A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF PALM DESERT, CALIFORNIA, APPROVING
A CONDITIONAL USE PERMIT, PRELIMINARY DESIGN
REVIEW CASE AND NEGATIVE DECLARATION OF
ENVIRONMENTAL IMPACT TO ALLOW CONSTRUCTION
OF A BANK LOCATED AT THE SOUTHEAST CORNER OF
EL PASEO AND LARKSPUR LANE.

WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 3rd day of August, 1982, hold a duly noticed public hearing to consider a request by
PALM DESERT NATIONAL BANK for approval of a conditional use permit, preliminary
design review case and negative declaration of environmental impact to allow
construction of a bank with commercial space in the C-1 zone located at the southeast
corner of El Paseo and Larkspur Lane, more particularly described as:

WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 80-89", in that the director of environmental services has determined that
the project will not have a significant adverse impact on the environment and a negative
declaration has been prepared.
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, of all interested persons desiring to be heard, said commission did find the
following facts and reasons to exist to justify the granting of said conditional use permit:
1. The proposed location of the conditional use is in accord with the objectives
of the zoning ordinance and the purpose of the district in which the site is
located.
2. The proposed location of the conditional use and the conditions under which
it will be operated and maintained will not be detrimental to the public
health, safety or general welfare, or be materially injurious to properties or
improvements in the vicinity.
3. The proposed conditional use will comply with each of the applicable
provisions of this title, except for approved variances or adjustments.
4. The proposed conditional use complies with the goals, objectives, and
policies of the city's adopted general plan.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the findings
of the commission in this case.
2. That approval of Conditional Use Permit 09-82 and Design Review Case 172
C is hereby granted for reasons subject to the attached conditions.

CONDITIONS OF APPROVAL
CUP 09-82 and 172 C
Department of Environmental Services:
1. The development of the property shall conform substantially with exhibits on file
with the department of environmental services, as modified by the following
conditions.
2. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all municipal
ordinances and state and federal statutes now in force, or which hereafter may be
in force.
3. Construction of a portion of said project shall commence within one year from the
date of final approval unless an extension of time is granted; otherwise said
approval shall become null, void and of no effect whatsoever.
4. Prior to issuance of a building permit for construction of any use contemplated by
this approval, the applicant shall first obtain permits and/or clearance from the
following agencies:
Riverside County Department of Health
Palm Desert Design Review Board Process
City Fire Marshal
Coachella Valley Water District
Evidence of said permit or clearance from the above agencies shall be presented to
the department of building and safety at the time of issuance of a building permit
for the use contemplated herewith.
5. Detailed exterior parking lot lighting plan in compliance with applicable standards
to be submitted to the city for approval; lights to be down -shining box type to
minimize glare.
6. Pursuant to municipal code requirements, all new and existing electrical
distribution lines, telephone, cable antenna television and similar service wires or
cables, which are adjacent to and provide service to the property being developed
shall be installed underground as a part of development from the nearest existing
pole not on the property being developed.
7. An easement, approved by the City of Palm Desert, shall be recorded prior to
issuance of building permit providing for cross access and joint parking between
subject property and property to east.
8. Provide approved trash enclosure or system in parking area and show on final
working drawings.
9. Retain all palm trees on the site and incorporate into landscaping plan.
10. Handicap stalls shall be 14 feet in width.
11. Locate trees adjacent to south and east side of building between stalls.
12. Three tandem and three adjacent stalls to be marked "Reserved for employees".
13. Parking space immediately south of existing electrical transformer to be
eliminated and replaced with landscaping.
14. Temporary plan and time schedule indicating removal of temporary building shall
be submitted to department of environmental services with final working drawings.

15. Provide "Drive up teller only" sign at west entrance of aisle of drive -up teller.
Design Review Board:
1. Construction plans shall be submitted for approval to the city fire marshal prior to
issuance of building permits. All conditions shall be made a part of construction
and no certificate of occupancy shall be issued until completed.
OF 2. Final construction drawings, including a final landscaping, grading, lighting,
amenities, trash storage, walkway layout, irrigation plans and sign program shall be
submitted to the design review board. No final inspection or occupancy permit
shall be given by the department of environmental services to this project until the
aforementioned approved plans and construction shall have been completed.
3. That the applicant obtain approval of any necessary conditional use permit prior to
submitting plans to the board for final approval.
Department of Public Works
Sidewalk shall be installed on El Paseo and Larkspur.
2. Concrete driveway approaches shall be installed.
3. Drainage and signalization fund fees, as required by city ordinance, shall be paid
prior to issuance of a building permit.
4. Full public improvements, including traffic safety lighting, as required by
ordinance and the director of public works, shall be installed in accordance with
city standards.
5. Existing utilities on Larkspur Lane shall be undergrounded pursuant to code
requirements.
6. This property is in the AO-2 zone as shown on Flood Insurance Rate Map. A flood
hazard report, as required by Ordinance No. 221 (Flood Damage Prevention
Ordinance), shall be submitted to the public works department. The report must be
approved by the flood review committee prior to submission of final working
drawings.
City Fire Marshal
1. Install a water system capable of delivering 3250 GPM fire flow for a three (3) hour
duration in addition to domestic or other supply. The computation shall be based
upon a minimum of 20 psi residual operating pressure in the supply main from
which the flow is measured at the time of measurement.
2. Install Riverside County super fire hydrant so that no point of any building is more
than 200 feet from a fire hydrant measured along approved vehicular travel ways.
a. Hydrants shall not be located closer than 25 feet to any building.
b. Exterior surfaces of hydrant barrels and heads shall be painted chrome
yellow, and the tops and nozzle caps shall be painted green.
C. Curbs (if installed) shall be painted red 15 feet in either direction from each
hydrant.
3. Prior to issuance of a building permit, the developer shall furnish the original and
three (3) copies of the water system plan to the fire marshal for review. Upon
approval, one copy will be sent to the building department and the original will be
returned to the developer.
4. The water system plan shall be signed by a registered civil engineer, and approved
by the water company, with the following certification: "I certify that the design

of the water system in Case No. CUP 09-82 is in accordance with the requirements
prescribed by the fire marshal."
5. Prior to delivery of combustible materials to the building site, the required water
system shall be installed, operating and delivering the required flow.
6. Building shall be protected by an automatic fire sprinkler system.

Mr. Joy reviewed the staff report noting the state and city requirements for a day
care center. Conditions to this case are being imposed in order to meet the necessary
requirements. Staff recommended approval.
Commissioner Richards asked staff what type of notification process was used to
notify the adjacent residences. He was concerned about this because of the lack of
audience attendance.
Staff replied that the same method was used as for all other public hearings; legal
notices were published and sent 10 days prior to the meeting to properties within 300 feet,
which is the method required by law.
Chairman Kryder asked staff what the maximum number of children allowed by
state. Mr. Joy replied that the state requires 1 teacher for each 12 children, and for the
proposed site the maximum allowed is 40.
Chairman Kryder opened the public hearing and asked if the applicant wished to
make a presentation.
MR. DANNY HIGH, 45-845 Panorama, was present on behalf of the church and
explained that he felt the reason there were no people present in opposition was because
that area is heavily fluxuatated with children.
Commissioner Wood asked Mr. High who would be operating the day care. Mr. High
replied that his wife would be.
Commissioner Miller was concerned with the applicant completing all the
conditions prior to opening the day care center.
MRS. LORETTA HIGH, explained that they have hired contractors to complete all
the required conditions.
Chairman Kryder asked if anyone present wished to speak in FAVOR or
OPPOSITION to this case. There being none, the public hearing was closed.
Moved by Commissioner Wood, seconded by Commissioner Richards, to adopt
findings for approval. Carried unanimously 4-0.
Moved by Commissioner Wood, seconded by Commissioner Richards, to waive
further reading and adopt Planning Commission Resolution No. 814, approving CUP 08-82,
subject to conditions. Carried unanimously 4-0.

Request for approval of a conditional use permit,
preliminary design review case and negative declaration of
environmental impact to allow construction of a bank with
commercial space in the C-1 zone located at the southeast
corner of El Paseo and Larkspur Lane.
Mr. Sawa reviewed the staff report indicating that the applicant is 11% short of
parking spaces. Staff felt that this shortage would be acceptable because the hours of the
bank and other office/retail uses in the building may not coincide early and late in the day
which lowers the parking demand. Additionally, there is street parking and joint parking
with the property to the east. Staff recommended approval.
Commissioner Richards stated that he reviewed parking lots at banks on Monday
mornings and Friday afternoons and there was not enough parking.
Commissioner Kryder did not feel that the spaces used for drive -up teller should be
included in the number of parking spaces they have provided. Mr. Diaz explained that
because the customers who would be using the drive -up teller would not be utilizing any
parking spaces, the 8 spaces available for drive -up should be counted as parking spaces.

He further noted that parking is of shorter duration for this type of facility than in retail.
Chairman Kryder opened the public hearing and asked if the applicant wished to
make a presentation.
MR. GEORGE RITTER, 73-899 Highway 111, architect, stated he objected to the
condition prohibiting encroachment over the property line (Condition No. 11), explaining
that revising the balcony would aesthetically change the appearance of the building and
felt that the encroachment would not be detrimental. He also requested deletion of
Condition No. 5, relating to parking lot lighting.
Mr. Diaz clarified that parking lot lighting was not required but if the applicant
proposes to light the parking area he must meet the parking lot lighting standards.
Mr. Ritter explained that he proposes to light only the area for the automatic night
teller which would meet the city standards. He specified the lighting would be in portions
of the parking lot in the points of ingress and egress. Mr. Diaz explained that he could not
just light a portion. Mr. Diaz, for clarification, explained how the city established the
parking lot lighting standards. He concluded with a suggestion to Mr. Ritter that the
automatic night teller be placed in the front of the building.
Commission agreed that for security reasons the automatic tellers should be placed
in the front of the building or, if placed in the parking area, provided with adequate
parking lot lighting.
Commissioners Richards and Wood asked if a precedence had ever been set as far
as encroachment being approved. Mr. Ritter explained there presently are buildings
existing that encroach over the property line. He further indicated that the balcony could
be cut back approximately one foot.
After further discussion, it was the consensus of the commission that the
encroachment of the second story balcony would not be detrimental. Therefore,
commission agreed to delete Condition No. 11.
MR. DON DAVIS, 73-655 El Paseo, stated they would abide by the decision of the
parking lot lighting and briefly explained that the drive -up tellers are being utilized more
now. He further explained how the peak hours for the bank are always a problem in terms
of parking space, but these peak hours only last a short period of time.
Chairman Kryder asked if there was anyone else who wished to speak in FAVOR or
OPPOSITION to this case. There being none, the public hearing was closed.
Moved by Commissioner Richards, seconded by Commissioner Wood, to adopt
findings for approval. Carried unanimously 4-0.

I. BACKGROUND•
A. GENERAL:
The site is developed with a temporary bank structure installed in October,
1981. It will be removed shortly after construction of the permanent
building.
B. DESCRIPTION OF SITE:
The site is flat and as noted above, developed with a temporary facility.
There are a number of tall palm trees scattered around the site all of which
will be retained, according to the applicant.

D. GENERAL PLAN LAND USE DESIGNATION:

IL PROJECT DESCRIPTION:
A. GENERAL:
The project consists of a bank with 7463 sq.ft. of floor area, 2755 sq.ft. of
commercial space and 1460 sq.ft. of office area on the first floor, and 2830
sq.ft. of office area on the second floor. A freestanding, four lane drive -up
teller facility is proposed in the parking lot.
B. ARCHITECTURE:
The project is Spanish in nature with exterior materials consisting of stucco
walls, ceramic wood trim and railing, and a tile roof. The height of the
majority of structure is 30 feet. A tower portion of the structure near the

intersection is 38 feet in height and complies with requirements for towers
or cupolas.
C. DESIGN REVIEW BOARD ACTION:
The design review board reviewed and approved preliminary plans for this
project at its meeting of July 13, 1982.
D. DESIGN CONCERNS:
Staff's major concerns relates to the second story balcony and eave hang
over the property line and sidewalk along El Paseo. Staff feels that it is not
in the best interests of the El Paseo streetscape to permit this
encroachment. This recommendation is based on the fact that construction
along El Paseo has not been permitted to encroach.
E. SITE DESIGN/PARKING/CIRCULATION:
Access to the site will be through two driveways on Larkspur Lane and from
the parking lot of San Luis Rey Village to the east. Modification of the
adjacent lot and an easement for cross access and parking is required and
will have to be recorded prior to issuance of building permits.
Counting the bank and office parking ratios separately and adding the
spaces, the required parking is 79 spaces (66 on -site plus 13 for modification
of easterly parking lot). 67 legal spaces are provided (including 8 drive -up
spaces). Counting the 3 tandem spaces which are proposed for use by
employees a total of 70 spaces are provided. This deficiency of 9 spaces
would amount to approximately I I% of the required parking.
The criteria the commission must use to determine if the parking
requirements are to be modified are as follows:
1. The parking demand generated by said use in relation to other uses in
the area.
2. The hours of operation of said use in relation to the hours of
operation of other uses in the area.
3. The relationship of the type of use to other uses in the area.
4. Any other factor the commission might deem necessary in making its
decision.
In this case, while we are only allowing 8 spaces for the drive -up teller,
there is additional stacking space for cars. The hours of the bank and other
office/retail uses in the building may not coincide early and late in the day,
thus, lowering demand for parking. It is conceivable that with the cross
access to the center to the east, there will be some use of the adjacent
parking lot. Street parking exists on El Paseo and Larkspur Lane which will
lessen the demand for parking in the lot.
III. ANALYSIS:
A. CONDITIONAL USE PERMIT FINDINGS:
1. The proposed location of the conditional use is in accord with the
objectives of the Municipal Code and the purpose of the district in
which the site is located.
Justification:
The location of the use is in the C-1 (general commercial district) zone

which was established for commercial purposes.
2. The proposed location of the conditional use and the conditions under
which it would be operated or maintained will not be detrimental to
the public health, safety, or welfare, or be materially injurious to
properties or improvements in the vicinity.
Justification:
The commercial location and conditions under which it will be operated
insure that the project will not be detrimental to the neighborhood.
3. The proposed conditional use will comply with each of the applicable
provisions of the municipal code except for approved variances or
adjustments.
Justification:
The project is designed to comply with all applicable provisions of the
municipal code.
4. The proposed conditional use complies with the goals, objectives and
policies of the city's general plan.
Justification:
The general plan land use designation for the site is core area commercial.
As such, the use complies with the goals, objectives and policies of the
general plan.
Staff feels the findings can be justified in this case.
IV. STAFF RECOMMENDATION:
Staff feels the project is acceptable with minor changes and based upon the
findings, recommends:
1. Approval of the findings;
2. Approval of Planning Commission Resolution No. , approving
CUP 09-82 and 172 C and a negative declaration, subject to
conditions attached thereto.
"A resolution of the planning commission of the City of
Palm Desert, California, approving a conditional use

The newly organized Palm Desert National Bank desires to establish permanent
corporate headquarters on the corner of Larkspur Lane and E1 Paseo.The bank feels by
locating in Palm Desert it would be advantageous,not only for the bank, but also,
for the downtown community. The old Firecliff Lodge site was one of the early
founding developments in Palm Desert and the bank feels it should carry on a tradi-
tion of creating an important anchor to the E1 Paseo experience.
The corporate headquarters for the Palm Desert National Bank will be housed in a
two story structure with a subterranean basement. The architecture of the building
will be done in a contemporary spanish colonial style. The building will have massive
rough wood beams, heavy textured plaster walls and course terra cotta roof tile.
The structure will also be comprised of an entry tower and fountain, on the corner
of Larkspur Lane and E1 Paseo, creating a central focal point to the design and a
community landmark.
Submitted are the applications necessary to obtain City approvals for the preliminary
design for the Palm Desert National Bank permanent structure. Included in these
applications are requests for the approval of the parking lot plan as it relates to
the commercial retail project to the east of the bank site. Also in the parking lot,
we are requesting that the stacking area and the drive -up teller stations be classi-
fied as twelve (12) parking spaces.

Prior to construction of any of the proposed buildings, the following conditions
must be met:
1. Install a water system capable of delivering 3250 GPM fire flow for a three (3)
hour duration in addition to domestic or other supply. The computation shall
be based upon a minimum of 20 psi residual operating pressure in the supply
main from which the flow is measured at the time of measurement.
2. Install Riverside County super fire hydrant so that no point of any building
is more than 200 feet from a fire hydrant measured along approved vehicular
travel ways.
A. Hydrants shall not be located closer than 25 feet to any building.
B. Exterior surfaces of hydrant barrels and heads shall be painted chrome
yellow, and the tops and nozzle caps shall be painted green.
C. Curbs (if installed) shall be painted red 15 feet in either direction
from each hydrant.
3. Prior to issuance of a building permit, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
Upon approval, one copy will be sent to the Building Department, and the original
will be returned to the developer.
4. The water system plan shall be signed by a registered civil engineer, and approved
by the water company, with the following certification: "I certify that the
design of the water system in Case Number CUP 09-82, *AR9" 2 is in accordance
with the requirements prescribed by the Fire Marshal."

First, a variance is required to permit the tower to be 38 feet high; second, a
parking variance is necessary --any approval by the Board should be conditional
upon applicant obtaining the required permit and variance.
RECOMMENDATION:
Staff recommends that the Board grant preliminary design approval for Case 172 C
subject to the following:
A. Construction plans shall be submitted for approval to the City Fire Marshal
prior to issuance of building permits. All conditions shall be made a part of
construction and no certificate of occupancy shall be issued until completed.
B. Final construction drawings, including a final landscaping, grading, lighting,
amenities, trash storage, walkway layout, irrigation plans and sign program
shall be submitted to the Design Review Board. No final inspection or
occupancy permit shall be given by the Department of Environmental
Services to this project until the aforementioned approved plans and
construction shall have been completed.
C. That the applicant obtain approval of any necessary variance and conditional
use permit prior to submitting plans to the Board for final approval.

NATURE OF PROJECT/APPROVAL SOUGHT:
Preliminary design approval for a 9438 square foot bank and
commercial retail do office building.
LOCATION: Southeast corner El Paseo and Larkspur Lane.
ZONE: C-1, S.P.
1. DISCUSSION:
The applicant is proposing the construction of a permanent bank a facility to
replace the present temporary structure on the property along with ancillary retail
commercial and office space.
II. ELEVATIONS:
The structure is to be a contemporary spanish colonial style two -stories in height
(309. The building will have massive rough wood beams, heavy textured plaster
walls and course terra cotta roof tile. Major features include an entry tower and
fountain.
III. SOLAR PROTECTION:
Extensive roof overhangs are proposed and as well the amount of glazed area at the
east and west ends is limited.
IV. LANDSCAPING:
Proposed landscaping amounts to some 23% of the parking area. The Board should
review the materials to be installed to determine acceptability. A six (6) foot high
slumpblock wall exists along the south property line. Additional walls (42" high)
are proposed adjacent to Larkspur Lane to match.
V. SITE PLAN:
The site plan has been designed to orient the building to El Paseo as well as
accommodate a drive-thru teller. The traffic circulation on the site is facilitated
by an access from El Paseo which exists on the property to the east. An easement
for this purpose has been obtained. In addition, two accesses onto Larkspur Lane
are provided. The on -site circulation and site plan layout are acceptable.
VI. DRIVE -UP TELLER:
In the parking lot at the rear a drive -up teller facility is provided. Four lanes are
shown with stacking for 12 cars. Access to the drive -up teller is via the shared
driveway on the property to the east. The drive -up teller area is covered by a tile
covered canopy to match the main building roof.
VIL CONCERNS:
Concurrent with the processing of this application a Conditional Use Permit as well
as a Variance application are being reviewed.
The CUP is required to permit the drive -up teller while the variance application is
two -fold.

The newly organized Palm Desert National Bank desires to establish permanent
corporate headquarters on the corner of Larkspur Lane and E1 Paseo.The bank feels by
locating in Palm Desert it would be advantageous,not only for the bank, but also,
for the downtown community. The old Firecliff Lodge site was one of the early
founding developments in Palm Desert and the bank feels it should carry on a tradi-
tion of creating an important anchor to the E1 Paseo experience.
The corporate headquarters for the Palm Desert National Bank will be housed in a
two story structure with a subterranean basement. The architecture of the building
will be done in a contemporary spanish colonial style. The building will have massive
rough wood beams, heavy textured plaster walls and course terra cotta roof tile.
The structure will also be comprised of an entry tower and fountain, on the corner
of Larkspur Lane and E1 Paseo, creating a central focal point to the design and a
community leadmark.
Submitted are the applications necessary to obtain City approvals for the preliminary
design for the Palm Desert National Bank permanent structure. Included in these
applications are requests for the approval of the parking lot plan as it relates to
the commercial retail project to the east of the bank site. Also in the parking lot,
we are requesting that the stacking area and the drive -up teller statio,A be classi-
fied as \twelve (12) parking spaces.
We are req ting that the bank vault, located in the basement, be classified as a
storage struc a requiring one parking for every 1000 sq.ft. of vault are

I hereby acknowledge that I have read and agree, to comply with
all the following requirements, and understand that the Depart-
ment of Building and Safety will not issue a building permit or
allow occupancy on the use permitted until this signed confirma-
tion has been received by the Department of Environmental Services.
The development of this project shall conform substantially to all
development plans submitted in behalf of this case, and as revised
according to the Design Review Board process. Any minor change
requires approval by the Director of Environmental Services. Any
substantial change requires approval by the Design Review Board.
All requirements of any law, ordinance, or regulation of the State,
City, and any other applicable government entity shall be complied
with as part of the development process.
This approval is applicable, subject to the development of this
project, commencing within one year from approval date and being
promptly completed.
Landscaping (with irrigation system) shall be installed prior to
final inspection and receiving certificate of occupancy.
Curb, gutter, curb cuts, and tie-in paving shall be provided along
the full frontage of the lot by means of installation prior to
final inspection or other provisions as approved by the City
Engineer. Construction shall conform to City Standards and all
requirements of the City Engineer.
All new and existing electrical distribution lines, telephone,
cable antenna television, and similar service wires or cables,
which are adjacent to and provide service to the property being
developed shall be installed underground as a part of development
from the nearest existing pole not on the property being developed
as ired Municipal Code.
