Chairman Wood noted that the council decision was not unanimous so the report
received from planning commission would have a great bearing on the final decision of
this matter.
Commissioner Kryder did not believe that the Palm Desert Medical Center (urgent
care facility) was not any different than a medical office but felt that if this facility was
termed to provide "urgent care" then the hours of operation should be clearly visible on a
sign.
Commissioner Richards stated that he took a friend to this facility one evening at
6:05 p.m. and someone inside refused to treat him. He felt that the facility was not
providing service as they propose and was strongly opposed to supporting this facility to
be "urgent care". He further stated that the planning commission had spent much time on
this matter and further discussion was unnecessary since the commission had already
made their decision.
Commissioner Crites also felt there was no legitimate reason for this to be

BACKGROUND:
October 27, 1981, the board reviewed preliminary plans for buildings C, D and E in
the Palms to Pines West, Phase II Development. Buildings A do B (both restaurants)
were to be processed separately. All these buildings are located to the south (rear)
of the existing Crocker Bank and Coast Federal Savings Building.
Some significant changes are proposed. T.G.I. Friday's one of the restaurants, has
been moved from building pad "B" to the pad to the east (pad "C"), and former pads
B, D and E are now proposed to be combined to provide two buildings all under one
(1) roof.
DISCUSSION:
The board is now requested to review the revised retail building plans.
SITE PLAN:
The site layout for traffic circulation and parking remains unchanged. Pedestrian
circulation is altered in that instead of having three separate retail buildings, two
buildings located under one roof are proposed. A central covered corridor connects
the two buildings.
LANDSCAPING:
A landscape plan for the parking area and perimeter strip as well as adjacent to the
retail buildings has been provided. Separate landscape plans are required for the
area immediately adjacent to the restaurants. Trees to be planted range in size
from 24" box to 5 gallon. Species include floss silk tree, jacaranda, California
pepper tree, carob tree, oleander, mock orange, India hawthorn and date palms.
Shrubs and groundcover include boxwood hedges, Ficus repens, star jasmine and
lawn.
The board should review the landscape plan and determine acceptability giving
particular attention to the required parking lot screening to be provided by the
perimeter planting strip.
ELEVATIONS:
The revised plans offer a substantial change from the plans formerly reviewed.
Portions of the roof have retained the tile while other areas have a flat roof.
Building height to the peaks is 23 feet except for the towers which are 29'6" high.
A covered walkway extends around the perimeter of the buildings. The width of
this walkway is 11 feet. Roof parapets range from 2' to 6' high to shield roof
equipment from public view.

Exterior walls are to be navajo white stucco. In the upper wall section a series of
painted window -like wood lattice structures with a wood trim are proposed.
Attached below these window -like structures will be awnings on which the business
signs are to be installed. The awnings are to be dark blue or rust colored.
PARKING:
The proposed retail building is substantially the same size as the previously
approved buildings. The parking provided complies with that required in that 366
spaces are provided for the entire center.
RECOMMENDATION:
That the revised plans for Case No. 157 C be granted preliminary approval subject
to the following conditions:

Construction plans shall be submitted for approval to the city
fire marshal prior to issuance of building permits. All conditions
shall be made a part of construction and no certificate of
occupancy shall be issued until completed.
2. Final construction drawings, including a final landscaping, grading,
lighting, amenities, trash storage, walkway layout, irrigation plans
and sign program shall be submitted to the design review board. No
final inspection or occupancy permit shall be given by the department
of environmental services to this project until the aforementioned
approved plans and cosntruction shall have been completed.

CASE NO: 145C - CROCKER BANK c/o WEXLER-URRUTIA - Application for
approval of a freestanding automated teller sign.
Mr. Smith said that he had spoken to Mr. Urrutia who requested that this matter be
withdrawn. Accordingly, no action was necessary.
CASE NO: 668 SA - HUGHES PALM DESERT, LTD. and JOHN HOWENSTINE, INC.
- Application for approval of two freestanding signs for center identification.
Mr. Smith reviewed the Staff Report. One concern of Staff involved the exact
location for the El Paseo sign.
Mr. Strickland of John Howenstine, Inc., was present and stated that the El Paseo
sign would be double-faced and located in front of the tree where the leasing sign
presently exists. It is to be externally lighted and made of ceramic tile.
The Board expressed concern over whether there would be a problem with
visibility. Mr. Strickland replied that the sign was lower than the existing leasing
sign and the light would extend out about 6 inches at the base. Mr. Sawa indicated
that its total height would be five feet.
On a motion by Mr. Leung, seconded by Mr. Holden, the application for the two
freestanding signs was approved. Motion carried 5-0.
CASE NO: 157 C - GERALD J. CHAZEN and ROBERT H. RICCIARDI - Application
for preliminary approval of plans for three retail commercial buildings in Palms to
Pines West, Phase II.
Mr. Cook declared a possible conflict and did not vote on this matter.
Mr. Smith reviewed the Staff Report and indicated different areas of concern.
There was considerable discussion regarding condition number "3". Mr. Sawa said
that Staff had inserted this condition to assure that there were no areas of
landscaping which were inadvertently omitted from the total development of the
site.

Mr. Diaz added that the Municipal Code requires all parking areas to be screened.
It was also decided that Condition NO. 6 be added, to read:

to be measured from grade of parking lot, be built adjacent to
El Paseo,to screen the parking areas".
Mr. Cook asked if there was a requirement to turn out a final landscape plan for
the entire Phase II Development. Mr. Sawa replied that Staff should have a
landscape plan for the entire development in order that it may be properly
coordinated.
Mr. Cook asked that the Sign Criteria information which had been submitted be
withdrawn.
On a motion by Mr. Holden seconded by Mr. Leung, the application for preliminary
approval of retail buildings C, D and E, was approved subject to the conditions
contained in the Staff report dated October 27, 1981, as well as Condition "6"
delineated above. Motion carried 4-0 (Cook Abstaining).
IV. DISCUSSION ITEMS:
1. TODAY MAGAZINE SIGN - Mr. Smith stated that since the applicant was
not present, he felt that the Board should reaffirm its position taken at its
October 6, 1981 meeting. The Board was in agreement and reaffirmed its
denial of the requested sign.
2. SAN CLEMENTE GROUP - 225 MF - Mr. Smith said that a Condition of the
preliminary approval required the applicant to submit a sample of the trim
color, a detail of the awning installation and a plan showing a second pool
location. The above noted items were circulated to the Board. It was the
concensus of the Board that the submitted details were acceptable. The
solar window protection is to be installed on all windows that are not
recessed at least 30 inches.
3. TOY STORE AWNING - Beatrice Pardo, designer for Reuben Klamer Studio
"K", was present. She indicated that this would be an experimental toy store
and demonstration store combined. The 'Ball and Stick" would be their logo.
A "K" is to be etched on the door facing East, facing Cedar Creek Inn.
The applicant was instructed to take the plans to the Planning Staff, prior to
submitting them for a Building Permit.
The Board approved the awning, which would be orange with white lettering
on it. The "K" on the awning to be 2 feet by 2 feet.
V. ADJOURNMENT:

LOCATION Westerly side of Palms to Pines Shopping Center, between E1 Paseo and
ZONE PC (3) S.P.
BACKGROUND:
Development Plan 06-80 was originally approved by Planning Commission July 1,
1980. Subsequently, on March 3, 1981 an amendment to the approved development
plan was approved to permit 16,380 square feet of restaurant uses. The present
request is for preliminary approval of three other retail commercial buildings.
The development plan approval permits a maximum square footage of 71,280 square
feet for the total phase II site. On July 28, 1981, the Board reviewed plans
for the Coast Federal building (9,000 square feet) and a rental building (9,000
square feet). Both buildings are to be located adjacent to Highway 111. Prior to
that the Board had reviewed plans for a 7,026 square foot Crocker Bank building.
STAFF ANALYSIS:
The three (3) buildings presently under review, are oriented toward the El Paseo
side of the site. The size of each of the buildings does not correspond exactly
with that on the approved development plan. This is not a critical problem at
this time. The developer should be aware of the maximum 71,280 square foot limit
for buildings on the Phase II Section of the property. Including these three (3)
buildings, a total of 50,864 square feet will be committed. This leaves 20,416
square feet for the remaining 2 buildings.
ELEVATION TREATMENT:
The buildings are one story in height with a height of 22 feet (scaled for
elevations). The structures are contemporary and will utilize exterior plaster,
exposed wood accent and a red tile roof. A condition of the Development Plan
approval required that there be a unifying architectural theme for the center.
These buildings are quite similar to the Coast Federal building and the Crocker
Bank building. Thus the requirement for compatibility would appear to be met.
The window area of the building is provided with extensive roof overhangs which
should provide adequate solar protection.

A landscape plan has been submitted along with a plan of the courtyard area
between the three buildings.
The Planning Commission granted the applicant's request to reduce the width
of the landscape strip adjacent to E1 Paseo from 20 feet to 10 feet. This
landscape strip is to be planted with a mix of Bottle Tree and Brazilian
Pepper. In the parking lot, a variety of trees including Washingtonia Robusta,
new improved Mexican Ash and Dwarf Fan Palms will be planted. Generally the
trees are to be 24 inch box size except for the 15 gallon Bottle Tree and the
Washingtonia Robusta being 12' or better. The Board should review the
landscape plan to determine acceptability.
Previously,the Board gave final landscape approval for the Crocker Bank building
Therefore, only the landscape plan for the Coast Federal building remains as
well as the courtyard and planting for the remaining two buildings.
SIGN:
A proposed sign program for the building has not been provided. The sign program
when requested, will require approval of the Board.
CONCI I IS T ON
Staff feels that the site plan, landscape plan and elevations submitted are
acceptable. The Board should review the submitted plans and determine acceptability.
Should the Board grant preliminary approval, said approval will be forwarded to
Planning Commission for affirmation.
Should the Board grant preliminary approval, it should be subject to the following
conditions:
1. Construction plans shall be submitted for approval to the City Fire Marshal
prior to issuance of building permits. All conditions shall be made a part of
construction and no certificate of occupancy shall be issued until completed.
2. Final construction drawings, including a final landscaping, grading, lighting
amenities, trash storage, walkway layout, irrigation plans and sign program
shall be submitted to the Design Review Board. No final inspection or
occupancy permit shall be given by the Department of Environmental Services
to this project until the aforementioned approved plans and construction shall
have been completed.
3. A minimum 30" mounding shall be provided along Highway 111 per Municipal Code
requirements; with 5 gallon Carissa Prostrata 3 feet on center provided
adjacent to parking lot between Crocker Bank and Rental Building 4.
4. Provide additional trash enclosure near northeast corner of proposed buildings.
5. Submit final sign program with final working drawings for this approval.

TENANT SIGN CRITERIA
The sign criteria is part of the lease documents -and shall conform to
requirements as follows:
All signs shall be submitted to Landlord, for written approval prior to
fabrication.
Size of letters and manner of construction shall be in accordance with
drawings and/or as directed in sign criteria.
Colors will -be -approved or determined during the time of submittal by the
Landlord and City of Palm Desert.
Tenants shall be required to conform to requirements and shall.make
necessary changes prior to written approval.
A. Requirements -
1. Store Front Signs.
a) Size of store front signs shall be approximately 12" high,
3-1/2" thick, with an overall length of not more than 8'-D
of the frontage dimension as described in lease documents.
b) Additional store front signs may be placed on side walls
conforming to limits as set forth above.
c) Letters may be indjyidual block type or script and shall be
constructed of wood. No neon tube signs shall -be allowed.
d) Store front signs shall be suspended from exterior soffit
above store front glass and shall be approximately centered
and/or on wood wall adjacent to store.- Either location shall
be approved by Landlord...

I hereby acknowledge that I have read and agree, to comply with
all the following requirements, and understand that the Depart-
ment of Building and Safety will not issue a building permit or
allow occupancy on the use permitted until this signed confirma-
tion has been received by the Department of Environmental Services.
The development of this project shall conform substantially to all
development plans submitted in behalf of this case, and as revised
according to the Design Review Board process. Any minor change
requires approval by the Director of Environmental Services. Any
substantial change requires approval by the Design Review Board.
All requirements of any law, ordinance, or regulation of the State,
City, and any other applicable government entity shall be complied
with as part of the development process.
This approval is applicable, subject to the development of this
project, commencing within one year from approval date and being
promptly completed.
Landscaping (with irrigation system) shall be installed prior to
final inspection and receiving certificate of occupancy.
Curb, gutter, curb cuts, and tie-in paving shall be provided along
the full frontage of the lot by means of installation prior to
final inspection or other provisions as approved by the City
Engineer. Construction shall conform to City Standards and all
requirements of the City Engineer.
All new and existing electrical distribution lines, telephone,
cable antenna t vision, and similar service wires or cables,
