ZONE: R-1, 10,000 Chairman of the Palm Desert Seniors' Association, Hank Clark and John Outcault, architect for the project were present and the preliminary plans were approved as presented. III. CASES: A. Final Approval: 1. CASE NO: 179 C APPLICANT (AND ADDRESS): CARLSON DESIGN AND CONSTRUCTION COMPANY, P.O. Box 819, Anaheim, CA 92805. NATURE an addition to LOCATION: Highway I I I and Lupine. ZONE: C-1, S.P. Amendment to Mr. Smith indicated that the commission at the study session had reviewed the proposed revisions noted on the plan which involve the installation of tile in lieu of the shake treatment on the mansard and the addition of a cupola in the middle of the north elevation which would be used to relocate the sign from the fascia area below. The commission did not feel the addition of the cupola would tie in with the rest of the buildings in the center and were concerned over the color of the tile shown on the new plan. Commissioner Gregory noted that the new plans show the deletion of windows on the left elevations. Mr. Dave Carlson, of Carlson Design and Construction Company was present and noted that the tile shown on the plans was the same as that approved by the commission. The reason for the cupola was to improve visibility. He felt the building was too hard to find. The windows were deleted as a requirement of the building department. Acting Chairman Martin felt that his problem was the frontage road situation and not visibility. The commission did not want to set a precedent allowing people to build cupolas for the purpose of displaying their signs. Mr. Diaz advised that the sign ordinance does not permit signs above the eave line which would preclude the signs from being installed on the cupola. Mr. Carlson asked if they could retain the cupola and keep the sign where it presently stands. - 3 - ARCHITECTURAL COMMISSION MINUTES JUNE 14, 1983 CASE NO. 179 C: The commission reiterated that the cupola would not tie in with the rest of the buildings in the center. On a motion by Commissioner Gregory, seconded by Commissioner Leung, the commission denied the cupola and approved the top cap on the roof, with the color of that top cap being the same as the beam fascia (dark brown). Motion carried unanimously 4-0. 2. CASE NO: 184 C APPLICANT (AND ADDRESS): JERRY DENNINGTON, (A-1 Surveying and Engineering), 73-400 Highway 111, Palm Desert, CA 92260. NATURE OF PROJECT/APPROVAL SOUGHT: Preliminary approval of plans for a commercial office building. LOCATION: 73-400 Highway III, north side of Highway 111, west of Las Palmas. ZONE: C-1, S.P. Mr. Smith reviewed the staff report indicating that the applicant had received preliminary approval of plans for the commercial building in April of 1981. The new building which is still two stories in height has been toned down somewhat from the one approved in 1981. The building is connected at the second floor level and separated on the first floor to allow for an ingress from Palm Desert Drive to the parking area at the rear. On a motion by Commissioner Holden, seconded by Commissioner Gregory, the preliminary plans were approved as presented. Motion carried 2-0-2, with Commissioner Leung and Commissioner Martin abstaining. IV. DISCUSSION ITEMS: 1. Walls Located in Front Yards: Mr. Diaz indicated that problems have arisen regarding six foot walls along the front setbacks in the R-1 zone. Unless the commission would like to examine them individually, staff will be requiring a minimum five foot setback from the property line when there is a solid wall along the front, so that there can be landscaping in front of it. Where they are adjacent to driveways, staff will require a ten to fifteen foot long base and height triangle be developed to provide visibility when exiting. Commissioner Holden asked if the condition would still apply if there is an existing parkway out in the middle of the property line. Mr. Diaz replied that it would. Acting Chairman Martin felt that setting back the wall from the driveway for safety purposes was acceptable but in terms of coming into the front yard, he didn't have any pro> lem with it being on the property line. If staff told them it would have to be five feet from the property line and they appealed, he would have to support the property owner. - 4 - 0 A AGENDA ITEM NO: III-B-1 DATE: June 14, 1983 ARCHITECTURAL COMMISSION CASE NO: 179 C APPLICANT (AND ADDRESS): CARLSON DESIGN AND CONSTRUCTION COMPANY, P.O. Box 819, Anaheim, CA 92805. NATURE OF PROJECT/APPROVAL SOUGHT: Amendment to approved plans for an addition to Kentucky Fried Chicken. LOCATION: Highway I I I and Lupine. ZONE: C-1, S.P. BACKGROUND: On March 22, 1983, the applicant received final approval of plans for a modification and expansion to Kentucky Fried Chicken. PRESENT REQUEST: The applicant wishes to amend the March approval by changing the roof design. The first change is structural in that a cupola is proposed in the middle of the north elevation. This cupola will be used to relocate the sign from the fascia area below. The second change involves the color of the mansard roof structure. The approved plans provided for stained wood to match the existing roof. The proposed change shows red tile to match the red tile on the cupola. A2 EXTERIOR ELEVATIONS MINUTES PALM DESERT PLANNING COMMISSION FEBRUARY 28, 1983 findings were approved as recommended by staff; carried unanimously 3-0. On a motion by Commissioner Richards, seconded by Commissioner Crites, Planning Commission Resolution No. 843 was adopted, approving CUP 03-83, subject to conditions; carried unanimously 3-0. C. Case No. CUP 04-83, FIRST BAPTIST CHURCH OF PALM DESERT, Applicant Request for approval of a conditional use permit to locate a trailer for a maximum of two years at an existing church in an R-2 zone located on the north side of Santa Rosa Way, 215 feet east of San Pablo Avenue. Mr. Joy reviewed the staff report and noted that staff had not received any letters in opposition. Staff recommended approval. Chairman Wood opened the public hearing and asked if the applicant wished to make a presentation. MR. JIM WILSON, 83-324 Fred Waring Drive, stated they were willing to meet any conditions necessary. Chairman Wood asked if there was anyone present who wished to speak in FAVOR or OPPOSITION to this case. There being none, the public hearing was closed. Commissioner Richards stated he was willing to support this case only because there was no one present to give opposition to this case. On a motion by Commissioner Crites, seconded by Commissioner Richards, the findings were approved as recommended by staff; carried unanimously 3-0. On a motion by Commissioner Crites, seconded by Commissioner Richards, Planning Commission Resolution No. 844 was adopted, approving CUP 04-83, subject to conditions; carried unanimously 3-0. VIll. DESIGN REVIEW BOARD ITEMS Preliminary plan approvals by the design review board at its meeting of February 22, 1983, requiring planning commission confirmation. A. Case No. 179 C - KENTUCKY FRIED CHICKEN AND CARLSON DESIGN AND CONSTRUCTION CO., Applicant Preliminary approval of plans for addition to Kentucky Fried Chicken restaurant located at the southeast corner of Palm Desert Drive South and Lupine Lane. Upon motion by Commissioner Richards, seconded by Commissioner Crites, the design review board approval of Case No. 179-C was confirmed by minute motion; carried unanimously 3-0. IX. Upon reviewing the submitted plans and the presentations by the staff and by the applicant, the architectural commission approved this project, subject to review by staff of the landscape plan. Date of Action: March 22, 1993 Vote: 3-0. (An appeal of the above action may be made in writing to the city clerk of the City of Palm Desert within fifteen (15) days of the date of the decision.) STAFF COMMENTS: See attached minutes. ARCHITECTURAL COMMISSION MINUTES MARCH 22, 1983 1. CASE NO. 797 SA (CONTINUED) Commissioner Martin agreed with Mr. Gregory and added that he would like the plans to show where the property line begins. On a motion by Commissioner Gregory, seconded by Commissioner Martin, the concept for the center identification sign was approved, to be located adjacent to Highway 111, with plans reflecting the following conditions: A. That the directory portion of the signs be deleted. B. That a detailed landscape plan be submitted and approved by the architectural commission for the area affected by the sign. C. That the detailed plans delineate the location of the sign relative to the property line. The plans shall be submitted by April 4th, to be submitted to the architectural commission for its meeting of April 12, 1983. Motion carried 2-0-1. Commissioner Holden voting nay. 2. CASE NO: 179 C APPLICANT (AND ADDRESS): CARLSON DESIGN AND CONSTRUCTION COMPANY, P.O. Box 819, Anaheim, CA 92805. NATURE OF PROJECT/APPROVAL SOUGHT: Final approval of plans for an addition to Kentucky Fried Chicken. LOCATION: Highway I I I and Lupine ZONE: C-1 S.P. Commissioner Gregory recommended that the applicant substitute the Agapanthus and gazanias shown on the plans with plant materials that would do better in a north exposure; he then moved to approve the final plans for the addition to Kentucky Fried Chicken on a minute motion, Commissioner Holden seconded. Mr. Smith reviewed the staff report and commented on the requirement of a wall to screen the outer parking area. - 2 - AGENDA ITEM NO: III-A-2 DATE: March 22, 1983 DESIGN REVIEW BOARD CASE NO: 179 C APPLICANT (AND ADDRESS): CARLSON DESIGN AND CONSTRUCTION COMPANY, P.O. Box 819, Anaheim, CA 92805. NATURE OF PROJECT/APPROVAL SOUGHT: Final approval of plans for an addition to Kentucky Fried Chicken. LOCATION: Highway l I l and Lupine ZONE: C-1 S.P. BACKGROUND: The board at its meeting of February 22, 1983, granted preliminary approval of plans for an addition to Kentucky Fried Chicken. Conditions placed on the approval included: 1. Construction plans shall be submitted for approval to the city fire marshal prior to issuance of building permits. All conditions shall be made a part of construction and no certificate of occupancy shall be issued until completed. 2. Final construction drawings, including a final landscaping, grading, lighting, amenities, trash storage, walkway layout, irrigation plans and sign program shall be submitted to the design review board. 3. The grade change shall incorporate the step planter. 4. The roof material shall be submitted to the board for approval. 5. The revisions shall be done on the site plan and shall illustrate the impact on walkways and adjacent structures. DISCUSSION: Final plans have been submitted. In the matter of Condition No. 5, the revised site plan indicates that the addition will have a five foot setback and the planter will be three feet from the property line. The distance will be some twelve feet from the main wall of Coco's to the east. Regarding Condition No. 4, a sample of the roof tile has been submitted. It is mission red "S" the and will be available for review by the board at the meeting. Regarding Condition No. 3, the revised plans have indicated the location of planters across the front of the addition and accounted for the grade difference. RECOMMENDATION: That the board review the plans for conformance with the conditions imposed at the time of preliminary approval. /pa -1- 00 DESIGN REVIEW BOARD MINUTES FEBRUARY 22 ,1983 CASE NO. 144 MF LEWIS HOMES (CONTINUED) Replying to Mr. Holden's question regarding wooden fencing, Mr. Sullivan stated that property owners had trouble with that type of fencing and the grading, but could put in tie-in walls if they felt it would be preferable. Mr. Cook asked if Mr. Sullivan could present a color study which might help to lessen the impact of the garage doors and if they had extended the buildings to the sideyards as far as possible to extend the house. Mr. Gayle Presswood, Architectural Coordinator for the development indicated that there is some flexibility to slide the garage to its optimum to soften the board's concerns. Regarding the landscape plan, Mr. Sullivan indicated that it was prepared with the same guidelines as the existing plans. Chairman Barton asked if any of the residents would like to speak and reminded them that this was not a public hearing. Mr. David Shy, Mr. Lee Schmidt and Mr. Gordon Lewis all spoke in opposition to the plans as submitted. Their main concerns being the three car garages, the roofing material, the increased size of the floor plans and the necessity in general for architectural compatibility of the homes. On a motion by Mr. Cook, seconded by Mr. Leung, the application was denied and sent back for a restudy in order that the following concerns may be addressed: 1. Asphalt shingles shall not be used. 2. Overhangs shall be the same as those approved on Phase I units or greater. 3. Colors shall be the same as those of the existing Phase I units. 4. Tie-in masonry walls shall be provided as constructed in Phase I. 5. Front landscaping shall match the previously approved landscaping for Phase I. 6. Applicant will study three car garages as to color, location and design and attempt to lessen the impact. Motion carried 5-0-1 (Mr. Gregory abstained). 2. CASE NO: 179 C APPLICANT (AND ADDRESS): CARLSON DESIGN AND CONSTRUCTION COMPANY, P.O. Box 819, Anaheim, CA 92805. NATURE OF PROJECT/APPROVAL SOUGHT: Preliminary approval of plans for addition to Kentucky Fried Chicken. LOCATION: Highway III and Lupine ZONE: C-1 S.P. Mr. Diaz stated that this was a request to add indoor seating to a restaurant facility located at the Smith's Food King Shopping Center. -4- .q DESIGN REVIEW BOARD MINUTES FEBRUARY 22 ,1993 CASE NO. 179 C (CONTINUED): Mr. Diaz indicated to the applicant that the board upon r• vieweing>the plans at the study session had been concerned with the appearance of the elevations in relation to the existing planter areas. Mr. Dave Carlson, of the Carlson Design and Construction Company representative, replied that they would use the natural elevation to extend the front and the side but would work with the board with any landscape amenities. Mr. Holden indicated that their concern was that the grade change incorporate a step planter area. Mr. Carlson replied that this would be acceptable. Mr. Carlson indicated that the tile presently used on the roof had been discontinued and they would like to replace it with terra cotta. The fascia would remain the same. Chairman Barton stated that the board would like to see a sample of the material before considering it for approval. Mr. Diaz asked that the applicant submit the sample by Tuesday March 1st, 1983, and submit a drawing showing that it would tie-in with the existing building. On a motion by Mr. Cook, seconded by Mr. Holden, the preliminary approval was granted subject to the two conditions set forth in the staff report and listed below, which cover the landscape plans and added Conditions 3, 4 and 5 also listed below: 1. Concurrent with this application, a conditional use permit is being processed through the planning commission. ELEVATIONS: The plans indicate that the addition will match the existing building. The walls will be tan stucco with brick also used. The dark brown wood fascia and roof will be extended. LANDSCAPING: A formal landscape plan has not been provided; however, a lawn area is indicated on the site plan. A detailed landscape plan showing trees and shrubs will be required to be submitted with the final plans. RECOMMENDATION: That Case No. 179 C, for preliminary approval of plans for a 504 square foot addition to Kentucky Fried Chicken be granted subject to the following conditions: 1.
