meeting of December 7, 1982:
1. CASE NO: 165 C
APPLICANT (AND ADDRESS): CREATIVE DESIGNS, 21-855
South Avalon, Suite 8, Carson, CA 90745.
NATURE OF PROJECT/APPROVAL SOUGHT: Preliminary
approval of plans for a two story office commercial building.
LOCATION: Southeast corner of Shadow Hills Road and
Frontage Road.
ZONE: C-1 S.P.
Mr. Smith reviewed the staff report indicating that this case
was before the board in March, at which time it was returned
to the applicant with concerns regarding the design of the
building and materials used, the circulation system in the
parking lot and the provision of solar protection. He indicated
that the site plan as presently submitted had resolved the
dead-end parking aisle problem, but felt the matter of building
elevations and landscape design should be reviewed by the
board to determine acceptability.
The board reviewed the building elevations and felt that they
lacked consistency in that there were several architectural
styles evident.

Mr. Gregory commented on the landscaping as follows:
1. Fountain grass grows to four feet in height, is
quite invasive and could result in problems in this
area.
2. The layout of other materials lacked imagination.
3. Spanish broom and common wormwood are not used
often in the desert.
4. If the landscaping is to be drought tolerant then
a drip irrigation system would be adequate.
5. If a conventional irrigation system is to be used
then it should be down -sized from 1S4" to approximately
3/4 inches and the "pop-up" heads replaced with
"bubbler" type heads.
In conclusion it was felt that a redesign of the landscape plan
and irrigation plan would be appropriate.
On a motion by Mr. Leung, seconded by Mr. Gregory, the
application was referred back to the applicant for a restudy of
the building elevations and resubmittal of the revised
landscape and irrigation plans.
Motion carried unanimously 4-0.
III. DISCUSSION ITEMS:
1. CASE NO: 154 C
APPLICANT (AND ADDRESS): 7-ELEVEN STORE
NATURE OF PROJECT/APPROVAL SOUGHT: Request for
approval of a roof over the storage area.
LOCATION: 73-800 Highway I I I
ZONE: C-1
Mr. Smith indicated that the storage section at the rear of the
building is enclosed on the top by a chain link fence. They are
requesting that they be allowed to build a roof over that area
to keep the rain out.
Mr. Gregory asked if this change would affect the parking
requirements.
Mr. Sawa replied that they would still have enough parking to
meet the code requirements.
On a motion by Mr. Gregory, seconded by Mr. Cook, the board
granted approval of the roof installation subject to the top of
the new roof being no higher than the existing enclosure walls.
Motion carried 3-0-1 (Mr. Leung abstained).

CASE NO: 165 C
APPLICANT (AND ADDRESS): CREATIVE DESIGNS, 21-855 South Avalon, Suite 8,
Carson, CA 90745.
NATURE OF PROJECT/APPROVAL SOUGHT: Preliminary approval of plans for a two
story office commercial building.
LOCATION: Southeast corner of Shadow Hills Road and Frontage Road.
ZONE: C-1 S.P.
BACKGROUND:
A similar application was before the board at its March 9, 1982, meeting at which time
the matter was continued in order that certain concerns could be addressed. The concerns
were as follows:
1. That the design of the building and materials used, reflect the type of
image which Palm Desert desires.
2. That the circulation system in the parking lot eliminate the dead-end
situation.
3. That adequate solar protection be provided.
CURRENT PROPOSAL:
The applicant is proposing to construct a two story office/commercial building. The lower
level will be retail commercial while the upper level will be for office use, a net building
area will be 7073 square feet.
SITE PLAN:
The current site plan has adequately addressed concern number two outlined above. A two
way driveway access is available from the Frontage Road and from Shadow Hills Road.
The building is in an "L" shape extending parallel to both streets with the parking located
behind. A 10 foot wide landscape strip is provided along the south property line.
Staff has no major concerns with the site plan as proposed, however it will have to be
confirmed by precise plan approval by the planning commission.
PARKING!
A 7073 square foot building must provide a minimum of 29 parking spaces. The plan
submitted indicates 31 spaces.
ELEVATIONS:
The proposed two story building will be 26 feet high. The exterior is to be navajo white
stucco. Access to the units is provided by exterior sidewalks on both levels. The north
elevation's second floor level is bordered with a wrought iron railing while the west
elevation is solid stucco to a height of 3-4 feet. The roof over the upper level sidewalk is
red clay tile.
The board should review the elevations to determine if concern number 1 outlined above
has been adequately addressed.

CASE NO. 165 C
LANDSCAPING:
The landscape plan proposes planting around much of the perimeter of the site. The plan
calls for 16 24" Washingtonia Robusta, 9 15 gallon Spartum 7unceum (spanish brown
evergreen and 24 1 gallon Artemisia Absinthium (common wood worm). Ground cover is to
be Pennisetum Setaceum (fountain grass). The board should review the landscape plan and
determine acceptability.
CONCLUSION:
The current plans have addressed the issue of traffic circulation adequately. The board
should review the elevations and landscape plan and determine acceptability. Staff is not
prepared to recommend that preliminary approval be granted.
RECOMMENDATION:
Should the board decide to grant a preliminary approval to Case No. 165 C, that said
approval be subject to the following conditions:

1. Construction plans shall be submitted for approval to the city fire marshal
prior to issuance of building permits. All conditions shall be made a part of
construction and no certificate of occupancy shall be issued until completed.
2. Final construction drawings, including a final landscaping, grading, lighting,
amenities, trash storage, walkway layout, irrigation plans and sign program
shall be submitted to the design review board. No final inspection or
occupancy permit shall be given by the department of environmental services
to this project until the aforementioned approved plans and construution shall
have been completed.
3. That the applicant file and receive approval of an application for a parcel map
to consolidate the two lots into one lot.
4. That the applicant apply and receive approval of a precise plan from the
planning commission.
5. That the wall proposed along the south property line be continued along the
east property line to meet the existing block wall.
6. That the existing power lines adjacent to the property (i.e. north and east
property lines) be undergrounded pursuant to code.
7. That a 3-4 foot wall or suitable landscape materials be installed to screen the
parking area from view from Shadow Hills Road.

4. That the trees and shrubs be replaced with a different
variety and that their location will not infringe on the
corner visibility.

CASE NO: 232 MF - MICHAEL GILANO - 2772 Main Street, Irvine, CA
92714, THOMAS MAURER, A.I.A., 206 W. Wilshire Avenue, Fullerton, CA
92632 and ADAMS, STREETER & WOOLSEY, CIVIL ENGINEERS, INC.,
17981 Skypark Circle, Suite M, Irvine, CA 92714. Mr. Thomas Maurer was
present to represent the applicant.
Approval Sought/Location: Final approval of plans for 13 unit residential
condominiums and recreational facilities located at Ryway Place, 250 Feet
north of Grapevine Street.
Mr. Sawa reviewed the staff report indicating that the Board had granted
preliminary approval to this application at its February 23rd, 1982, meeting
subject to a series of conditions contained in the staff report dated February
23, 1982. He added that Conditions 1, 2, 3, 4, 7, 8, 9, 10, 11, 12, 13 and 15
had been fulfilled but that Conditions 5, 6, 14 and 16 had not yet been
addressed on the plans.
Mr. Maurer presented Staff and the Board with a letter indicating that they
would install a wrought iron fence on top of the retaining wall adjacent to
the south property line where the wall will exceed 30" in height (Condition
6) and that they would color the north side of the northern perimeter wall to
match the exterior color of the property owners homes (Condition 14). The
applicant indicated that he had with him the plans from the Sanitation
District (Condition 5). Mr. Maurer felt that skylights with a mirror finish
would be obtrusive, that if possible he would like them to be dual glazed
with the outer surface being solar bronze. He added that solar bronze would
be used on the windows on the west side too.
On a motion by Mr. Barton, seconded by Ms. Jackson, the Board granted
final approval of the plans subject to Condition No. 16 being changed to
show the skylights as being "Solar Bronze" instead of "Mirror Finish".
Motion carried unanimously 6-0.
3. CASE NO: 165 C - BRAXTON, DENNIS - CREATIVE DESIGNS, 21,855 South
Avalon, Suite 8, Carson, CA 90745.

Mr. Diaz reviewed the staff report indicating that in terms of the plot plan,
Staff was concerned with the parking layout to the rear. That the property
line to the south requires a 10 foot wide landscape buffer area and that the
southernly parking aisle is a dead-end parking area which could cause a
problem, this could be resolved by moving the entire building to face north.
He indicated that Staff had completed another plot plan for submittal
utilizing the building and placing it at the corner of the property which
would be able to attend the 31 parking spaces as desired and which would
eliminate the dead-end parking situation. He added that this plan would call
for some redesign of the building in terms of the elevations.
Ms. Jackson felt that if the building were turned around it would create
solar problems which would call for redesign of the building.

On a motion by Mr. Barton seconded by Mr. Gregory, the Minutes of the February
23, 1982, meeting were approved subject to the second paragraph of Case
No. 229 MF, Hoffman Builders, Inc., being amended to read: "Preliminary and final
approval of plans for a ten unit residential condominium complex located at the
southeast corner of Parkview and Fairhaven" and that on Case No. 230 MF,
Skyward Place, the name "Silk Oak " be changed to "Silk Tree".
Motion carried 3-0-3 (Mr. Cook, Mr. Jackson and Mr. Leung abstained).
CASES
1. CASE NO: 154 C - SOUTHLAND CORPORATION , 16,069 Shoemaker
Avenue, Cerritos, CA 90701 and BERNARD LEUNG, 73-960 El Paseo, Palm
Desert, CA 92260. Mr. Leung was present to represent this case and
indicated that he would abstain from voting.
Approval Sought and Location: Request for approval of landscape plans for
a previously approved 4,800 square foot retail commercial building.
Mr. Sawa indicated that the final building plans for this case were reviewed
and approved by the Board at its February 23, 1982, meeting and that the
applicant had since submitted a landscape plan which was reviewed during
the Design Review Board study session.
On a motion by Mr. Cook, seconded by Mr. Barton, the landscape plan was
approved subject to the following conditions being addressed with
Conditions Nos. 2, 3 and 4 being reviewed informally by Mr. Gregory when
the changes are brought about:
1. That the retaining wall proposed for the northwest
corner of the property be redesigned and/or relocated
in compliance with Municipal Code 25.56.200.
2. That the parking stall at the east of Frontage Road
entry be shaded with a planter containing material
that is colorful and of a high -growing nature.
3. That the rear driveway shall be reduced to a 35'
maximum width.

continued in order that the applicant may address the following concerns:

out and the dead-end parking situation be
eliminated.
3. That solar protection be provided if the buildings
are turned facing north.
Staff was further instructed to indicate to the applicant that the Board
would not be able to approve the submittal as presented because of those
concerns.

4. CASE NO. 164C - ROY CARVER - 110 West Las Tunas, San Gabriel, CA
91776 and BERNIE LEUNG, 73-960 El Paseo, Palm Desert, CA 92260.
Approval Sought/Location: Approval of preliminary landscaping and
elevation plans for a commercial shopping center at the southeast corner of
Country Club Drive and Monterey Avenue. Mr. Leung asked to be excused
from voting but indicated that he would represent this case.
Mr. Diaz reviewed the staff report and indicated that staff was not overly
concerned that tree wells were not proposed within the parking rows along
the common center line of each row of parking (Condition No. 3 ). After
some discussion, the Board decided to delete this Condition.
Mr. Cook questioned the fact that a blow -sand buffer had not been required.
Mr. Diaz replied that if they were required to put up an eight foot high wall
the commercial area would not be seen.
On a motion by Ms. Jackson, seconded by Mr. Barton, the preliminary
landscaping and elevation plans were approved subject to the conditions
listed below and subject to Condition No. 3 of the staff report dated March
9, 1982, being deleted.
1. Construction plans shall be submitted for

1. CASE NO. 221 MF - CHACAHUALA LTD, 10677 W. Pico Blvd., Los Angeles,
CA 90064. Mr. Leonard Greenberg, applicant was not present.
Approval Sought/Location: Request for a time extension of previously
approved preliminary plans for a 117 unit condominium project on the north
side of Mesa View Drive, between Alamo Drive and Arrow Trail.
Mr. Sawa indicated that the applicant was seeking a time extension for
preliminary plans which were approved by the Design Review Board at their
meeting of March 1, 1981 and approved by the Planning Commission at
their meeting of March 3, 1981.
On a motion by Mr. Cook, seconded by Ms. Jackson, the Board moved to
grant a time extension for this case.
Motion carried unanimously 6-0.
2. PALM DESERT TOWN CENTER
Mr. Sawa reviewed this case indicating that it was before the Board for final
approval of landscape plans.
The Board reviewed the plans and felt they were adequate.
On a motion by Ms. Jackson, seconded by Mr. Barton, the Board instructed
Staff to compare the final working drawings with the preliminary plan and
continue this case to the next meeting.
Motion carried 5-0-1. Mr. Cook abstained.

for a two story office/retail building.
LOCATION: Southeast corner Shadow Hills Road and Frontage Road.
ZONE: C-1 S.P.
DISCUSSION:
The applicant is proposing to construct a two story commercial building. The lower level
will be for retail commercial while the upper floor will be for office use. The total floor
area in the building will be 7,695 square feet.
SITE PLAN:
The site plan submitted indicates the building is to be located toward the north side of the
lot adjacent to the frontage road. The parking lot is located on the southerly 2/3's of the
lot. Access to the parking lot is via two (2) 25 foot wide driveways from Shadow Hills
Road. In addition, an ingress only driveway is proposed along the east side of the building
with access from the Frontage Road.
Adopted parking standards require that all parking lot circulation be provided on -site. This
has not been provided for the southernmost driveway which dead ends at the east property
line.
The area available on the south side of the building is sufficient to provide the necessary
parking and acceptable on -site circulation. Staff will provide an acceptable revised site
plan for review by the Board.
PARKING:
A building of the size proposed (ie: 7,695 square feet) requires that 31 parking spaces be
provided. The site plan submitted provides the required number of spaces, however, as
noted previously, there are some circulation problems in the parking lot which may cause
a change in the number of spaces.
ELEVATIONS:
The proposed two (2) story building will be some 25 feet high. The basic exterior is to be
textured Spanish stucco across the front and rear; at the second story level a balcony is
proposed. Access to the second story will be via stairways located at the east end of the
building. Across the front, the balcony will have a guardrail which will be partially open
and partially solid stucco. Across the front facing roof and visible from the west a
concrete mission tile roof is proposed, the remainder of the roof is hidden behind the
parapet wall.

LANDSCAPING:
The landscape plan indicates areas to be landscaped at the front of the building and
distributed within the parking lot. If possible it is felt that the perimeter landscape strip
in the parking area should be increased in width to allow for additional planting. The plan
calls for the installation of four 24" box Mexican Fan Palms, three 15 gallon Spanish
Brown Evergreens and twenty-two 1 gallon Common Wormwood. Ground cover is to be
Fountain Grass.
Across the rear (south property line), a new six (6) foot high block wall is proposed
to separate this commercial site from the multiple residential zone to the south which is
presently vacant.
CONCLUSION:
Provided that the on -site traffic circulation problem can be resolved, Staff has no major
concerns with the plans as submitted. The Board should review the plans and determine
acceptability.
RECOMMENDATION:
That the Board grant preliminary approval to application 165C, subject to the following
conditions:

1. That the parking lot layout be revised to conform to the
Municipal Code design standards for off-street parking facilities.
2. Construction plans shall be submitted for approval to the City Fire
Marshal prior to issuance of building permits. All conditions shall
be made a part of construction and no certificate of occupancy
shall be issued until completed.
3. Final construction drawings including a final landscaping, grading,
lighting, amenities, trash storage, walkway layout, irrigation plans
and sign program shall be submitted to the Design Review Board. No
final inspection or occupancy permit shall be given by the Department
of Environmental Services to this project until the aforementioned
approved plans and construction shall have been completed.

I hereby acknowledge that I have read and agree, to comply with
all the following requirements, and understand that the Depart-
ment of Building and Safety will not issue a building permit or
allow occupancy on the use permitted until this signed confirma-
tion has been received by the Department of Environmental Services.
The development of this project shall conform substantially to all
development plans submitted in behalf of this case, and as revised
according to the Design Review Board process. Any minor change
requires approval by the Director of Environmental Services. Any
substantial change requires approval by the Design Review Board.
All requirements of any law, ordinance, or regulation of the State,
City, and any other applicable government entity shall be complied
with as part of the development process.
This approval is applicable, subject to the development of this
project, commencing within one year from approval date and being
promptly completed.
Landscaping (with irrigation system) shall be installed prior to
final inspection and receiving certificate of occupancy.
Curb, gutter, curb cuts, and tie-in paving shall be provided along
the full frontage of the lot by means of installation prior to
final inspection or other provisions as approved by the City
Engineer. Construction shall conform to City Standards and all
requirements of the City Engineer.
All new and existing electrical distribution lines, telephone,
cable antenna television, and similar service wires or cables,
which are adjacent to and provide service to the property being
developed shall be installed underground as a part of development
from the earest existing pole not on the property being developed
